The take away is that if you have an open container that you can go to a restaurant and have a glass of wine and have a bottle left over and if you bring it home, you can stick it in the back seat instead of in the trunk. You can get an infraction for that. It should be the same if you are smoking a joint or drinking while driving. We want to make it more serious because thats what it is, a more serious offense. If you are drinking and driving, you could be impaired in your ability to drive and we think it should be and misdemeanor or an infraction. Let a judge or District Attorney decide how serious or egregious the violation is. It could be a misdemeanor. We are trying to add that today. At the end of the day, we want to stop Impaired Driving. We lose individuals from Impaired Driving and we want to prevent that. Reporter how is it just now coming to the forefront . With proposition 64, it was left out. I think it was unintentional. I think they thought they covered it by having an open container. In reality, thats not going to work. We need a separate bill and separate legislation and a separate law just like we have with drinking and driving and an open container. Two separate violations in two separate laws. If you were to have an open container or you are driving or drinking with an open container, it could be at the discretion of the District Attorney. You are charged as an infraction or a misdemeanor. It is pretty serious if you are drinking and driving or drinking and smoking marijuana, that is serious. That could impair your driving very easily and quickly. It should be a little more serious than a traffic ticket. Reporter it is interesting there are opponents to this bill. You cannot have an open container and drive under the influence. They say it is redundant and why do you need this . Is the same thing with alcohol. We want to be consistent. First that driving is as safe as possible and that the laws consistent.
