declared brain dead after she had tonsil surgery. her family has lined up 'another' facility to care for her. but the hospital may not go along with that decision. kron four's justine waldman reports from children's hospital oakland. the family has until monday at 5pm to and tonight they found a place that will care for jahi mcmath. and said insurance will pay to keep her on life support. but they need help from children?s hospital oakland first. and it does not appear they will get it without a fight. sot as of right now it looks like we might have found a miracle and give her another fighting chance to wakeup. the night started off so positive for the family of jah-hi mcmath ? her uncle proudly announced they found a new facility to care for the brain dead 13 year old. but before the place? somewhere in the bay area that ?they choose not to name? will? accept her,? she needs a tube in her throat to help her breath and a tube in her stomach to get nutrition. sot this is great and i am very optimistic this will work out. about an hour after the family revealed their plans? their hopes were crushed when a spokes person for the ?hospital read a statement to the media? children hospital oakland does not believe that performing surgical procedures on the body of a deceased person is an appropriate medical practice.? it appears, no outside doctors can insert the tubes. dashing voting right now on its new contract. a-t-u local 192 hopes to have results by late tonight. this will be the third vote on a new contract for a-c transit. union members voted it down the other two times. dozens are flocking to the city today for the annual san francisco bird count. it's a 31-year tradition where people gather from dawn to dusk to observe over 100 birds species. last year included sightings of beautiful birds such as the violet-green swallow, the tropical kingbird and the rufous hummingbird. the event is expected to produce data about bird habitats and could reveal three p-m usit's expected to be thousands of pages long. last month, prosecutors issued a summary of the investigation into the december 2012 shooting that killed 20 students and six staff members. the summary did not reveal gunman adam lanza's motive. lanza, who had significant mental health issues according to the report, committed suicide as police starting tomorrow, federal jobless benefits expire for more than one million americans. the checks will stop coming after a program signed into law back in 2008 expires saturday. an additional 850-thousand workers will also lose state unemployment benefits over the next three months. congress extended or expanded federal aid to the long-term jobless eleven times, but an extra lifeline wasn't included in the latest budget deal. a has signed a budget bill easing automatic spending cuts over the next couple of years. he signed the bill yesterday while on vacation in hawaii. the deal reduces across the board cuts, and restores about 63 billion dollars over two years. its not a grand bargain for the white house, but it prevents another government shutdown for now. a man charged with shooting and killing a t-s-a officer at l-a-x last month pleaded not guilty in court yesterday. paul ciancia made a brief court appearance. he faces 11 charges -- including murder. investigators say he specifically targeted t-s-a agents when he burst into the airport with a gun on november 1-st. ciancia accused of killing t-s-a officer gerardo hernandez. two other t-s-a officers and a passenger were hurt. the trial is set to begin in february. japan's government has given the go-ahead to relocate a controversial u-s military base. okinawa's governor approved a proposal allowing for construction of a new base in a rural area. the marine corps air base futenma has been unpopular with the island's population because of crimes committed by americans stationed there. relocation comes more than 17 years after the u-s and japanese
