davis. we'll have more coming up. a broken pipeline in central california off the coast spilled thousands of gallons of oil off refugio state beach in santa barbara county. anne makovec has the latest from the newsroom. >> reporter: the coast guard is going to send up a chopper at sun-up to see how far this oil may have already spread. they estimate that about 21,000 gallons of oil spilled into the ocean when a pipeline broke. it stretched for four miles of beach last night and 50 yards into the ocean. a whale was spotted swimming in it yesterday. this is near refugio state beach as. the broken pipeline sent oil into a culvert that ran into the ocean. the clean-up has begun but the level of damage is unknown. >> we plan to do a first light overflight with a helicopter to determine if the oil has moved. there are wind projections that say that the oil could move two to four miles south down the coast. >> reporter: the company which owns the pipeline, plains all american, shut down that line and is promising a full investigation. >> plains deeply regrets this release that is occurred and is making every effort to limit its environmental impact. >> our focus remains on ensuring the safety of all involved no injuries have been reported at this time. >> an assemblyman from the area says the spill went undetected until santa barbara county firefighters traced powerful gas smells to that area. he plans to speak out from sacramento about it this morning. live in the newsroom, anne makovec, kpix 5. orinda mayor steve glazer will become the newest state senator from the bearing winning a runoff ee -- from the bay area winning a runoff election last night. defeated assembly member susan bonilla by 9%. supporters cheered him in orinda last night. he will replace mark desaulnier who was elected to congress. glazer will have to run again next year when his seat comes up for re-election. one big issue in the campaign, glazer's call for an end to all bart transit workers' right to strike. labor unions were backing bonilla. a proposed water deal could become a model for farmers throughout the state who are facing tough water restrictions. farmers near sacramento are offering to cut their water use by 25%. they hope to avoid more cuts in the future as the drought continues. under the proposed deal, farmers would take less water for irrigation or leave a quarter of their crops unplanted. farmers are meeting with state official later today. 4:33. a full check of weather now with roberta. and the song remains the same? >> it is. but yesterday we had and the mystic news. we had the climate -- we had some optimistic news. we had the climate center telling us we have a 90% chance of a rainy summer. i'm cautiously optimistic. we saw the same report last year and then saw drought in the winter. but i received telephone calls for quotes all day yesterday and especially concerning the farmers because they are watching this el nino report very mindfully. good morning. we'll see a little bit of drizzle to maybe some moderate drizzle but it's all associated with a very deep marine layer. west winds at 13 in oakland. we could see wet roads due to the condensation associated with the marine layer. temperatures all in the 50s around 8 a.m. not much of a change as far as the temperatures span is concerned from yesterday. we'll have the full report coming up. >> out the door, so i had mentioned a bad wreck in pinole. it was a car fire fully engulfed multiple lanes blocked. everything cleared around 4:00. so now everything looks okay on westbound 80. it was all happening before the pinole valley road exit. everything looks great out of hercules with 62 miles per hour and you continue to move well down the eastshore freeway. here's a live look once again at 880 in oakland. it's a little farther south as you head into san leandro right there between marina and davis where you may still hit some overnight roadwork. it's scheduled to wrap up by 5:00. this morning, it's northbound and southbound on the nimitz freeway. that is "kcbs traffic." back to you guys. >> thank you. cruise ship that ran aground with nearly 3500 people on board now anchored off bermuda. the norwegian dawn it just set off for boston yesterday when it hit a reef. it was stuck for more than 6 hours before rising tide enabled it to move into deeper water. norwegian cruise lines says the ship is now waiting for an inspection by experts before it can move back on the water and up to boston. it is the largest automotive recall in u.s. history. japanese auto supplier takata announced yesterday airbags in nearly 34 million vehicles are defective. the airbags are linked to at least 6 deaths and dozens of injuries. ten automakers have already recalled about 16 million vehicles in the u.s. because of faulty airbag inflaters from takata. >> takata still hasn't identified the root cause of the defect. but we cannot let that delay our actions. >> consumers can check national highway traffic safety administration website for more information. the driver who led police on a chase from concord to berkeley sunday night called 911 asking the officers to call off the chase. kpix 5's andria borba has the story. >> reporter: it started in concord when officers noticed someone driving a stolen honda. >> wrong way on the freeway westbound 4 off the port chicago. >> reporter: the wound went through the bay area hitting highway 4, 242 and even i-80 all going the wrong way scaring drivers. >> i almost got head oned by some maniac driving to drive in the slow lane going the wrong way on highway 4. >> i'm on speaker phone right now. [ screaming ] stop chasing me! i'm going to crash! >> okay. are you the driver driving the wrong way? >> yes, i am! now, stop chasing me! [ screeching tires ] >> justin, you need to pull over. >> i can't pull over, lady! >> reporter: the driver apparently named justin was right. he did crash in north berkeley at the corner of first and california. andria borba, kpix 5. >> the driver ran off after the crash in berkeley. they know who he is but he hasn't been caught. a high-priced prostitute has changed her plea in the death of a google executive. alix tichleman pleaded guilty yesterday to involuntary manslaughter for giving forrest hayes a lethal heroin dose. surveillance video obtained by "48 hours" showed her making the injection on hayes' yacht in november 2013. yesterday, tichelman received a six-year jail sentence. >> as graphic and horrific as the evidence here is, her callous indifference about a person who was probably in the this rose of death when she -- throes of death when she casually walked over him, it is still involuntary manslaughter with no intent to kill. >> prosecutors say both families wanted the case closed. tichelman reportedly asked her defense attorneys to make the plea deal. police in waco, texas say that deadly shootout involving the rival motorcycle gangs started over a parking dispute. it escalated when someone ran over a gang member's foot. that led to an argument inside the restaurant with fighting followed by gunfire. when it was over, nine people from two gangs were dead, 18 others were wounded. officers confiscated 50 weapons and arrested 170 bikers. there's now a criminal investigation in connection with a mountain lion search in san mateo. a 90-pound mountain lion which had been roaming a neighborhood was brought back to its natural habitat monday. but before police and fish & game wardens moved in to tranquilize the animal investigators say a man emerged from an apartment complex and fired a shot. >> his explanation was that he thought he was trying to scare off the mountain lion. in light of the circumstances it was poor judgment. >> no charges have been filed. the case will be referred to the district attorney's office. just getting going on this wednesday. 4:40. still to come, actor bill murray joining david letterman one last tight before the veteran hose -- host signs off late night television. >> panned what's cool about your school? we can still see everything. >> and they saw quite a game. we'll highlight it later in morning sports. game 2 is thursday night in oakland. >> they scared me when they were down 12. >> they had a slow start in the 1st quarter but they came back! >> i was out running yesterday at 4:15 a girlfriend calls me she goes, i got two tickets. let's go to the game. i was like five miles into a run. >> i'd come back and get over there. >> it couldn't happen but i enjoyed watching it instead. had front row seats from my living room couch, right? out the door this morning, what a happy day after a big -- should i say what happened? i guess i can't say what happened the outcome of the game. let's give you the outcome of your weather forecast for today. see that right there? that gray slate. we are going to be experiencing that again as we take a look at the blue and gold lights lining the embarcadero. temperatures uniform due to the deck of the clouds 3,000 feet deep at this hour. because the marine layer is so deep even though it's poorly defined we'll have light to moderate drizzle. so the roads could be wet out the door. below average temperatures again today. we have a daily chance of a light shower or thunderstorm in the forecast. this is an area of low pressure spinning to the east of us. it continues to prompt some showers and thunderstorms in throughout the high sierra. and then we have a long wave trough that's been going through the bay area. this as it ejects east will cause a lot of instability. therefore, i have to keep a daily chance of an isolated scattered very light rain shower in the forecast. once it moves out, after the holiday, we'll have a milder week ahead. and that kicks off by the weekend. here's our futurecast. watch the higher elevations light rain, and then thursday rain to the east of the morgan hill area. and we just kind of like hit and miss scattered light rain showers very brief but much cooler for this time of the year, as well. temperatures across the state today 70s and 80s in interior valleys thunderstorms possible throughout the high sierra through yosemite 61 degrees cool day in monterey bay. no clearing at the coast today in the 50s. partly cloudy inland. southwest winds 10 to 20 miles per hour. you want the abundance of sunshine? the best chances are over the weekend through the holiday on monday. temperatures more seasonal by the beginning of next week, as well. >> everything looks good for now on the roads. i mentioned an early-morning hot spot in pinole on the eastshore freeway. but now that that's cleared it's a clear shot way to hercules into emeryville. you can see all green on the sensors. if you are heading to the bay bridge toll plaza, everything looks good so far getting into san francisco. i mentioned some overnight roadwork. it is still out there and if you are heading to the dublin interchange, westbound 580 between hacienda and san ramon road they have the three left lanes blocked until 5:00 and then we are seeing the usual delays out of the altamont pass and on 205 but even with the overnight roadwork there approaching hacienda, it still looks okay as far as our live pictures go. obviously it's crowded for this time of the morning but all green on the sensors everything still moving at top speeds. the roadwork is still out there as well in san leandro northbound and southbound 880 between marina and davis. that's "kcbs traffic." back to you guys. a bear charged out from behind some trees right at a man in sweden. take a look at that. the man was brave. he screamed and waved trying to make himself look big to the bear and it worked. the bear turned around and went back into the woods. >> someone has an iphone? shooting that? i'd run for the woods myself! san jose city council is giving medical marijuana shops more time to comply with regulations. some new rules require dispensaries to be a certain distance from schools, parks and religious centers. they also prohibit marijuana use on site. and now the pot shops have until mid-december to comply instead of july. that includes going through a permitting and registration process. a san jose--based company is combining coffee or tea with marijuana. as betty yu shows us, business appears to be booming. >> reporter: when you brew caffeine and cannabis in a k- cup -- >> you will taste a gourmet cup of coffee or cup of tea, organic, um, fair trade and locally roasted. >> reporter: jill runs house of jane, a premium marijuana coffee & tea company out of san jose. >> this is where all the teabags, the k-cups. >> reporter: she started testing her ideas in her kitchen after a trip to amsterdam. >> we have four flavors in k- cups. >> reporter: since launching the product five months ago the k krups in high demand. we stopped by her processing center where workers package up to 1400 k-cups and 700 bags of marijuana teas in a day. they are sold in 120 california dispensaries. >> my favorite is the mocha. >> reporter: she says it's easier for patients to medicate with these kinds of drinks on the go or in public. her brand is about getting rid of the stigma. the "stoner" image associated with marijuana. >> our target market is mainstream. we not marketing at all to the barely legal. our products don't necessarily appeal to a pot head. >> reporter: next up for this company they are rolling out cannabis infused bottled coffee. they have already outgrown their san jose location. they are looking for a bigger facility in the bay area. in san jose, betty yu, kpix 5. 4:51. scary moments when a car bursts into flames. how one man's quick thinking h look at your tv screen and look at concord. temperatures averaging 10 degrees below normal for this time of the year. no clearing at the coast today in the mid-50s. partly cloudy across the peninsula, 60s swinging around to the santa clara valley up to 69 in morgan hill. we could see a 70-degree reading towards mountain house and in tracy. otherwise, mid- and high 60s the eastern portion of the bay area. southwest winds 10 to 20 miles per hour in bodega bay. 65 in san rafael. partly cloudy in sonoma. and we have a slight chance of a light shower in windsor at 66 degrees. heads up heading to san francisco international airport. northbound 101 a wreck blocking to lanes with delays. there was a stalled car and several other cars hit it more coming up. an army captain's training kicked in when he helped a couple trapped in a burning car. a witness captured the crash in north carolina last sunday. you can see the captain in the red shirt dragging the driver to safety. he broke the windows with a fire extinguisher and helped all three victims. the driver and the wife had been hit head on by another car. on capitol hill the house passed a bill to keep highway aid and transit aid flowing to states. lawmakers can't seem to agree on how to solve the infrastructure problems. a senate vote is expected later this week. the engineer of the train that derailed near philadelphia had only worked on the northeast corridor for a couple of weeks. ntsb officials are investigating engineer brandon bostian's actions leading up to the crash. eight people were killed and more than 200 injured when the train derailed last tuesday night. two leaders of fremont construction company could each get four years in jail after a jury convicted them in a worker's death. raoul zapata died when a dirt wall caved in on him in milpitas three years ago. yesterday, the owner richard liu and his project manager were both convicted of involuntary manslaughter. the deadly accident happened three days after a city building inspector issued a stop work order. new police recruits in san francisco helped catch two burglary suspects stealing items from a store. the recruits were on their way to an assignment for bay to breakers sunday morning when they witnessed the theft. 55-year-old dale brackner and 37-year-old cory lawler were arrested. police say both were carrying merchandise from the store. legal age to buy tobacco could be raised to 21?
