they're normally if someone keeping an eye out side of cameras in place, that was no surprise to it. someone could break in threaten or has been like that. questions about security are being referred described as a hippie collective where many other people live, including a well-known new to some activists in the bay area. >> fbi agents visited this berkeley home friday afternoon. they could be heard asking about david to poppy, the man accused of attacking paul pelosi, the people who answered the door at the home turn the agents away. i didn't even know he was david until i just received the picture. >> neighbors say they recognized the poppy. i just seen him helping out around the house would like yard work. and then i saw him in teased a little according to records, the home is linked to gypsy top. a famous new activists in the bay area. we were there for her nude wedding in protest on the steps of san francisco's city hall in 2013, according to the san francisco chronicle, the poppy was asked to be the best man. top was not home friday. she's in jail for an unrelated incident. the home is described as a hippie collective. but the people who live there they are unlike in her car to visit a relative on a sunny afternoon in august. but that is when the suspect approached her and pulled the trigger, killing her. now, police are revealing that this was part of a clockwork. we've got some showers on the way. it looks like at least a good that's in the forecast for you outside right now on the scale of it, the clear and cold temperatures developing around the bay area's got some high clouds up above and come patches of fog likely form, but a beautiful shot of san francisco. you can see the sales force building the bay bridge in the background and looks like some changes on the way. temperatures today running a little bit below the average and sem cisco. 63 degrees. 65 in oakland. 71 in san jose. 72 degrees in livermore, 71 in concord and 63 degrees. 10 degrees below the average in santa rosa. outside, though, we've got some passing high clouds, some cool temperatures on tap again. a little cold in the north bay valleys likely to see some of those temperatures dropping off into the 30's overnight tonight. and then tomorrow we're going to be kind of a mix of sun and clouds like today and then otherwise it's going stay dry. and then sunday, i think mostly sunny. and it's going to be a little bit warmer outside on sunday afternoon. temperatures probably a little bit above the average. still, we're starting to cool off coast side. 48 half of a 49 now in pacifica. 48 in fairfax. we've got 45 1 of the cool spots in petaluma and 53 degrees in napa. here it is. you've got a cold front off the coastline. high pressure now begin the weekend. you've got a numer system just kind of battering this ridge now helping to flatten out. but it's going to roll on. i think for the weekend and keep us dry. and that fact it may just strengthen a little bit on sunday before we really start to see things changing in the next week. right now, doppler scan your skies can't find any raindrops, least not in the showers all the way up in oregon. but for us, we're going to keep it dry for now. that cold front looks impressive. but really the kind of fall apart as a runs into that ridge. so we're going to see some high clouds from that. maybe some scattered showers well to the north, but for us suffer the most part, keeping a mild around the bay area overnight. tonight, we are going to see a couple clouds continue to pass on through and you see that on the way for tomorrow, as well the most clouds kind of meandering through your skies. most that some mid to high level cloud cover that's going to be pushing on through. so it's really looking like a nice weekend will be a little cold to start tomorrow morning. you've got some 30's in the north bay about 39 in napa. 36 furlough in santa rosa and a cool 43 in livermore importers along the coastline. so by day tomorrow, though, we should warm things up nicely. you're talking 70's, maybe some mid 70's, the warmest valleys as high as 74 in love war. maybe 76 in santa rosa. 72 in the bottle. 72 also in napa about 63 degrees cooler in the san francisco. then as we look out over the next few days yet but looks nice. and then the clouds roll in on halloween. but staying dry and then a chance of showers returns. the bay area with some much colder temperatures may be some record cold numbers as we get into tuesday wednesday and thursday of next week. lawrence, the big story we're following out of the south bay tonight. >> the santa clara county judge did not hand down a sentence for the couple convicted of kidnapping a little baby in san jose camilla barco explains why. >> prosecutors now have to listen to several 100 phone calls made in jail by one of the suspects. in this case, the new evidence has pushed back the sentencing date for the 2 people who snatched baby brandon back in april and could impact how many years they spent behind bars friday morning prosecutors in the baby brandon case revealing new information. >> one of the baby kidnappers you saying at waterloo pay ramirez may 300 phone calls in jail after she pleaded no contest in august before it went to trial. what has been said in those phone calls hasn't been made public yet. i can't speak to their because it is in public as matter of public record at this time because the calls are in spanish. it's going to take some time to sort through them. ramirez faces up to 14 years in prison after kidnapping. >> then 3 month old baby brandon in san jose. her secret lover, jose faces up to 5 years in prison for joining in on the plan, prosecutor rebecca weiss says the calls could impact their sentencing recommendation of something with incriminating in these called it could lead her to a higher sentence. however, ramirez is attorney cody salfen says he's been able to review some of the phone calls. as of now, i have not found anything that i would suggest that it's going to change kind of our approach to sentencing. baby. brandon's grandmother was taking care of him when he was kidnapped by ramirez and >> after 20 hours of searching for him, he was found safe in petito's bedroom. the couple attempted to kidnap baby brandon 4 other times before they did so on april 25th, both parties will review those phone calls over the next few weeks and then they'll come back on january. 13th for ramirez and party owes sentencing hearing. >> and that was camila barco reporting for us tonight. new video tonight from the sonoma county sheriff's office showing an incident earlier this month where deputy shot a man several times. the shooting happened. >> on sunday, october 15th around 6. 45 at night, the sonoma county sheriff's office says got a call from a woman de a relative of 43 year-old nathan smart was allegedly threatening to kill her and himself. police went to a home on clinton avenue and tried for hours to talk smart into coming out of the home and surrendering. but about 3 hours later, police say they realized smart wasn't in that home, some 20 minutes or so after that police started getting reports of a guy breaking car windows in a shopping center parking lot. this is on west napa and second streets. that's when they say they found the man who was later identified as the same guy. nathan, smart deputies say they told him to drop the gun but he ignored that and they say he shot at police. the man then took off running around the corner and you can see in body camera video. what happens next a warning tonight. this may be disturbing to watch for some people. pops out from around the corner gun still in hand, the deputy shoots multiple times and smart falls to the ground. the sheriff's office says smart received emergency medical attention at the scene was taken to the hospital in critical condition. police say smart was using a homemade gun which they say is right here. he is expected to survive and we'll be facing charges. >> the east bay now the contra costa county district attorneys spoke publicly today about her decision in the shooting death of 33 year-old tyrell wilson, controversial decision. she explains why her office declined to file criminal charges against the former danville police officer accused of killing wilson. he did kill wilson crowd forcibly plates. >> the day before speaking publicly during a news conference friday contra costa county district attorney diana becton says she reached out to 33 year-old tyrone wilson's family. she told them directly former county sheriff's deputy and denville police officer andrew hall will not face criminal charges in wilson's case. of course, they're disappointed in the decision. but becton says it is based on an independent investigation into the march. 11th 2021 shooting. it includes the analysis of 3 use of force experts being deadly force was reasonable. one saying it was not we're bound only to file charges when we have a good faith belief that we can prove those charges beyond a reasonable doubt. and that is ultimately where our decision life based on the facts included in the district attorney's office is 43 page report into wilson's killing. diana becton concludes that there is insufficient evidence to prove beyond a reasonable doubt. that hole is criminally liable in reaching this conclusion. the district attorney's office does not condone. >> the actions of deputy hall in the fatal shooting of tyrell wilson hall claims he was acting in self-defense when he opened fire on wilson that deadly day. he was responding to reports of a man throwing rocks onto the freeway from an overpass. wilson had a knife and was shot when he moved toward hall in march. the county settled before 0.5 million dollars civil lawsuit with the wilson family a week earlier, paul was sentenced to 6 years in state prison for the november 2018 shooting death of 33 year-old laudemer arboleda. >> friday wilson supporters held a protest outside the district very sad for the karen back. so she would often see wilson in her danville neighborhood. i never appear that a died because of the fire. the flames broke out about 4 o'clock in the afternoon thursday in broken arrow, which is about 13 miles south of tulsa. residents were ordered to evacuate out of a 14 story. oceanfront condo building in miami beach after engineers deemed it unsafe. the property is on the same avenue where the champlain towers south collapsed last year, killing 98 people. inspectors found a main support beam of the 14 story, port royale condominium. shifted cracks in the other supported grown. the beam was identified for repairs 10 months ago. the building constructed back in 1971. has 164 unit. federal court has cleared the way for former president donald trump's income tax returns to be handed over to congress. a house committee is looking into how the irs asking about david, the poppy, the man accused of attacking paul pelosi, the people who answered the door at that home turned the agents away, according to records, the home is linked to a woman named
