maintain a positive climate that discourages cyber bullying and inappropriate conduct. we talked to the santa clarasheriff about how and when the sheriff department first learned about the crime and what charges the boys are facing. >> we learned of it from the school. our school resource officer started looking into what these rumors were. you know how schools are. you hear many, things. we heard it within a few days of her death and started looking at it and realized there was more. we needed to look at it more extensively and do more search warrants and needed to do more information. >> if it turns out your -- >> reporter: if it turns out your conclusion says, yes, it led to her suicide, will charges change? >> no, i don't think there's changing of the charges. i think it's an important circumstance. >> the boys are charged with the sexual assault and distributing photographs of a minor. in a case that echos the tragedy there, dozens of people gathered in nova scotia today to honor a young girl who killedherself after being bull lead on-line for 17 months. her family says the torrent of abuse continued even after parsons hang herself. they say she did it because of photos showing her being sexual assaulted what is sent to her her friends. she was only 15 at the time. she was assaulted by four classmates after she had been drinking. police investigated, but they did not press charges saying there was not enough evidence. the hack collective known as "anonymous is promising to publish the identities of the alleged attackers. a 10-year-old girl is molested inside a bay area office building. this happened monday about 5:00 in the evening. kron 4 shows you video of the man who police say is responsible for the crime. >> reporter: this surveillance video of the man after he allegedly molested a child into daly city. it was recorded inside this ross store. >> the color contrast in this video -- >> reporter: daly city police detective says the 10-year-old female victim gave a description of the suspect who was also spotted by several people in the area. >> there were witnesses that described him as wearing an army green nylon jacket with a fur-lined hood and black paints and the victim specifically said he had a black sweat schlereth with white writing and a red and black hat. he's carrying a hat in the video. >> reporter: this is your guy? >> yes, the greeter at ross just across the parking lot from the office building remembered him coming in. he was either chinese or other asian descent and describe themustache as being sparse and said he had a variety of moles op his face. a 10-year-old girl that was at a building in daly city for her therapy appointment and the building is a mixed use office building and some of the businesses use a common bathroom in the hallway. after her appointment, she said she needed to use the restroom and took the key from the wall to unlock the bathroom door. after she unlocked the door and started to go in, this guy went in after her and molested her in the bathroom. >> reporter: in daly city, kron 4 news. >> we're going to map this out for you. this is the plaza where the girl was who left. she was attacked in a bathroom in this office building right here. police saying after the attack, the suspect then left that building, went across the street and into this ross store. that's where the surveillance cameras captured the suspect walking into the store past the greeter. police saying the suspect was last seen leaving that store in a gray compact sedan, possibly a honda. they say an elderly asian female was driving that car, but she is not believed to be a suspect. >> kathryn? >> two women were shot today at a community college inside a virginia mall. the gunman has been arrested. police are still not releasing any details tonight. we do know that both women were taken to the hospital. police say they got a call with a man with a gun and shots being fired in the southwest virginia community of christiansburg. the college has a site light location inside the mall. local schools were briefly closed as a precaution. bay bridge safety concerns still unfolding tonight. we are now learning more about why those 32 anchor rods may have broken on the eastern span of the bay bridge. charles clifford has an update. >> reporter: caltrans is saying they suspect an excessive amount of hydrogen seeped into the rods eventually causing them to break. the question is how did the hydrogen get into the steel. on friday, caltrans releaseddetailed information describing the fabrication, galvanization and testing of all 288 anchor rods. after scanning through the material, there's no apparent explanation for how an excess amount of hydrogen may have got into the metal. the devil it seems is in the details. there are a couple possibilities. during fabrication of the bolts, the metal is heat treated or baked to make the rods stronger. this process may have strengthened the steel, but left it vulnerable to hydrogen. the rods are galvanized or coated with zinc to keep water away from the metal. poor quality galvanization may have kept the steel exposed. the bolts broken were installed years ago but only recently tightened down. during that time, rain water may have seeped into the metal making the rods brittle. caltrans wouldn't say it any of the scenarios or some other cause led to the 32 broken rods. >> we do know there is hydrogen. there is an excess of hydrogen in the steel bolts. at what point that hydrogen came to be in the steel bolts, we don't know. that's what the investigation is looking into. >> reporter: in the meantime, testing continues on the remaining bolts. cl transengineers are working on a -- caltrans engineers are working for a way to repair or fix the broken rods. another gorgeous spring day to finish off your workweek. sheer live look at our cameras -- here is a live look at our cameras on the roof looking at the city. lots of sunshine once again. temperatures right now are still very comfortable. warm in a lot of locations including mountainview, you have 77 degrees. fairfield at 78. hayward upper 60s. half moon bay, you're at 58degrees. what do we have going on? sea breeze returning tomorrow. temperatures to cool down tomorrow. same defor sunday and into monday. -- thing for sunday and into monday. the winds will pickup. tomorrow, i'm expecting breezy conditions. beyond that, windier conditions for sunday into monday. for tonight, clear skies. it will be cool out there. still, a pretty nice evening if you're going out for dinner tonight. tomorrow, still plenty of sunshine. a tad cooler but also breezy. beyond that, winds will pickup and we will talk about the coolest day in that seven day before another warmup coming this way. new tonight, we are learning more about the teen boy who was struck and killed by a train last night in san lorenzo. for more on the story, kron 4 mike pelton has the latest. >> this involves a student at san lawrnzo high school which is located next to the train tracks. the principal spoke with us and confirmed it's one of their own who passed away a sophomore named austin price. the principal called today a sad day and all morning long students understandably so are devastated finding out austin passed away last night. authorities say austin and two friends were playing a game of chicken with a northbound amtrak capital quarter train last night around 6:40 when the train struck him. all morning long, dozens of students brought flowers and candles to add to a makeshift memorial near the tracks. they said lots of prayers and hugged each other as they mourned the loss of their friend. >> he was a good student. he got good grades. he was always nice to everybody. he was a loving person. >> austin was a loving student. 10th grader. will certainly be missed, well loved here on campus. >> reporter: the principal tells us a train struck and killed another student several years ago and all shown a safety video each year being that the train tax are so close to the school -- tracks are so close to the school. grief counselors were on hand throughout the day and i'm told a second memorial is currently growing in front of austin's locker. in san lawrnzo, mike pelton kron 4 news. just released information about the richmond refiney-- refinery fire and what caused it. the north korean nuclear threat. the u.s. saying it is willing to enter into talks, but only under very strict conditions. i'll have the story at 5:30. first, the north bay middle school banning leggings because it's distracting the boys. it's turning into quite the controversy. the news at 5:00 continues next. you kids should count yourselves lucky. we didn't have u-verse back in my day. you couldn't just... guys... there you are. you know you couldn't just pause a show in one room, then... where was i... you couldn't pause a show in one room then start playing it in another. and...i'm talking to myself... last december's massive refinery fire in richmond. katherine is here now and has been looking into this with details on the story. >> reporter: chevron is basically acknowledging it is to blame for the huge fire last august admitting its failure to identify and replace the corroded pipe. we know the refinery repairs have been wrapped up and chef ron released this -- chevron released this video saying they expect to resume operations soon and it is promising to improve inspection procedures and says it is inspecting now every pipe in the facility. as for what went wrong august 6 when that leak led to the huge fire, chevron's findings aren't that different from those of federal and state inspectors. chevron admits it mishandled the response to the pipe leak saying in part its workers did not recognize the result of the pipe rupturing and igniting and the 2002 discovery of the pipe was getting really thin and worn and was buried in a soft data base and admits the 2011 inspection passed over that very same pipe which ruptured a year later. federal inspect found -- inspectors have found they failed to inspect the '70s era pipe that leaked despite finding corrosion in other pipes nearby. the problems were so significant cal-osha questioned whether chevron can properly go forward and fix and identify any few -- future problems though it gave them the ok to bring the refinery back on- line. chevron is insisting they have a new protocol for fixing problems and it can prevent a similar incident in the future. >> i'm sure critics will looks over the report very closely. >> reporter: they already are. some are saying since they're admit to go a lot of this, why are they -- admitting to a lot of this, why are they fighting over some of the fines? a baseball brawl that's likely to have a ripple affect. it involved the dodgers and padres. you see them going at it right here. two of the giants national league west rivals. the headline here is that dodgers star pitcher zack greinke broke his left collarbone and it was just announced he'll need surgery and is expected to be out for two months. take a closer look at the video. last night greinke hit carlos quentin with a pitch right there. quentin starts walking towards the mound. then it's on. they lower their shoulders and collide like two football players. we'll play it again and slow it down this time when they ram each other so you can really see it. watch right here. boom. greinke didn't have any momentum, so quentin really got the better of that one. the pair ends up at the bottom of the scrum as teammates then converge. dodgers star matt kemp who you see right there was not happy at all. greinke had to leave the game. he then had to leave the ballpark with his arm in a sling. tempers flared again as the players were leaving their clubhouses in san diego. that's matt kemp and here iscarlos quentin. kemp was mad on the field. quentin got hit by the the pitch and charged the mound. this is as they're exiting the park in san diego. you can see them having words and padres pitcher clayton richards had to step in and try to play peacemaker although it doesn't look like there's too much peace going on right there. eventually, police had to step in and help diffuse the situation. quentin likely to be suspended for at least a couple games. greinke, again, going to miss two months. this after signing an offseason contract with the dodgers as a free agent for $147 million and these two teams will play each other again on monday in los angeles. watch out, pam. this weekend's presidential address is going to be unusual. president obama is turning over the microphone to a mother whose son was skilled in the -- killed in the sandy hook school massacre. >> i want to know as we continue to key bait common sense measures -- debate common sense measures to reduce gun violence and save lifers, nothing is clear than nobody has a more important or powerful perspective on the issue than the families who have lost loved ones because of the sciewrnlg of gun violence -- scourge of gun violence. >> he added the only other time president obama had someone else do the address was one he was out of the country. the vice president stepped in that week. the newtown families have been in washington. they were lobbying members of congress over gun control measures. the senate cleared its first hurdle for gun control legislation on thursday and will allow debate to consider expanded background checks next week. closed door meetings have paid off for four democratic and four republican senators work on immigration reform. according to lawmakers and staff, the eight have reached an agreement that will remake the nation's immigration laws. the legislation would only allow people who have been in the country before december 31 of 2011 to apply for legal status. applicants would also have to have a clean criminal record. they'd have to show financial stability. there are roughly 11 million immigrants living illegally in the u.s. and we sit with a live look on the san mateo bridge this evening. things are moving well here. we have a hazy sky out there. we saw lots of sunshine. it was another gorgeous spring day. temperatures right now still comfortable if you're firing up the grill especially for inland communities, a really nice night to do that. 75 degrees in concord. antioch, you're still at 80 degrees. mid-70s for livermore. 63 in oakland. cooler in the city at 59 degrees in downtown san francisco. and a halfia -- napa in the upper 70sment sunnyville 72. san jose has cooled down to 68 dreers-- degrees. satellite radar is showing us lots of sunshine. just hazy conditions out there for some locations. overalthough, clear night in store for us. all the storms are stale well north of -- staying well north of us. we'll see a sea breeze kick off tomorrow into monday. we'll cool things down here. future cast for tonight, 8:00. [ man ] where all systems are go. ♪ this is the bay area news station. kron 4 news starts now. tonight, the u.s. secretary of state is in south korea responding to nuclear threats aimed at the u.s. from north korea. he says there is a united front aimed at becoming -- north koreaia from becoming a nuclear -- north korea from becoming a nuclear threat. >> kerry saying that the u.s. is willing to enter into talks with the north but only under strict conditions. secretary of state john kerry arrived in south korea armed with a message for the north. >> the united states will, if needed, defend our allies and defend ourselves. >> reporter: a stern voice, but leaving the door open for negotiations. >> we are prepared to work with the conviction that relations between the north and the south can improve and they can improve very quickly. >> reporter: kerry making it clear the u.s. will only talk to the north if it gives up nuclear weapons, but that could be a nonstarter for leader kim jong un. kerry is in seoul meeting with the foreign minister. more questions about what pyongyang can deliver a nuclear weapon or not. after an assessment reportsupposedly classified was mistaken marked as declassified and read allowed at a capitol hearing this week. >> the north currently has nuclear weapons capable of delivery by ballistic missiles. >> the white house disagrees and is pushing up. >> they have not demonstrated a capacity, a can't to deploy a nuclear armed missile, attach a warhead to a missile and fire it. >> reporter: secretary kerry downplaying the report also. he says it could be inaccurate to suggest north korea is able to launch nuclear missiles. kerry's next stops on his asian trip, china and japan. his message in china is expected to be that they hold the key to stopping north korea's reckless behavior despite strict u.n. sank -- sanctionings, china provides the north with food and money. we're getting an in-depth look at north korean television that jake nixon declared a state of emergency. in arkansas, this man was in his semi truck when the wind tossed him around. >> i started spinning out of control for a long time and i was all of a sudden it just stopped and then all i could do was pray and ask the lord to, you know, not let me die. >> reporter: this woman in alabama had only seconds to get to safety when a tornado hit there. >> i went home to take me a quick bath and herd the siren going -- heard the siren going off and i jumped in my clothes and came out of the house quickly. >> reporter: dangerous spring weather is not uncommon for these areas, but a cool march means there have been fewer tornadoes than normal. forecasters say this does not mean storms will be less powerful. something this man knows firsthand. >> very, very powerful. this one is pretty impressive just the way it threw the metal around in the trees and stuff. >> reporter: as tornado warnings and watches expire in parts of the southeast today, the task of cleanup begins. a utility worker in missouri died after electrocuted while restoring power and one person died in mississippi after strong winds there destroyed a steel building. breaking news in san francisco. we want to tell you about. this is a live picture from our helicopter partnership with abc 7 news. right now police are investigating a shooting which occurred at 15th and guerrero in san francisco. details are scant. there is no word on the condition of the victim or suspect. police are in the area. you can see police tape there cordoning off a certain area as they continue the investigation. we'll keep following this story and gather more details and bring the information to you later in this newscast. for today's market update, four days worth of gains came to an end on wall street today. here are the friday closing numbers. the dow fell just under a point to close at 14,865. the dow rose 300 points in the first four days of this week. the nasdaq lost five points today. the s & p500 fell four points. retail sales fell in march and lower gas prices may be partly to blame. according to a report, retail sales were down 0.4% last month. economists were expecting it to be unchanged from february. spending at the gas pumps dropped more than 2% and americans spent less at department stores and on electronics, appliances and motor vehicle goods. the report could be tied to the lackluster job market. hiring slowed in march and 500,000 people dropped out of the labor force according to the labor department. j. p. morgan chase is recording higher first quarter profits than it originally expected. those profits come from releasing more than $1 billion set aside to offset potential losses. investors were not impressed by the gains saying they are not a true indication of demand for the bank services. as a result, shares fell 1% in premarket trading. for the time being, american airlines ceo tom horton will not receive his $20 million searches-- severance package. a federal bankruptcy judge says the law prevents such high- priced payouts, but the judge says they are willing to reconsider the request in the future. horton will use his position when they merge later in -- this year. this is into the kron 4 newsroom. police look for a man trying to kidnap a 5-year-old boy that happened in front of an elementary school yesterday afternoon just after 2:30. police saying the suspect tried to pickup the young boy, but a staff member from the school actually intervened and then the suspect took off. the suspect described as a black man mid-30s, 5'10", 170 pounds with short hair. he was wearing a white t-shirt and black jeans. we have a crew in oakland digging for more details on this attempted kidnapping. we'll have that story tonight on where police continue to keep watch over the schools in that community following a threat. new at 6:00 we are brought up- to-date on what happened and what police are doing about the threat. >> reporter: police officers stood guard in front of locked gates as scotts valley high school was closed and classes canceled friday as a result of what authorities say is nothing less than an act of terrorism. >> we have the first amendment right to say stuff. you can not say anything in a crowded room and yell fire. in this case you can not threatened to shoot up a school. >> reporter: on thursday evening an anonymous posting posted on facebook warning if you go to school tomorrow you will die. gathered at a local skate park students worried the culprit might be a classmate. >> of course everybody is all happy to be out of school and stuff. it is weird somebody would theretoen our school. it is peaceful and we don't do anything up there. >> if i went to school i would be scared. it is a threat. you don't know if it is going to happen. >> reporter: the threat was directed as the high school. as extra precaution police stationed officers at a nearby middle school and other schools around town. permitted behind locked gates camera shows a quiet high school campus. shutdown costing the district of lost funding. >> i hope it is a hoax. i hope someone says it is not a funny joke. right now i don't know. i don't know the origin of what somebody intend. >> reporter: as of late friday police revealed little about efforts to track down the source of the threat saying extra patrols were considering whether to canceled activities scheduled over the weekend. three teenagers have been arrested in san jose for allegedly sexual assaulting a teenage girl and bullying her online. she later killed herself. teresa talked with investigators about new developments in the case. >> reporter: we are learning new details tonight about the case against three high school students that have been arrested in connection with allegedly sexual assaulting a 15-year-old at a high school party in september. audrey potts committed suicide days after the party. this, after pictures of the alleged assault circulated on the internet. tonight santa clara sheriff smith elaborates on the case against the teenagers and why the investigation took so long. >> we have arrested each of the three for three charges. one for digital penetration which is a felony. a sexual battery which is touching of private parts. and for distributing of photographs of a minor. i know she was upset. i know there were photographs out there. that's probably what lead to the suicide or at least a huge contributorring factor. it is a tragic case. this is sad. this is bullying. to me it was to humiliate somebody. it is very, very sad. the reason this investigation took so long is we get multiple search warrants of residents, cell phones, electronic equipment and the forensic. we did a lot of work before we were able to really find the evidence that we needed. we just received a statement issued by the school superintendant. a 10-year-old girl is molested in a restroom in daily city. police say surveillance video from a ross store in the same plaza captured this video of a man matching the victim's description of the suspect. >> greater at ross remembered this guy coming in. he described him being 17 years of age to early 20s and either being chinese or asian decent. described the mustache as being sparse and also said he had moles on his face. >> investigators say the suspect was last seen getting in a gray compact vehicle. possibly a honda. with an older asian female behind the wheel. in freemont police are searching for a man who they say grabbed a woman, ripped off her shirt and tried to take off her pants. it happened at beta park 8:30 thursday evening. victim was able to escape and run home to call the police. suspect is described as 5'8", weighing 200 pounds. new tonight san jose police made two arrest connect today the burned human body found on a highway onramp earlier this week. victim was stabbed at least once by steven burns and christopher james. their pictures are on your screen. police are trying to figure out a motive for the killing. initial investigation revealed an altercation lead to the victim being stabbed to death. identity of victim has not been released. san jose is planning to fight a judge's ruleing that could open the e-mails of thousands of government employees to the public. city council voted to appeal last month's ruling which declared employee messages about city business and public records are public records. even if they were sent by a private device. it could plug a hole in california's act. chevron released results of the investigation into last august refinery fire in richmond and much like the findings of federal and state inspectors chevron admits it mishandled the response to the disaster. chevron failed to properly document test near a corroded pipe near the one that failed and caused a fire. it failed to inspect all corrosion-prone pipes in the area. the own workers did not recognize the risk of the pipe rupturing and igniting. oil giant expects to resume normal operations at the refinery soon and insists it has new procedures in place to prevent a similar incident. employees at a newark lumber company can safely return to work. this is video from abc 7 news. unknown substance sent one person to the hospital. it happened at 9:00. a forklift hit two five gallon containers knocking one over with the lid off and spilling unknown substance. employee is doing fine. hazmat team isolated the container and is sending samples to the lab for identification. bay bridge safety concerns unfolding. we are learning why those 32 anchor rods may have broken on the eastern span of the bay bridge. >> reporter: cal says the anchor rods may have made the steel brittle and causing the rods to break. r[did hide rej get in the steel. on friday cal trans said the fabrication and testing and installation of all 288 anchor rods. after scanning through the material there is no explanation for how hide rejen may have gotten in the metal. there are a couple possibilities. during fabrication of the bolts metal is heat treated or bakes to make rods stronger. this process may have strengthened the steel but left it vulnerable to hydrogen. rods are coated with zinc. the bolts broken were installed years ago. only recently tightened down. during that time rainwater may have seeped in the metal breaking rods brittle. on friday cal trans would not say if any of these scenarios lead to the 32 broken rods. >> we know there is an excess of hide rerow jen in the steel bolts. >> reporter: they are working on replacing the broken rods. we are learning identity of a teen boy fatally hit by an amtrak train. austin price was hit last night to be tracks north of amtrak station.
