A lot of protesters marching through rows of car, all headed to the Ferguson Police station. Police are lined up to take defense of the building if they have to, well be watching the situation all night. Live update at 6 30 if not before. Thank you. All right, bringing in the legal analyst, melissa, the case before a grand jury, normally low bar for indictment. Right, looking probable cause, you have a grand jury to determine whether theres enough evidence to warrant an actual criminal trial, so not nothing, but it is low bar to just see if theres enough to actually take the person to trial. All right, we know the grand jury doesnt have to reach a unanimous decision, whats the makeup . Seven men, we know five women, nine white people on the grand jury, and three black people, and i tell you, it might be the only thing we learn because state law requires the county to withhold the identity of the members of grand jury, and they deliberate in private and we my never know whos on it or how or why they voted the way they did. And any statements the grand jury makes, theyre protected, what about the range of options, i suppose they can let the officer go with no charges leading up to murder. Thats right, and missouri is a Death Penalty state, so theres murder all the way down to manslaughter, all the way down to nothing at all. In the case the prosecutor turned over all the evidence to the grand jury, and said you guys decide what youd like to charge, thats unusual. Usually the prosecutor will say this is what we think you should charge them with, but in this case its all in the hands of the grand jury. And the grand jury has had the case now for the past three month, does that seem about right in terms of how long theyve been deliberating . Well, remember they only meet once a week, so it seems like its taken awhile, but theres also evidence that theres a lot of witnesses and experts they have taken into consideration as well. All right, thank you. Phil is live in oakland, whats happening there . Reporter well, this is demonstration going on awaiting the word from the grand jury, just like a lot of the rest of america. Protesters gathering here at 5 00 oclock, promising to go into the night. We just spoke a couple of minutes ago with a Police Spokeswoman and asked her the rules this time for the demonstrations. We want to remain fluid, we want to remain open, but the bottom line is we want it to be safe the record everyone. Reporter so the basic rules are going to be theyll allow them to go out in the street if they want to, taking over the intersection is sort after a tradition here, and then of a tradition here, but if they hit the stores, the police will move in. So far however its noisy but peaceful. Everyone is waiting for the verdict to come in, theyve already made up their minds, and theyre letting the world know about it. All right thank you. And of course heres whats going on at the county courthouse in ferguson, and if anything starts to break well go to it immediately. And mark is in San Francisco, any demonstrating out there tonight . Reporter it has just started, they started trickling in around 5 00 today, its definitely grown a little. I spoke with some of the protesters, theyre out here for one reason, and its what theyre calling an epidemic of Police Brutality, not just in ferguson, but all across the country. Now this group, this political protest, its an Organization Act now to stop war and end racism. Theyre holding the protest here in the mission, and two dozen protests all across the country comparing ferguson to grant. And police say brown struggled with the officer, but the crowd here saying brown was shot with his hands up, unarmed, and theyre calling for the grand jury to indict him. So the protest here at 24th and mission, a lot of anticipation as far as what that grand jury is going to decide. I spoke with San Francisco police just a few hours ago, they tell me theyll be monitoring this corner of the mission for the rest of the evening. Of course theres also a little bit of concern when it starts to get dark as it is right now, that some trouble could start to brew, but police are ready for anything at this point. Now the grand jury has gotten the case, and theyve been looking eight for several month, and weighing all the different evidence and information thats come in, and even to the point of subpoenaing their own witnesses and getting people to testify, when they render their decision to charge the officer or not, what happens after that . If they decide no charges, can the county prosecutor come in and say we are going to charge them . Yes, they can. The prosecutor can make the decision to indict the officer anyway. He could also get a second grand jury to hear the case again, but they already said they dont plan to do this, so while he has the power, its unlikely well see any additional moves by the prosecution. Theres still two federal investigations going on though. What are those two investigations taking place now . The department of justice is looking at two things, the actual incident, and theyre also looking at the Ferguson Police department as a whole to see if theres issues causing violations of civil rights, so theyre both happening, not going to be effected either way depending on what the grand jury does. Whatever happens tonight, the brown family would still have the right to file civil litigation against the Police Department and officer himself. Yes, in the oj simple son simpson trial, he was exonerated, but the family still filed a suit against him, and got money. Its actually easier to prove wrongful death in a civil case than in a criminal case, and thats one reason why they might be looking to do that. How likely would the brown family for them to come, to go after officer wilson versus the Police Department, versus the state, versus the county . Well, they definitely want to go after the state and county because thats where the money is, so theyre looking to show institutional bias, and they should have known this would happen, and wilson maybe demonstrated some previous issues with a situation like this. Those are the kinds of things theyd be doing. Officer wilson probably doesnt have enough assets for him to be the target of the lawsuit. Standing by, theres a live picture in the inset there of ferguson both inside the county prosecutors officers, and outside. Probably the courthouse or the Police Department there where hundreds of people have gathered tonight to be there when the information comes down from the grand jury. We are going to monitor the situation there and cut back immediately once anything gets going. In the meantime other news to talk about, including the new bart extension to Oakland Airport. Its up and run, and it could be decades before the connection pays for itself, but Ann Notarangelo shows us if initial rider reaction is an indication it could be sooner rather than later. Im so happy that i was born in the era of technology because i love it reporter this weekend nearly 3900 passengers took bart to oaklands, up about 28 percent compared to the same time last year. All eyes on wednesdays big travel day. If they get a 20 percent increase from last year, theyre looking at 5,000 people on the threemile stretch, but with a price tag of 484 million to build it, it will take nearly 81 million rides to cover the cost. Is it worth it . Whats the airport worth to the area . Reporter bart to fso has more than paid for it. Riders fares will cover the operating expenses in oakland, and bart thinks by 2030 theyll get all the money it took to build it. Thats if it lives up to expectations. For those of you watching cbs prime time programming, it will continue shortly right where it left off, but right now we are about to hear the grand jury decision in the Fatal Shooting of Michael Brown by ferguson, Missouri Police officer Darren Wilson. For the past three months, 12 st. Louis county grand jurors have been hearing evidence in the case. Wilson shot brown, who was 18 years old and unarmed, during a confrontation on a ferguson street. Wilson says there was a struggle over the officers gun and he about 150 people crowded outside the county Justice Center to hear the announcement to be part of the communitys history. This courthouse has been secured by National Guardsman and Police Officer, and they want to hear what the 12 members of their community, seven men, five women, did they find something criminal in what officer wilson did the day he shot Michael Brown, and thats what theyre here to hear, and this community is bracing for whatever happens. And heres where were expecting the county prosecutor to show up in a few memo, and i believe moments, and i believe we see him coming through. Yes indeed, the county prosecutor with the grand jurys decision. Good evening. Thank you for your patience. Sorry were late getting up here. I have a statement, the very beginning here, and then well be happy to answer some questions when were finished with that. First and foremost id like to extend by deepest sympathies to the family of Michael Brown. I know regard letters of the six regardless of the circumstances here they lost a loved one to identify lens, and their violence, and their pain knows no bounds. August 9th, Michael Brown was shot and killed by officer Darren Wilson. Accounts filled with speculations on social media, and little if any solid accurate information. Almost immediately neighbors began gathering, and anger began growing because of the various description of what had happened, and the underlying tension between the Police Station and neighborhood. The Police Conducted an extensive investigation at the crime scene, at times under trying circumstances. Beginning that day and continuing for the next three months, along with the agents of federal bureau of investigation at the direction of attorney general eric holder located numerous individual, and gathered additional evidence and information. Aware of the growing concern that the investigation and review of this tragic death might not be full or fair, i decided all the physical evidence gathered, any people witnessing any part of the shooting and any other matters would be presented to the grand jury. 12 members of community selected by a judge in may of this year, long before this shooting occurred. Id like to briefly expand on the unprecedented cooperation between the authorities. The attorney general pledged federal investigators would work with local authorities as closely as possible at every step of the way and would follow the facts wherever they take us. Our separate investigations followed the trail of facts with no preconceived notion of where the journey would take us. The only goal was that the investigation would be thorough and complete to give the grand jury, the department of justice, and ultimately the public all Available Evidence to make an informed decision. All evidence obtained by trillion authorities was federal authorities was immediately obtained by the st. Louis county investigators, and vice versa. An autopsy was performed at the request of the brown family in addition to the federal autopsy. All this information was also shared. Just as importantly all testimony before the st. Louis county grand jury was immediately provided to the department of justice, so although the investigations are separate, both the local and federal government have all of the same information and evidence. Our investigation and presentation of the evidence to the grand jury in st. Louis county has been completed. The most significant challenge encountered in this investigation has been the 24 hour news cycle, and its insatiable appetite for anything to talk about. I realize the lack of detail around the shooting frustrates the media were ask general public, and breeds suspicion all distrustful of the system. But the closely guarded details, especially of the physical evidence give Law Enforcement the yardstick to estimate the truthfulness of witnesses. Many witnesses to the shooting of Michael Brown made statements inconsistent with other statements they made, and conflicting with the physical evidence. Some were completely refuted by the physical evidence. Before the results of private autopsy were released, witnesses on social media during interviews and questioning claimed their saw the officer stands over brown and fire multiple rounds in his back, others said he shot him in the back while he was running away, but the autopsy showed he didnt sustain any wound to the back of the body, no additional witnesses made such a claim, and several witnesses adjusted their stories in subsequent statements. Some even admitted they didnt witness the event at all, but merely repeated what they heard in the neighborhood or assumed had happened. Fortunately for the integrity of the investigation, almost all initial witness interview, including those of officer wilson were recorded. The statements and the testimony of most of the witnesses were presented to the grand jury before the autopsy results were released by the media, and before several Media Outlets published reports they received from a dc government officials. The jurors were therefore, prior to the time the information was released going public, and what followed in the news cycle, the jurors were able to have already assessed the correct of the witnesses credibility of the witnesses, and those were consistent throughout the interviews and with the physical evidence. My two assistants began presenting to the grand jury august 20th. It was presented in an organized and orderly manner. The jurors gave us a schedule of when they could meet. All 12 jurors were present for every session and heard every word of testimony and examined every item of evidence. Beginning august 20th, and continuing until today, the grand jury worked tirelessly to examine and reexamine all of the testimony of the witnesses and all of the physical evidence. They were extremely engaged in the process asking questions of every witness, asking specific witnesses and specific information and asking for a certain physical evidence. They met an 25 separate days if the last three months, heard more than 70 hours of testimony from about 6 other witnesses, and review 60 witnesses, and reviewed hours and hours of recorders o. Media recordings of media and police interviews. They examined hundreds of photographs, some of which they asked be taken. They examined various pieces of physical evidence. They were instructed on the law and presented with five indictments ranging from murder in the first degree to involuntary manslaughter. Their burden was to determine based upon all the evidence if probable cause existed to believe a crime was committed and if Darren Wilson committed the crime. Theres no question that wilson caused the death of Michael Brown by shooting him, but the inquiry doesnt end there. The law authorizes officers to use deadly force in some situation, and all people can use deadly force to defend themselves. So the grand jury considered with wilson was the initial aggressor or whether there was probable cause to believe women son was wilson was authorized to use deadly force in this situation or acted in selfdefense. I detail this so everyone will know as promised by promised by me and the attorney general there was a full investigation and examination of all the evidence and presentation to the grand jury. Second, as a caution to those in and out of the media who will pounce on a single sentence or witness and decide what should happen in this case based on that tiny bit of information. The duty of the grand jury is to separate fact from fiction, after a full and impartial and critical examination of all the evidence in the law, and decide if the evidence supported the filing of criminal charges against officer wilson. They accepted and completed it in an expeditious manner. Its important to say again they are the only people, the only people who have heard and examined every witness and every piece of evidence. They discussed and debated the evidence among themselves before arriving at their collective decision. After their exhaustive review of the evidence the grand jury deliberated over two days making their final decision. They determined that no probable cause exists to file any charge against officer wilson and returned a no
