sunday. locally we have some sports news as well. the golden state warriors, water front arena, it sounds like it will maybe be put on hold for a year. it doesn't look like they'll make the 2017 deadline. we'll talk about what is behind this and what's in store. >> that is new information this morning. president obama made some big commitments in his state of the union address to the country. we'll sit down to see if the president is a lame duck or if he could fulfill the big goals. >> we'll talk a bit about the changing california congressional delegation, big names are pulling out. we'll have the impact. >> we have a lot coming up. but the rain is good news for the bay area. it is falling right now. let's take a look at our doppler. this is a rain that's been falling over the last couple hours. you can see light to moderate. we'll see that continuing throughout the rest of the day. you can see a few rain drops. looking at the bay bridge, these are your current conditions, 42 concord, 48 san francisco. carry your umbrella today. we are going to see showers on and off for the next several hours. it's also going to be a little breezy out there with even the chance of a lightning strike. we'll have more details on that and the possibility of more rain ahead for your work week coming up. >> in developing news a violent night in west oakland. two are dead and police are looking for clues this morning. the shooting happened on 24th and market street. shots rang out around 10:45 last night. police have few leads at this point. it's unclear if the victims are adults or teens. there is no information about possible suspects either. police in napa are investigating murder of a 4 year old girl and they're looking for this couple. sarah krueger is the victim's mother and ryan scott warner is krueger's boyfriend. they were last seen leaving an apartment on wilkins avenue yesterday while carrying luggage. three hours later police found the girl dead in a bed inside the same apartment. they say there are signs of foul play at this point. krueger and warner are wanted for questioning. call napa police if you know where they are. new this morning, there appears to be plenty blame to go around in the death of lynn spaulding. the 57 year old went missing at san francisco general hospital last september and was found dead in his stairwell two weeks later. a federal report says both hospital staff and sheriffs department made mistakes. the san francisco chronicle which got the report says nurses failed to carry out written orders to watch spaulding around the clock and sheriffs deputies did not check all the hospitals' stairwells as ordered. autopsy found spaulding died of dehydration and liver problems. the reverend al sharpton will be in oakland to open a chapter of his civil rights organization. the national action network aims to address social and economic injustices experienced by african americans. he will be speaking on telegraph avenue at 10:00 am today. agriculture is taking a big financial hit from the drought. the lack of rain could cause california farmers and ranchers $5 billion in revenue. with water at a premium everything from milk and beef to basic crops could be harder to produce. for more on the drought here is anne and phil. >> despite the rain the state drought has gone from bad to worse. >> it looks like the tri valley will be among the hardest hit in california. >> 80% of the district's water normally comes from the state and that's cut to 0. >> it is drastic. it will be a severe hardship to the communities that we serve. >> a special water district that contracts with the state to bring sierra water here. luckily they have been saving water but there is concern that the water in the district back up reservoir will end up too salty to drink. this news is capping off a week of concerning drought revelations. >> we are projecting no water to be delivered if these conditions persist. >> that means water districts tapping into the state water project need to come up with other ways to keep faucets running. the state's largest reservoirs are at 36% capacity and with 750,000 acres of farm land depending at least partially on reservoirs like these it's going to be one of the toughest years on record for agriculture. >> we got a problem. as governor i am responsible for the whole state so i am going do my best to unite the state. >> 17 communities statewide could run out of water in the next few months. southern california water officials met with the governor to talk about how extra reserves in the south could help communities in the north and president obama personally called the governor offering federal assistance. >> he pledged his support to help california. >> several local water agencies are calling for cut backs in use. the marin district, mandatory 25%. santa clara, voluntary 10, two more, a 20% voluntary cut. san francisco puc which water to several other agencies services 2.6 million users in the area. it's asking for a 10% cut in water use. >> it won't be that long before if things do not change we will start to seriously consider higher levels and consider swallow. a new tax proposal on both sugary soda and other sugar sweetened beverages. the money would go to health programs focused on nutrition and physical activity. some are skeptical about paying more for their soda fix. >> i don't know if the government taxing people anymore than they're taxing us would really help the situation. >> the approach is similar to the approach we took with tobacco taxes. >> scott weiner and three others came up with the soda tax proposal. american beverage association has spent millions to defeat similar legislation in other places like new york and richmond. is it feasible to think it would pass here? >> it's got a good shot. san francisco is a progressive town and don't mind saying yes to taxes like this. one of the questions however is where is the money going to go? >> the people against the tax are saying at this point it is based on faulty science because obesity is caused by the number of calories you consume, not where they came from. >> they figure sugar drinks account for about 10% of obesity. that leaves 90% of other causes out there. if you can put big tobacco, big oil, big sugar, it's a political target. this is a political move. this is politics involved. >> it doesn't seem like it's that popular with the people. how is this a political move? >> because it is being put in front of the voters for ratification. they could outlaw the soda tax, right? they could outlaw sodas if they thought they were that bad. it's a political move. you grab a target you think you will win with and they think they can win with sugar. >> volcano. a series of blasts thundered yesterday and just a day earlier authorities had allowed thousands of people to return home believing the danger from the volcano had receded. rescuers found a body today about two miles from the peak. bad timing for woody allen with charges of sexual abuse surfacing again against him. he is nominated for best screen play for blue jasmine filmed in san francisco. in an open letter on the new york times blog his adopted daughter accuses allen of sexually abusing her when she was 7 years old. a 1992 investigation already concluded that pharaoh had not been -- farrow had not been sexually abused. the team is saying they will not open in 2017 as it had been envisioned. this comes as cost estimates have doubled. >> this is one of the most ambitious not just sports development deals we have seen but buildings we have seen on the west coast i think in history. the latest with the project, we are sitting with rick welts, president of the bar i can't remembers, what is behind the decision to hold off for a year? >> i think what's behind the decision is we are doing what we said we would, fully embrace public input, regulatory input and as a result it takes longer to complete. so we'll open in 2018. >> how did you pick the 2017 deadline? was that just something out of the air? >> no, it was possible do if everything fell in place at the right time. in sacramento they announced a year after we did that they would open earlier. a time line is do-able. >> what makes the site so appealing? >> access to public transportation is number 1. there is no site west of the hudson as transit rich as this site is. it is on 13 acres of piers falling into the bay now mostly built in 1912, gives us a chance to bring 13 acres of the city back to life not just for the warriors. this will host all kinds of events from entertainment, business and provide all sorts of ways for the city to interact. >> it's such a massive undertaking. you just said it, 13 acres, not next to the water, on the water, on crumbling piers. you are finding out that the cost of rehabbing the piers is double. people are saying do they have the money? and are they nuts? >> well we do have the money and no we're not nuts. all right. this is about what the current warriors ownership group wants to accomplish in creating something great for the bay area in terms of warriors franchise. if you look at everything we said we would do every single one of the things has happened. finance is the last of the problems. we are comfortable with the project as it stands today, even as expensive as it is today. we'll get it done. >> one of the reasons for delay had been redesign, trying to accommodate various coastal commissions and such. are we going to see more redesigns? >> we have committed to take all the public input available. we have had over 100 public meetings. we have cac, community advisory committee meeting monday. that continues. we have regulatory input. we'll create a project san francisco is proud of but it requires taking time to incorporate suggestions into our design which is what we have done. tomorrow a group of san francisco ans is going down with 15,000 signatures to go on the ballot saying if you want to build the water front arena you will have go to the voters on height limits and say we will exceed height limits. where do you stand on that idea of this proposition mandating that you have to go to the voter in his. >> we don't have position on that yet. first things first, we want to see if it qualifies, how it affects the project. this is not a warriors focused initiative. this affects all developments on the water front, whether it's pier 70, the giants project, it would affect all those. we will take a look at that. we have fully embraced the process from day one. if the rules are going to change we will embrace the process as rules change. >> some people have suggested as it stands now for you to finance the deal without public money you are asking for permission to build a condo tower across the street and a hotel and use that money to help pay for the arena and the work. some people have suggested knocking those off the project in order to pass easier. are you thinking about eliminating the hotel and condos? >> we are looking at everything we are talking about. again this is across the street. they are not on the piers. >> so you are taking a look at getting rid of the hotel and condo. >> we will certainly listen to any ideas. remember this is the path the city gave us to have the ability to invest $180 million of warriors money in city infrastructure and rehabbing the piers. there has to be some value derived from that. what that's going to be we are not 100% committed to. we want to listen to what people have to say is the best use. >> it's very interesting. it is tough to peg you down. i have to say that, yes or no, you are still studying, still looking. i will ask you an easy question. broncos or seahawks? >> i am rooting for the 49ers to be back in the super bowl next year. >> have you ever thought of running for public office? i think you would be a natural. we'll have you back because this arena will be the center piece of san francisco and bay area talk in the coming year. thank you rick. >> thank you. >> we know one guy who does not mince words, our will be six more weeks of winter. while we don't have punxsutawney phil we have doppler radar and we have anne. >> let's take a look. we actually want six more weeks of winter because we need more rain. it has been falling for the last several hours. that's what you are seeing there. we see the areas of yellow and green meaning light to moderate rain around the bay area and also arrival delays at sfo of up to two hours. here is what we can expect. the rain will continue on and off until the evening hours, slight chance of thunderstorms, and the rain will be ending late tonight. these are our highs today. you can see significantly cooler than we saw last week at this time. also a little breezy in the 50s all around the bay area. a dry monday and tuesday and then another chance of rain later in the week on wednesday and thursday. we'll keep our eye on that. it all spells good things when we talk about this drought we have been dealing with. >> thank goodness rain is here. super bowl raise. >> her trip follows retirement of henry waxman and george miller, two known for raking in big dollars. >> they've got a little while longer to go on terms but it will have a big effect not only on california delegation but also on the democratic politics nationwide. that's why we sat down with former state assembly speaker willy brown and said what do the losses mean to policy and politics? >> two things it means for the state. one, we have lost two powerful figures and great voices on subject matters that affect the lives of people in this state particularly on the liberal side of the isle. >> george miller was big on the environment. >> and lions bore. >> mr. waxman is big on healthcare and in particular hiv and aids. the two represent a formidable force on the policy side. as important if not more each of them represent tremendous fund raising abilities for redistribution to democrats need. >> why? how does somebody in los angeles and somebody in concord represent a huge wealth of campaign contributions? >> you raise money phil based upon your status and the congress, your positions, your titles, and the influence you have been able to develop with the people who donate money. each of the persons for 40 years have been at the top of the crest for nancy pelosi. >> so they would raise money and they would then funnel it to nancy pelosi and she would spread it to contested races where they need money. is that it? already or go through democratic national committee or congressional campaign committee. in each category candidates in states where they don't have resources get help. >> what effect does this have on her? >> it makes it far more difficult for her to counter all the resources she needs. that's why you see michelle obama in town now. >> because she's sort of trying to pick up the slack? >> absolutely. if say those two guys were responsible for half a million each or a million each per year suddenly that's got to come from somebody else. you are not going to get it from just barbara bee, lund and two or three others. >> the people replacing these two, they won't be able to raise that. >> from a political standpoint the two replacing them will be on welfare. >> it's not just these two, other congressional senior people are starting to say enough is enough. i have done my time. i am moving on. it's going to effect the entire party in would give convicts a better second chance you might say. it is basically prejudice that remains against people who have committed crimes part of a growing nationwide movement now called ban the box prohibiting employers or landlords from asking applicants up front about their criminal history. >> we are also going to be talking with san francisco mayor he had lee. there is big questions about the middle class and the nation in the bay area. we will talk about affordable housing and we'll talk about the obama administration's plans for middle class and the chances of anything passing. >> the rain is falling outside now, we are still in the extreme drought situation in california. we are finding new information and concerns about the tri valley could be one of the hardest hit areas in california. we have more details on that and lots coming up. let's start with mark. >> our top story is the rain, widespread throughout the bay area and northern california. right now rain is light to moderate throughout much of the area so you are going to need an umbrella when you are headed out of the door. be careful driving too. the roads are pretty slick. here is a live look at the bay look at your top stories. back to you. in keeping with the weather and drought california department of water resources is getting stingy with water supply. it turns out that the state won't be funneling a drop from reservoirs to local districts this year. the bay area's tri valley is one of the areas really in need of water. >> that's right. the communities that are thirsty for every last drop. >> irrigation water continues to flow in this dublin office park. reality hasn't subject in yet. but other residents are about to feel some drought pain. 80% of the tri valley's water normally comes from the state and that's been cut to zero. >> it is drastic. it will be a severe hardship to the communities that we serve. >> the general manager of zone 7, a special water district that contracts for the state to bring sierra water here. she says they've been saving water for drought year, recharging and conserving allocations. dry as it is, it may still be the tri valley's safety net. >> from last year we tried to conserve what water we could. that water is being transferred to the extent possible into lake dell val so they're pumping into the lake and then it willing available locally if they have to stop pumping through the delta. >> what's happening with the tri valley drought and loss of state water is being repeated in districts across california. >> we have 17 agencies across the state in danger of running out of drinking water in 60 to 100 days. >> even though water agencies like zone 7 may have unused allocations due them they may cut that too if it gets too salty to drink. >> the impacts will be largely on landscaping. we have enough in the basement, well capacity, to serve public and health safety needs of the community. >> residents will be asked to cut back water use 20%, maybe more if rain or snow doesn't arrive in the sierra any time soon. >> it's not just a lack of water. there has also been an increase in demand. the tri valley for example has more than doubled people in dublin and other areas. i tri valley has seen incredible growth in population. the number of people in dublin has more than tripled since 1980. next door pleasanton has doubled the population as well. >> still doing okay with water supply despite the drought. they expect cities and farms to get water they need. if dry conditions continue, a few cities like may have to buy water. while they may be in good shape officials urge people of course to conserve water. at what point does a convict deserve a fresh start? >> that's a big question san francisco is mulling over along with prohibiting landlords and employers from asking applicants if they were arrested or convicted of a felony. supporters say since housing and jobs are more difficult for ex-con six to find they might turn on the wrong path and feel defeated about return to society society. >> here are the details. no up front inquiry about criminal history but you could ask after the first interview or after offering someone a job. some things would be off limits completely like erased convictions or those older than seven years. this is an issue that i think people have gut reaction to. in some ways you want people to have a second chance but do you want a convict living next to you? do you want one working next to you? >> this doesn't say you will have a convict living next to you. >> right. >> this says initially, in the front door. the feeling is if you check that box you are just shot off the list without being able to give an explanation. sometimes they have a line in there that doesn't explain things. this would say you can bring it up in an interview or something like that and you get an explanation for it. that's all this does. >> so you think this has a chance? >> i think this has a good chance of passing in san francisco. >> okay. we see it in a couple other cities. >> we'll see what happens. >> tesla is making the drive east where they're planning certainly caught me off guard this morning. president obama declared 2014 will be a year of action in his state of the union address tuesday. >> here are his four focuses, creating new jobs and manufacturing, energy and innovation, training americans to fill the jobs, access to education and increasing minimum wage. >> we all watched the state of the union address. one person who was right there in the room is congressman eric swellwell who joins us. i have thought the president is up there laying out the agenda and you are sitting there looking around and you must be clicking in your mind that's going to happen, that's not going to happen, that's going to happen. let's look at this. immigration reform front and center what will we see? >> we are in the red zone now. to use super bowl analogy i think one issue is the road map to citizenship and republicans are accepting legal status. >> for people here illegally, they're ready to give legal status. what about citizenship? >> i think we have to get on the same team, same playbook now because for me i don't want to have a second class citizenship in our country. i think we have the votes in the congress to have a road map to citizenship. i think that can pass. right now i think the speaker has to throw a few bones to the most extreme members of the caucus. if he puts it for up or down vote in the congress it will pass with democratic and republican congress to have a road map. >> that's one. unemployment, extending? >> 300 and counting are losing it. i hope we can bring it to vote. it will have to come up in the senate. they weren't able to get it passed. if we do, there is more momentum in the house. >> so that doesn't look good. >> unfortunately now we need the pressure up. >> minimum wage? >> $7.25 now for federal living wage. that's not a living wage. that's $15,000 a year. we are pushing for $10.10 over the next years. it's not looking good. but we have to keep the pressure up so people know with housing and medical costs and everything going up, minimum wage staying flat. >> i want to change gears. henry waxman and george miller announced they were retiring. in part i suspect it seems like it's just a tough job. it's wearing on them. it's interesting. we just had statistics that showed over 50% of congressional representatives are millionaires. what is so tough about being in congress? >> most of the millionaires were millionaires before they went to congress. i am about 415 out of 435. i am at the bottom end of that. but george miller and henry waxman, two lions of the house. we will miss both of them. if congressman miller has a vacancy in the house he rents out i would like to apply for that. >> he rents his house and has four roommates that live with him. >> he has chuck schumer and dick durbin, two others. >> where are you? >> i rent a room ten minutes away from the house. i fly back and forth. i do three nights a week in washington. >> you don't get living expenses? >> no. >> do you get parking free? >> no parking where i live. i have to pay to go to and from work like everyone else. my father will get these crazy spam e-mails that say congress gets free pensions for life and you don't pay social security, get free healthcare. all not true. i have do all the research and send it to my dad and say no these are misconceptions. it's not true. we have to pay for is all about football but giants' fans are looking ahead to baseball season. i was at att park yesterday as thousands poured in and around the park for the giants annual fan fest. >> at&t park taken over, baseball fans lined up for hours on the famous filed to see their heroes for a moment. they aren't a bit shy about who they like. >> hosey. >> that's your guy. >> he is my man. he is wonderful, beautiful. look at him. >> how long would you wait in line to see hunter? >> two hours i think obviously. >> reporter: many did just that to snatch up an autograph or pose for a picture at the plate. others like norman mall wanted just a moment to test ride his favorite seat in the house, the dug out. >> i got to stand where they stand during the game at the corner. it's a very cool day. >> reporter: for the players all the love is reciprocal. >> it's fun to interact with the fans. it's the feeling of getting back into baseball. >> when it comes to being into baseball the hernandez family certainly steals the show. at the least they take home the award for creativity. >> i just want romo to sign my ring. >> reporter: fan fest feels different than opposing game, no team, no scoreboard, no hanging onto your seat. just pure giants pride and of course a gut prediction or two of how the new season will play out. >> i think they're going to do very well because they've kept key people. >> we picked up hudson and morris. we're going do great. >> mark kelly, kpix 5. >> what a fun day. >> not a bad story to handle. >> i gotta hand it to the giants with marketing and fan involvement, whether it is runs around the park, parties, these events, they know how to keep them going. mayor ed lee was in washington for the state of the union where one of the themes was how to help the middle class. >> one of the biggest challenges the mayor is facing is sky rocketing rent and housing prices forcing the middle class out. >> we sat down with the mayor on his return and said okay what do you plan do to try to help with the problem? what's your top drive this year? >> housing, jobs, transportation transportation. all those things are important and i will keep working really hard. i think we can open up 6 to 7000 units of housing ready to go. they're already under construction. phil we're only 49 square miles so unless we build more housing the pressure on the existing housing stock is going to be higher and more because people want to live here. >> not just people around here. you are dealing with globalization. when we see high rises downtown, a lot of people see apartments. if you are a foreign investor, you see basically a safety deposit box where you can park 500,000 to $1 million in real estate value if you buy in and it's a lot safer than keeping money in india, china or indonesia. we are competing with that market as well. >> absolutely. that's why it cannot act alone. my counterparts in oakland, san jose and santa clara so they build enough housing particularly around the transportation corridors that we have been building. >> your problem is while oakland becomes brooklyn to your manhattan or san jose becomes connecticut to your new york, the people in the city feel like they're getting priced out. >> well if we don't build more housing, and by the way we've got to change some of the ways in which evictions happen, protect long term ten abilities, but if we don't build that problem will get worse. >> when you say affordable to a lot of people that's a combined income of under $70,000. come on you know in san francisco to be middle class by your measurements it's 80 to 100. the middle class doesn't qualify for affordable housing and can't afford market housing. >> middle class in san francisco probably ranges between 75,000 to 150,000. they're being priced out of two or three bedroom apartments and housing. that's the kind of housing you want to build. that's what we are building in hunters point shipyard, treasure island. these are the types of houses you want to build. when we are doing that people are already saying by the way, we like what's happening in the public school system as well. those two things are the most important things for all residents including the middle class to want to stay and grow here. >> on this foreign investment, is there anything good about that? >> it brings in money for buildings but it is one of the situations where housing in san francisco is a good investment. it's stable. it's going to appreciate. so if you are looking to park money, this is a place do it. it puts pressure on the housing bill. we are only about 48 or 49 square miles. the mayor is scrambling to find more land. but in some of those whenever they have availability the people applying for it is 3 to 5 times available. >> what can we expect? >> it's going to be tough. they're going to try to make it easier to build housing in san francisco and try to drive down cost. the other thing we are famous for is regulations. >> regardless, it's going to take a long time to make an impact. >> it is. >> all right. we'll have more after the break. i miss my sister. i miss my old school. i miss my
