Of kcbs traffic coming up. Thank you. It sounded like a dump truck dumping its load but a house being remodeled collapsed in the twin peaks area of San Francisco. The house had just been lifted so they could put a new foundation under it. About 10 30 last night, the supports gave way. And the house slid down the hill until a retaining wall stopped it and thats where it sits this morning. It fell just the way we wanted it to because all on the corners of the building which is much stronger and it should somewhat, you know, contain the situation. Inspectors decided not to red tag the house thats downhill from the one that collapsed. They are trying to figure out what happened. Nobody was hurt. Dont pull the plug today the family has one last hope for a 13yearold oakland girl declared brain dead after routine tonsil surgery. There will be one last test to see if theres any brain activity. As joe vazquez reports that test is supposed to happen sometime this morning. Reporter people in the waiting room with us, these are all friends and family. This is not even all of them. So all these people right here got the same belief that we all have, that she could still wake up. Reporter she was supposed to walk out of the hospital after a routine tonsillectomy but a week ago, jahi mcmath experienced severe bleeding and cardiac arrest. By the end of last week she was declared braindead. Earlier today the family says hospital staffers informed them the hospital was going to take jahi off life support against the familys wishes but late this evening, jahis mother says she convinced the doctor to try one more eeg a test of her brain for activity. They are telling me straight up the coroner is coming to get her. Come say your last goodbyes and i cried to this man and said just check her brain one more time. I asked him, do you have children . He said yeah. Well then you should know how it feels. I wont give up on my daughter. Just a little brain activity, keep her on. So pray for my daughter. Reporter you convinced him . I did. I had to. [ crying ] reporter joe vazquez, kpix 5. A hospital Spokesman Says that they wont discuss the case with the media at the familys request. Right now, a big wildfire continues to burn out of control in one of californias most popular tourist spots. 15 homes have been destroyed near big sur including the fire chiefs. About 500 acres have burned more than 600 firefighters are working on it. The fire has been burning for more than 24 hours inside the Los Padres National forest. Marissa schwartz is there with an update. Reporter the firefighting effort continues tonight in big sur. 400 to 500 acres have burned and its 0 contained. They say progress is being made. Smoke is making it difficult for firefighters to build that containment line. They say theres a lot of structures and homes in the area but its been so thick they havent been able to get in to see just how many structures are affected. The firefighters say that about 100 people have been evacuated. And they are not sure if any more evacuations will need to happen overnight. Today president obama will meet with technology executives. He is going to talk about National Security. As Tara Mergener reports, this comes one day after a federal judge said the governments collection of americans telephone records is likely unconstitutional. Reporter a federal judge has ruled the National Security agency should stop its full collection of americans phone records saying it is likely unconstitutional. Under the nsa program, the government says it collects and stores metadata on hundreds of millions of telephone calls in the hunt for potential terrorists. What number called what number at what time on what date how many times how long. Thats metadata. Reporter in the 68page ruling, judge richard leon said the Government Surveillance Program was almost orwellian and said i have little doubt that the author of our constitution, james madison, would be aghast at what the judge said amounts to an unreasonable search. The Justice Department responded saying, we believe the program is constitutional as previous judges have found. President obama put together a commission to look into the nsa practices shortly after former nsa contractor Edward Snowden leaked details of the program. Our sources say that that commission is going to recommend largely the same thing, which is that the nsa stop keeping that massive database, that it either lives somewhere else, maybe at the phone companies, and that they get an individual court order for each case. Reporter the judge put his decision on hold pending a government appeal. Tara mergener for cbs news, washington. Edward snowden weighed in on all this saying that he felt the judges ruling justified his decision to leak those secret documents. The white houses report on nsa practices will probably become public in the next few days. And today, ceos from a number of leading Tech Companies, google, twitter, facebook and others will meet with the president to talk about nsa spying and healthcare. Gov. We have a couple of slow spots out the door now because of roadwork and several lanes are blocked. We are seeing it again on 101 coming into San Francisco. That silver to vermont street, the left lanes blocked until 5 00. Again we are seeing a little bit of slowing. We saw it yesterday until 5 a. M. , as well. This time in oakland, actually its coming into san leandro southbound 880 between davis and marina right lanes closed until 5 00 wrapping up in the next 20 minutes. Bay bridge toll plaza cruising along at the pay gates, westbound midspan they have two left lanes blocked until 5 a. M. You can guess. All right. Eastbound 580 we also have some lanes blocked this morning from strobridge leaving Castro Valley y out towards san ramon. They have two left lanes blocked until 6 a. M. Three major paint companies are ordered to pay 1. 1 billion to remove lead paint from millions of homes across california. A santa clara judge found the three companies marketed paint they knew to be harmful to children. Lead based paints were banned in 1978. But millions of homes painted before them still pose a health risks. The companies will appeal. A couple of parking lot scammers are targeting shoppers in the east bay. Their m. O. Running into cars to trick drivers into paying. Kpix 5s brian webb shows us who the scammers are after. Reporter a Christmas Season scam showed up at this el cerrito safeway. Some shoppers got wind of it from a police text alert. Call police if you are approached by someone saying you hit their car. Reporter jasper holt doesnt need an alert. He saw the scam in action as he was collecting donations for Homeless Veterans out front. He says one of the victims asked him where he could find an atm. What do you need it for . He says old lady out here said her daughter say i run over her mother. And i needs 200. Reporter heres how the scam works. When a car drives by, one of the women pounds on it making a loud noise. The other woman approaches the driver saying, you hit her with your car. And now we need money for medical bills. Ha. I said no, i wouldnt do that. I would call the police. I wouldnt give them no money. Reporter El Cerrito Police say two women seem to be targeting older men and in one case follow the victim to his home demanding 1,200. Well, you know, theres people out there that are willing to do anything. Reporter when Police Arrived the women drove away emptyhanded but free to strike again. But they shouldnt come back to this safeway at least not on jaspers watch. I feel good, man. You know . I feel good because hes a older guy, he was scared. And he was going to go get the money. In other headlines around the bay area this morning, caltrans says the tower on the new eastern span of the bay bridge needs better lighting. They tested 2300 new lights last night. 800 at the base and 1500 at the deck level. The idea is to make the tower stand out. It looks like it stands out there. Caltrans hopes all the lights will be on by 1 1. Things are normal at terminal a at san jose airport. A water line broke causing flooding yesterday. It was closed for most of the day. Crews had to bring out fans and hoses to remove the ankledeep water. And the time now is 4 41. The anger growing over the influx of tech workers into San Francisco. How the mayor is trying to defuse the situation. After two landlords go to prison for terrorizing their tenants, fallout from the case continues. The new proposal aimed at protecting renters from harassment. ,,,,,,, with the tech industry. They call it the tech divid chanting ] protestors are angry about what they call a too cozy relationship with the tech industry. They call it the tech divide, the difference between regular people and techies accused of driving up the cost of little in San Francisco. As phil matier shows us, protestors want the mayor to know that they want it stopped. Reporter it was all smiles as mayor ed lee flipped the switch on a Tech Partnership to bring Free Internet to the midmarket area of San Francisco but he also had a message. And we have more to do. Reporter and indeed, across town, the mayors close relationship with the tech influx was triggering howls of protest. Whose city . Our city reporter protestors were upset with the mayors meeting with tech titans to talk about the future of the city. The message to the mayor is hey, why dont you talk to the rest of San Francisco about the future of the city . Reporter 1900 well paying Tech Companies coming in recently had protestors targeting tech workers by blocking buses that take them to their jobs in silicon valley. The issue is more than just rents. They live in their own tec bubble. They talk to each other and theres a certain arrogance thats been demonstrated. Its always tempting to point at this group or that group and say they are to blame for our housing woes and the fact, we have made our bed in San Francisco. Were not producing enough housing. Reporter supervisor weiner says the problem runs deeper than the latest boom. Our population has grown by about 75,000 in the last decade. And over that same time period, we produced Something Like 5,000 units of housing. San francisco has always been a boom and bust economy. We go up, we go down. When were down, we want to attract these businesses. When were up, we fear the consequences of these businesses. Reporter phil matier, kpix 5. San franciscos soaring cost of living is causing another problem. A wave of complaints from renters who say their landlords are trying to bully them out of their apartments. As kpix 5s ken bastida shows us, in one case, the landlords ended up in prison. He actually saw the saw coming up and trying to saw through. Reporter it was the story that set a new benchmark for bad landlords. Soak the victims bed and clothes and electronics with ammonia. Reporter for four years a husband and wife terrorized their San Francisco tenants hoping to drive them out so they could renovate and sell this building. They sent threatening letters to the victims that they will have them deported. Reporter kip and nicole macy are now serving four years in prison but the fallout from that case continues. The sad thing is this case is not uncommon. Reporter at city hall supervisors heard a string of Horror Stories many of them from immigrant families who say their landlord tried to scare or even bribe them out of their homes. [ nonenglish language ] my wife cried, uhm, my children became really scared because we didnt know where we were going to go. Reporter currently, their only option is going to court. A costly prospect for tenants, landlords and the Justice System itself. Supervisor david campos would rather see these cases heard before the citys rent board. Look at the facts. Hear from both sides and depending on what they find, you know, they may or may not refer the matter to Law Enforcement to the d. A. In this case. Reporter campos says that kind of hearing would protect landlords from bogus lawsuits and tenant advocates say it would protect renters from Property Owners looking to illegally cash in on a hot market. Harassment is an incredibly effective and cheap way to get your tenants out because it doesnt cost a landlord anything to bully someone out of their home. In 2008, San Francisco voters approved measure m, which allowed a tenants rent to be lowered if they were harassed by the landlord but thats been thrown out by the California Court of the appeals that part of the law. Otherwise around the state not bad, 65 sacramento, 70 fresno, 68 and haze and smoke from the fire from big sur. Clouds today and then sunshine in between. So i think another nice day ahead with temperatures above average but no records for today. The south bay you will see numbers well into the 60s almost 70 into morgan hill. East bay into the 60s. Inside the bay 60s. Next couple of days we are going to see some much cooler temperatures, partly cloudy skies and then thursday a little breezy too and then slowly warming up over the weekend. No delays on bart, ace, muni and caltrain. We are seeing slowdowns on the road. If you are coming up northbound 101 into San Francisco, we have seep this roadwork since yesterday as you pass silver towards vermont. 18 miles per hour. They pick this up right around 5 00 so you wont see these slowdowns for much longer but in the meantime the left lanes are blocked. If you are traveling southbound past the airport from san bruno or san mateo, no delay towards hayward. East bay sensors, top speeds all the way towards the bay bridge toll plaza which is obviously cruising right along. If you are traveling on the westbound 80 upper deck of the bay bridge or the new span of the bay bridge there is roadwork that should wrap up in 10 minutes. And looking towards the dublin interchange, westbound 580 all those headlights, thats the commute direction. Its actually the eastbound lanes from strobridge from Castro Valley out towards pleasanton where we have various lanes blocked blocked but westbound looks great all the way towards 238.
