Inside a Subway Sandwich shop on market near 5th street. This is video of the aftermath. But today, officers released new body camera video and Surveillance Video taken inside the store of the incident. A warning now as some viewers might find the video disturbing. Officers say 26yearold Nicholas Flusche began attacking a subway employee. With a knife. Hes wearing the camouflage shirt. He unlocks the little door to get behind the counter and thats when he starts attacking the employee. Bystanders try to help one woman even starts hitting flusche with a pan. Two officers who were in the area show up. Heres what happens next, the stabbing victim, a bystander trying to help. And flusche. All come out from behind the counter as officers point their guns at them. Moments after one officer shoots. Flusche was shot once hit in the lower back area. He died at the scene. The stabbing victim was treated and released from the hospital later that day. The officer who fired the shot has been identified as officer kenneth cha. Its still unclear what provoked the stabbing attack. vicki it is also important to note that officer kenneth cha was also involved in a shooting back in january. That injured a man. Officers had responded to sean moores house for a noise complaint made by his neighbor in the citys oceanview neighborhood. Moore, who is mentally ill, was unarmed at the time of the shooting. Officers says moore began kicking and punching officers during a struggle. Forcing police to open fire. Last month, a judge dismissed most of the charges against moore and prosecutors today dropped the remaining charges. The shooting remains under investigation. vicki and happening now. Oakland police are searching for a man who attempted to kidnap a 10 yearold boy. It happened last night in oakland on 45th street near broadway. Police say the boy was outside a home. When a stranger approached him and grabbed him. Officers say there was a brief struggle but the boy was able to escape. Police have not yet released a suspect description. grant now to a big story we have been following all week. 26yearold antolin garciatorres now waits for his punishment life in prison without parole. Or the Death Penalty. Yesterday a jury found him guilty. Of kidnapping and murdering morgan hill teenager sierra lamar. The 15year old disappeared in march of 2012, on her way to a school bus stop. Her body has never been found, but dna evidence linked garciatorres to the crime. The sentencing phase starts on tuesday. grant a day after the emotional verdict. This was the first Fatal Shooting under new police chief, bill scott. The department decided to be transparent. And release body camera footage. Grant lodes is here with some of the dramatic video. Grant . grant you really get an idea of the snap decisions Police Officers have to make in the field. Everything happened in a matter of seconds. We start with some of the Surveillance Video from the subway store. You see a man walk up. And Start Talking with one of the employees. We now know according to investigators this turned into an argument and he goes behind the counter and starts stabbing one of the subway employees. A woman appears to use a baking sheet to try to stop the attack. But clearly that wasnt enough and other bystanders tried help out. Police were closeby and saw what was going on and were there within a matter of minutes. Officers rushed in and they say when the suspect came at them with a knife. They opened fire. This body camera footage is from just seconds after the shooting. Got it inaudible i got it. A lot of chaos going on there. This happened last wednesday. The man police shot is 26yearold Nicholas Flusche. What we learned from police today is an officer fired just one shot at flusche. And as you could tell from that video we showed you. It all happened in just a matter of seconds. The man flusche was stabbing is recovering and is out of the hospital. During todays town hall meeting on the shooting. Chief bill scott said this is all part of an effort to be transparent. He would not comment on whether or not it was justified since the matter is still under investigation. steve were now learning that the same Police Officer involved in the subway shooting. Was also involved in a shooting that happened back in january. In that case. All charges have been dismissed against 43yearold sean moore. You can see bodycam video capturing the incident. Moore was initially charged with a number of felonies. In connection to his encounter with police. Police had responded to moores oceanview home. Over a noise complaint. He repeatedly told officers to get off his steps. They say moore eventually started hitting and kicking officers. Thats when they opened fire. Moore survived the shooting. But has undergone multiple surgeries. 2shot catherine some say hes a hero but hell tell you that he simply did the right thing. 2shot steve the right thing, in this case, was intervening in a brawl on board a Southwest Airlines flight. Captain green says the real heros are the Flight Attendants who stepped in and tried to keep the situation under control until he and eventually some other passengers got involved. Joanna eyesum was in court yesterday with the lamars when antolin garciatorres was found guilty of sierras murder. Joannas daughters grew up with sierra. She says the past five years have taken an emotional toll on all of them. But theyre happy to know garciatorres is being held accountable. She just hopes that he decides to reveal the location of sierras body. Joanna isom family friend um, yesterday when i was in the courtroom, i just prayed for god to, to, he was the one who was there. He knows what happened. Please let the verdict reflect what he did. And, he was guilty. But at the same time, were human and i just feel bad. She lost her life and his family lost him too, you know, and its just sad all the way around. Its just. Staying in the east bay an arsonist could be on the loose in Contra Costa County. steve at least two cars went up in flames overnight. And investigators think it was no accident. Kron 4s jeff pierce caught to one of the victims. Layfayette resident Pat Mccormick came out to his drive way early this morningto find his suv ablaze. I came out saw it was on fire, went back there and tried to keep the garage wet. When he spoke with fire officials he found his was not the only vehicle that was the victim of fire. They just looked around a little bit and they said youre not the only one. Just minutes earlier east bay fire crews had extinguished a blaze on this car just a short distance away in walnut creek. Fire officials are investigating both incidents as possible arson fires. They were in a very short span of time, they were very close together geographecly. Both fires are currently under investigation by our arson investigation unit. Layfayette fire officials were more emphatic when they spoke with mccormick. Layfayette police, layfayette fire they said it was set. So they found something that made them think it was set and they just come from another one too. These fires follow a string of car fires in Contra Costa County. Last year we had over three hundred vehicle fires and i think over half of them were determined to be arson or intentionally set fires. Police arrest a woman in milpitas after she was allegedly found in possession of a stolen vehicle. It happened saturday morning at the Sonesta Silicon Valley Hotel on barber lane. At the scene officers located a gray 2001 Honda Odyssey van reported stolen from San Francisco on april 16th. The suspect, identified as Stephanie Riedel of sacramento, was arrested. Officers searched the stolen vehicle and found 16 grams of meth and other drug paraphernalia. East bay mud says another chunk of the money will cover repair and replacement of aging pipelines the proposal calls for a 9. 25 percent rate hike this year and another 9 percent next year. My wife was just going back and back and back, she had to jump off. My brother and i, we had to carry her over to safety to get on one of our atvs. One of the other couples, they went through same thing. We held on for dear life. We got stuck in water for 20 minutes. It felt like three days, thats what it felt like. Im still petrified. I could bust out into tears right now, but my stomach inside is literally still shaking.
