to be near their stuff which is in their vehicles and also near their pets which are outside because they can't come into the shelter. >> the government will reimburse the state up to 75% of what it spends. juliette goodrich shows us how residents are doing their best now to cope with this emergency. >> reporter: from the ground to the air, fighting the butts fire has been tough to tackle. hundreds of people evacuated except ron, who isn't leaving. >> it's like a war zone. >> reporter: he says he is staying put. >> in that way it came right down to the houses and i decided to stay. >> reporter: wendy has been checking the hillside hour by hour all day all night. >> it's very unnerving when you consider our house is just on the other side of the hill. it's very frightening. >> reporter: just as fast as firefighters knock out one spot fire, another flares up. and the shifting winds make the butts fire seemingly untameable at times. access to hot spots can be treacherous by ground. we learned that firsthand. this rancher taking us up a private access road to get a closer look. behind me is ground zero where the fire started. you can see essentially by those solar panels it quickly moved north and then over the ridge and then jumped over roadways. this smoke and charred-filled canyon parched by drought conditions. we're looking at what could be a summer-long firefight throughout the state. and it's all of this devastation -- amidst all of this devastation, there is a story about life. just before the fire started, this foal was born. both mom and baby had to be evacuated and it wasn't easy. >> it's a zoo. >> insane. >> it was insane. you got him. >> reporter: debbie gardner said it wasn't easy evacuating this mare and her newborn as the fire moved closer. >> it took a while, about a half hour, to -- mama had to go in first, and she didn't want to leave the baby. safe and sound now. and everyone's horses are fine. >> reporter: juliette goodrich, kpix 5. >> that will make it a little more difficult to fight that fire there. looks like the conditions there for the fire today a little breezier throughout the day and into the afternoon the sunshine. the temperatures are going to stay mild for this time of year. but the humidity this afternoon will be a little bit higher about 35 to 45%. the winds though this afternoon gusting to about 25 miles an hour. of course, you get through some of the canyons and that very difficult terrain, makes it hard to fight the fires when that wind starts to blow. all right, around the bay area today, we are going to see patchy fog to begin with this morning. the temperatures now in the 50s. by the afternoon, return to more sunshine. the numbers in the 70s and 80 in san jose, 84 concord, 81 in the napa valley and 66 degrees in san francisco. let's check on the roads where it's going to get busy liz. >> especially on 101 where the 280 closure started last night. first out to the bay bridge. if you are trying to get into san francisco from the east bay, everything looks okay across the span. the connector ramp in the maze still closed for about 25 minutes westbound 580 to eastbound 80 and you can make a u-turn in the bay bridge toll plaza parking lot. so for right now, if you are trying to get into san francisco from the peninsula, that northbound 280 closure went into effect at 9:00 last night still shut down from 101 to downtown. you can use the southbound lanes and that should say southbound 280 is open. you can use 101 as well as your alternate. right now all green. so everything looks good in both directions of 101 for now. no big delays. as lawrence said, that could change later on. and for right now as well, san mateo bridge also looks great at hayward. that is your latest "kcbs traffic." back to you guys. >> all right. thank you, elizabeth. illegal fireworks and dry brush have people on edge as we head into the july 4th weekend. this grass fire in antioch last night was caused by unauthorized fireworks. flames came dangerously close to park middle school. plenty of dry fuel on that hillside helped the fire quickly grow to about an acre and a half before it was brought under control. >> there are fuel conditions this year with the drought, extremely serious. so all the wildland fuels are very dry and the burning conditions are extremely dangerous. >> fireworks are illegal in all of contra costa county and most other bay area counties. >> and illegal fireworks such a big problem in one oakland neighborhood. people are now asking the feds to step in. this may look like a professional fireworks show but it's not. neighbors say every 4th of july fireworks begin when the sun goes down and they go all night in this neighborhood. >> fireworks themselves are great. i have always celebrated those. but these aren't just fireworks. these are extremely danger fireworks that are not meant for people in the neighborhoods to handle. >> we have got to respect the laws. we have got to respect our neighbors. we have got to respect the fact that this is a fragile environment that can catch fire at any time. >> the city is holding a town hall meeting on fire danger tonight at the diamond recreational center. two people hurt in campbell after a barbecue pit exploded there. it happened in a backyard of a home on briarwood way at cambrian drive around 10:00 last night. six girls were sitting around the pit, which was running on natural gas. debris from the explosion went everywhere but it didn't start a fire and no damage was reported. two girls had minor burns. san jose is ready to adjust some of its pension reforms to bolster its police force. some would be able to return with retirement benefits the same. another would offer a firefighter injured and misses work for a year to qualify for disability retirement. the proposals would need to be approved by the city's unions and then by voters. the fight over pensions and budget cuts have left the san jose police department understaffed in recent years. a newark motel in danger of being shut down just got a six- month reprieve. the e-z 8 motel is the only home that some people have. but many say it's a magnet for all kinds of crime. last night neighbors told a city commission that crime is spreading in the area and enough is enough. >> the crime is in the surrounding neighborhoods when they are breaking into our houses. when they break into my car, when i'm having dinner at bj's, when they're shoplifting over at the mall. >> planning commissioners gave motel owners a list of demands to improve their security. if nothing changes the motel could lose its business permit and will be forced to close. kpix 5 has learned of a second hate crime during san francisco pride weekend. police say this member of the group sisters of perpetual indulgence was attacked during a party saturday. the suspect yelled anti-gay slurs and punched the victim. today the jury in the bryan stow civil trial will begin a sixth day of deliberations. yesterday they told the jury they are deadlocked. but the judge ordered them to go back to work. they are reportedly stuck on the first question, whether the dodgers or former owner frank mccourt were negligent in providing insufficient security when stow was severely beaten outside dodger stadium. the mother of the former santa clara county paramedic says she understands how difficult this is. >> they have a job to do and whatever they come up with, uhm, i'm sure is going to be hard for them, difficult for them. do we hold it against them? no. >> stow's family has asked for $37 million to pay for his healthcare for the rest of his life. but his mother says she is prepared if they don't get anything. the a's deal is in limbo again. oakland city leaders say they will vote down a contract today that would let the a's play at the coliseum for another decade. >> and alameda county folks are not happy about this. kpix 5's da lin explains why the two sides won't play ball. >> crisis -- >> reporter: at last week's a's lease extension vote oakland was a no show leaving those chairs empty. this week, oakland councilmembers plan to show up to kill the contract. alameda county supervisor nate smiley admitted last week it's hard to work hand in hand with oakland leaders. >> this governance structure might possibly come crumbling down just as a result of these actions. >> reporter: it's so bad, miley says alameda county wants out. >> the county would love for the city to just buy us out. i have said that before. if the city buys us out the city can have total control over what happens. >> reporter: oakland councilman larry reid blames the county for the contract problem say they are forcing the vote knowing full well the city doesn't like the deal. >> i hope that we can act like grownups and not like bullies and not like dictators. >> reporter: the proposal says the a's would pay $1.75 million to play at the coliseum this year but the rent would drop next year to 1.25 million. also, oakland would have to forgive five million dollars the a's owe in back rent. the oakland city council says it's a bad deal and wants more money. reid wants a better deal as well but worries rejecting the contract will frustrate major league baseball. >> tomorrow is just going to be another black eye in the city of oakland. >> reporter: i'm da lin, kpix 5. >> oakland leaders do plan to present a counter-offer to the a's today. our sources tell us though that the a's owner lew wolff doesn't plan to give the city any more money than what's already on the table. the lease extension has out clauses for both sides which the a's could potentially use if and when they clear account legal hurdled everiles to build a new ballpark in san jose. the giants consider san jose their territory though and, of course, oppose the a's moving there. san jose has filed a lawsuit against major league strength in the atlantic and getting closer to land, too. emergency officials have ordered a mandatory evacuation for both visitors and residents on the hatteras islands on north carolina's outerbanks. people are being told to leave by road or ferry before conditions get too dangerous. >> if it's mandatory, you have to go. so that there's no decision to make. >> yeah. >> arthur is expected to bring high winds, rough seas and rip currents. it will likely give north carolina a glancing blow tomorrow on the 4th of july. farther north the annual boston pops concert and fireworks show have been moved up to today because of potentially heavy rain tomorrow from that hurricane. >> the 4th of july is such a big, big holiday on the eastern seaboard all the way up to new england. they are all going to get wet. >> all of them. this storm system could intensify. wouldn't be surprised if we saw it turn into a cat-2 so a serious storm system working its way along the east coast now. arthur a hurricane now and will likely strengthen over the next 24 hours so here we go. let's take you in for a closer look. a well defined eye looking back at you off the coast of florida just beginning to work its way a little further to the north now. sustained winds just at above hurricane strength at 75 miles per hour. gusting to 90. currently moving fairly slowly at 9 miles per hour but that would pick up speed as we head in toward the next 24 hours. and here we go. as we look toward the 4th of july, 2 a.m., looks like the outerbanks could get hit by arthur moving on land there. but just really skimming the coastline. the tide dal surge there may be about 2 to 4 feet causing serious damage. you're looking at a lot of rainfall up to 6" but then it moves all along the east coast bringing plenty of rain along the way and some strong gusty winds, too. so kind of a mess for the holiday there. all right. we have some low clouds and fog a little more patchy around the bay area this morning. as we look toward the afternoon, becoming mostly sunny again with some similar temperatures and then it looks like mostly sunny for the 4th of july. in fact, we are going to start to warm up the temperatures as high pressure likely to strengthen. right now a cold front swinging into the state will usher in some breezy conditions throughout the day today. inside the bay, we have a small craft advisory. temperatures in the 90s even hot 100s into the central valley. around the bay today you will see those numbers running well into the 70s even some 80s in the south bay, 60s along the coastline with patchy fog and wind. some 80s into the east bay. and then the napa valley checking in about 81 degrees and about 66 in san francisco. next couple of days, we'll start to warm the temperatures up for the holiday. getting hot in the valleys over the weekend. still cool out toward the coast. all right. let's check on the roads now with elizabeth. >> thank you, lawrence. outside right now, it's quiet. some folks may be starting their 4th of july long holiday weekend. we have noticed kind of less traffic each day this week and probably tomorrow a lot of folks will be off but for right now you can see it's relatively quiet through the altamont pass nursing a few yellow sensors coming westbound but nothing too unusual. we also have a high wind advisory that was issued around midnight by chp for the altamont pass and some overnight roadwork still in lanes both directions through the livermore valley. as you can see, though, if you are heading to the dublin interchange, headlights are moving westbound. everything is still moving at the speed limit. and same thing up and down the nimitz freeway in oakland, 880, bay bridge quiet slight delays in some of the far left cash lanes. and the san mateo bridge still looks good as well over the high-rise into and out of foster city. once again, that northbound 280 closure from 101 to king street lasting all weekend should re- open by monday morning in time for the monday morning commute. but this weekend, we got to deal with the alternate. southbound 280 remains open but you can use 101 all weekend long maybe if you are catching fireworks celebrations along the embarcadero in san francisco on friday night. that's your latest "kcbs traffic." frank and michelle, back to you guys. >> thank you. some car trouble for san francisco mayor ed lee. a chevy was parked in a crosswalk. the mayor's office is not commenting. but the guy who snapped a photo tells cate caugiran the picture speaks for itself. >> reporter: these photos are raising a few eyebrows. >> it's ridiculous. san francisco politics, what do you expect? >> reporter: this man didn't want to go on camera but his online popularity jumped after tweeting a series of photos of mayor lee and his entourage violating a few parking laws. >> he just pulled right here in front of the traffic lane and it's like why would you move from a perfectly good spot to an illegal spot? >> reporter: to be clear the mayor isn't driving his car. it's his security detail a san francisco police department officer. the officer says it doesn't tell the whole story. the officer was trying to find a new place to park while the mayor was inside a shop. as the officer waited for one car to move, the mayor decided to leave earlier than scheduled so the driver pulled up in front of the shop. >> it's obviously king mayor lee because how dare he have to walk more than 6 steps from the door of one business to another? >> reporter: sfpd says this is a tactical move, stay close in case of an emergency and if the mayor needs to bolt. the mayor's office, though, under fire over another parking mishap. this photo was taken of his car illegally parked in a bus zone on friday. the police department says in that case, it was the officer's fault and this will be a learning experience for them. in san francisco, cate caugiran, kpix 5. >> normally if you're caught parking in a bus zone you would get a $279 ticket. now ed lee isn't the only bay area mayor with car trouble. you may remember oakland mayor jean quan caught redhanded texting and driving although she said she was looking up at her gps and then this is a couple of weeks later mayor quan in a fender-bender. some witnesses said she was on her cell phone again and ran a red light. they are still investigating. the mayor denies that. she said she learned her lesson the first time. it might well be the most expensive bag of chips ever. a walgreens employee fired for eating chips on the job has her day in court. andria borba explains. reporter: ever heard of a $180,000 bag of potato chips? walgreens has. it was 2008 at this walgreens on el camino real in south san francisco when she went into diabetic crisis and grabbed a bag of chips in her cart to keep from fainting. >> she didn't have time to check them out. and then pay for them and then eat them. she was in a crisis situation. >> reporter: that's not how walgreens saw it. they have a zero tolerance antigrazing rule. you pay before you eat. josefina paid eventually even explaining on a form that she just couldn't pay immediately but she was suspended. then fired from her job of 18 years. >> you are having a medical emergency? >> exactly. and they don't care! they care more about the bag of potato chips. >> reporter: she went to the equal employment community commission and sued walgreens on behalf of the federal government for violating the americans with disabilities act. >> even if there's a hard and fast rule, if somebody breaks that rule because of their disability, then the employer should look at how can i accommodate this person? >> reporter: walgreens has to pay josefina 180 grand in back pay. josefina is relieved. her fight is over. >> i want to jump, cry and scream. >> reporter: andria borba, kpix 5. >> a bay area city votes to give away medical marijuana for free and not just any something we don't see every day in san francisco, a more not found on potrero hill has been caught, marmot. the squirrel like critter should be up in the sierra. john ramos reports on how it may have gotten here a how it's going to get home. >> reporter: a home invasion happened on this block of san francisco's potrero hill. the intruder was still on the loose. but neighbors had an unusual reaction when they saw a picture of the suspect. >> it's adorable! >> reporter: not that guy. this guy. the yellow-bellied marmot normally lives in the sierra above 4,000 feet and looks remarkably like -- >> large unhappy gopher. [ laughter ] >> reporter: but a neighbor on this block snapped some pictures of one hanging out near her backyard deck. so they called in duane titus with wildlife emergency services. >> this is like i said the sixth one in four years. so we have become the de facto go to folks for wayward marmots! [ laughter ] >> reporter: duane says marmots are notorious for stowing away in the engine compartments of cars parked overnight in the mountains. >> nice warm engine, they hop up in there, find a cozy spot, and i guess the next morning folks must leave and they hitch a ride. you know? they get out the next evening and they are in san francisco! [ laughter ] >> reporter: but they also have a sweet tooth for fruit and late this afternoon, the trap was sprung. and the marmot is now taking another trip, to the wildlife clinic in san jose. after he gets a check-up, he will take one last ride back home to yosemite. in san francisco, john ramos, kpix 5. >> well, the city council in berkeley just voted to give medical pot to the low income for free. and it's not just any weed. it has to be the good stuff. a city councilman told us he realizes how expensive it can be so he felt it was the responsible thing to do to make it available free of charge. one pot club in the city already does this. >> found over the years that one of the cruel realities of when you do get sick and you have a serious illness is that it's often hard to keep a job. it can be hard to keep your income up. so those people really need the help the most. >> the final vote is next week. it is 4:56. the suspect in the benghazi, libya attack appears in court on u.s. soil. the decision on where he will state while awaiting trial coming up. >> reporter: and while you slept, crews were hard at work on highway 280. coming up, we'll check in on the progress and the closure. alabama ,,,,,,,,,,,,,, very unnerving when you consider our house is just on the other side of the hill. it is very frightening. >> a huge wildfire in napa county continues to burn out of control. hundreds of people have left their homes many at an evacuation center. >> everybody will be safer. >> reporter: passengers flying into the u.s. from certain countries would soon have to go through enhanced security screening. there are concerns that terrorist groups could recruit westerners who smuggle bombs on airplanes. >> i hope that we can act like grownups and not like bullies and not like dictators. >> later this morning, a vote to extend the a's lease at the coliseum. the team reached an agreement with alameda county last month. but oakland city council members have vowed to kill the deal. from across the bay to around the world, the stories that matter on "kpix 5 news this morning." captions by: caption colorado comments@captioncolorado.com 4-4- your realtime captioner is linda macdonald. good morning, i'm michelle griego. >> hi, everyone. i'm frank mallicoat. 5:00. a little traffic and weather and we start with lawrence. good morning. >> good morning. yeah, we are seeing that onshore push again with the low clouds and fog. some of that fog sneaking back up into the napa valley is good news. the bad news is they are seeing more wind there this morning. we are seeing some winds sustained between 14 to about 16 miles per hour. this afternoon, southwesterly winds going to continue 10 to 20 miles per hour gusting to 25. humidity levels dropping this afternoon. 35 to 45%. i think the next couple of days we'll see less humidity as the temperatures are going to start to rise. numbers around
