weekend and he was unable to recover. good afternoon, i'm elizabeth wenger in today for frank mallicoat. >> i'm michelle griego. we start with that breaking news this noon. cbs reporter omar villafranca with more on the death of the first person diagnosed with ebola in the united states. >> reporter: thomas eric duncan is now the first person in the united states to die from ebola. the 42-year-old liberian passed away after being hospitalized at texas health presbyterian in dallas since late last month. the hospital released a statement expressing its condolences and saying ebola is a disease that attacks the body in many ways. we'll continue every effort to contain the spread of the virus and protect people from this threat." duncan was originally sent home when he first came to the hospital. by the time he was admitted four days later, his condition had worsened. duncan, who brought the virus back with him from liberia, received experimental treatment and kidney dialysis. health officials are keeping a close eye on the people duncan came into contact with, either directly or indirectly, while he was contagious. they say this is the midpoint of the virus' incubation period so anyone who was infected could start showing symptoms in the next few days. omar villafranca, cbs news, dallas. >> federal officials announce they will start screening passengers from west africa for fever at u.s. airports in five major cities. the screenings will be held at chicago, new york, new jersey, washington, d.c., and atlanta airports. developing today, crews removed the body of a firefighting pilot this morning from his plane that slammed into a cliff and burst into flames in yosemite. the pilot was part of an air tanker attack on a fire that broke out yesterday afternoon near highway 140 in the national park. search-and-rescue crews worked for hours in difficult terrain to get to the crash site. >> they were not going to give up last evening as darkness felonies very difficult terrain until they were able to reach the crash site and identify and confirm the status of the pilot. >> officials are not releasing the pilot's name yet only saying he has been a veteran of cal fire for 13 years. the ntsb is taking over the investigation this morning looking into how it all happened. for now, fire officials have grounded all air tankers in that firefight. witnesses nearby caught the flaming wreckage on camera. >> i was right up the street here and i saw the black smoke cloud going up and went out and took pictures immediately. >> meanwhile, fire crews are continuing their fight today against the flames that have burned more than 200 acres. authorities expect containment by tonight but say fire conditions are explosive and they are working fast to get it under control. uber is under fire, a man says a driver for the rideshare company attacked him and left him seriously hurt. the victim spoke out publicly today for the first time. kpix 5's anne makovec is live in san francisco where a rally is just getting under way. anne? >> reporter: yeah, this rally is by cab drivers and they are rallying against uber in front of uber's headquarters here on market street. they want the company to face the same rules and regulations they do. this is just one of many public digs against the company which is facing several legal issues this afternoon. his eye still swollen shut from an attack two weeks ago, 35- year-old roberto talked for the first time about his injuries. >> they're not sure whether i'm going to lose my eye or not or even regain vision in my left eye. >> reporter: he and two friends caught an uber ride home from a nightclub in september and the next thing he says he remembers is waking up in the icu. >> doctors have said that i have a very long road of recovery ahead of me. >> reporter: investigators say the average today the uber driver pulled off the highway on alemany boulevard after the passengers said he was going the wrong way. he threw them out of the cab and then hit them in the head. the lawyer says uber should be responsible. >> they are taking money, as much as 25% of each fare, and trying to avoid liability. we're not going to let them do that. >> reporter: uber has suspended the driver's account. they sent out a statement saying we take reports like this seriously and are treating the matter with the utmost urgency and care. we stand ready to assist authorities in any investigation. >> reporter: the driver in question has pleaded not guilty. he is out on bail. >> this comes as san francisco's d.a. accuses uber of multiple violations. >> reporter: that's right. george gascon has called uber and the other ridesharing companies like lyft a continuing threat to public safety and to consumers in general. so he is threatening legal action against these companies saying that they are breaking several rules including failing to provide proper background checks. i should note though the driver in this case did have a clean background, no criminal history. live in san francisco, anne makevoc, kpix 5. san francisco firefighters responding to the call of a boat crash along the waterfront found a body in the water. it happened just after 6 a.m. near pier 52 south of at&t park. fire officials say they were investigating reports of a boat that crashed into the pier. they found a field of debris and a body floating in the water, but no boat. authorities are still investigating what happened. dozens of san francisco children walked to school with the mayor this morning. they are celebrating international walk and roll to schoolday. mayor ed lee accompanied kids from an elementary school. the school is near the congested 7th street off-ramp from interstate 80. >> so that's why we're working hard this november to pass a bond that will help us get more money to fix the streets. >> mayor lee and other officials took the time to announce efforts to improve safety around other schools in the city. and parents, teachers and students in the south bay also followed in mayor lee's footsteps today. this is blackford elementary school in san jose. it was busy with lots of walkers and bike riders on this international walk and roll to schoolday. of course what everyone is talking about the san francisco giants heading into their third nlcs in five years. >> they will play the cardinals in the national league championship series after winning a nail-biter against the nationals at at&t park. the giants were hanging on to a one run lead in the 6th inning last night when jason wirth blasted one to right field. hunter pence take a look made a spectacular leaping catch as he crashed against the right field wall. giants scored the winning run in the 7th, joe panik came home on a wild pitch with the bases loaded. san francisco beat washington 3- 2. >> a lot of veterans right there stepping up, tim hudson, jake peavey, baumgarner going to get another chance to do what he does best this time of the year. >> goggles and all, the win got the champagne flowing in the giants club how the every house. it was an exciting series with three of the four games decided by one run including game 2 that went 18 innings in washington. >> we're gritty and grindy, you know? >> what's that. >> your forecast. >> thank you so much. yes! it's looking good out there now. a lot of sunshine around much of the bay area. still some fog and low clouds hugging the coastally, hazy. looks like plenty of sunshine and mild temperatures inside the bay. 81 degrees in concord and livermore. 64 san francisco, 74 san jose. we are going to enjoy a lot of fall sunshine this afternoon. but the fog likely to linger toward the coastline. that will keep those temperatures cool. then low clouds and fog make a return for tonight but big news is, the offshore wind going to be kicking in. if you have weekend plans, should be another spectacular weekend all around the bay area. high pressure sliding east. the marine layer may deepen so more fog and low clouds over the next couple of days. we'll cool down through tomorrow maybe friday, too. temperatures around the state today looking at 94 sacramento, 93 fresno. 70 monterey bay. patchy fog hanging out along the coastline, kind of stubborn there for the better part of the day and then surging back onshore through the gaps of the mountains into the bay overnight tonight and into tomorrow morning. so yeah, we're going to see more fog over the next couple of days. temperatures going to be dropping off a bit. comfortable 81 degrees and sunny and bright into san jose this afternoon. 78 degrees in fremont. 65 a little cool some patchy fog in pacifica. temperatures as high as 88 in livermore today. 87 in walnut creek. and about 83 degrees in vallejo. as you get inside the bay, 74 degrees in oakland. 69 degrees in san francisco. and about 65 degrees in daly city. your sunset time, 6:42. sunrise tomorrow 7:13. and it looks like the next couple of days these temperatures going to start to bottom out a little bit on thursday and friday. high pressure building in over the weekend. of course, we have fleet week this weekend, a lot of activities around the bay area. and the weather is going to be fantastic! offshore winds could very well bring those temperatures into the 70s right out to the beaches once again. and we don't have many offshore events for the rest of the year so enjoy it. the fog will hold off for fleet week and then next week late next week we start to talk about some rain. we'll see what happens. >> thank you. well, there are still some issues to work out around levi's stadium in santa clara. as kiet do reports, people who live nearby are frustrated. >> reporter: there have been 7 major sporting events here at levi's stadium so far. five of them 49er home games, and neighbors are now frustrated and everybody is getting an earful. last night neighbors complained at a meeting held by the 49ers. santa clara police and the vta. the complaints included fans illegally parking in neighborhoods, noisy planes carrying banners over the stadium, and that loud foghorn during games. >> what's that. >> your forecast. >> thank you so much. yes! it's looking good out there now. a lot of sunshine around much of the bay area. still some fog and low clouds hugging the coastally, hazy. looks like plenty of sunshine and mild temperatures inside the bay. 81 degrees in concord and livermore. 64 san francisco, 74 san jose. we are going to enjoy a lot of fall sunshine this afternoon. but the fog likely to linger toward the coastline. that will keep those temperatures cool. then low clouds and fog make a return for tonight but big news is, the offshore wind going to be kicking in. if you have weekend plans, should be another spectacular weekend all around the bay area. high pressure sliding east. the marine layer may deepen so more fog and low clouds over the next couple of days. we'll cool down through tomorrow maybe friday, too. temperatures around the state today looking at 94 sacramento, 93 fresno. 70 monterey bay. patchy fog hanging out along the coastline, kind of stubborn there for the better part of the day and then surging back onshore through the gaps of the mountains into the bay overnight tonight and into tomorrow morning. so yeah, we're going to see more fog over the next couple of days. temperatures going to be dropping off a bit. comfortable 81 degrees and sunny and bright into san jose this afternoon. 78 degrees in fremont. 65 a little cool some patchy fog in pacifica. temperatures as high as 88 in livermore today. 87 in walnut creek. and about 83 degrees in vallejo. as you get inside the bay, 74 degrees in oakland. 69 degrees in san francisco. and about 65 degrees in daly city. your sunset time, 6:42. sunrise tomorrow 7:13. and it looks like the next couple of days these temperatures going to start to bottom out a little bit on thursday and friday. high pressure building in over the weekend. of course, we have fleet week this weekend, a lot of activities around the bay area. and the weather is going to be fantastic! offshore winds could very well bring those temperatures into the 70s right out to the beaches once again. and we don't have many offshore events for the rest of the year so enjoy it. the fog will hold off for fleet week and then next week late next week we start to talk about some rain. we'll see what happens. >> thank you. well, there are still some issues to work out around levi's stadium in santa clara. as kiet do reports, people who live nearby are frustrated. >> reporter: there have been 7 major sporting events here at levi's stadium so far. five of them 49er home games, and neighbors are now frustrated and everybody is getting an earful. last night neighbors complained at a meeting held by the 49ers. santa clara police and the vta. the complaints included fans illegally parking in neighborhoods, noisy planes carrying banners over the stadium, and that loud foghorn during games.
