home on ashbourne circle in san ramon. brian webb explains what happened. >> reporter: an armored vehicle and cop cars coming down from a hill covered with million- dollar homes, something you don't see every day. >> we can't go up because we live right up the street so they told us we have to stay down here. that's about all they told us. >> it's pretty boring out here. nothing exactly is happening. this happens when we come back, so i guess it's not as boring as you would think. >> reporter: two deputies served an eviction notice at a home being foreclosed with a locksmith and property owner. the locksmith started to open the door and the property opener was hit by a bullet fired through the door. a s.w.a.t. team rushed to the scene and residents were warned to stay inside. the property owner was flown to the hospital. >> my daughters were not home and i wasn't near there. so that's just the blessing. >> he moved in about 2004. >> reporter: this woman says she know the 42-year-old suspect and asked us to hide her identity. she says he bought:a lot of property during the good old days then lost them one by one. >> i believe this would be his last one. that's why he was desperate. >> reporter: after four hours of negotiating by phone, authorities were tired of talking. they rammed the front door and sent gas inside. the suspect gave up. this is him in the back of a deputy's car being taken to his new home, the county jail. brian webb, kpix 5. >> there have been 154 foreclosures in san ramon this year. investigators are still working on building 157 at the washington navy yard as they try to find a motive for monday's killing spree. susan mcginnis reports. >> reporter: the washington navy yard reopens this morning for the first time since monday's deadly shooting. >> it is a little surreal i guess showing up to work again after this incidents. >> reporter: the yard returns to mostly normal operations although the fbi is still investigating building 197 where the shooting happened. it was there that police found 34-year-old aaron alexis's gun etched with two cryptic phrases. the first said, better off this way. the second, my elf weapon. investigators are trying to determine the meaning. with many questioning how alexis was able to carry a large weapon on to the base, defense secretary chuck hagel has ordered a review of military security and employee screening programs for bases around the world. >> our people deserve safe and secure workplaces wherever they are. >> reporter: alexis' mother is speaking out for the first time. she says she doesn't know why her son did what he did. >> "aaron is now in a place where he can no longer do harm to anyone, and for that i am glad. to the families of the victims, i am so, so very sorry that this has happened. my heart is broken." >> reporter: alexis' family also says he sought treatment from the veterans administration for mental health problems but the va says it has no record of that. in washington, susan mcginnis, kpix 5. >> va records show alexis sought treatment for insomnia at a rhode island medical center on august 23rd. he followed that up with a va hospital visit in washington five days later. all right now. it's about 25 minutes before 5:00. time to get a look at traffic and weather. we'll begin with mr. karnow and weather. >> this is it. summer is coming to an end. i think summer's last gasp today. we are going to enjoy some beautiful weather outside lots of sunshine coming our way, these temperatures are going to be warmer than yesterday. mostly clear skies this morning. looks like it is going to stay that way all day long as high pressure sits overhead so beautiful weather coming our way. the temperatures are running a little cool if you are stepping outside this morning. dropping down into the 40s in santa rosa, 55 degrees in san francisco and livermore checking in at 56 degrees. but how about this? by the end of the day, temperatures up in the 80s, some low 90s in the interior valleys. 70s and 80s around the bay, 78 degrees in san francisco. that's a very nice summer's day and about 69 degrees in pacifica. enjoy it! we have some big changes coming our way. more on that. right now let's check the roads with elizabeth. >> reporter: thanks, lawrence. and unfortunately, in traffic we have a hotspot. it is in pleasanton. we have a slightly updated location for ya. it's southbound 680 approaching bernal so we know four cars and a big rig are involved. two of those cars may have actually gone down the embankment but the other ones are blocking the slow lane. one car on its roof. so again, this doesn't sound good. right now southbound, no slowing on the sensors. 64 miles an hour. so likely there's just very minor slowing right now approaching the scene. if you are coming 580 this is a live look at that 580 traffic heading towards the dublin interchange. so far no delays to the drive times still clear 14 minutes out of the altamont pass. that will change quickly in the next half hour or so but for right now, you are reporting no delays and the golden gate bridge nice slow traffic across the span. they should have four southbound lanes open in the commute direction here very shortly. and the bay bridge no metering lights and no delay. not seeing any major roadwork. there may be some eastbound if you are heading into oakland. coming up we'll get a check of mass transit. back to you guys. guess what we are going to start hearing about now? we are moving closer to another bart strike. the war of words continues between bart and the unions. the seiu and the atu say bart negotiators walked out of the talks without responding to their latest counterproposal. bart said that once again the unions wage damages are too high. the unions say bart's chief negotiator has rejected daily talks. bart says that's not true. >> there's no explanation other than bart is not treating these negotiations seriously and do not intend to come to an agreement in an expeditious manner. >> the current calendar is not set in stone. just because their current calendar is what it is doesn't mean that we can't add days and we're willing to do that. >> right now there are no new talks scheduled until monday. that would give them about two weeks to figure things out. bart workers can go on strike on midnight on october 10th. bay area drivers are getting ready for another bridge closure, the golden gate. ann notarangelo tells us it will make driving a lot safer. >> reporter: october or november of next year, they are going to shut down the golden gate bridge so they can install a new movable median. now, these will take the place of those plastic pylons that really don't do much to prevent a head-on collision. what they will put in their place are 800 one-foot real thick heavy steel concrete barriers. to do this work, they are going to have to shut down the bridge for 52 hours essentially a weekend and at this point, the golden gate bridge district says it doesn't know what sort of plans they will put in place to get people between the north bay and san francisco. they do think at this point though it will certainly call for more ferries, maybe even more buses. they will have to take other bridges throughout the bay area. in marin, ann notarangelo, kpix 5. >> we'll have a better idea of the exact dates of the bridge closure in about six months. oakland police officers are doing more desk work in their patrol cars. they are doing briefings and filing reports in the areas that the opd calls hot spots. the officers are doing the work in locations where crime is high so they can respond more quickly to any calls in the areas. yesterday was just the first day. and some officers say the idea is already working. >> saw somebody with a gun turned out the person had a large bowie five with a felony warrant for his arrest. so -- knife with a felony warrant for his arrest. so we were able to respond quickly and arrest the person. so it's effective. >> officers say low staffing levels are forcing them to get creative. by spending more time in the streets, building relationships in the communities, they hope that crime will drop. two small dogs are in quarantine after what looks like an attempt by their owner to get rid of them. kpix 5's kiet do tells us one dog was seen coming out of a window of a truck driving down fremont boulevard and the second was spotted wandering the streets of fremont half a mile away. >> reporter: judging from the way they look and act, these two yorkie mixes are likely brothers. right now, all they have is each other. >> something clearly happened. i hate to say that somebody dumped them. >> reporter: a witness saw one of them go flying out of a blue truck. a worker got the dog out of traffic. they figured the dog had jumped out of the truck so they waited for the owner to turn around and come back. but they waited and waited and waited. >> this is really weird. how does a dog jump out of a car and you not turn around and come back and get it? >> reporter: a short time later the second yorkie was found wearing the same type of collar and leash. it was wandering a few blocks away from where fremont police say the first dog was, quote, helped out of the vehicle. >> i think you're being too nice when you're saying the dogs were "helped" out of the car. common sense would say they were tossed out of the car. >> they could have been tossed out of the car. >> reporter: animal dumping is common in fremont. leopard, turtles, boa constrictors. people do it because they fall on hard times or don't want to pay the surrender fees. >> it's a hard economy. it's not an excuse. but i can understand where they're coming from but it's not the right way to do it. >> reporter: fremont police want the owner to come forward with the dogs' background and medical history to help get these dogs into a loving family that actually wants them. in fremont, kiet do, kpix 5. >> the dogs have to be quarantined for a week before they can be put up for adoption. the owner could face animal cruelty charges. all right. it's now 20 minutes before 5:00 on this thursday morning. bad news for iphone robbers. the brand-new security feature that could keep them away. >> misleading expiration dates may be sending good food into the trash. coming up. [z funding the government, if e plan includes money for the on capitol hill, house republicans say they will not vote to keep funding the government if the plan includes money for the obama administration's healthcare reform. speaker of the house john boehner scheduled a vote for tomorrow to keep the government running. but defund the affordable care act. if a compromise with democrats can't be reached before the october 1 deadline, most federal agencies will be fully or partially shut down. and fed chairman ben bernanke has issued a warning to congress and the white house, he is urging them to find a way to fund the government and to raise the debt limit saying the nation's economy will suffer otherwise. the fed said it will continue its stimulus policy of buying bonds in order to keep interest rates low. ben bernanke says the economy is recovering but at a slower pace than expected. the fed's decision helped wall street hit a new record yesterday. the dow was up 147 points to a record close. the nasdaq up about 38 to a 13- year high. it's a dating game with your refrigerator. those sell by dates on milk, yogurt and other items may not really be accurate. kpix 5 consumerwatch reporter julie watts with the experts who say those dates are just a waste of food and money. reporter: best by, use by, sell by, they are stamped on almost everything you eat these days. but what exactly do these dates mean? >> some of them mean sell by, some of them mean eat by. kind of confusing. >> reporter: you may be surprised to hear none of them mean expired by. that's the problem according to a new report by the natural resource defense council in harvard law. >> nine out of ten people may be throwing out food based on the mistaken impression that these labels are conveying information about safety and that's not the case. >> reporter: for instance, the sell by date is simply an internal stocking note to retailers. after which the food is usually donated to a food bank. and contrary to common belief, the best by and use by dates are not discard dates. >> they are usually just indicators of peak quality that a manufacturer often determines by their own criteria. >> reporter: the report is calling on manufacturers to hide the sell by dates from consumers and print uniform date labels that clearly differentiate between safety and quality. the council would also like more oversight of the labels that are currently unregulated and completely voluntary. do you recommend people ignore those dates and rely on their nose and their sense of taste? >> in terms of safety, i think that's right. these labels are not meant to communicate safety anyway. >> reporter: julie watts, kpix 5. >> throwing out all that food is expensive, too. the average family wastes hundreds of dollars a year. and i told you as soon as i see the date, it's -- >> out it goes. >> and if you have children, you don't want to get them sick. >> or yourself. >> there's also you. [ laughter ] we have great weather coming our way, lots of summer sunshine outside, today the warmest day of the week with high pressure. a nice start to the day as we have mostly clear skies with just a hint of a patch of fog. cool to begin with some of the overnight temperatures into the 40s. sunny skies and warmer weather enjoy it. we are going to see some big changes as early as tomorrow and into the weekend. high pressure sitting overhead right now. but you can see in a cold front off the coastline. not the strongest one we have ever seen but somewhat unusual for it to come in this early. so a chance of rain in the forecast as well but not today. we are going to see some 90s into the central valley, 88 yosemite. 71 monterey. 92 ukiah. you can see the computer models skies are clear and then into friday the clouds return and then into friday evening here comes a chance of showers as that weak cold front drops on by ushering in some cool unsettled air into saturday so a chance of some continued showers into saturday. not a washout. but could be a little wet at times. temperatures today under mostly sunny skies we have some 80s and 90s into the south bay 60s and low 70s at the coastline. in the interior valleys looking at 91 in brentwood. 91 livermore. about 90 degrees in pleasant hill and inside the bay, enjoying some 70s and gorgeous into san francisco. almost 70 into daly city and 88 santa rosa. next couple of days big changes on the way the clouds roll in for tomorrow. a chance of showers by tomorrow evening and into saturday. sunday looks like just a partly cloudy day as we head in toward fall then looks like those temperatures staying a little cool into next week. let's check the roads with elizabeth. >> reporter: thanks, lawrence. out to pleasanton, we have just confirmed with chp that they have cleared that accident. everything is off to the right shoulder. there's still a lot of emergency crews out there and sensors have caught up southbound 680 approaching bernal. this is an accident involving a big rig sounds like a couple of other cars. at least one of those cars went down the embankment so obviously, it's going to be a little slow commute once you get past that 580 interchange. otherwise, just your overnight roadwork is all that's out there. here's a live look at the nimitz freeway. let's see. this morning, it is southbound 880 approaching 23rd and northbound between embarcadero and high streets. so if you can just wait another 15 minutes or so, all of this should be cleared. it's not causing any big delays but lanes are blocked until about 5:00 this morning. and here's a live look at one of your bridges, the san mateo bridge in the commute direction. it is only 14 minutes between hayward and foster city. that's your latest "timesaver traffic." brian, michelle, back to you. >> thank you. finally you can do something to protect your phone. apple is now offering a kill switch aimed at stopping the epidemic of smartphone thefts. but kpix 5's joe vazquez says, first you have to figure out how to use it. >> reporter: could apple picking, the rampant robberies of iphones, become a thing of the past? the ios 7 apple's new operating system has a kill switch. the first of its kind in the u.s. >> i think it will have a tremendous impact. >> reporter: san francisco's district attorney george gascon has been pushing reluctant phone companies to make this change. that's because half of the robberies in the city are smartphone-related. >> of course, i don't think the impact would be overnight. i think that there has to be an adjustment in the marketplace. first of all, the thieves have to understand that they no longer can use the phones because the phone will be inoperable. >> i think it's a great idea. it's somewhere to start. >> here we go. we are going to go to the icloud. >> reporter: but cnet says it has a long way to go. first of all, it's not automatically on your phone. you have to opt in meaning you have to navigate the complicated process of turning on the kill switch by signing on to icloud and then clicking on the find my iphone feature. once that kill switch is activated, temperature your phone gets stolen it will never -- if your phone gets stolen it will never work again unless the correct password gets typed. >> so before you could steal a phone, plug it into anyone's computer and restore it as if new and resell it. you can't do that anymore. it's really hard but it's a good first step. >> reporter: what do you think about a kill switch? >> i want to have it. >> it would be helpful if you knew how to use it. >> i have it. haven't turned it on. >> reporter: why not? >> i don't want to deal with it. [ laughter ] >> reporter: kind of complicated? >> yeah, i just don't want to deal with it. >> reporter: joe vazquez, kpix 5. >> keep in mind, this is one operating system on one kind of phone. the iphone. so it may not make a difference in the apple picking until all of the phone companies start offering a kill switch. well, massive layoffs could soon be happening at blackberry. the smartphone maker has been struggling. the "wall street journal" reports blackberry could cut up to 40% of its staff as many as 5,000 employees by the end of the year. gamers are snapping up a new game at a record pace. the new grand theft auto v game racked up $800 million in sales the first day it came out on tuesday. that means that people bought about 13 million of the games in one day. and that's a record for the videogame industry. and fast growing industry of 3d printers is making almost everything possible to print. the traveling 3d printon conference and expo just had three days at north san jose. printing is now possible for everything from toys to appliance parts and musical instruments. some experts say in a few years, 3d printing could change the medical world as we know it. >> they are starting to see it in jewelry, some incredible jewelry being made, clothing is being made. even food. >> we're talking about using 3d printing commonly used with plastic and metal materials and using it on cells, living human cells. >> san diego-based organovo is already printing human tissue and is working toward the day when human organs can be printed and transplanted in patient bodies. >> extraordinary. need a kidney?
