now there's a man sitting in his car outside mcdonald's home. who's speaking for the defensive lineman. and he's declining visible from the street though. are happy birthday balloons in mcdonald's backyard. it appears the seven-year veteran was arrested at a party thrown in his honor. loud music is still audible from the street. even after his arrest for domestic violence. san jose police got the call just after 2:45 sunday morning. they arrived here at mcdonald's home on bentley ridge drive in san jose. birthday balloons in the lineman's backyard point to a celebration. ray mcdonald turns 30 on tuesday. he was booked into the santa clara county jail. and later released on 25 thousand dollars bail. san jose police have not clarified who mcdonald is accused of assaulting. the niners released this statement on mcdonald's arrest.saying ".the 49ers are aware of the recent reports regarding ray mcdonald and we take such matters seriously. as we continue to gather the facts, we will reserve further comment." now the 4e9rs are awaiting further comment from league commissioner roger goodell. goodell recently raised the penalty for all n-f-l players and staff involved in domestic violence. the first offense now carries a six game suspension. the second offense bears a lifetime ban. this, only days after goodell said he "made a mistake" with baltimore ravens runningback ray rice. who was given a two game suspension, after he appeared to be caught on video assaulting his wife. the niners are already reeling from another of goodell's decisions this week. when the commissioner announced a nine game suspension for star linebacker aldon smith. like smith. ray mcdonald's problems, at least in-part, stem from his use of alcohol. mcdonald's previous run-in with the law was in 2010. when he was arrested for driving under the influence. the nfl does not have to wait on legal proceedings they can do whatever they want. we have more details later with sports point "oh" earthquake rattled napa. and early this morning.a significant aftershock struck the area. the u-s-g-s says a three point two tremor hit just five miles south of napa. there have been more than 70 aftershocks since the big quake last sunday. the six point "oh" quake was the strongest the bay area has experienced in 25 years. no one was killed.but more than 200 hundred people were treated for injuries. it also caused as much as one billion dollars in damage around the bay area. 300 million alone in napa. the labor day holiday is *normally one of the biggest weekends of the year for businesses around napa. kron 4's alecia reid spoke to owners of velo pizzera. who struggled throughout the week and has now finally reopened. >> alecia reid salads are leaving the kitchenpizza's are being ordered for the table, and by the slice. after 2 days of reinforcing velo pizzeria's roof, customers can now enjoy the eatery's food. >>they were red tagged here, so this is our way of saying thank you for reopening and supporting them. >> i heard they were un red-tagged and we were meeting for lunch so i said lets see if we can get in. they were only opened 2 weeks ago. what a challenge to have the first two weeks of business. >> alecia reid as you walk around downtown napa, more and more stores are opening their doors. >> i heard 95% of the restaurants are opened, 90% of the shops are open. it took a herculean effort but we're so happy and grateful that people are coming. >> alecia reid ceja vineyards also reopened over the weekend. tourists were happy for the big quake. the same dogs visited students at sandy hook elementary school. after the massacre in new town, connecticut. the four dogs were at church services in napa today.and will be in the bay area that seemingly simultaneous pops. >> philippe djegal the scene of the crime was her home around 1230 friday morning. >> i made sure all the doors were locked in turn off the lights. >> philippe djegal minutes later she snapped this photo of police in front of her home where five people including two men, all in their early 30's were wounded by gunfire. police say that this man pulled the trigger. he is one of three uninvited guests who showed up to a house party here. >> once they are at the party they got into a verbal confrontation. >> philippe djegal partygoers asked him and his two guests to leave and they did. >> 30 minutes later a white sedan pulls up to the house were lots of people are in the yard. they then begin to shoot. >> philippe djegal the driver was then arrested 30 minutes later. police say the victims all suffered non threatening injuries. thorez was booked into jail on five counts of attempted murder. vickifirefighters safely rescued two men who were trapped below san francisco's cliff house restaurant this afternoon. it happened just after 3-o- clock just north of ocean beach. officials say the men were unable to get out of an area under the restaurant. after walking there from the beach. firefighters were able to rescue the men within about an hour. there were no reported injuries. fire investigators say paint- stained rags caught on fire yesterday. causing 100-thousand dollars in damage to a santa rosa home. it happened around 2-45 along the 500 block of buena vista drive. crews had the fire under control within 30 minutes. residents say they had used the rags to stain their fence on friday. however. officials say they were left uncontained in the dirt alongside the home. the afternoon heat then caused the rags to catch on fire. no injuries were reported. a mountain lion was spotted in woodside today. the caller spotted the cat in the wunderlich county park. san mateo county deputies are looking into the sighting. officials say if you see a mountain lion avoid them at all costs. generally mountain lions avoid contact with people. >> brian van aken i would definitely try to avoid them if i saw them! we have lots of sunshine and blue skies out there as you can see at the golden gate bridge. otherwise the sun is really warming things up for today. temperatures range from the upper 60s that the coast to mid- 90s inland. commute in san francisco is about to go up tomorrow. the muni adult fare will be increasing from two- dollars. to two- dollars and twenty- five cents. muni monthly passes will also be going up. the muni only pass will cost 68- dollars. and the muni and bart pass will cost 80- dollars. senior, disabled, and youth fares are not changing. it's the end of an era in oakland. the last of the downtown shop this weekend. sears at 20th and broadway has been winding down in recent months. we shot this video when sears first announced it was pulling out. the 85 year old building was sold to a silicon valley investor and is slated to reopen again in about a year. the new and improved sears building is expected to house a high tech company as well as a cluster of hip new stores. the city says it's an economic shot in the arm downtown oakland desperately needs. coming up at eight. severe thunderstorms sweep through the northeast.washing out labor day weekend events. and sending people running on one beach.where lightning hit three men. a southern california man could face criminal charges.as prosecutors say they have evidence he purposely tried to spread h-i-v. several people killed as a small plane goes down near denver. details on the deadly crash. officials say all five people aboard a small plane that crashed near denver are dead. the piper p-a-46 airplane crashed near the erie municipal airport just before noon today. three people were declared dead at the scene. and two were taken to hospitals where they later died. authorities say the plane crashed a few hundred yards northwest of the runway. but do not know if it was landing or taking off. the n-t-s-b is investigating the severe thunderstoms have wrecked havoc across the northeast. the weather has delayed flights. caused damage at music events. and more. officials say three men were struck by lightning in new york as storms rolled through the area. the extent of their injuries is unknown. additionally. bad weather forced an early end to the made in america music concert in philadelphia. and the electric zoo music festival in new york. the weather even halted play at the u-s open tennis tournament. >> in tomorrow night before midnight making a really cloudy start. temperatures will drop five to 10 degrees which is where we will stay for the rest of the week with a cloudy morning and drizzle. also relatively mild to warm afternoons. tomorrow looks like an excellent day at the beach with fog in the morning but should be clearing by 11 to noon with a fair amount of sunshine in the afternoon. a attorney's office filed a complaint against thomas miguel guerra. saying, he purposely infected a man with the virus. which can cause aids. prosecutors say, some of the evidence includes text messages and emails. where guerra appears to tell people he is h- i-v negative. and then, engages in sexual activity with them. an accuser in a long- term relationship with guerra. opened up about what he vicki liviakis still ahead. a day at the beach ends in tragedy for one young girl. what happened when she decided to explore a giant hole in the sand. plus we look into what caused a 50 car pile up. that made drivers blind to what was ahead. and a cat killer on the loose in daly city. you'll hear from its devastated owner. >> vicki liviakis a cat found bloody and badly injured in daly city. has triggered an animal cruelty investigation by police. kron 4's maureen kelly got the disturbing details from the pet's owner. >> maureen kelly this is a picture of a cat named candela before it went missing. this is a picture after panda was found. it had a broken jaw, broken teeth and extensive eye damage. the owner says that one of the that that treated the six year old cat says it looked like the cat was hit with a blunt object like. a baseball like the cat went missing the thursday before last when they were taking out the trash. they looked everywhere but could not find him. they put up fliers but someone kept ripping them down. the following saturday they found someone had written on a flier posted in the elevator a big note that said the cat was dead in the broad behind the door. what kind of human could do this to a little cat you can still see the blood stains from where panda was found.at the time he was still alive. the cat eventually succumbed to his injuries on monday. >> we were devastaed. this is horrible. >> maureen kelly pyper believes someone..abducted the cat.beat him.and later left him for dead in the garage.because they had looked there before and found nothing. he is distrubed to think the culpruit could live close by.maybe even in his building. the penisula humane society is joining the investigation. they are conducting a necropsy on panda's remains. the spokesperson for the agency says the pictures of panda's injuries turned his stomach. they are offering a one thousand dollar reward for information leading to the arrest and conviction of the person or persons responsible. >> vicki liviakis u.s. airstrikes have helped break an isis siege in iraq. the sunni extremist group had surrounded the town of amerli. a u.s. official said a massacre of a minority ethnic group was "imminent." mary moloney reports from atlanta. >> "we have to protect americans. that's the number one issue." go >>mary maloney the u.s. is continuing airstrikes in iraq. sunday officials announced the u.s. had hit isis targets near the town of amerli. the town of about 20 thousand is home to many of iraq's shiite turkmen, an ethnic minority facing massacre from isis. >> "we got into iraq because we had humanitarian issues we had to deal with and because we have to stop isis. it's a very dangerous group of people." the u.s. also air-dropped humanitarian aid to amerli; residents have been without power and faced severe food and water shortages, according to the u.n. following the strikes, iraqi security forces entered the town and broke the isis siege, according to iraqi state t-v. the u.s. and its allies are concerned about the growing threat of isis in iraq and syria. friday british prime minister david cameron announced the u.k. would raise its terror threat level to "severe." at home, president barack obama is facing criticism that the u.s. doesn't have a plan to combat isis in syria. >> "we had a year that the president has talked about trying to put together a strategy in syria. it was unfortunate he used the term 'we have no strategy in syria.'" the administration says that plan is still being developed. >> "it would be putting the cart before the horse to talk about what sort of congressional authorization would be required for a plan that hasn't even been put in place yet." >>mary maloney i'm mary moloney reporting. >> vicki liviakis members of congress are urging president obama to take action. new york republican rep peter king says the longer we wait the more dangerous isis becomes. australia's prime minister tony abbott says today there is some concern about radicalized australians joining isis. speaking in canberra, about the situation in iraq with isis and the humanitarian aid drops his country is participating in. abbott said it isn't a stretch to think attacks could happen in australia. >> the problem with a significant amount of australians going with them is that they are radicalized, brutalized, and if it is right to kill in the name of god and i rack there is no reason to think they will not do the same elsewhere, including in australia. >> vicki liviakis abbott also announced an australia will be airlifting equipment and supplies to irbil in the coming days. rebels in tripoli went for a splash in the u.s embassy's pool. an islamist-allied commander says a militia umbrella group as been guarding the compund ever since. the group had also taen control of their capitol and international airport. u.s. personnel fled the embasy over a month ago to avoid the fighting. the unrest in lybia continues even three years after mommar ghadafi was removed from office. a 9-year-old girl who was pulled from a collapsed sand cave in oregon on friday, has died. emergency crews tried to revive the girl. she was pulled from a hole dug in the sand on a lincoln city beach. the girl was visiting the area with her family. she climbed in the hole to see how deep it was when the sand collapsed. the girl wasn't breathing when she was pulled out. the hospital wasn't able to revive her. >> "well the people were digging and digging and digging, and it looked like the sand kept collapsing." butted to "it was heart-wrenching. you could see that people were trying and - i don't even know what to say. it was awful." >> vicki liviakis mourners have laid flowers at the beach where the girl was playing when the sand collapsed. a huge dust storm is being blamed for a more than 50-car pile-up in washington state. strong winds kicked up a ton of dust on interstate 82. drivers had a tough time seeing right in front of them. a few dozen minor injuries were reported. mostly cuts and scrapes. a total of 9 people were taken to the hospital for their injuries. e-m-t-s say no one was critically hurt. russian president vladimir putin is calling on ukraine to start talks on a political solution to the crisis in eastern ukraine. putin said the goal should be to safeguard the interests of those people who live there. however. hours after the announcement. ukranian officials say land-based forces fired upon a border guard vessel operating in the azov sea. the attack comes after heightened concern that pro- russian rebels are trying to take control of the land bridge between russia and the crimean peninsula. violent protests continue in pakistan. a protest turned ugly when they tried to storm the prime minister's house. they wanted him to resign from office. two pepole were killed in the commotion. omar sharif has refused to step down as prime minister. protesters returned to the streets today. tens of thousands of people are left homeless in gaza. after almost two months of airstrikes much of the city is in ruins. an international organization is saying it could take 20 years to rebuild. the refugee agency, shelter cluster says gaza already needed more housing. now, almost 20 thousand homes are destroyed or badly damaged. a park ranger may be temperatures ranging from seventies to the '90s and the labor day forecast >> vicki liviakis a new report says lack of sleep in adolescents causes poor academic performance. and poses a serious public health concern. according to the american academy of pediatrics. schools that start too early are contributing to the problem. they say lack of sleep can lead to traffic accidents. depression. and even obesity. the report says sleep-deprived teens tend to eat more carbohydrates and fats. however. schools that start later in the day have students that tend to be less sleepy. have fewer attention difficulties. and have better academic performance than schools that start early. >> brian van aken lots of clear skies tonight with a little bit of fog developing at the coast. we will stay mostly clear the 04 tonight and tomorrow with lots of sunshine for labor day. that means warmer temperatures than today. sunshine and blue skies and by noon. it has been a week since the big earthquake last sunday. we still have some aftershocks. this map shows little dots with earthquakes of 2.0 magnitude or greater. there have been 16 in the past seven days and they are still occurring. aftershocks could still persist for the next several days. temperatures tomorrow are warming up for the south bay going to the mid to upper 80s. (see local temperatures) things change big time on tuesday with fog rolling in. it will take a long time to clear out. by tuesday afternoon temperatures will drop five to 10 degrees. things will continue cool off to the rest of the week with fairly heavy fog throughout the week in the morning. >> vicki liviakis a state parks ranger arrested for allegedly drinking and driving his state issued car - an act, it appears, someone caught on camera. a person snapped this photograph of tyson young. after they spotted him unconscious with a beer on august 15-th. the person says, they tried to wake young. whose car was parked along state route -254. in humboldt redwoods park. when he would not wake up. they were worried he was hurt. and called 9-1-1. butt he, young did wake up and drove off before emergency crews arrived. he was later pulled over by the c-h-p. and arrested for d-u-i. young is now also facing investigation by california state parks. and has been placed on administrative leave. a bugatti is the kind of car that can easily get away from you. coming up, we show you the high priced wheels that ended up under water and the owner - in hot water. it is amazing to see the bottle survive this violent shaking. they stay on the rack with thisquake --guardian. people have contacted me from as far south as lost angeles that they want tough order these. each time an earthquake strikes anywhere in america he did say assessors--spike in orders. >> people love their wine to. they don't even let strangers into their wine room. it is like a part of their family and they will do anything to protect it. >> it works with any iraq out there and is basically a blubbering that can expand or contract which she pinned down once. each guardian can hold up to 100 lbs. of it is a high-quality contraption. it is only $2.50. by a six-pack or 20 pack and it becomes more cheap. unless you are a wine box only drinker you might consider locking those wine bottles down. >> vicki liviakis uber is expanding and heading down under. the app-based rideshare company posted on its website thursday that it has launched in 24 new markets. 22 of them are in the united states, one in australia, and another in new zealand. that means uber is now available in over 200 cities in almost 50 countries. a 6-year-old boy is recovering after a car ran him over in china. take a look at this surveillance video. the boy was playing on a road in the shandong province when a red s-u-v drove right over him. officials don't know if the driver knew that he or she ran over the child. somehow. the boy was able to fit his body between the tires of the car as it drove over him. miraculously. the boy was not hurt. and was seen dusting off his pants before running to safety. the boy's grandfather was in tears after seeing the surveillance video. and says his grandson was extremely lucky to joan rivers remains on life support tonight. it's been three days since she went into cardiac arrest during surgery. her daughter, melissa, says they are hopeful about her condition. in a statement she said that their fingers are crossed. melissa thanked everyone for expressing their support. mt. sainai hospital in new york says there is no change to her condition. a prank call sends a colorado swat team into action. it evacuated businesses and puts schools on lock-down. but as tak landrock reports, a digital trail could lead police to the caller. >> they're clearing rooms, what in the world? cuz i can stop? no! i love you and your show. it's cable. customers are more satisfied with u-verse. switch and we can stay together forever. forever? ow. i'm not gonna lie to you. it's also the biting. break up with cable. choose u-verse tv from $19 a month for 2 years. >> vicki liviakis a texas family was brought to tears by a random act of kindness by a group of firefighters. the men fought to save a man's life.then offered help in a way his family never expected. as kevin reece reports. it's a heartfelt gesture family members say they'll never forget. >>kevin it was a normal call for the men of engine 4 in baytown. at a house one mile away, 65 year old john mccormick collapsed while mowing his front yard. he had a history of heart trouble. this time his heart stopped. firefighters and emt's revived him and followed the ambulance to the hospital. but then engine driver luke bednarek had an idea. so, they drove back to the house. >> push the mower first." and that's when a neighbor secretly took this picture. firefighter blake steffanauer finishing the front yard. >> "i just happened to get off the truck first and grabbed the lawnmower first. we were all fighting over it." >>kevin they took turns. they did the backyard too. locked the garage, put the key in the mailbox, and left this handwritten note that said "we felt bad that your husband didn't get to finish the yard, so we did." and they didn't think it was that big a deal. >> "no not at all. just something to help someone out in the worst time of their life." >>reporter but it was a letter, and a gesture, that made a daughter weep. >> "it just showed me that there's still compassion. that people still do random acts of kindness every day for people that they don't know." >>reporter this story does not have a happy ending. john mccormick died two days later. but his family thanked the firefighters for giving them those two days to say goodbye. and for restoring their faith in people. lease "i just couldn't believe it. i just couldn't believe they took the time to do that." .with a simple random act of kindness.
