they said there was one other gentleman and two or three other females with him so much it was a large group. but only stone is seen in that video. so it's unclear how it all unfolded. >> and stone was the only one stabbed? >> reporter: yes, stone was the only one stabbed in this entire incident, and police are saying alcohol was a factor although they are not saying whether or not he had been drinking. his friends had been drinking. >> okay. thank you. we have breaking news out of san jose. fire crews are working a 2- alarm grass fire in hellier and highway 101. it looks like crews pretty much have a handle on it. we saw a helicopter picking up water and dropping it on the fire. the flames seemed to be out around 4:45 this afternoon. also in san jose, police are on the lookout for a suspect who escaped right before he was about to be booked into the county jail. this is a picture of the fugitive, police describe him as vietnamese, 5'11" with a thin build and a tattoo on the left side of his neck. he was being booked into the jail when he managed to escape even though he was huffed at the time. he had been picked up for two outstanding felony warrant. an s.w.a.t. team and canine unit searched several neighborhoods but didn't find him. anyone with information is urged to call the police. > > a stunning turn of event ogs capitol hill as kevin mccarthy, heavily favored to plan to sue. they filed two claims for damages, exceeding $10,000 each. all of this stems from an incident in september when jonathan chow apparently molested the 8-year-old girl. he was arrested and is facing five felony accounts of sexual assault. the claim alleges that the charter school and its employees were negligent in how they hired and supervised him. not all employees had gone through background checks. san francisco unveiled improvements to a city app helping the less fortunate living on the streets. it's supposed to be an alternative to calling 911 to alert police or other city the crew missing from the ship that went down in joaquin. he is from southeast of boston, one of 33 men and women lost at sea. last night, family members say they're being hit heard by his 790-foot long ship went missing eight days ago after the captain radioed the ship was taking on water. debris from the ship including fragments of a lifeboat have been recovered. the coast guard called off the search for survivors yesterday. >> at least 17 people are confirmed dead after devastating floods in south carolina this week. and though the water is down in some parts of the state, other parts should expect it to get worse through the weekend. almost 2 feet of rain fell in some parts of the state. now that rain is flooding rivers and rushing its way through rivers making its way to the atlantic. crews are watching 60 dams for potential failure. 13 have already collapsed. >> the water is coming. i know those people in those areas have had water come up before. this is a different kind of event. and i just want people to be cautious. >> officials are estimating that south carolina could need up to $1 billion in federal aid. let's check in with bill martin in the like on the satellite map. the hurricane or the tropical depression is now just moving to the north of us. very indicative of an el niño year. we talked about all that moisture coming from the tropics. warm water in the equatorial pacific generating that hurricane. and the moisture is going north and bringing potential rain to the pacific northwest. you got plenty of cloud cover, a little patchy fog. i saw a little bit of it this morning. not much though. current numbers, 91 in concord. then you can see the temperature, 88 in walnut creek. and you can see 79 in san jose. looking at forecasts as we go through the next couple of days. certainly through tomorrow that are going to warm us up a little bit. today was warmer than yesterday. warm again tomorrow. maybe a little bit warmer, and is temperatures gradually cool down into saturday. so this high pressure here tomorrow, friday warm, then it dips a little bit. and that's enough to cool us down a little bit. the clouds get closer. it's really just dividing the warmer air from the colder air. and the jet stream is the division point. you knew that too. 86 in the inland valleys, 88 in fairfield tomorrow. 90 in program that served to defeat the regular emations testing regime. >> reporter: his remarks revealed his plans to withdraw applications seeking u.s. emissions soichgz for the 20 -- certification for the 2016 models. by removing the application, volkswagen is leaving thousands of diesel vehicles stranded at ports nationwide. he says the company is working with regulators to get certification. >> they did recover a handgun. >> reporter: this is where steve carter was killed on monday evening. >> all three of the suspects are currently detained and being interviewed by my investigators. >> reporter: marin county sheriff's lieutenant doug pittman released little information about the three suspects. investigators found no record. morrison had been booked there on five different occasions. >> it appears we have three people that identify as being three lost souls. and we're trying to identify exactly what their motivation, their state of mind, all these things are going to come into play. >> reporter: the key piece of evidence recovered with the suspects was a handgun. >> and it's a weapon that we believe is a weapon that was used in the commission of the crime here in fairfax this past monday night. confirmation will only come through scientific testing. >> reporter: it was before 6:00 pm on monday that carter was shot and killed on the trail. his dog is still being treated for a gunshot wound. earlier that day, one of the suspects stopped at perry's deli. >> he just wanted the most food he could get for $5. but he looked a littleantsy. i'll say that. >> reporter: he left without buying anything. >> it was a little nerve- racking. it was the same day. and the fact that i interacted with him was -- it was a little crazy. >> reporter: three days after the killing, search and rescue crews were combing along sir francis drake for evidence that may have been tossed by the suspects. >> a citizen here in marin county happened to be liking along a roadway -- hiking along a roadway, seeing a wallet, looking inside, and seeing that it belonged to our victim, called the sheriff's office. >> reporter: it's unclear when they will return to marin county. a former nanny is suing two bay area tech executives claiming she was underpaid and harassed. she accuses the couple of failing to pay her the required minimal wage and that he sexually harassed her. union workers have voted to walk off their jobs for one day next wednesday to protest stalled contract negotiations. the seiu represents about 1,800 workers. they accuse the county of unfair labor practices. officials say they made their last, best, and final offer. two bay area libraries reopened today after being treated for bedbugs. another will be closed tomorrow to be checked. the library in palo alto reopened this morning. it was shut down after bedbugs were discovered two weeks ago. the building has been treated and passed a reinspection. the menloe park main library also reopened today. those beads are called exfoliants and are found in toothpaste, soap, and body scrubs. they are so small they can pass through water treatment plants and are found in the bodies of fish and other wildlife. this new law allows the use of serial exfoliants but ends the use of plastic beads by 2020. another caltrain accident is prompting the county to take action. the driver had gotten out. no one was hurt. there have been six caltrain accidents involving vehicles since august 1st. the crashes have prompted transit police to start work closer together. joe biden addressed a crowd in washington dc this afternoon and talked about the growing economy. he shared the stage with massachusetts senator elizabeth warren at the event. the vice president says job growth and the grit of the to go out in whatever is available. and that would include the highway patrol. >> reporter: three coast guard canines worked with a chp chopper the airforce, including ricky who has never been hoisted before. >> it just makes it that much more difficult to complete the host when you have a 60-pound dog who's freaking out. >> reporter: the idea is to get ricky and the other canines used to the wind and noise from a chopper so they can safely be hoisted and sent to a ship. ricky is fitted with goggles and ear protection and attached to the steel cable that will carry him and his human partner 75 feet into the air. >> reporter: the hoist operator keeps a close eye to make sure nothing goes wrong. >> look at the dog, make sure everything is good. >> reporter: his first hoist goes well with his handler gently stroking him on the way up and down. >> i was petting his back half and neck. >> reporter: perhaps the trickiest part is getting the animal over the chopper skid where a leg can get tangled or where the dog might lash out. >> some dogs might try to by the my leg, for example. better >> reporter: but that didn't happen. his wife wanted him to call after the flight to make sure
