Were going to begin tonight with that payment made to Stormy Daniels to keep quiet about the affair she says she had with donald trump years before he became president. Mr. Trump denies the affair but no longer denies knowledge of the payments. The president s version began changing in a latenight eglevision appearance by one of his newest legal advisers. Heres Major Garrett. He didnt know the details of this until we knew the details of it, which was a couple of s eks ago maybe not even a couple of weeks. Maybe 10 days ago. Reporter that was President Trumps new personal lawyer, rudy giuliani, describing what the president knew about a 130,000 payment to adult film actress Stormy Daniels to gain her silence days before the election about an alleged affair with mr. Trump. That payment was arranged by mr. Trumps selfdescribed fixer, Michael Cohen. The night before, also on fox, giuliani said mr. Trump personally repaid cohen for the real. The president repaid it. Reporter today, cohen ignored reporters questions. D have a good day, guys. S reporter giulianis revelation contradicts what the president said on air force one april 5 reporter in a series of tweets this morning, the president struck a decidedly different tone saying the nondisclosure agreement with daniels was common for celebrities and was used to stop the false and extortionist oncusations made by her about an affair. Michael avenatti is the lawyer representing daniels. Its an outrage, frankly, ntat the president of the United States would stand on air force one on videotape and blatantly lie to the american people. The president and his advisers are making this up as they go along. They realize they are in a heapload of trouble. Glor major, i also want to ask you, there were reports today about a possible wiretap between the white house and mr. Trumps attorney. What can you tell us about that . Reporter well, two federal officials tell cbs news there are no wiretaps, there are no transcripts, there are no phone recordings of any of Michael Cohens telephone conversations, including any he may have had with the president. Now, we do know from investigators in a general sense there is a monitoring of some of cohens communications, including his email. Earlier today, i talked to giuliani, and he described the federal treatment of cohen as heavy handed. He also said he is calling on the justice department, jeff, to close the entire russia investigation down. Glor Major Garrett at the white house. Major, thanks. Rikki klieman, joins us, our cbs news legal analyst. Rikki, always good to have you. There is a difference between monitoring and listening to these calls. What is it . One is a wiretap and one is a pen register. And when you have a pen register what, it tells you is the to, the from, the duration, the time. Now, that can show us a pattern of activity. It would be fine to have a pattern of activity between Michael Cohen and donald trump. You had a lawyerclient relationship, or at least a fixer and a fixee relationship. Glor lets talk about what giuliani said last night. He also spoke to Major Garrett this afternoon. He says this repayment was made through monthly retainer fees. Is that how retainers work . No. When a lawyer charges a retainer on a case, or for a number of matters, the lawyer says, id like you to pay me x number of dollars. And that goes to be billed against the lawyers time. You keep a time clock of how you spend your time. It also may go towards some expenses, whether its supplies, fedex, or whether its an expert witness. It does not get used to pay a settlement, especially a settlement the president still says he didnt know about the contract, the agreement, or anything except the fact that at some point he knew there was some money paid, and then he was going to pay it back through the retainer. Shoppers and workers ran for their lives in nashville today when shots were fired inside a mall. That led to a large police onsponse. Demarco morgan is following this story. sirens reporter shoppers at nashvilles Opry Mills Mall found themselves running to the nearest hiding place after a gunman opened fire. I did not know what to do besides run into somebodys store. Tmean it was just crazy. Reporter soon after the shooting, Nashville Police tweeted out the shooting appears rs be the result of an ongoing dispute between two men. Authorities say the suspected 22yearold shooter ran outside the mall to a Ticket Office where he surrendered this gun to a retired Police Officer. Nashville Police Spokesman don aaron that Police Officer took possession of the gun, directed the gunman to go outside and to lie prone on the ground, on the grass. Reporter the victim was taken to a local hospital, where he was pronounced dead. The incident comes after the april 22 waffle house shooting oc nearby antioch that left four people dead. The tennessee Highway Patrol just happened to be in the mall parking lot today conducting motorcycle training, so they were in the right place to assist Nashville Police with the tiooting. Glor the right place at the right time. Demarco morgan, thanks. It turns out the military cargo plane that crashed in georgia yesterday had just completed routine maintenance. Nine members of the Puerto Rican National guard were killed. They leave behind 17 children. The cause of the crash is not known but its the latest in a surge in accidents involving military aircraft. Heres david martin tonight. Reporter military aircraft are falling out of the sky. Yesterdays crash that killed nine members of the puerto rico National Guard involved a c130 cargo plane that was more than 50 years old and on its way to be retired in an aircraft bone yard. Last year, 15 marines and one sailor were killed when another c130 experienced what the commandant of the marine corps called a mechanical problem and fell from 20,000 feet. So last year we had a horrible year. We had a horrible year. Reporter wrecked aircraft litter the landscape. An analysis of Accident Data obtained by military times found a nearly 40 increase inen cingressional spending limits asown as sequestration went into effect, and by one estimate, cost the pentagon 147 billion over five years. The accident rate for the navys ne18 super hornet more than doubled. But most of those were relatively minor, happening during routine flight deck or runway operations. Weve got to stop doing stuff on the ground that causes us to lose otherwise perfectly good airplanes. Reporter no one is killed, but the aircraft has to be taken out of service for repairs, setting off a chain reaction. Thats reducing the number of airplanes we have. Thats the stuff we have to fix, too. We want to be able to fly more, because if we fly more we should become more skilled and fewer class as. Reporter class as, often the fatal accidents, involve pilot error. The 2015 crash of a marine helicopter in california was blamed on faulty installation of an oil filter cover. But the investigation sailed the two pilots, both of whom died, ignored a warning light that should have prompted them to land immediately. The military says it needs more flying hours, more spare parts, and newer aircraft. But it also has to reexamine its own procedures to avoid these needless accidents. Jeff. The Washington Post reported today that 27 more women have come forward to say they were harassed by rose, 14 of them at cbs news, 13 elsewhere. The posts initial investigation of rose led to his firing by cbs last fall. More from bianna golodryga. Reporter cbs news management, the Washington Post reported, was told about roses behavior toward women on three different occasions, going back to 1986. Todays allegations in the post include groping, indecent exposure, and initiating inappropriate sexual conversations while rose was at programs, including cbs night watch, 60 minutes 2, and 60 minutes, as well as cbs this morning. In one case, the post cited, rose began take a 24yearold employee to expensive lunches and suggested other job opportunities. It was brought to the attention of the morning shows executive producer, ryan kadro, who said in a statement he was not told about any inappropriate behavior. A cbs news spokesperson said kadro determined it was a job interview. Response to the post article today, cbs news said, we cannot corroborate or confirm many of the situations described. In a separate statement, jeff fager, executive producer of 60 minutes and former cbs news chairman who hired rose two separate times said, he was one of the best interviewers in the country. Period. Glor a cbs news report about a rare eye cancer affecting groups of people in alabama and North Carolina is getting reactions from around the world tonight. Hundreds say they or someone they know has been diagnosed with ocular melanoma and that anna werners report this week gave them hope. Heres annas update. We have had people reach out to us from ireland, south africa, australia, all over the nsited states, offering support, asking questions. Reporter that reaction, coming after Ashley Mccrary and three other Auburn University graduates told us of developing a rare eye cancer called ocular melanoma. I mean, its like you had just had the breath knocked out o you, you be. Reporter three had to have an eye removed. That was very hard for me. You know, growing up, the one thing that. Reporter the rare cancer typically occurs in just six out of every one million people, so e e groups found in auburn and in huntersville, North Carolina, are extremely unusual. Doctors like Carol Shields at Wills Eye Hospital in philadelphia are trying to find the cause. We need to really carefully go through, you know, exactly e ere they lived, what foods they like, how close were they to a nuclear reactor, how much time did they spend outside . A. , fingerprints and body photographs of the suspected golden state killer. 72yearold Joseph Deangelo is accused of a string of murders and rapes committed decades ago. A d. N. A. Match on a genealogy website led to his arrest, which now has investigators reexamining other cold cases. Heres carter evans. Reporter it was an unconventional approach that landed Joseph Deangelo in court decades after his alleged spree of murders and rapes. Investigators entered evidence from the golden state killers cases into a genealogical lotabase, and through links with several distant relatives, they were able to track down deangelo. Now, that same technology could help solve some of californias most notorious cold cases, including the infamous Zodiac Killer murders. It will break it wide open. Reporter jim jaksch has spent most of his career on the zodiac task force, hunting the man who 50 years ago terrorized northern california. The Zodiac Killer boasted about killing as many as 37 people, and taunted police by sending them cryptic letters.
