forty-niners fan in los angeles at the niners-rams game has been arrested. yeah. he's claiming self-defense. >> when he and daniel luna tangled up there in the parking lot outside of the stadium. he is still in a coma. luna is a crawford's will trend actually live for us at levi stadium. and will you been digging on this story? i understand you actually had a chance to speak with englewood mayor. >> i called his personal cell phone. i just got off the phone with inglewood mayor james butts about 10 minutes ago. and he confirmed that, yes, they did make an arrest in the overnight hours after this person turned himself in. this person has made bail and is at home this morning. daniel luna, he was at the game on friday by himself. he flew down to see the forty-niners. he never made it into the ballpark as it was. so fi security staff that saw him on the ground. they were the ones who called the paramedics to rush him to the hospital. talking to the mayor. here are new details. we do know and he has been able to clear up some of the confusion. he says it was not a suspect in a rams jersey. he said he made a mistake. he meant to say red jersey, meaning a forty-niners jersey or t-shirt and that luna was wearing a white jersey white t-shirt. also a niners jersey and they were in a niners tailgating area. >> more details about this. according to the mayor. he says that luna was the aggressor, that he was the one who pushed the suspect. then the suspect pushed him back and then luna pivoted. that's when the suspect punched him in the face. and that's when luna fell back. hit his head on the concrete. and we all know james and darya. it is that concrete that really does a lot of damage. and 5 days later, he still in a medically induced coma for his protection. they will hold a news conference down in englewood at 9 o'clock this morning. so less than one hour from now, the mayor did say after he gets off the phone with me that he would speak to the police chief with the inglewood police department and they will perhaps jointly hold a news conference for the very latest details. as far as this suspect is concerned, his name not be released to the public. he's the only one arrested and no, they have not released the surveillance footage yet, but you never know. once the news conference begins, but he says he did make a mistake and he apologizes for that. i know a lot of people might go. he might be the rams niners rivalry that might have played a role in this. but he says he meant to say read not rams. when he held that news conference last night. back to you. >> a great job getting that confirmation will. and just to clarify our newsroom has been told, perhaps in the 9 o'clock hour that press conference may happen. is that what you're hearing as well? >> we are hearing 9 o'clock this morning. we have our sister station down there and i'm sure they are hustling to get to the scene as well. this is the biggest story down in los angeles. a big story here and it's made national attention. so if we can probably try to, we might even be able to carry that news conference live as it happens. but again, this was just a bang-bang thing, meaning a span of 5 seconds. >> he wanted to clarify, especially to the bay area and you laugh if my cell phone has a 4, 1, 5 area code. he doesn't have my number into his contacts. but once he saw 4, 1, 5, he san francisco is calling. and i said absolutely. it's a big story here as well. and we spoke for about 10 minutes. so he knows the gravity of this story and he wanted to clarify, especially with bryan stow being from the bay area. he wanted to clarify that this is not similar to bryan stow where he was savagely beaten in the parking lot after a dodgers giants game still being a giants fan. and this case, it only lasted about 5 seconds and the suspect turned himself in. okay. thanks a lot. well. >> today in the east bay, parents, teachers and students are going to hold some rallies in oakland because they're against possible school closures. yeah, the effort is save those schools from being shut down. >> there is a vote planned for next tuesday and kron 4. sarah stinson is going to be following the story today. the on as we closer and closer to that vote. sarah. >> yeah, it's a story we've been following very closely. it's a passionate topic in oakland with teachers and families and even city leaders. they're all against the school's closing. so today they're going to be rallying at the school sites that are on the chopping block and they'll be marching from oakland city hall to the school district office later in the afternoon. this is ahead of the school board's february 8 vote which could close or merge 16 schools in the next 2 years. >> people against this say they're upset because of the schools that are being threatened to close and merge are predominantly serving black families, black and brown families that say they depend on this is their livelihood. the oakland unified school district claims they need to consolidate in order to survive in over 12 million dollar deficit caused by declining enrollment and attendance. if you don't know, funding is given to schools based on how many kids attend every day. but of course, the pandemic that's cause a major hit to oakland city council president, along with 3 other city leaders are asking the state for help not only for the district's debt to be eliminated, but also for funding based on attendance to be changed. let's hear now from the city council president and then. but first, let's hear from the mayor who explains why this consolidation needs to be done. >> that districts like stockton, san fremont serve roughly the same number of students about 33,000 and do it in far fewer campuses between 41 and 48 campuses. compared to oakland, 80 campus. it's and so i am hopeful that this consolidation. can improve our compensation and our retention of our incredible educators as well as offer more to our students every single time their school closure. it's always and most hardest hit communities. these black and brown kids are low income families. >> our most marginalized families. >> and so families and students and teachers, everybody affected by this. they are getting together today. it's sort of the last push before tuesday's vote and so they are meeting at the schools that are affected by this. and then they're also meeting at city hall at 3.30 this afternoon and will be marching from there to the school district's office. now, i just interviewed some of the people who are going to be at those rallies and we did on zoom, of course, because i'm here at home and also getting videos of you. join us at 9 o have not only some of the interview with them will have video for district is going to get students more time to get vaccinated. district leaders are moving the february 18th deadline because more than 7,000 students still haven't verified their vaccination status. the superintendent is now expected to bring deadline for pows ulta the board's meeting which is on february. 16th. there are teachers, however, who aren't too happy with this decision. >> and many teachers are very disappointed about this news. you know, we've been working really hard to keep schools safe and we know what the best thing to do to keep kids safe and keep schools open is vaccinations and the district made a commitment and have them go back on their word was quite disappointing. >> 4 members had previously recommended extending the enforcement date to august, which would be in line with what oakland is doing oakland, unified district set a deadline of august. 1st. >> well, happening right now in the south bay, san jose's new covid vaccine requirements for people attending events. city owned buildings like the sapd center is now in effect. >> yeah, crawford's camila barco is live. you've got to know the rules. if you're going and you have to make sure that the timing is right because what you want to take care of we can advance at least or something. >> well, you can practically just take a covid test a few days before and then you're good to go at me. the city is asking everyone to be fully vaccinated and boosted if you want to attend any indoor event in san jose with 50 or more people and this goes for then use their hosting indoor events will like concerts shows and sporting events. so this would apply to places like the sep center they have right now the convention center and historic theater is now the city says if you're not eligible for your booster shot, you can provide a negative covid test. now this is where the rules apply. that test must be taken within a day of the event. it's an antigen test for today's it's a pcr test and these rules apply to anyone who is entering the sep center regardless of your age. but starting today as well, people who work for the city of san jose are also required to have their booster shot. and san jose city council members voted unanimously on this proposal last month and they say this mandate is for the long haul city. we have a city leaders say that this mandate is going to avoid hospitals from being overwhelmed. and they also say that the booster shot provides better protection against covid compared to only having the initial covid shots. now, daryn, james, this is the city of san jose is the first city in california to implement such a vaccine mandate. so it will be interesting to see how this plays out. and also if other cities will follow suit. one stock to see for short-staffed u.s., employers apparently added 467,000 jobs in january. now as far away above what economists had expected. they say it shows many employers are willing to hire even during this covid surge and pay people more to try and get him to come back into the workforce. the labor department also says that the unemployment rate went from 3.9% to 4%. coming up next on the kron, 4 morning today. nothing exceptionally windy like we saw earlier this week. but you will notice it especially near the coastline in our north bay mountains where temperatures heading today. well, it's going to be a nice feel to it. low to mid 60's for almost all of the bay area at the coast by the bayshore further inland. all of us going to be sharing this pleasant range of numbers, palo alto at 64 san jose and surrounding areas. our warmest at 66. well, east bay temperatures as well as in the north bay, mostly in a range of low to mid 60's filet o napa. sonoma youngsville among spots at 63 degrees back to you. thank you very much. >> 8.17, is the time and new this morning, some san jose food pantries may soon be getting a little help from the city. last month we told you about the lighthouse ministries food pantry, which was in danger of closing. the pantry was told that it needed a $15,000 special permit in order to continue doing its work. well, now there's a new proposal going before the city council later this year. that would waive those fees for not only that pantry, but any pandemic-related food pantry. city officials say the deadline for light house to apply for that special permit has now been pushed back until this program can be put into place that will waive those fees, meaning that the pantry is allowed to continue operating. >> it's 18 right now. and the san jose spotlight is suing mayor sam liccardo saying that he used his personal phone to do city business. the spotlight has partnered with the first a man called amendment coalition to file a lawsuit. >> against the mayor and they're asking. >> that no city official can exclusively used a private e-mail accounts for city businesses and the suit also asks the court to search. mayor lockhart is private accounts for any official records that have not been released in the past 2 years. >> so we're going to work very hard to try and put an end to this practice to try and uncover the records that they're still withholding to try and get the records that they've redacted or blacked unredacted. and to shed light on what the elected officials and employees of the city of san jose. are doing. >> a bill recently published by the state legislature could take effect as soon as next week. it would apply to businesses with more than 25 full-time employees. executive director of the golden gate restaurant association laurie thomas says she understands how bill like this benefits employees that need their paycheck. but she says it could hurt smaller business owners who don't have the means to pay out all the sick time without some help. >> it's people that were in the position or maybe just don't have the cash to pay it. i remind everybody, not everybody got all the federally funding would like them. if this is in final to consider moving that, that employee head count up to some words of like 100. and are we putting a disproportionate, you know, burden on maybe many, many businesses. but on our certainly our small restaurants and majority of businesses. >> the bill would give an employee 40 hours of supplemental covid paid sick leave and 40 more hours if they have to care for a family member who test positive. >> will children under 5 could soon be eligible for covid vaccinations. a local doctor says that would bring peace of mind millions of americans. in fact, nearly 20 million us children are in that age group right now, an emergency use authorization would really close one of the biggest gaps that we have currently in vaccine eligibility. it's happening as the omicron variant continues to affect children both at home and at school. and this news that pfizer could pfizer could get the go ahead is really promising for a lot of folks. >> they're actually fairly strong for for kids for 6 months to years of age in preventing hospitalization and death. that they are a bit less strong kids. 2 years to 5 years of age with the vaccine, at least in the initial trials. but given the massive increase in infections and hospitalizations, i think the fda is looking for a solution to the problem facing kids that he stays. >> an fda advisory committee will take a look at the submission on its next meeting, february 15th. all right. now let's get back to will track as we've established a connection. now, we want to know more about this fight between a 40 niner fan. >> daniel luna and a rams fan in la at the game. well, actually, that clarified apparently not a rams fan, but let's get the latest. will we don't we don't really know is. i guess we'll. >> this story changing because the mayor on his personal cell phone, he and i were talking, he was adamant that it was a red jersey that the suspect was wearing that he miss spoke last night during a news conference when he said rams when he meant to say ready was very adamant with me on that red red was what i said. and that luna was wearing a white jersey and that they were added 9 years, tailgating section. mean, there are so many niners fans at the game that they were in the niners area, whether other niners fans. so he told me he does not believe this was a rams versus a niners fan. the confrontation, but it keeps changing because now my sources are telling me possibly that the suspect was, in fact, wearing a rams jersey. hopefully this will be put to bed in about 25 minutes from now when they will hold a news conference. the mayor did tell me once he got off the phone with me and i spoke to him at around 07:45am. in the morning that he would talk to the police chief of inglewood. so it looks like they will jointly hold this news conference, which we will try to live you once it happens down in englewood as far as daniel luna, what he blew down to watch his favorite team, the san francisco forty-niners play the los angeles rams on sunday. but he never made it into the ballpark. that he was injured in the parking lot and it was so fi security. there was the stadium security that spotted him at 4, 0, 9, and that they were the ones who called paramedics to rush over to the scene. despite all of those people in the parking lot, either they saw it didn't want to get involved. who knows. but it was the security that called the paramedics. did speak to mayor james butts of englewood. he did give me more details. he said that it was according to the surveillance footage that luna was the aggressor, that he was the one who pushed this suspect. the suspect then pushed him in his back. then luna pivoted turned around. now at this point facing the suspect. the suspect then punched him in the face. luna falls backward, hits his head on the concrete. and as we all know, sometimes it's not the punch. it's the fall. that is more horrific. 5 days later, he still in a medically induced coma just to protect his brain. i do know that the suspect did turn himself in last night to be questioned. and during the questioning, james and darya, it appears that investigators had enough to go ahead and make an arrest that he has been charged with assault with the intent. 2 got cause great bodily harm. we also do know that the suspect has made bail, that this person has not been as far as his name been not released to the public. we are awaiting that news conference very shortly to see what's going on again. that should happen in about 20 minutes from now. back to you. >> okay. we'll hope for more answers than thank you very much. well, >> we're also getting some more information about what happened with the shooting on a greyhound bus in oroville court. records show that the man who's accused of opening fire had a warrant out for his arrest for violating probation in alameda county. and the man they arrested is 21 year-old a soggy coleman. so he was a passenger on the bus, police say something that i'm upset and he ended up opening fire, killing a woman and wounding other people wednesday night. and they say that after the shooting, he threw away the gun and ran into a nearby walmart. police ended up getting called at walmart people called 911 santa guys in here taking office close. >> on entry in walmart, our deputies encountered the subject at that point. he had no clothing was acting erratic. immediately are able to take him into custody with out a further incident. >> 5 people were hurt. i told you that one winds out there at times, but nothing like we had during the middle of this past calistoga, about 15 miles per hour. wind gusts this afternoon. we will be seeing conditions out there along the bay shore. just a nice light, offshore breeze where we had with temperatures. well, after a morning full of 30's, it's going to be an afternoon full of 60's low to mid 60's near the coastline and pretty solid mid 60's for the majority of the bayshore south bay. temperatures will be among our warmest 66 for much of the santa clara valley, east bay temps low to mid 60's for u union city and hayward at 64. same from san leandro up to berkeley, north bay. temperatures low to mid 60's until you get to the coast. that's where you'll find your 50's and point raise in stinson beach. looking ahead at our
