>> thanks, this morning we continue to follow the latest in the wake of the stanford rape case. we are learning that brock turner will probably only spend half of his six month sentence in jail behind bars and new court documents show evidence that it was from turner's cell phone and shows text message ands pictures showing that he smoked marijuana. take a look at the pictures found on his phone. he's holding a pipe for drugs there, the prosecution says brock had a history of partying and drug use. there he is with a bong. >> brock turner in jail and the isn't it true evidence detail how the former stanford swimmer took add vang: journal taj of a -- advantage of an intoxicated woman who could not stand or talk. was quote, more a kin to a predator searching for a pray. the pray -- prey was a young woman who drank too much and was unable to protection herself. turner was found to have a blood which will level of .16. in court character witnesses painted the star swimmer with olympic dreams as a good kid. turner told the judge quote, come frog a small town in ohio, i had never really experienced celebrating our partying that involved alcohol. but the prosecution found evidence to the contrary. on his own cell phone with texts and pictures showing him smoke frog a bong and drinkingly consistency of range. going back to high school where he want today bedrapings and while at men from sweden who while biking saw the unthinkable and did in fact intervene. carl frederick is one of those cyclist ands spoke to nbc about the events of that horrible night. >> saw a couple that seemed okay at first. when we looked closer, we start noticing she wasn't moving then stopped. basically talked about what to do, decided to approach her and starting to ask what's going on. after he stood up, we saw she wasn't moving at all so talked to him briefly then he started running away. my friend peter ran after him and caught him and called the police and basically restrained him till the police came. >> thank god for the heros. >> he motions are running high at standard as a -- stanford as a lot of students have a opinion in this case. why brock turner will serve half the time he was sentenced to. >> nothing in recent memory has touched a nerve quite like the brock turner case. nearly everyone feels he got off too easy. >> i think that if it had been somebody else, if it had been not a star athlete at stanford, that the verdict might have been different. >> i don't think justice is being serve and had what type of message is being assigned to the community. >> brock turner was sentenced to six months in the county jail but will most certainly be released after serving three months. >> the fact that he was sentence today a local county jail sentence means you only have to do 50 percent of his type. had he been sentence today a state facility, he could have had to serve significantly higher portion of his jail term. >> students are not buying his efforts to blame alcohol and peer pressure for his abs. the publicity unfolding is a kind of punishment. a tough sentence might that the have made a bigger decision. >> the crime was no excuse. if i was going to consider his punishment, i wouldn't considering consider that as a deciding factor. >> i think everybody would probably agree that the way this case was handled was an injustice. >> at stanford, kron
