The family of a guatemalan immigrant shot by San Francisco police is bringing a federal civil rights suit against the department. He was shot by officers in the mission in february. Officers say they opened fire when he lunged at them with a knife. But the familys Attorney Says their forensic evidence shows he was shot in the back five times. If i were to shoot somebody who is running away from me, four times in the back once in the back of the head, im getting charged with murder. Thats an easy case. The sfpd would not comment on the suit calling the shooting an open investigation. The officers involved are now back on patrol. A San Jose Police officer finally faced charges today ten months after his arrest involving a secret stash of pot. Veteran cop son vue was formally charged with possession of marijuana with the intent t sell. He was arrested in june when police found 13 pounds of marijuana and growing equipment in his personal storage locker. Police say its taken this long to build a case against the officer. And the resulted from that search warrants determined that there were email correspondence in the name of mr. Son vu in which marijuana cultivation equipment was ordered and there were discussions pertaining to marijuana in those email correspondences. Police also found almost 6,000 in cash in vus personal car and a thumb drive containing internal police files on recent calls to marijuana grow houses. Vu is due back in court monday for a bail hearing. Other bay area headlines tonight, a tow truck rear ends a vta bus. This in san jose. The collision shattered the trucks windshield. The tow truck driver had two children with him at the time. All three to be taken to the hospital with minor injuries. More than two dozen buildings on the cal campus lost electrical power today. The outage happened after a contractor accidentally cut a power line at about 11 a. M. The power was out for about two hours. Students did not get to skip class in some cases. It is lined with red oak trees planted decades ago but theres a problem. The trees are causing the sidewalks to buckle which is causing people to fall. Which is a serious issue. I love trees. Unfortunately these trees have to go. Reporter they were celebrating trees at this arbor day gathering. He says something needs to be done about the 44 red oaks on broadway. If you look at sidewalks bubbling, if you look at sewer lines being destroyed, thats where we need to look as a city. Reporter the trees were planted 22 years ago to beautify the entrance to the city. 300,000 in donations paid for the trees. Cutting them down has some folks pretty upset. If we all have to chain ourselves to the trees to save them thats what well do. Reporter the former mayor says these trees have no business going anywhere. If it comes down to a choice of do we want to support concrete or living things, im on the side of living things. Now the city council wants to see if theres a compromise. That will take time and monday. It will cost 10,000 to do studies on it and we can see possibly maybe we take every other tree out. Reporter and one more thing. Broadway is also state highway 12 so nothing gets done without caltrans approval. One city official says now with studies and permits and caltrans involved it could be up to a year before anything happens if anything happens to these trees at all. In sonoma, don ford, kpix 5. So far caltrans has not commented on the tree controversy. Sinbads isnt about to leave its spot on the San Francisco waterfront. So the city is going to have to sue the restaurant. The port which runs the property says sinbads lease expired last month. It needs sinbad to move so it can knock down the building, make way for a new ferry terminal. Sinbads owner has said his lease allows the restaurant to stay open through the spring of next year. A historic napa landmark damaged during the august quake has been fully repaired. Crews completed the last touchups on the napa steam laundry building this week. The property has a long history in the city dating back to world war ii. Repairs totaled about 600,000. More than 30 of the buildings exterior has been reengineered to meet seismic standards. The drought is revealing an unpleasant side of the normally Pristine Lake tahoe. The water levels have dropped so low that trash buried for years is now being seen on the surface. Reporter colin ligren shows us whats being pulled up from the mud. Reporter these beaches are naturally beautiful but they dont stay that way on their own. Several times a year the league to save lake tahoe hits the sand and cleans up the trash. We find it very important to have beach cleanups all yearing on there protect the shoreline because eventually, all trash will make its way to the lake. Reporter once the trash is in the lake it can stay there a while as became obvious this week. A beach cleanup on sunday found trash buried in the mud that had probably been there for years. The water level is definitely lower this year. And we did find some trash that we might not have found when the level is higher. Reporter broken bottles, rusted cans and jagged pieces of metal all exposed by tahoes below normal water levels. Tahoe is only a quarter of a foot below the natural rim but a full 6 feet below its maximum capacity. Thats most obvious here at this buoy field. These concrete anchors are supposed to about 6 feet under water. But right now theyre fully exposed. We want to protect the environment. We want to protect lake tahoe. We want to protect its clarity. Reporter the first step in taking care is picking up your trash. Sundays cleanup yielded 170 pounds of it. The discovery of the old trash shows whats left here can stay here. That was colin ligren reporting. Californias not the only place dealing with the drought right now. The water levels at the Great Salt Lake in utah are at an all time low. Boat owners there are making a dash to get the boats out of the marina before they sink into the mud and get stuck. In some places the water is only four feet deep. Reporter ken, if you take a look here, theres a sign letting people know that this starbucks is shut down. The companys Corporate Office also confirmed it. This coffee crisis started just before 6 p. M. Sales registers arent working across all coffee chains here in the United States and in canada. So its International Starbucks says it happened after a daily system refresh and a spokesman told cnn money this is not a hack. They are working to get the systems back up. And we know that the glitch has closed most of the stores but our photographer down in los gatos told us there is one starbucks there open but they are taking cash only.
