Necessary after bart workers go on strike. Good afternoon, im michelle griego. Im frank mallicoat. We are midway through day one of a bart strike. Lets check the roads right now. Mobile5 heading across the bay bridge. Traffic is backed up on the left side of your screen. As for the rest of bay area, a few slow spots. Nothing major to report at this hour and it was a much different scene this morning when thousands of bart riders hit the roads, buses and ferries to get to work. Right now kpix 5s mark kelly is live at the San Francisco transbay terminal with more from those wornout commuters. Mark. Reporter well, frank, the many bart riders turned to bus riders today. Bart set up 8 east bay locations to bus folks over to San Francisco right here to the transbay terminal. So how did day one of this strike go . We asked the riders. Trouble for me. This is not good idea. Reporter total frustration for riders snagging a seat on the last bart bus out of walnut creek. After 8 a. M. Many riders were out of luck and out of a ride. Yeah, pretty frustrating not to be able to get there on time. Reporter for the bart folks organizing this bus operation, the morning was a roller coaster ride. There were ups and downs but in the end it went well. Reporter the morning certainly had its moments before 5 a. M. Riders lining up to stake their seat on the bus in walnut creek, at times concerned there wouldnt be enough buses. In the end, 600 people used the bus from here but Ruth Phillips wished she had her bart back. Then, you know, you see that they are going to continue to talk and thats scary. So yeah, lack of sleep and glad its friday. Reporter one rider was confused how to get home. I have to go back to oakland. I dont know how to come here. Reporter bart will be running buses into the weekend. As for how this commute won on day one of the strike as for how this commute one on day one of the strike, bart gives itself a humble grade. A bminus. Reporter so we can all breathe a sigh of relief. We made it through the morning commute. How will the evening commute go . One of the bart spokesmen says it depends on the the San Francisco streets and the traffic on the bridge. Mark kelly, kpix 5. Thank you. Reporter a few dozen picketers, day one and no end in sight. I spoke with both sides of the dispute. They are willing to talk. Right now, no new talks are scheduled. If we hold the line, were going to play poker until this is over and wait to see who blinks first. What do we want . A contract Reporter Union members started marching at 4 a. M. Less than 12 hours after talks broke down. Progress is being made. We were substantially close to reaching an agreement. But in the last minutes in the last part of the bargaining, bart sort of did a switch. They came up with a poison pill. Reporter that poison pill not pay, not benefits, but work rules. Management insisted on changes in exchange for a 12 raise over four years. Our Union Members should work a full workweek before they are allowed to collect overtime on their regular day off. Reporter plus, bart says a lot of the employee business right now is inefficient with money being wasted doing things the oldfashioned way. But the unions say the work rules in question are more than that. There is language to protect you in situations of how work is assigned, to protect people around health and safety, around preventing sexual harassment, nepotism, favoritism. Reporter both sides say they would consider arbitration but cant agree on whats on the table. Bart wants the whole 57 million package, the unions say work rules only. Thats what the unions want. They want to take the money and run. And no. That is not acceptable. Reporter bart Board Director zachary says each board member needs to check with his constituents to answer this question which is more important to you, holding the line and protecting the longterm Financial Sustainability of the bart, or ending this strike as soon as possible . Reporter bart says its current offer will be on the table until october 27. And if the unions decide to accept it, they would get paid let tro active to july. Frank . Anne, there was some talk about replacement workers. Will they help next week . Reporter bart couldnt even start training replacement workers until workers went on strike. Thats finally happening. So in order to get that ball rolling, the board needs to approve that which could happen as soon as this weekend but the board member i spoke with said it really isnt in their purview right now. The governor stepped in and delayed that strike and that made a huge difference. Check out the line of people waiting for a bus at this stop at 20th and broadway in oakland this morning. Hundreds of bart riders are turning to ac transit to get around while the bart strike continues. And ferries are motoring back and forth across the bay. The San Francisco bay ferry is operating 12 boats instead of the usual 8 to ease congestion. The golden gate ferry is operating on a regular schedule from marin county. Other commuters took shuttle buses to get to work. Bart offered freed charter buses from nine east bay stations to San Francisco during the morning commute. The tickets are first come, first served. So if you didnt get a ticket this morning, you cant get one this afternoon. Hov lane hours have been expanded. Carpool lanes are open from 5 a. M. To 7 p. M. Its near bryant and division streets. Bus service has been rerouted and nearby streets currently are shut down in the area. The bicyclist has not yet been identified. The Alameda County d. A. Has charged randy alana with the murder of sandra coke of oakland. Randy alana will be arraigned this afternoon on murder charges. Coke was a federal criminal investigator who dated alana briefly about 20 years ago. Police say the two were together the night she vanished from her oakland home in early august. Her body was later found in vacaville. New details now. Prosecutors Just Announced they will not press charges against a firefighter who ran over and killed a survivor of the Asiana Airlines flight that crashed at sfo. They said the death of the 16 yearold student from china was tragic but firefighters responding to the crash did not violate any criminal laws. The case is considered closed. People running for cover as bullets flew. Investigators have recovered four ak47 rifles and two bodies believed to be the attackers. More than 60 people were killed in the siege. Somali terror Group Alshabab claiming responsibility. Prison workers thought they were following the letter of the law when they walked two murder convicts out the door to freedom. The cbs reporter Jericka Duncan tells us it turns out the documents ordering the Prisoners Released were fake. Reporter it was a homemade get out of jail free card that sent two convicted killers on the loose. Joseph jenkins and Charles Walker were serving life sentences when prison officials released them. The men were set free after the prison received these forged documents bearing the signature of Circuit Court judge belvin perry. The papers ordered the inmates immediate release. If you have some fundamental knowledge not a great deal of knowledge but some fundamental knowledge concerning a computer system, it is easy to go on and lift that signature and affix it on something else. Reporter judge perrys signature isnt hard to find. He presided over the Casey Anthony case and his signature appears on dozens of court papers easily accessible on the weapon. Authorities say they learned of the mistake when relatives of the man jenkins killed contacted them but that mans wife says thats not the case. Thats not true at all. They are trying to cover their behinds because they failed to meet the protocol. Reporter jenkins was convicted of the 1998 murder of roscoe pew. Pews wife crystal says she is in hiding living in fear. Not knowing where this man is and who is going to be next. Reporter police are searching the state for the two convicted they believe the men are receiving help and may have returned to the orlando area where both committed their crimes. What makes the story more bizarre, we just learned that two escapees registered as felons at a florida county jail right after they were released. Its still unclear who forged the documents and if jenkins and walker were work together. A man storms into a classroom wearing a ski mask and waving a gun but the gun was just a toy and the whole thing was just a drill. A scary one. Sixth graders at the middle school in greensboro, north carolina, were supposed to practice being aware of their surroundings but when that pretend gunman a School Employee by the way appeared in the classroom, it sent some students home crying. This comes back down to of all the things that happened in recent years regard to school tragedies, it was insensitive. Thats really where the issue lies. The School District agrees. The lesson went too far. But not all the parents are upset about it. They feel the more realistic the drill is, the better prepared their children will be in a reallife situation. That is a bit of a scary drill. Right . Can you imagine . Oh, my. Hard to believe they are even thinking about practicing things like that in that grade. Lets talk about the weather. Outside we have seen the sea breeze make a returning bringing with it some low clouds and fog, some dense fog out along the coastline. But most of that confined right at the coast now. You can see inside the bay, we have plenty of blue skies and working on a good afternoon. But the sea breeze is blowing so the temperatures are going to be down just a little bit approaching the coast. Right now were warming up in the valleys, though. 77 degrees already in livermore. 74 in concord. 65 degrees a little breezy into San Francisco. And 69 in san jose. As we head throughout the afternoon, still going to see some lingering clouds toward the coastline mostly sunny elsewhere and then tonight, clear inland, some patchy dense fog along the coastline and maybe a couple of patches inside the bay but the weekend is looking good. Lots of sunshine coming our way after some morning clouds. High pressure in place now going to stick around for the weekend bringing us some mild weather. But we have seen enough of a sea breeze not getting the offshore wind like the past couple of days. Well still see fog and cooler weather at the beaches but away from the coast it heats up. 80s into the Central Valley for today. About 68 degrees in monterey bay and mostly sunny skies. 73 yosemite. 63 lake tahoe. Computer models picking up on some of the patchy fog. Not clearing out much. Flames and smoke pouring from a residential highrise on the west side of los angeles in the brentwood neighborhood. A posh area, more than 100 firefighters are on the scene. The fire may have started at one of the luxury 25 25 story luxury building there. Right now its unclear if there are injuries. But well update you. A marathon runner with a message of hope and strength. A bay area mom isnt just training for sundays nike womens marathon. She is doing it while battling cancer. I did not run before the nike. Reporter amy is known as a motivator in her running group. She has a great sense of humor and also has a toughness about her. Reporter she began running marathons when the children of two friends were diagnosed with leukemia. Aiden and ashley called the a team. But in july, amy became a part of that team. I said, well, i guess they need a team captain. Im a for amy. Reporter she was diagnosed with neuroendocrine gastric carcinoma a rare form of cancer. Its aggressive. Theres not a lot of treatment for it. The only treatment right now is chemo. Reporter even though chemotherapy is hard on her body, amy still trains for the nike womens marathon in San Francisco. Im running to show them that you can get through the obstacles. You can get through the challenging times. And get through it with a smile on your face. Reporter her teammate will carry amys bib until the 22nd mile where she will hand it off to her. Having the bib with me it will be nice to have a physical reminder that amy is there in spirit. Reporter and amy will run the last 4. 2 miles herself for the four rounds of chemo she has been through and the two left in her treatment cycle. Im not someone that is going to tuck the tail between the legs and say, oh, life is over, i have cancer. I said im going to beat the odds. Reporter her fighting spirit is inspired by her husband, two children and the future she wants to share with them. I have never felt anything so deep the love for my kids, my family. And i dont want anything to take that away. Cancer will never take that away. And i want them to know that [ crying ] that im doing this fight for them. For me, for our family and for everyone out there thats struggling. Reporter although she doesnt know what waits for her at the finish line, with every step, amy keeps hope. She is great. Nike just agreed to give bibs to her family, husband and two children so they will run across the finish line with her. Oh, great.
