60 days in jail, 230 hours of community service and three years probation. malesia hughes got a chance to ask for >> i'm so sorry this happened. i'm so sorry all of these gorgeous dogs died. i'm so sorry. >> reporter: as soon as the judge wrapped up, jesse todd hughes was put into custody and he was handcuffed and left the courtroom. starting now. the pet owners wanted a he have sentence. they are ok with this although some wanted more punishment for them. many got a chance to speak in court today. their main concern was not only animal cruelty but fraud. they claimed that the hughes lied to them about how their dogs would be treated. they billed out as a disney land for dogs but many of the dogs were that is where the dogs died on a hot night in june. one of the dog owners was a boy with special needs. his dog, his service dog died at the green acre boarding facility and he claims now that dog was his best friend. take a listen. >> i know as soon as i see him, i'm going to be happy about it, and they wanted to make sure he was not happy with 23 days. >> 60 days is good. anything better than the 23 days. i wanted longer but anything more than the 20 days. i feel like the judge listened. some actions for their consequences is being taken. >> reporter: the judge mentioned when she handed out the sentence that the testimony addressing to special needs court weighed heavily in her decision to increase the jail time from 23 days to 60 days in jail. todd hughes reports to jail today and malesia hughes will have to report to jail on january 15. four people on a small plane survive when the small aircraft goes down northwest of phoenix. wickenburg injuring two married couples on the flight. they have been taken to valley hospitals for treatment. let's take a closer look at where the plane went down. this is the airport where it took off from. this is the us-60. the pilot took off from wickenburg municipal airport and the plane went down a quarter mile away. >> reporter: this is wickenburg airport where the twin-engine cessna took off couples aboard. they were all in their 60's. fred and linda gagliano and patrick and linda brewster were in the twin-engine cessna. just after takeoff, it had engine problem. >> i knew it was an airplane and i heard a bang. i went out this way to see if it was someone who shorted the the trailer over here. >> reporter: the tail of the plane hit the house, narrowly missing the family. it was a close call. >> it looked like it was aiming from the house where it hit the trailer. it hit and probably saved their lives because it gave. it probably did a 360 in the yard. >> reporter: luckily, the plane didn't exp of the cessna. they have serious leg injuries and cuts. they are being treated at a hospital in phoenix. the national safety board in phoenix is looking into the cause of the crash. steve krafft, fox 10 news. >> thank you, steve. a developing story in north dakota where a federal judge denies a request from a native tribe to halt access to a pipeline but then three voluntarily pause work on where the standing rock suix tribe says there are art facts. they are trying to block the project from moving forward. in addition to sacred grounds, they are concerned about the water supply. the pipeline would run 1,200 miles carrying oil from north dakota to south dakota and illinois. >> it is location. they talked to residents who were concerned. the maricopa reentry is located off of the pinnacle peak road. sex offenders will participate in other programs and receive help to reintegrate them into society. the concern was it was too close the hotly contested primary race in arizona's fifth congressional district is still up new the air. there will be a recount next week. earlier today, a judge ruled on a lawsuit filed by christine jones over the unofficial results, ordering that 18 additional ballots be counted in this race. those ballots involved voters who were not told their provisional ballots would not be counted if they went to the incorrect polling andy biggs gained 12 of the 18 votes putting him 16 votes ahead of christine jones. she got five and don stapley got one. christine jones alleged 300 votes have not been counted by maricopa county for different reason, you including ballots at the wrong precinct. house, the first ballots of the general election behalf. reporter: the victims names will be read at the national september 11 memorial and museum on sunday. there will be six pauses to mark the exact moment of the attacks and the time the two
