thanks for joining this early tuesday morning. we want to turn our attention right now to the weather. the bay bridge is looking pretty good. coming from the north bay, super foggy out there and dave spar is with us to tell us all about it. >> the fog is low you may have to exercise around the bay, a little bit of windshield activity. >> like with the exercise. >> just one hit. >> it's intermittent. if you have, great. >> does that mean it's going to stick around all day? >> no. no. that's the good thing on the golden gate shot there, you can see the fire towers are blocked out a little bit here with the surface fog and a little bit of drizzle. let's watch it from aloft. there you can see all the bay kind of covered up. the east bay shore line does not get too far. we did get the cooling. again, this will mix out as we mentioned, looking into a sunny afternoon for everybody. temperatures in the 60s territory. 60 san jose and 56 covers san francisco. novato is 55. 2 degrees ahead of where we were at this time yesterday. most readings across the bay a couple of degrees shy across the bay and even inland, we see that. looking at oakland, morning fog, mostly sunny. temps get back to the business of around 70 or so. mild to cool afternoon depending upon your perspective and a glance of the day as a whole, clear aloft. the surface, particularly along the bay. we are already breezing past 80 by noon. inland temperatures in the lower 90s before we start to break that by the mid of next week. first day glimpse at what is happening on the roads. >> pretty quiet out there. looking good at the bay bridge toll plaza. it's wide open no, problem approaching the toll plaza. checking in on the san mateo bridge, a live look at 92. ride here heading to the peninsula so far at the limit. if you need to get into hayward into foster city, it is a good commute right now. the ride across the golden gate bridge, going to be a good right from across the bridge into san francisco, even doyle drive is looking good. sensors are green at the limit so far. 24 the east shore freeway. the nimitz, macarthur maze, getsing through dublin, livermore, castro valley no, problem. 680, that's a good right. from hayward, union city rolling into fremont at the limit. coming up in my next report, i'll take a look at the south bay. back to the news. our top story this morning a violent shooting in an east bay highway stretch. people are increasingly frustrated saying that steps taken so far are not working. eastbound 80 in emeryville. this is the latest spot where a driver has been shot. in time in the head. it happened about 2:30 monday morning just before the powell street exit. all these drive-by shootings are crazy. >> it does concern me about the shootings that's happening. >> those who travel i-80 or watching their backs. >> i'll be worried and now more checking around while i'm driving, trying to, you know, be cautious of the surroundings. especially when it comes to those traffic jams. >> reporter: the latest east bay freeway shooting is the 26th since november of last year. the chp says that most have been car to car and gang related with the victims targeted. the chp is not saying if that's the case this time the rash of shootings has already led to the installation of cameras along a stretch of highway 4 and prompted a task force to seek funding for i-80 cameras. >> probably not a bad idea. >> while some drivers support the idea, others are not so sure. >> freeway cameras are not going to stop the shootings. it may help find the direction that shooter may have went. but if somebody is having road rage or if they are aggressive, they'll do what they are going to do. those cameras are not stopping the crime. >> reporter: the highway troopers are working to get funding for the cameras many meantime, they are tipping to collect evidence. this latest shooting is one of three dozen the east bay highway has seen since last november. we want to take a look now at what is being done to curb the crime rate. in pittsburg, surveillance cameras are now up and running. the cameras came after the murder of shaneka williams. the chp, various police agencies and several bay area mayors are also on a task force. they are working to put in high resolution cameras. shot spotter technology and license plate readers along interstate 80 from el ceritto and herculeses. and on our website, can you find more stories on what's being done to increase safety in that area. there is also more information with the latest updates on yesterday's shooting in emeryville. another big story we are following for you this morning after the deadly shooting in austin, texas on sunday. we learned that woman killed was from the bay area. taneka moltre was 24-year-old old. we talked to her wife. >> she was a bus driver here at the sequoia union high school district where her wife said she always felt like she had something to give. >> sabrina rudd, the wife of three months is still austin processing the tragedy. >> i'm just heart broken because our future was ripped away from us. >> they were visiting family when a night on the town turned deadly during a random shooting spree. >> reporter: her colleagues in redwood city put flowers on her bus. rudd said that everyone loved her wife, and everybody who she loved everyone and especially the children. she loved working with special needs children she loved -- >> the couple's most he is sighting plans were dashed to pieces. though they had a small private wedding ceremony in april, they had planned for a big one in october. >> i'm going to miss her soap so much. she was my wife. she was my everything. >> austin police still have not made an arrest in that shooting though they have put out a warrant in the arrest of a 24- year-old man. three other women were also shot in austin an ended up in the hospital. in redwood city, spencer wake, kron 4 news. in the east bay a car plow neighborhood a super hair cutting salon in livermore. take a look at some of the damage. the accident happened around 1:00 yesterday afternoon. fire crews say that the car just went right through a huge window and a vacant business next door. the car finally stopped after crashing into the wall. >> heard a big loud noise and -- oh, my goodness. got louder. so it must have come through the first window here. i jumped up and ran out. and like -- there was a big car. >> employees say that two people were inside getting their hair cut at the time. it was an older man behind the wheel who may have hit the accelerate for instead of the brakes and no injuries were reported finally after many delays, a judge denied a request to delay the trial of the man accused of kidnapping and murdering teenager lamar. the attorney general of torres asked for additional pushback to october but based on the length of the time, the case has been pending. the judge turned down the request. investigators say that her dna was found in garcia torres' car. her body has never been found. jury selection is now slated to start in mid-september. san francisco officials want the parents of kate steinle to drop the lawsuit against the city. police say hat shooter was an illegal immigrant who had recently been released from jail. city argues that it had no duty to notify federal immigration officials of the man released unthe sanctuary ordinance. the city insists that it has no responsibility. the parents argue that the man would intrn arrested, and deported if the city had done its job. the c.d.c. issues a travel warning and florida's zika virus outbreak. the way that the city is working to stop the spread of the zika virus in the united states. and the ways that a panel is working to help brain trust between communities and the police. also, the deadly monterey county fire is growing this morning. a look at where firefighters stand as they work to contain the massive wildfire. all coming up next on kron 4. the sobrannes fire near big suhr still burning. over 40,000 acres have been burned. one man died driving a bull doze en down a ravine while fighting the fire. the fire already destroyed 17 home runs. the fire start ed a week and a half ago and containment is not expected for another two weeks. the department has sent a lot of the people there to the sobrannes fire. sffd shared these pictures. nearly 350 people are assigned to this fire and about 1600 firefighters are still working near fresno to put out the goose fire. that wildfire has burned just over 2000 acres and is 20% contained this morning. and dave is joining us right now to talk about the conditions out in. golden gate bridge, there is some dense fog out there. >> a little pit. and a little bit of drizzle, too, which is the story. you are talking the fires and more help on the way as we see cooler temperatures on the way. everything -- >> i thought it was supposed to get hotter? >> later in the week? >> yes. >> that's now and gets a little better now. that's funny. >> that's the trend we like to look for there. the bay bridge, we have it there. thing will be changing inside. some spots in the 90s. here is a look at what whats up above. the fog is spraying all over the east bay shore line. finally, things start to lift, the same suspects getting warmed up going up only to 10:30 a.m. then it starts to bleed on through. east bay shore line insulated by 6:15. just about this ocean cool air is about to make its way to the east again there. we see the change overnight. a little sluggish around the live more valley. more temperatures today, about 65 or so from downtown san francisco. san mateo about 75. along the coast, lower 60s will do it with palo alto about 77. mean while, for much of the peninsula to the south, redwood city at 74. half moon bay at 62. south bay, we still have some lower 80s on here, 83 at work for san jose. mallmalpetas at 64. 90 concord, 91 for pleasanton. 85 for petaluma. napa about 85 and some 90s hanging around yet again in the seven-day forecast. we see temperatures drop a little bit. into the aigz we go. a little cannotter than what we have been through. robin, a check of the traffic holding good? >> yes, not so bad out there. pretty good driving conditions. how about 92? do you need to use the san mateo bridge? if so, here are live pictures coming out. nimitz freeway in good shape. a good right here coming from the east bay heading over to the pens la. that's how we like it. the ride from the ridge month bridge? no problems rolling into the north bay. now is a good time to use it. eight minutes from the tomorrows out to 101 rolling into san rafael. no big problems coming from the north bay. south bay, hot spot free at morning has been in the u.s. for months. we are now just seeing the first cases of locally contracted zika. the ill necessary is most dangerous for pregnant women and their babies and it's been linked authorities described as serious. >> something that i described as pandemic. >> this is in our backyard. >> the c.d.c. issuing an unprecedented warning, warning pregnant women and their partners not have 10 more cases. >> federal officials stressing the impoance of mosquito control. >> when you have travel-related cases and the mosquitoes that are capable of transmitting this infection, you're 2:30 this morning on eastbound 80 in emeryville just before the powell street exit ramp. a 24-year-old man was shot in the head. he is in critical condition this morning. police are still looking for a gunman and there is no motive. there have been three dozen shootings on east way preways since last november. police in austin, texas, are still looking for the gunman who shot and killed a bay area woman over the week. 30-year-old taneka moultrie who was visiting texas with his way. a 20-year-old man is listed as a suspect but he is still on the loose this morning. a judge denied a request to delay the trial of the map accused of kidnapping and killing morgan hill teenager sierra la more. the defense attorney asked for a delay but the judge turned down the request. jury selection is slated afternoon. there is that thermally thing again. 80 by 12:00. however, this afternoon, some areas inland will experience yet again some lower 90s and the bay will have 60s and 70s. >> we are hot spot here rolling through the peninsula. golden gate bridge looking good. >> and with the drive time, highway 4 west, it's the quick 13 minute trip from 160 out to 242 in concord. no big problems for 580 westbound rolling through the altamonte. looking good. still crowded. from 205 to 680, a quick trip. from san jose from the 85 split to 237, a quick 18 minute trip. back to back to the news. >> thank you,robin. this video shows officers arresting a young man. many people are extremely upset the man is 22-year-old michael smith. it happened at the embarcadero station. he was arrested for being connected possibly to an armed robbery. now, police say that smith kicked one officer in the head and throat and bit another and spit at another. smith remains in jail on a $180,000 bail. some people who were on the platform say that police were unnecessarily physical. this video and others like it have been viewed about 100,000 times. the event policing the police is hoping to pave the way and set an example for the country. the pam was formed by the d.a. last year following racist and homophobic text messages exchanged by san francisco police officers. kron went to the event and we have reports on the ways that the panel hopes to restore trust between the police and community. >> do you feel safe? >> no >> reporter: outrage sparked through communities after video was released of unarmed black and hispanic women and men killed by police. >> violence and injustice is not a new phenomenon. it is a deadly link to our origin as a nation. >> monday night, san francisco's district attorney invited his blue ribbon panel on transparency, accountability and fairness in law enforcement to find solutions to a broken police culture using examiner siev force. as an immigrant, george gascon says he was mistreated by officers which served as an inspiration. i got to see first hand good policing and bad policing. but as a young man, i saw more bad policing than good policing. i remember being stopped often. >> now the panel strives to speech that lesson to sfpd by highlighting the use of force. >> in 2015, san francisco police searched black and hispanic people without their consent at higher rates than any other racial groups. of all the peoples searched without consent, black and hispanics were the least likely to be found with contraband on they. >> 70% of people shot door. san francisco officials want the parents of kate stainle to drop a lawsuit against the issue. the city argues that hit no duty to notify federal immigration officials of the man's -- when the tonight and returns. giving you some relief from the heat during the overnight hours. temperatures today, we'll try about 65. 62 going on for daly city. 75 for san mateo. half moon bay at 62. much of the south bay experiencing lower 80s for toi. cupertino at 82. east bay shore line, temperatures hold here mostly in the 70s, 76 for heyward. chilly 65 but 91 livermore. 91 pleasanton with walnut creek at 88. here is the reduction in temperatures back to the middle to maybe even lower 80s in spots. the coast not a whole lot changed but again you will be treated to morning drizzle. here is robin. details on that. >> all right. still watching backup at the bay bridge toll plaza heading into san francisco. a little bit of a slow down in those cash lanes on the right hand side. only two cash lanes able and there is usually a shift change during this type of the morning. that's what's cause this backup. on the left, it's wide open. overall, not a bad right coming out of oakland into downtown san francisco. checking in on 580. here is a live look at the ride. it's a nice commute. you will find no problems right now rolling into the north bay. 8 minutes to 101. 101 across the golden gate. we have the zipper truck switching around the lane configuration to accommodate the commute traffic coming from the north bay. we'll switch to four lanes out and two lanes north. smooth and light in both directions so far. stop and go track here rolling into morgan hill. 101 between dunn and cochran. some road work wrapping up. not a big deal. it's just between these two points, after that continuing through south bend all day, through san jose. no major trouble spots right now. back to you, theresa. >> thank you very much. a shining tower of wealth and prestige is sinking. millenium tower in downtown san francisco is losing ground. the building finished in 2008 is singing 16 inches and even tilting a couple of inches as well. a spokesperson for the tower is putting the blame on san francisco's neighborhood trans bay transit center project. a big huge project. he says that a half a mile tunnel was built next to the building and the millenium was not properly protected. one woman is concerned about her famous former 49er neighborhood. >> where you are sitting right now, it's sinking 16 inches so far. >> you know, once you start digging -- they have not done a lot of construction in a long time. does joe know? we better tell him. >> the sink is is not considered a huge safety problem but it could affect residents' investment and is expected to set the stage for a huge lawsuit which could hit taxpayers. another big story we are following in a little over a month, convicted sexual assault offenders and ex-stanford swimmer broc turner is expected to be released from jail. the 20-year-old was sentenced to six months in jail. the outrawj over his spunnish. has not gone away. kron was there as new attempts were made to remove the judge who sentenced turner from the bench. >> three months is not enough. >> reporter: a small group of protesters chanted that three months is not enough as they carried signs reading "convict white rapists". >> coming all wait interest from florida, she came to demand that california lawmakers take action to impeach a judge who they say is biased. the santa they are bringing a box full of a million signatures, they say. >> this is separate from another which delivered over one million signatures on the state commission of judicial performance. >> this is also a move to recall judge percy. he was recently re-elected but that drive can't get underway until he begins his next term in 2017. >> an entire year is an extremely long time for the judge to be staying on the bench when basically what he was doing is telling rapists that it's okay. >> this is a petition up on change.org in support of the george with petitions coming from public defenders. >> rather than using a one size fits all, i would encourage the use of judicial discretion. >> broc turner is expected to be released from jail on september 2nd. coming up, a look at the new players you will be seeing in the bare area following the fog came in, pretty much covering the perimeter of the bay, not a lot of progress getting inland, we got some of the cooling but you can't see a whole lot in the way of fog coming in. oakland, 70 or so, morning fog, a mostly sunny day, and mild, cool afternoon on tap. here's how it breaks down for us, 64 inland by 9:00 a.m., we are talking 84 by 1:00, some areas still revisiting some of the traffic problems out there. tracking a backup at the bay bridge toll plaza. a little crowded rolling in backing up toward the end of the lot on the left side, it's wide open, the fastrak lanes are wide open. overall not a bad commute. if you need to get out of oakland into san francisco right around now, it will be under 10 minutes from the maze getting over to the skyway. coming up we will crews out in san francisco after a fire broke out underground and power has just recently been restored in some parts. >> we have been live on the scene at geary and hide where this happened. what's going on now, jackie? >> reporter: you can see crews from pg&e still out here at the scene at the corner of geary and hide. they say most of their work is done and power has been restored to about the 350 customers that lost it when this fire broke out underground. here's video from when it actually happened. about five hours ago, around midnight according to pg&e, somebody called to say smoke was pouring out of a manhole when they got here, they went underground to find out what was going on. what we are being told now is it's an equipment problem, copper, wire, the insulation on it somehow caught fire, caused the smoke and also caused the power to be knocked out. they were able to reroute the power and reestablish power to the 350 customers that lost it. what caused it, well, right now they don't know exactly what caused the fire. they say that will come at a later time as they investigate it. but the good news is, nobody was hurt. power has been restored. the street lights are still out here. you can see that the signal lights are out here at the corner of geary and hide but they say that's a city issue, not a power issue. so the good news is this should not have any effect on traffic in the area. mark, teresa. >> we will check back in with you a little bit later. another big story we are following, a 27-year-old oakland man in critical condition after another shooting on interstate 80. this time in emeryville. here's the latest of a string of shootings along east bay highway since late last year, this latest one happening yesterday morning before 2:30 in the morning, this on eastbound interstate 80 at the pal street off-ramp. officers found the victim in a silver nissan altima. he had been shot in the head. he was taken to an area hospital in critical condition. no one has been arrested in this latest shooting. this is now the 36th shooting on east bay highway since november. investigators believe the majority of the shootings are gang related and that the victims have been targeted. and in the wake of the recent shootings on east bay freeways, surveillance cameras have been installed on the stretch of highway 64 in pittsburg. the decision came after a woman was shot and killed while driving along highway 4 in pittsburg in may. 14 cameras now in place so police can monitor who is driving in and out of pittsburg and identify the people involved in case of any future shootings. and chp officers, several police departments and a group of mayors in the east bay have created a task force to try and stop these shootings. they are working on installing high resolution cameras shot spotter technology and license plate readers along i-80 from el cerrito to hercules. we have a lot more on the story on air and online. you will find the stories about what's being done to prevent shootings along the freeway and you can find updates about yesterday's shooting in emeryville, on kron4.com. a historic health advisory from the cdc, health experts say that pregnant women should not travel to what is being called the zika transmission area in florida. pregnant women who live there should take steps to prevent mosquito bikes and sexually spread the virus. >> the virus has been linked to devastating birth defects. it swept through south and central america and has been in the u.s. for months now. >> but -- >> but -- >> sorry. >> go ahead. >> we are now seeing the first cases of locally acquired zika in florida. >> i think that's completely nerve racking. it's scary. i don't know what to do. >> it's alarming. >> reporter: miami residents frightened and with good reason, amid a growing outbreak of zika virus in south florida that officials characterize as serious. >> something i have described as a pandemic in process. >> this is in our back yard. >> reporter: the cdc issuing an unprecedented travel warning monday, advising pregnant women and their partners not to travel to a small community just north of downtown miami. the historic move coming amid an increasing number of locally transmitted zika cases in the area among people bitten by mosquitoes. concerns started mounting friday. >> florida has become the first state in our nation to have local transmission of the zika virus. >> reporter: and monday another frightening revelation from governor rick scott. >> on top of the four cases we announced on friday, we have 10 more cases. >> reporter: federal officials stressing the importance of mosquito control. >> when you have travel-related cases and the mosquitoes that are capable of transmitting this infection, you're going to see in certain situations like we have seen now what we call a local outbreak. >> authorities in florida are working to test mosquitoes for zika, treat and eliminate mosquito breeding sites and cut back on a key breeding factor. >> no standing water and then no standing water and then no standing water. >> reporter: i'm reid binion reporting. wildfire burning in seven western states including several here in california. higher humidity and lower temperatures yesterday helped firefighters battling the destructive silveranos fire. 57 homes have been destroyed. that number has remained the same. and 11 outbuildings also destroyed but there are more than 2000 homes still threatened this morning. the fire turned deadly last week when a bulldozer overturned while a man was inside battling the fire. as of last update, that fire still only 18% contained. and a strike team from san francisco that was sent to help fight the silverandis fire -- have been sent in to help fight this fire. nearly 5300 people on the front lines right now. and then the wildfire burning in fresno county, it's destroyed three homes and grown to more than three square miles. it's the goosh fire and started on saturday. 400 homes are threatened this morning. about 300 people are under evacuation orders. containment is up to 20% this morning. a judge has weighed in on the trial of the man accused of kidnapping and murdering morgan hill teenager sierra lamar. the trial for 25-year-old antolin garcia torres has been delayed several times in the past. his attorney asked to push the trial back to october but a judge turned down that request yesterday. a request wasn't granted based on the length of time the case has been pending. and the fact that garcia torres has three attorneys. sierra lamar was last seen walking to school back in 2012, investigators say that the 15- year-old's dna was found in garcia torres' car. however, lamar's body has never been found. jury selection is set to start in september. a san francisco man died while attending a popular music festival in southern california. 22-year-old derrek lee died early sunday morning after attending the hard summer music festival in fontana. he died after midnight after being taken to a hospital in colton. two other festival attendees also died over the weekend after being taken to the hospital. investigators say the three deaths are not related. sheriff's deputies are trying to figure out how all three died. they have not ruled out extreme heat. and still ahead in the morning news, we are learning more about the san carlos woman who was killed in a shooting in austin, texas. we speak with family members ahead. later billionaire warren bullet is getting -- buffett is getting involved in thundershowers again in the green areas that you see, which basically is good portion of the country. heavy storms right now, you can see in missouri, but i want to zip out here over the west coast. our neighbors to the south getting actually some flash flooding as we speak now near lake havasu, there's a flash flood warning that's been posted. very small area geographically but we could continue to see the flare-up of thundershowers in a small portion of so cal. the dangerous thing with these monsoon thunderstorms is they can sometimes produce a lot of flaps of lightning and not much in the way of rain, which can actually start more fires yet again. here's a look at our temperatures as we watch the warmup happening again today, mid-afternoon, there we have them, the 90s popping up, meanwhile west of the hills there's the cooler temperatures along the east bay shoreline at work. then we get that ocean cooled air to return into the inland valleys. it takes a little doing there but we do see it happening after midnight. look at our temperatures now, 65 san francisco, golding gate park coming -- golden gate park coming in lower 60s territory. daly city at 62, 77 palo alto, san mateo at 76 and pacifica at 61. 76 for redwood city and to much of the south bay we are going to revisit again the lower 80s here, santa clara at 82, cupertino as well. 71 oakland, 78 for hayward but a cool 66 for richmond. for concord at 90, 91 for pleasanton and still holding onto some of the 90s in the far east bay reaches but more 80s thrown into the mix a little bit and up to the north bay briefly 85 in petaluma and parts of wine country still 80s and inland areas could revisit again some lower 90s. we do change this pattern as we finish off the week into the weekend, mid-80s, some at the limit so it's not a problem for you if you need to get into the north bay coming from the north bay, a live look at the golden gate at the limit in both directions, no big problems in san big problems for south 680 out of dublin into fremont and guadalupe parkway rolling through san jose, still checking in hot spot-free. this morning we are hearing from the wife of a bay area woman who was killed in a weekend shooting in austin, texas. sabrina rudd had been married to tonika mulltree for three months. the two were visiting family when the shooting broke out early sunday morning. tonika was a school bus driver in redwood city and her colleagues have placed flowers on her bus. sabrina rudh says everyone loved her as much as she loved them, especially the kids she worked with. >> she loved her jobs, she loved being around the kids. she loved helping them. she worked with special needs children for a long time and she loved meeting someone new, brought something to their day. the kids loved her too. >> austin police have yet to make an arrest in the shooting. but they do have a 24-year-old man they have listed as a suspect who is still at large. three other women were also shot and are still in the hospital this morning. city officials in san francisco are asking parents of kate steinle to drop their lawsuit against the city. steinle is the woman who was shot to death along pier 14 last summer. the suspect in the shooting was an illegal immigrant who had recently been released from jail as part of the sanctuary city ordinance. city officials say they had no duty to notify federal immigration officials that the man was being released because of the ordinance. steinle's parents argue that the gunman would have been kept in custody and deported. if city and federal officials had done their jobs. since the virus was first discovered the animal shelter has euthanized 11 cats that were tested positive to the virus and exposed it. symptoms include fever, decreased appetite and letting geo-- lethargy. animal shelters in hayward say they will not be accepting cats for the next few weeks to reduce the risk of the virus spreading. cat owners are advised to make sure their pet is up to date with vaccinations. and take a look at this, a car plowed into a supercuts in livermore. it happened around 1:00 yesterday afternoon. the car went right through a large window in a vacant business next door and then it went right into crashing through a wall shared by supercuts. witnesses say they were really taken by surprise. >> heard a big, loud noise and i -- i thought, goodness, what is it? it got louder. obviously i must have heard them come through the first window here and i came and ran through so i jumped up and ran out. and there was a big car in the salon. >> two people were inside getting their haircut at the time of the accident. fortunately no one was injured. police say an older man was driving the car that crashed and he may have hit the accelerator instead of the brake. and decision 2016 news, billionaire warren buffett is suggesting that donald trump is afraid to release his tax returns. buffett appeared at an event with hillary clinton in nebraska yesterday and he criticized trump for breaking with decades of presidential campaign tradition by keeping his tax returns secret. buffett says those documents can reveal much about a candidate's charitable giving, assets and spending priorities. trump says he will release the returns after the irs is finished auditing him. but buffett said that wasn't reason enough to withhold his tax returns. >> one point, and he said it several times is that he can't do it, can't release it because he's under audit. i've got news for him. i'm under audit too. [ laughter ] >> and i would be delighted to meet him anyplace, anytime between now and election, i'll bring my tax return, he can bring his tax return, nobody is going to arrest us, it is not -- there are no rules against showing your tax returns and just let people ask questions about the items that are on there. you're only afraid if you got something to be afraid about. fall. new any emojis include female threats and professionals. apple users can download the beta ios software now ahead of the beta launch next month. mcdonald's is removing high fructose corn syrup from the menu. no longer contain artificial preserves. the changes will impact about half the himes on the mcdonald's -- items on the mcdonald's menu. the company says it's also serving more natural communities of the bay, not getting as far inland, we got the cooling certainly with that and that's good news and this will mix out for us in most communities, pretty nicely this morning. for san jose the breakdown gets us to the lower 80s in the early afternoon, a mild breeze coming with that and our general breakdown puts us at 64, sunny at 9:00 a.m., basically it's clear skies aloft, we had a lot of cloud cover going on above us yesterday. 1:00 p.m. at 84, but some areas will revisit some of the lower 90s. that will change as well. we will explore coming up. right now robin covering your the usual crowding approaching the pay gates. beyond the 880 overcrossing to west grand but still moving very well across the eastern span, the suspension span, the skyway looking good. less than 20 minutes from downtown oakland to downtown san francisco. drive times looking good, no big problems for westbound 4, the usual crowding for 580 west so under 30 minutes from 205 to the 680 split and checking in on the south bay which is hot spot-free, 101 north from 85 to 287, a quick 18 minute trip. check in on the san mateo bridge coming up in my next report. back to the news now. b.a.r.t. conducting an internal investigation after video surfaced showing officers arresting a young man. this happened friday afternoon at the embarcadero bart station. the video was shared on social media as officers were seen struggling with the man identified as 22-year-old michael smith. police said smith was being arrested in connection with an armed robby but he resisted. officers say he kicked one officer in the head and the throat, bit another officer and spit on a third. smith is now in jail on $180,000 bail. police have reached out to the witness who posted the video of the arrest online. and a man was clubbed and beaten by alameda county sheriff's deputies now filing a lawsuit. stanislaus petrov is seen in the video being beaten by deputies with batons. it happened last november after sheriff's deputies say he led them on a chase in a stolen vehicle. the beating was caught on surveillance video in a san francisco ally way as -- alleyway as you see here. his attorneys filed a civil rights lawsuit yesterday against the two deputies involved in the beating. attorneys say the beating was illegal street justice and petrov was left with severe injuries. the deputies took photos of petrov when he was bleeding and stole his golden chain and money to silent witnesses. an event hopes to help ease tensions between the police and public. outrage has been sparked in communities across the u.s. including san francisco after videos were released of unarmed black and hispanic men and women being killed by police. san francisco's district attorney invited his blue ribbon panel to an event last night to find solutions to what he calls a broken police culture of using excessive force. as an immigrant, da george gaston says he was mistreated by officers and that served as his inspiration. >> i go the to see firsthand good policing and bad policing but quite frankly as a young man i saw more bad policing than good policing. i remember being stopped often. >> from our research we found that in 2015 san francisco police searched black and hispanic people without their consent at higher rates than any other racial group. of all the people searched without consent, though, black and hispanics were the least likely to be found with contraband on them. >> as part of a list of 81 recommendations, the panel concluded san francisco should create an office of inspector general to oversee police. and new this morning, we learned the name of the truck driver who died when his tanker truck carrying used motor oil crashed and burned on interstate 80 in san leandro last week. 23-year-old hector francisco medina crashed his big rig near the davis street off-ramp just before 4:00 last wednesday morning. the chp says the san jose man was trapped and killed instantly. chp investigators have not said yet what they think caused the crash. attorneys for the man charged with killing nine people at a charleston church is challenging federal prosecutors intention to seek the death penalty against him. lawyers for dylann roof argue an emotion that the federal death penalty law are unconstitutional. the motion asked for a judge to declare the death penalty law unconstitutional. it says that ruling would permit roof to enter a guilty plea and be sentenced to life in prison without the possibility of troll. roof is also facing a death penalty trial next year in state court in connection with the june 2015 shootings. and a growing number of homeless people are setting up tents in one east bay city and people who live there say it's becoming a big problem. the city of oakland is going around to tent cities around town and cleaning them up but almost as quickly as the tent city sites are cleaned up, new ones spring up in other locations. how long tent city lasts depends largely on what part of oakland it's located in. >> in areas like this, i don't get complaints, usually in the neighborhood, in the park, in the business corridor, you know, the complaints will come immediately and numbers and so we tend to address those first. >> oakland city councilman says the city is looking to create more permanent solutions including putting peninsula. so far a good commute rolling into foster city, rolling into san mateo. less than 20 minutes from the nimitz to the bayshore freeway. there's now little proof that positive medical benefits come from flossing every day. that's according to an investigation from the associated press. the federal government has recommended flossing daily since 1979 says it prevents gum disease and cavities. the flossing recommendation was removed. experts say they haven't researched the effectiveness of flossing. there have been 25 studies over the past decade that compare the use of a toothbrush with a combination of toothbrushes and floss. evidence for flossing, they said, was weak and unreliable. and the zika virus is a growing concern around the world and there are bug sprays that can help repel mosquitoes that transmit the virus. consumer reports puts 16 bug sprays to the test now to see about that. the two that were the most effective in repelling mosquitoes are stay wear and benz wilderness 30% deet. those sprays kept the bugs away for up to eight hours. doctors warn that clothing with repellent built in is not enough to stop mosquitoes from biting you. that is a big bummer. but they say you should layer up with more bug spray. and the amount of meat that you eat could impact your lifespan. a new study in the journal of american medical association found that meat eaters may have a higher risk of early death. the study looked at data on the diets of more than 131,000 people. it found 10% increase in animal protein intake was linked to a 2% increase in on overall mortality and an 8% risk in cardiovascular-related death. people who ate more plant based protein had a 10% decrease in overall mortality and a 12% decrease in cardiovascular mortality. researchers don't know why animal protein is linked to earth death. we are days away from the start of the rio olympics and there's growing concerns about the health and safety of the athletes. why
