"my father used to say that the greatness of the raiders is in its future and the opportunity to build a world class stadium in the entertainment capital of the world is one opportunity that will give us the ability to achieve that greatness." and it didn't take long for mark davis to get the greenlight to move to sin city. nfl owners opened monday's meeting at about 8-30 in the morning, two 1/2 hours later, the vote came down. ultimately, the league's top executives could not walk away from 750-million dollars of nevada public money... and as far as oakland is concerned, commissioner roger confirmed there was never a workable solution presented to him. "we need certainty on a viable plan that will work for the community and the team long term. it had to be actionable. we understand the contingencies sometimes occur, but major contingencies that put the entire project into doubt are just unreasonable in a case like this.' in the meantime, awkward times await oakland's raider nation contingent. the team will stay in the coliseum for at least the next two seasons...while their 1.9- billion dollar stadium is built. davis hopes to maintain a strong relationship with the bay area fanbase. "i wouldn't use the term lame duck. we are still the oakland raiders and we are the raiders and we represent the raider nation. as i said earlier, there's gonna be some disappointed fans and angry fans and it's gonna be up to me to talk to them and let them know why, how and what has happened and hopefully we can work this out and work together for the future." one step davis is taking to make it work..is he announced fans who paid deposits for season tickets will receive a full refund. but-- no dollar amount can heal the now-fractured relationship raiders and the people of oakland. reporting from the nfl owners meeting in phoenix, mark carpenter,kron4 news (vicki) and the team did release a statement... regarding today's decision to move the raiders to las vegas. the team writes quote, "the raiders were born in oakland and oakland will always be part of our dna. we know that some fans will be disappointed and even angry, but we hope that they do not direct that frustration to the players, coaches and staff. we would love nothing more than to bring a championship back to the bay area." - end quote. (catherine) one of the people reacting fast this morning -- raiders' quarterback derek carr.he sent out a long tweet saying he's overwhelmed with emotion...saying he 'feels the pain'of fans in oakland....whil e also seeing the 'joy on the faces of our new fans in las vegas.' carr says he would have loved playing his whole career in oakland, but he 'understands thebusiness side of the n-f-l.' his message to vegas? he says the city should count on the team bringing a piece of oakland along with them. he ends by saying that for now - it's all about the diehard fans in oakland.it remains to be seen how many of them will 'remain' diehards.. grant? (vicki) we are following more breaking news out of the east bay... right now - we know of two people who are dead - and several others had to be rescued from an apartment fire in oakland. we first broke this story - to you on the kron four morning news... (vicki) we are learning that dozens of people had to be evacuated - and are now without a home this evening. (grant) the fire was first reported around 5:30 this morning... it happened at an apartment building on san pablo avenue near mead avenue. kron four's haaziq madyun is on the scene - he joins us live now from oakland with more on this deadly fire. haaziq? oakland firefighters are still here on san pablo keeping an eye on the apartment building. the fire was put out hours ago but there has been several flares ups throughout the day. fire officials confirmed two people died in this fire.. the majority of the residents made it out alive. one resident told me how dangerous it was trying to get out nats/haaziqhow did you realize it?sotgilbert jones/fire survivior: "the fact that somebody, people was yelling fire, fire, fire, get out, get out, get out"that is the sound gilbert jones heard just before 6am here inside of his apartment building here on san pablo avenue in oakland. jones says it is the only warning sound he heard on the second floor of the 3-story building gilbert jones/fire survivior: "i know one thing for sure. there were no fire alarms at all. that kind of fire, you would hear the beep. it should have been all through the building. it was absolutely quiet. all you heard was the burning of the fire"sot battalion chief erik logan/oakland fire department: "i don't know if the building was sprinklered or not. on arrival we didn't here any alarms that could be heard. of course we were dealing with a rescue situation. we had atleast 15 rescues"there are over 40 units in the building, atleast two exterior fire escapes. jones made his way to one of them because the exit out of the building was too dangerousgilbert jones/fire survivior: "i knew there was no way to get out through that exit because of the smoke. you could see the fire and the flames. so i went the other way right down the hall and that's where that fire escape was and i come down that way. and i thought if the thing didn't work i was going to have to jump from the second floor and i would have just jumped and tried to make it" mr. jones did not have jump. he made it out safely using the fire escape. however two people lost their lives. oakland firefighters rescued 15-people. 4 residents 2 adults and 2 children were taken to the hospital suffering from smoke inhalation. the investigation into the cause of the fire continues. in oakland haaziq madyun kron4news (grant) bart service has resumed after some powerlines fell across the tracks near the west oakland station. it happened just after 8am and closed the station during the morning commute as crews worked to fix the problem. it took about an hour for pg&e crews to remove the powerlines from the tracks. bart is operating on a normal schedule now. (grant) drivers on 680 near alamo this morning had an unusual holdup during the morning commute... a horse and a mule running around loose. the animals had roughly a half hour or so of freedom... starting on city streets -- and ending up on northbound 680. traffic was stopped and the northbound lanes were briefly closed. the horse and the mule had broken through a fence after wandering out of their stable. this was all playing out around 7:30 this morning...with the lanes finally reopening around 8:30. the animals were eventually returned to their owner uninjured. (vicki) turning now to the south bay where testimony resumed in the sierra lamar murder case. kron four's rob fladeboe has been keeping tabs on the trial... and checks in now with a live report from the hall of justice in san jose rob? we are about eight weeks in and the murder trial of antolin garcia torres still has a longways to go. today, the defense called it's first witness and he was on the stand most of theday. that's lead defense attorney al lopez on the right. on the left is defense team investigatordavid jaquez. the first witness called by the defense on monday, jaquez testified about his analysis of surveillance video made by deputies who had been trailing defendant antolin garcia torres prior to his arrest and about video from a vta bus in the area on the morning sierra lamar disappeared. the jury saw evidence of rain, which the defense claims could have tainted evidence found later but the prosecution seemed to score points by pointing out that the bus video did not show a vehicle an earlier witness said might have been garcia torres' red volkswagon jetta. among those watching the case closely is sierra search volunteer emma spencer. emma spencer/search team volunte,erback and forth it went. prosecutor david boyd trying to poke holes the jaquez testimony while the defense continues it's attack on a case based on forensic evidence. fewer than 20 people in the gallery including both of sierra's parents, steve and marlene lamar and a handful of search team members who say they too are now part of sierra's family. despite the amount of time spent on just one witness, the trial is said to be pretty much on schedule. about half way now with the jury expected to get the case toward the end of next month. live in san jose rob fladeboe kron 4 news (anchor) time now to check on our weather... with chief meterologist brittney shipp. slightly cooler conditions are expected on thursday as a weather system moves into eastern california and nevada. that weather system will bring only a slight chance of showers to the northern and eastern portions of our area, and also result in blustery conditions near the coast and in the hills by late thursday. high pressure will redevelop late in the week and result in warmer weather once again by the weekend. (grant) attorney general jeff sessions is threatening to take away federal money from "sanctuary cities" - like san francisco, and several others in the bay area - which do not comply with federal immigration laws. that sets up a conflict with the hardline stance of the new administration. attorney general jeff sessions sessions urged states and cities to carefully consider the harm they are doing to their citizens by opting to be sanctuary cities. "unfortunately some states and cities have adopted policies designed to frustrate this enforcement of immigration laws. this includes refusing to detain known felons on the federal detainer request or otherwise failing to comply with these laws. such policies cannot continue. they make our nation less safe by putting dangerous criminals back on the streets." (grant) some legal experts believe president trump cannot force sanctuary cities to comply with federal laws by withholding money. they say the supreme court has repeatedly interpreted the tenth amendment to prevent the federal government from taking control of state and local governments. (vicki) in national headlines... a cincinnati nightclub is giving up its liquor license after a shooting over the weekend left one dead and 17 wounded. city officials say the cameo club is voluntarily surrendering the license after the deadly shooting early sunday morning. the club will remain closed until until the police investigation is complete. authorities have identified the man killed as 27-year-old o'bryan spikes. (colonel chief eliot k. isaac/cincinnati police chief): "several local men got into some type of a dispute inside the bar and it escalated into shots being fired from several individuals." five victims remain in the hospital. police believe the shooting stemmed from a conflict between two opposing groups in an area known for crime. cincinnati police are still searching for the suspects involved in the shooting. no arrests have been made. (grant lodes) another big story we're tracking. police are reviewing security video from inside a double-decker bus where a passenger shot two people on the las vegas strip. but the recording... won't be made public it happened saturday. officers say this man , rolando cardenas was sitting in the back of the bus near the victims. and when the bus stopped...the 55-year-old suspect allegedly stood up and fired several shots. they say he then barricaded himself in the bus for hours... but eventually surrendered peacefully. a montana man was killed and a las vegas man was wounded. (vicki) and in north carolina a small protest over a jewelry store billboard... has created a big social media stir. about 15 demonstrators picketed with signs outside spicer greene jewelers in asheville... organized through a facebook post. they're upset about this new billboard that says, quote, "sometimes it's o-k to throw rocks at girls"... and shows seven precious gem stones. the company says it's intended message was'nt to promote violence...and that the sign will be removed soon. (steve) vicki... it was a massive fire that destroyed an apartment building in west oakland. as many as 86 people were in the building when the fire broke out early this morning. one resident told kron 4 he did not hear any fire alarms while he was trying to escape. he made it out... but two people were killed by the fire and several others were hurt. tonight we will hear from him and have the latest on the investigaton. we will also have the latest on the raiders getting the green light to move to las vegas. vicki we'll see you in just a few minutes for kron 4 news at six. (grant) uber is suspending tests of its self-driving cars after one of the vehicles was involved in a crash.the accident happened friday in tempe, arizona. police there say the uber s- u-v was struck by another car, causing the uber vehicle to roll onto its side. no one was seriously injured. police say the driver of the other car did not yield, leading to the crash.an uber spokesperson says the ride- sharing giant would suspend testing of its self-driving cars in arizona and two other sites pending the results of the crash investigation. (vicki) united airlines is defending its decision to prevent 2 teenage girls from boarding a flight -- because they were wearing leggings..(grant) catherine heenan is here with more on the leggings which sparked a social media uproar... (catherine) now united airlines is explaining that 'regular'-paying customers are welcome to wear their leggings... but the two teenagers in question were flying on employees' travel passes.... meaning a different dress code because they 'represent the airline.' the incident happened before a recent united flight from denver to minneapolis. one of united's competitors seems to enjoy the fact that united is getting heat....tweetingtoday "flying delta means comfort. that means you can wear your leggings.' but united is getting 'some' customer support. one woman says she was kicked offa flight long ago - for wearing the wrong shoes. we had to go and buy me a pair of shoes just to get on the plane and that was in 1986 so this has been going on for a very very long time. this wasn't anything new.if that's the hoops we had to jump through, then i didn't see a problem with it. but there's still a lot of online criticism of united. it was sparked by a united passenger who saw the girls being singled out...and began tweeting out messages. today - united says its policy is not meant to discriminate against anyone - and it's sticking withits dress code decision.. vicki and grant? "fearless girl" was installed by the group "state street global advisors" to advocate for more women on corporate boards. the statue... which was originally permitted to stay until april second... it will now remain in place until at least february of next year as a part of a city public art program. several officials -- support the cause. (representative carolyn maloney/(d) new york): "i must say, miss visbal created the fearless girl to inspire and to personify the resilience of women everywhere, even in the face of most daunting challenges and to encourage businesses everywhere to employ more women and to put more women on corporate boards, which is a vision of state street." since the statue appeared, more than 28- thousand people have signed a petition to make it permanent. many see it as a inspiring symbol of gender equality. (steve) it was 31 to one for the raiders to go to las vegas. and it played out quickly. kron 4's mark carpenter has been in phoenix for the owners' meeting... and was there as mark davis and commissioner roger goodell made the announcement. heading into today, there were reports that a vote could happen before lunch time, which seemed unreasonable granted that there are so many logistics involved...and usually relocation discussions take a while. but the owners knew what they wanted. they walked into the meeting at 8-30, 2 1/2 hours later a vote came down. and the raiders are going to las vegas. and owner mark davis now has a new place to call home. "i have mixed feelings obviously. i love oakland. i love the fans in oakland and i know there's gonna be disappointment and maybe some anger and i just hope that in the future as we play in oakland this year that they understand that it wasn't the players. it wasn't the coaches that made this decision, but it was me that made it and if they have anybody to talk to about it, it should be me and i will in the coming days try to explain to them what went into making this difficult decision." and for 31 of 32 nfl owners...there was nothing difficult about this decision at all. ultimately, the league's executives could not walk away from 750-million dollars of nevada public funding. the kind of money oakland wasn't about to spend... that, in addition to the presence of the a's at the coliseum, left the league no choice, but to look to sin city."you know they have commitments to the a's. that is a complicating factor in this because you don't have the certainty of when the a's are going to be leaving the site, where they are going to be able to build on the site, when the development is going to occur on the site and all of those important decisions when you are investing that kind of money." in the meantime, the raiders will remain in the bay area for two seasons...while the team's new 1-point-9 billion dollar stadium is constructed. a venue that will serve as the nfl's latest crown jewel... and raider nation's permanent headquarters. raiders owner>"my father used to say that the greatness of the raiders is in its future and the opportunity to build a world class stadium in the entertainment capital of the world is one opportunity that will give us the ability to achieve that greatness." it's worth mentioning that davis is making an effort to avoid a bitter relationship with the fan base. he said season ticket holders that made a deposit for next year...will receive a full refund. the raiders shortly after the vote was announced posted a statement on the team's website from owner mark davis. it reads in part: "the raiders were born in oakland and oakland will always be part of our dna. we know that some fans will be disappointed and even angry, but we hope that they do not direct that frustration to the players, coaches and staff." "while i am from california and would have loved playing in oakland my whole career, i understand the business side of the nfl. it affects us all. oakland, our team loves you, and my family and i love you!" perhaps one of the more intriguing reactions comes from punter marquette king. he has been known to be outspoken... and brash at times you see it a here.. he went with just an emoji. read into it as you see fit. head coach jack del rio, born in castro valley, hayward high grad...life-long raiders fan...told nbc sports california, in part, that his emotions are mixed...quote... while i'm sad for family, friends and fans in the oakland area, i also recognize the tremendous opportunity going forward for our organization. steve. ( steve ) the raiders move is something that has been in the works for a number of years. it first came out in 2014 that mark davis spoke to san antonio about a potential move. then in 2015, the raiders and chargers announced plans for a shared stadium in l-a suburb of carson. then in january of last year, n-f-l owners approved the rams move to los angeles. the chargers were given an option to move... if they passed on it... the raiders would get it. in april... davis announced plans to move to las vegas. it gained steam... ultimately leading to today's vote. (pam) with the raiders approved to go to las vegas, attention now shifts to the oakland a's. the team has been exploring its ballpark options. one possibility is down along the waterfront, but today's news could put the coliseum site back in play ..... and possibily at the top of the list. with the raiders set to move and the warriors opening a new arena in san francisco, the a's would be the only tenant .. when 2019 rolls around. the team has a lease at the coliseum which runs through 2024. (steve) in the south bay, the trial of the man accused in the murder of morgan hill cheer leader sierra lamar, back in 2012, has entered its 8th week. (pam) kron four's rob fladeboe brings you up to date now... as the defense begins to present its case. that's lead defense attorney al lopez on the right. on the left is defense team investigatordavid jaquez. the first witness called by the defense on monday, jaquez testified about his analysis of surveillance video made by deputies who had been trailing defendant antolin garcia torres prior to his arrest and about video from a vta bus in the area on the morning sierra lamar disappeared. the jury saw evidence of rain, which the defense claims could have tainted evidence found later but the prosecution seemed to score points by pointing out that the bus video did not show a vehicle an earlier witness said might have been garcia torres' red volkswagon jetta. among those watching the case closely is sierra search volunteer emma spencer. emma spencer/search team volunte,erback and forth it went. prosecutor david boyd trying to poke holes the jaquez testimony while the defense continues it's attack on a case based on forensic evidence. fewer than 20 people in the gallery including both of sierra's parents, steve and marlene lamar and a handful of search team members who say they too are now part of sierra's family.rob fladeboe/san jose the proposal from scott wiener would extend hours until 4 a-m. right now california law cuts off alcohol service at 2 a-m. if it passed, the decision would ultimately be up to local governments on determining closing time. the bill is identical to one pitched in 2013... it never made it out committee. it met fierce resistance from law enfocement and other groups concerned about public safety. (steve) and the big story we are following tonight. the oakland raiders have been giving the green light to move to las vegas. more reaction is coming up.(pam) drivers on 680 near alamo this morning had some unusual competition for room on the road.... a horse and a mule running around loose. catherine heenan is here with details on an unusual commute sighting .... and how it all ended. (catherine) the horse and mule had roughly a half hour or so of chaotic freedom..... starting on city streets -- and ending up on northbound 680. traffic was snarled and the northbound lanes were briefly closed. in the meantime -- the horses were putting on quite a show for surprised drivers.. they'd broken through a fence after wandering out of their stable. and had people grabbing their cellphone cameras - trying to catch the scene..this was all playing out around 7:30 this morning...with the lanes finally reopening around 8:30. the horses had managed to evade c-h-p officers for about 20 minutes before getting onto 680....using an on-ramp. then, with the help of walnut creek police and contra costa county animal control -- they were safely rounded up. and eventually returned to their owner uninjured. (pam ) michigan and the city of flint... have agreed to replace thousands of home water lines .. the agreement is part of a sweeping deal to settle a lawsuit over lead - contaminated water . a court filling today says... flint will replace at least 18 - thousand lead water lines by 20-20. and the state will pick up the bill using state and federal money. the wolverine state will pay $87- million and keep another $10- million in reserve if necessary. the settlement will be presented to a federal judge in detroit tomorrow for approval. flint's water was tainted with lead for at least 18 - months. ( steve ) tonight congress is bracing for yet another fight - this time over the supreme court. democrats are threatening to block judge neil gorsuch's nomination.( pam ) the vote has already been delayed until next week. kron 4''s washington correspondent mark meredith takes a look at the battle looming ahead in the u.s. senate. tonight democrats are delaying a vote on judge neil gorsuch's nomination. but this could just be the beginning. some senate democrats are pushing for a filibuster to send a loud and clear message.judge gorsuch made it through his senate testimony without any major mistakes. but the toughest test could come in the next two weeks."my vote will be no, and i urge my colleagues to do the same" senate minority leader chuck schumer is eager to unite democrats against gorsuch. if he succeeds, republicans may use what's known as the "nuclear option". the option changes sacred senate rules and lowers the votes needed to end debate.
