nothing to do with like terrorism or doing something to the public. maybe it's just some sort of a hobby he had, i truly feel bad for him, because i know he wasn't, it's not something he would do, matter of fact. it was just something i guess was a dumb mistake. >> a search for his address turned up this home on a quiet street in san carlos. a man with what sounded like a russian accent there said he needed to talk to a lawyer before making any comments. maureen kelly, kron4 news. a person is in the hospital after reportedly being stuck beneath a bart train. police say it happened after 5:30 this evening. bart experienced major delays but now training are running about 20 minutes behind. right now police are not sure how or why the person got on the tracks. the persons condition has not been released at this time. a 21st birth day party in east san jose ended early this morning with a man being stabbed to death. kron 4 reports on the cities fourth homicide of the year. >> reporter: they do like to party, but you know, i don't know who or why someone would do that. i don't understand. >> and neither do the family and friends who attended a 21st birth day party at this home on the foothills of east san jose. hours after the deadly stabbing, one person after another, some nursing injuries, seen walking in and out of the house, too emotional to talk about the tragedy that took place here early sunday morning. >> is this family normally peaceful? >> yes, they are, lovely people. >> lowell baker lives next door to where the stabbing happened. he says he has such a good relationship with the family that three days prior to the incident, the mother of the household let him know that on saturday night, her family was going to host a 21st birthday party for her daughter and that alcohol would be involved. >> yes, they were drinking. >> baker says the party was peaceful and everything was going smoothly up until about 1:24 in the morning, when an altercation broke out on the front lawn. >> i heard a lot of arguing going on out in the yard. >> baker later learned from the birthday girls mother her daughters 22 year old boyfriend was the man who was stabbed, and that to baker's knowledge the boyfriend was sober. >> the boyfriend went out to break it up. he was inside. the mother told them to leave because they were starting arguing so they went outside and that's when it happened. >> by the time police arrived at the home on suncrest avenue, baker says the boyfriend was already in bad shape. police say he died less than an hour later. investigators have yet to name a suspect or announce an arrest. >> i don't know who did it but somebody does. >> in the meantime, the family is asking for their privacy. baker feels bad for them, especially the mother. >> she was crying on my shoulder when i went over there she just found out the boy had died, and i just comforted her and said i pray for her. >> in east san jose, kron4 news. students at san jose university are on alert as police are investigating two reports of sexual battery and another attempted sexual battery all taking place on campus overnight. kron4 mike pelton shows us who police are looking for and if authorities believe the cases are related. >> you never know what's going to happen when you walk through campus. >> reporter: studentses at san jose state university spent their first weekend back on campus reading text and e-mail alerts about two reports of sexual battery. >> that's disturbing. >> around 7:00 p.m. saturday night police say a man on a bicycle rode up behind a woman and inappropriately touched her outside the event center, then later around 9:30 the suspect struck again touching another woman outside hoover hall before riding away. >> kind of concerned about my safety on campus because i am a freshman and i'm a girl and i don't want to go walking by myself at night. >> police describe the suspect as a 20-30 year old white man with a black hooded sweat rich shirt but police are investigating a third unrelated incident around 1:00 this morning outside macquarie hall where two men on skateboards attempted to touch a third victim and police tell me she defensed herself and those suspects rode away marking three incidents in a six hour span. >> really shocking, everyone was talking about it like at work, at school. >> police say all three victims are students at none were injur detectives will investigate the case but some students are so freaked out this one did not want her face on camera. >> i woke up today having to go to a meeting in the morning and it's just scary. >> police advice walking in well-lit areas and staying aware of your sir reasonings, students say she plans to do just that. >> i know a lot of my friends say to carry pepper spray around so i'm actually carrying one right now actually. >> so you're ready? >> yeah, i'm ready. >> in san jose, mike pelton, kron4 news. a shooter is loose after shots were fired earl your in a pleasanton bar. one man was left injured at the shooting at red coats pub. witnesses say the suspect is pacing inside the bar when he pulled out a handgun and fired several shots at the ceiling. most of the bullets caused damage to the roof but one did strike a patron. the victim was taken to the hospital and is recovering from his wound. a richmond gang member has been sentenced to 31 years in prison for a hate crime, gang rape in 2008. 20 year old robert ortiz plead guilty friday to rape and other charges. ortiz was 15 years old at the time of the crime in december 2008. ortiz and two other gang members were convicted of repeatedly raping a 28 year old lesbian woman who was walking home at the time. darryl hodges, whose now 20 years old was the other teen involved in the rape. hodges was sentenced to 24 years in prison. 36 year old umberto salvadore was also convicted by a jury and will be sentenced next month. new tonight, a frightening encounter for an 11 year old boy after getting bit by a german shepherd dog that happened saturday morning on the 2600 block in san leandro. officers had to shoot one of the dogs involved in the attack. they spoke to the boy and shows us what happened. >> right here on the back of my legs, three teeth right there. >> reporter: matthew shaddle shows off his injuries after being attacked by a german shepherd while playing basketball saturday morning. >> i thought they were the gardeners dogs so i continued shooting baskets here. >> matthew saw the dogs but didn't think anything of them until? >> and the dogs started like trotting down here and then one of the dogs started biting me. >> he kind of like bit in and held on to my shorts. >> that's when matthew's dad rushed outside and noticed the two german shepherds did not look familiar. >> he got in the car, wife called the police so i had them cornered and the police came. >> when officers arrived they were able to immediately locate the dogs, but police say both german shepherds became aggressive, one of them even charging at an officer, forcing that officer to fire their gun, shooting and killing one of those dogs. an investigation determined the same dogs were also aggressive towards some landscaping workers just before one of them bit matthew. >> a tough situation for them. here is two big dogs that have attacked an 11 year old boy and they had unfortuntely to take care of them. >> i'm pretty lucky. it could have been a whole lot worse if both of the dogs came at me. >> matthew, a very lucky young man. they are lucky those injuries were not more serious. i did check with police and they have quarantined the other dog in question. as for who owns these german shepherds well i've asked around the neighborhood so far, haven't heard anything. reporting in san leandro, kron4 news. the 14th consecutive day of record high temperatures around the bay area in the upper 60s and low 70s, records for oakland, sfo, livermore, san jose and mountain view but it looks like our record breaking temperatures are going to end today, as the storm track is making a come back to california and we have some rain in the forecast for this week. not a whole lot but better than nothing. we are looking at showers tonight over southern california from the first, it brought a few high clouds today and then we have a second system in the pacific going to approach monday afternoon, tomorrow afternoon we'll see some high clouds and then the chance for a few light showers going into tuesday, another system behind that that arrives late wednesday and thursday bringing heavier rainfall and just preliminary estimates of rainfall totals this week look like a half inch possible around the bay with higher amounts into the north bay perhaps an inch or more for the hills but this is a developing situation, we'll keep you posted over the next few days, i'll have more details coming up. well customers waited hours to enjoy their last meal at joe's of west lake in daily city today, after more than 50 years of serving great italian food the owners sold the restaurant. diners who have been loyal customers for decades made it their business to eat before the restaurant shutdown. it will reopen in 2015 but with new owners. current employees are afraid they won't be offered a union job, like the ones they have now. >> we're heart broken. this was our home, we all enjoyed coming to work here. and they broke all our hearts. they don't know what they've done to these people that have put in so is for sure, danica darcia was well loved. >> reporter: this 14 year old was killed in this intersection last week right outside of her high school at del mar. the santa clara county sheriffs office is trying to figure out how she ended up in the path of a light rail train. today, over 200 danica's friends and family members honored the beauty she brought to their lives. >> she wouldn't be afraid to talk to you, she was so outgoing. she's just very friendly and sweet. >> it hit her pretty hard. she didn't want to go down the tracks to see all of the notes and stuff initially. >> danica's immediate family asked not to be interviewed but they wanted our camera to be rolling at danica's service so she can be remembered for how she lived. meantime people in maryland are still in shock a day after a gunman killed two people inside a shopping mall who then killed himself. police say they know the name of the shooter but aren't sure of a motive. scott thompson has more. >> reporter: this is the busy shopping mall in columbia, maryland where police say 19- year-old darian marcus aguillar went on a shooting rampage. >> this country needs a lot of help for somebody to be that angry to go to a mall on a saturday morning and shoot people. >> investigators are trying to figure out his motive. >> we've not been able to verify any type of relationship at this point between him and either of our victims. we can't establish there is one. we've not been established there's not one. >> 21 year old brianna benlolo and 25-year-old tyler johnson were both killed in the shooting before he turned the gun on himself. authorities say he was armed with a shot gun, large amount of amunition and apparent home made bombs. no other explosive devises were found at the crime scene. one shopper who didn't want to be identified says he came face to face with the gunman. >> basically scrambled out of the store on my hands and knees right by the male employee who was down on the ground. >> while that shopper escaped without being hurt others weren't so lucky. five people were taken to the hospital. all have since been treated and released. scott thompson reporting. >> police say he didn't have a prior criminal record and purchased the shot gun used in the rampage legally in december. a brain dead and pregnant woman at the center of a legal battle in texas was removed from the ventilator today. the move comes after her family fought for weeks to have the 33 year old taken off the machine. the hospital had kept her body on a ventilator to preserve the fetus that she was carrying. it said that state law prevented it from complying with the families wishes but friday a judge ruled to remove her from the ventilators by monday afternoon. today the hospital said it would comply with the court order and they acknowledged she had been brain dead for months and the baby would not survive. natural gas pipeline explosion rocked a small community in manitoba canada yesterday. this video was taken by a resident near the blast. nobody was injured in the explosion but witnesses say flames shot up 300 feet in the air. it could be seen for miles around the town of otterburn. it burned for more than 12 hours. thousands are without heat after the gas was cutoff to the surrounding communities. canadian officials have not said what caused the explosion but they don't think it was suspicious. hundreds of people are sick on the explorer of the seas that set sail from new jersey on tuesday. the passengers and crew have come down with a stomach illness but nobody knows the cause. health officials are expected to board the ship today while docked off the virgin islands. they are expected to conduct an investigation and evaluate the response to the illness. officials say their ship skipped their stop in haiti yesterday to head to puerto rico for an extensive cleaning of the ship. yesterday the french president announced his split from long time partner but despite the breakup she seems to be bouncing back. valerie treewwith iller caught a flight to india to support a non-profit organization fighting hunger today. the news of their breakup came after rumors that she had been having an affair for the past two years. last weekend she left the hospital where she stayed for a week being treated for stress and fatigue, they were never married but she's assumed the role of first lady of france. record highs today, vickie, in san jose we made it up to 71 degrees, this shot from east san jose looking back down toward downtown, and you can see lots of haze in the air as we had poor air quality but fortunately the air quality conditions will be improving over the next few days as we have a couple of weather systems rolling through the bay area mixing up the atmosphere and we're also looking at some onshore winds bringing them low clouds for tonight into the bay. that view earlier, this is a live view from sfo, so we'll continue to see the low clouds filter into the bay, for tomorrow low clouds in the morning clearing out about 10:00 but then increasing high clouds since the afternoon as the second weather system arrives for tomorrow. the first one impacted southern california and this one will impact northern california and bring in the chance for showers coming up on tuesday but she light and scattered activity as you can see on futurecast. this is 8:00 a.m. tomorrow morning, here is the high clouds beginning to push in so we have sunshine early on in the morning, but increasing gray skies as we go into the afternoon and watch as we get into the evening green showing up here, that shows light rain just in case you've forgotten that rain begins to show up here into the north bay for tomorrow evening, just to the north ofsanta rosa at 11:00 p.m., and this tries to push to the south and a few showers do squeek in here for tuesday morning but largely the first system is going to break up as it arrives and will see partial clearing into tuesday afternoon but there's yet another system arriving late wednesday and thursday and i think that one will hold together a little bit better and it could bring in some more significant rainfall, perhaps a half inch or more which isn't much but it's better than what we have had lately. now for tomorrow morning look for temperatures to start out in the 30s, north bay and eastbay valleys 40s by the bay with low clouds and temperatures cooler in the afternoon looking at mid to upper 60s. the seven day around the bay tuesday chance for light isolated showers in the morning with afternoon clearing, the second system comes in for wednesday afternoon and evening with a chance for mainly light rain but it could get heavier as we go into the day on thursday along with cooler temperatures, clearing and cooler into next weekend. vickie? justin bieber's while antics motivate another super star to make an international trip to help the troubled young star. we share to made the treck. next called frequent fliers but nothing to do with an airplane. stanley roberts shows us why they are taking money out of your pockets. san francisco fire department responded 100,000 medical calls in 2013; however, an astonishing 20,000 of those calls were to a group of people known as frequent fliers. our stanley roberts explains exactly what a frequent flier is in this edition of people behaving badly. >> reporter: san francisco fire department medic 96 is responding to a report of a man unconscious and not breathing on market street. but they aren't the only ones to respond. two other fire engines were also arriving at the location just outside. they find a man slumped over and quickly determined it is a possible drug overdose and administer a drug to counter the overdose. then, they wait for the drug to take effect. what they find in his pocket is a half a bottle of vodka, but a half a bottle of alcohol is only half the problem. it turns out he had taken quite a bit of other meds including methadone. >> how much do you take a day? >> 170. >> 170? >> he also took two anti- seizure pills he bought off the street to boost a high and two valium pills. >> that's a lot of medicine now that he's awake he wants medic 96 to take him home. >> it's not an option. >> then he asks, he was taken to st. francis hospital where it was determined he was there just the day before for the exact same reason. this man is also considered a frequent flier. in fact he's still wearing his wrist band issued by the hospital from the day before. apparently he also checked himself out of ucsf two days before for a condition paramedics never heard of. but now he wants to go back to ucsf more than three miles away. and despite the fact that st. francis hospital is only three blocks away so paramedic 96 has to take him there. paramedics just can't look the other way when they get an emergency call. they have to respond and offer assistance even if they know the person is abusing the system. for the record every tomb a medic has to respond to a call that involves a frequent flier, it costs san francisco taxpayers thousands of dollars, and takes one more medic russian citizen arrested in pennsylvania for possessing a weapon of mass destruction turns out to have bay area ties. police officers say they were looking for evidence of a marijuana grow operation inside the home of vlad mistakof and found a home made bomb and bomb making materials in his suit case. the 19-year-old is an engineering student at penn state and he grew up on the peninsula and attended high school in bellevuemont. a man was stabbed to death in east san jose earlier this morning. the victim was the 22 year old boyfriend of a girl celebrating her 21st birthday in her home on sun crest avenue. witnesses say the victim was trying to breakup a fight when he was stabbed. police have yet to release any suspect information or announce an arrest. students at san jose state highs and at last things are about to change here as we go into this week. we have cooler weather on the way and even the chance for some rain just a little bit but it's definitely a change here and we'll i think at least see a little bit of wet weather for this week and temperatures already cooling down as we have low clouds pushing into the bay, last night at this time, san francisco was in the low 60s but with the cool ocean air and the fog beginning to make its way in just in the low 50s right now, 51 degrees, 44 in fairfield for tomorrow starting out with low clouds, bay side, north bay valley as well but it will clear out mid morning, so we'll have a mixture of sunshine and clouds midday within the clouds increasing once again as we have a storm system headed in, most of the rain is going to remain north of the bay area but i think well see a few light spotty showers for tuesday and this first system opens up the way for another system arriving late wednesday and thursday and that could bring more rain, i'll tell you how much to expect coming up, vickie. brian, people across drout stricken california are hoping and praying for rain but maybe none more so than those who depend on snowfall up in the sierra. kron4 reports from south lake tahoe. >> reporter: signs like these at the powder house and other ski shops say it all. >> this really has affected everyone. >> i have to send people homerly and not schedule them for certain other days as well. we're 40%-80% off all our skiis and brand new boots are 40% off as well. >> other signs like vacancy at motels and sparse traffic on lake tahoe boulevard are further proof that business is off some 20-30% due to the lack of snow. >> just praying for snow to see what happens. obviously this is the worst drout in i guess they say a hundred years. >> the resorts are making snow as fast as they can with good if limited skiing up high. but still? >> it was a bit disappointing because we just thought we would see a little bit more snow. >> the water level in lake tahoe itself is falling. sierra mountain sports is one of the snowmobile parks still open. that's manmade snow. >> the kids are having a great time so they've been able to play in the snow regardless of the fact there's none. >> if it doesn't snow soon, layoffs are looming, ski shop techs like josh esposito are worried. >> it's affecting everybody here. we all got our hours cut back to 32 hours or so and they are talking about closing ski shops and the resort, so we may be looking at moving down the hill somewhere to find real work. >> no hard numbers are available but judging from the empty parking lots business is off some at the casinos too, in south lake to hoe, kron4 news. check out this incredible video from eastern north dakota today . the area recorded wind gusts up to 49 miles per hour and currently under a blizzard watch. winter weather is still causing some headaches for travelers throughout the midwest and east coast and that messy weather is forcing dozens of flights to be cancelled or delayed at chicago's o'hare airport. the city saw several inches of snowfall and is also dealing with strong winds and the weather is only expected to get worse, as bitter cold temperatures move in. forecasters expect temperatures to remain below zero for the next couple of days. trouble for the oakland raiders, is following the teen from the field to the courtroom. a raiderette filed a lawsuit against the team earlier this week for exploitation. kron4 sat down with her to find out what she wants. >> hi, raider fans. this is my rookie year. >> reporter: in her biovideo, raiderette lacey shows off her skills. she does not use her last name per raider policy for security reasons. she says the way the raiders treat her is nothing to cheer about. >> there was a point in the season when i realized i think we were being taken advantage of. >> per her contract lacey is only paid $1250 a season, which by her lawyers calculation amounts to less than $5 an hour, below minimum wage, for all of the time spent rehearsing, performing, and doing promotional appearances like photo shoots. >> and that doesn't seem right. it's not. i know it isn't and that's why things immediate to change. >> this stay at home mom has a young daughter and spent two years as a cheerleader for the golden state warriors. in the nba she tells me it was much different and while she loves her job with raider nation she feels she deserves more respect, plus she must pay out of pocket for many business expenses, such as driving to events and keeping up her appearance, from manicures to her hair style, concerns the team makes her feel guilty about. >> you can go somewhere else. there's a hundred other girls that want your spot. not all teams have nfl cheerleaders so you're lucky to be here. there's always comments like that that make you feel like you can't speak up to make a change. >> her lawyer tells me the contract lacey has with the raiders has numerous illegal provisions. >> we thought it was one of the most outrageous things we had seen in a long time. >> i definitely think being a raiderette will help me achieve being a stronger more beautiful confident woman. >> she is very aware by speaking out she may never cheer again but she just wants to be compensated fairly. >> in many ways it's probably going to be [ male announcer ] connect all your wi-fi-enabled devices with u-verse high speed internet. rethink possible. nsa whistle blower edward snowden was wanted by u.s. authorities for leaking secret documents held a live web chat this week. it was where anybody could ask him a question through twitter using "extra snowden." there was pretty good questions and his answers were revealing. glib slate gives us a look at the highlights from the live chat. >> reporter: during the one hour live chat, thousands of questions came flooding into twitter. he picked 13 to answer, the questions and answers were posted on the website free snowden, which is a watch dog group that has a website with information about snowden, and raising money. when asked about current whistle blower laws he said they are full of holes and that they don't protect contractors that are working for the government like he was. he said based on current laws he showed congress the documents he had. they could have arrested him for a felony so he played it safe and gave them to newspapers. someone asked if he felt bad about stealing his co-workers logins and passwords and he said the reuters report about that was not true and he never stole from or lied to any co- workers. when asked if he would consider returning to the u.s. , this was his reply: "returning to the u.s. , i think, is the best resolution for the government, the public, and myself, but it's unfortuntely not possible in the face of current whistle blower protection laws which threw a failure in law did not cover national security contractors like myself." he then went on to say congress needs to reform the whistle blower protection act and maybe he can get a fair trial in the u.s.. when asked for his opinion on how much spying is okay for our government to do, he says some spying is okay and necessary. he just wants a person in america to be able to dial a number, make a purchase, send a text, write an e-mail, or visit a website without having to think about what it looks on their permanent record and lastly when asked if he feared for his life he said he's not going to be intimidated doing the right thing means having no regrets. gabe slate, kron4 news. if you live in the north bay and travel into san francisco you're paying five or $6 a trip across the golden gate bridge. the bridge district wants to hike the toll another $2 over the next five years. kron4 explains why and he speaks to commuters about the proposal. >> reporter: driving across the golden gate bridge into san francisco could soon get a lot more expensive. right now drivers pay a $6 toll, or $5 if they have fast track, but the bridge district is planning to gradually hike tolls bias much as $2 over the next five years. >> it's about $440 a year right? 220 workdays a year and $2, yeah, that's a trip somewhere, it's a vacation, you know? it's a couple nights in a hotel. >> come summer of 2018 fast track users would pay trend 6.50 and $7 to cross and non- fast track users would pay $8 to cross the bridge. >> couple of dollars kind of adds up right now. everybody is trying to kind of save money and do the right thing. >> most commuters we spoke within marin county found the fare hike difficult to swallow. >> i go into the city a couple times a day sometimes so i think that's going to change. >> i'll continue to commute but it may be a little, you know, force me to start looking at carpooling and using the marin bus system. >> i think if the bridge toll going up gets more people on the buses that's good for everybody. >> it just seems like they are gouging us, like an awful lot of money. can't they raise money a different way besides hitting the people who are working? >> the bridge district says current tolls will not cover its future costs. not just repairs, maintenance and improvements to the bridge but subsidies of golden gate bus and ferry service as well as the reconstruction of doyle drive. >> public meetings to discuss this toll hike have been scheduled for tuesday, wednesday and thursday of this week, in san francisco, for the formal public hearings scheduled for february 12th in san rafael. in san francisco, kron4 news. here is a nice twilight shot from san leandro. high clouds out on the rise and blue skies up overhead but those blue skies tomorrow will be replaced by some clouds as a weather system rolls in, and we also have low clouds pushed into the bay. here is a time lapse from this afternoon and we have the bank of low clouds pushing into the bay making for cooler temperatures here for tomorrow, and on top of that a couple weather systems to talk about. one in southern california, that brought some showers today. that one missed us but it did produce high clouds and then we have another system out here to the west. this one is stronger and it's taking a more northerly track that's going to approach for tomorrow and bring in some increasing cloud cover for the afternoon and evening and even the chance for a few showers, but it will be really light, but it will open the door for another system behind that coming in late wednesday and thursday, and between the two we could see about a half inch of rain by the bay, with higher amounts into the north bay but still this is a ways out and these amounts could change quite a bit, but we will have the updates as we go through the week. temperatures for tomorrow with clouds increasing for the afternoon, going into the mid to upper 60s for the south bay, san jose 66 degrees, temperatures topping out in the mid 60s, concord, pittsburgh, livermore 68 down from todays high that was in the low 70s, 64 hayward, san francisco down from 70 today to 62 tomorrow, thanks to the low clouds that will be hanging around in the morning and high clouds in the afternoon, 65 petaluma, 70 around the bay and things are changing. tuesday lack for a few light and spotty showers in the morning with afternoon clearing, the second storm comes late wednesday with clouds increasing in the afternoon. rain light for the evening and steadier possibly heavier rain for thursday, clearing friday. vickie? just under two weeks away from the start of the sochi winter olympics and for the first time since 2002 the jim ache an bobsled team qualified to go but they didn't have enough money to get there, but thanks to generous people their hope for olympic glory is about to come true. cnn reports. >> reporter: they're the hottest thing on ice. for the first time in more than a decade the biggest underdogs in bobsledding defied the odds and qualified for the olympic games. but before packing their bags for sochi, the jamaican bobsled team had one problem, money. they needed a lot of it. more than $80,000 to cover travel and equipment fees. so they turned to the internet, two online campaigns helped the team raise more than double the amount of cash they were hoping for. one online fundraiser was started by an average olympic fan and anyone who donated $50 or more got a free t-shirt featuring the hash tag cool runnings 2. >> [applause] >> it was the popular 1993 disney movie cool runnings which chronicled the olympic journey of jamaica's first bobsled team and made them one of the most famous teams in the sport. >> remember we don't have to win the gold the first day. just like any other run. >> there's at least a hundred million people watching. >> go! >> but after missing the last two winter olympics, the jamaican bobsledders were determined to qualify for sochi. >> it's such a really really great feeling just like you will see winning so much races you know?
