We dont. But this one is a bad one, ken. Alleged bad cops caught on video, five of them current officers who now have been suspended without pay. Their guns taken away. A sixth officer was already fired on an unrelated case and tonight, an emotional chief responds. Our department is shaken. This was our worst fear. I dont know that it gets any worse than this. Reporter six officers were indicted for being dirty cops. The visual proof, surveillance videos released by the public defender three years ago. Undercover cops allegedly barging into Tenderloin Hotel rooms without a warrant, in some cases stealing computers, cameras and money and lying about it on police reports. Another case officers are accused of stealing marijuana from evidence and making deals with informants to sell the drugs and then split the proceeds. These officers were called in court regularly. They were involved in making hundreds of arrests. And their word was believed by judges and prosecutors who relied on their testimony to secure convictions. Reporter public defender jeff adachi says the alleged misconduct led to the dismissal of 100 cases because these officers could not be trusted. He will be looking back at even more cases. The chief says he has made a lot of changes in procedures and policies involving undercover operations. So that he says this will not happen again. Five of the officers will be in court tomorrow. A sergeant found himself in the spotlight in 1998. He and another officer shot and killed a man a block away from here. They said the man was trying to run them over. Firminger earned aid gold medal after valor for that incidents. In 2001 he was at the metreon Movie Theater in the bayview when several Police Officers shot and killed a person in selfdefense. Firminger did not fire his gun in that incident. The persons mother said the police were unnecessarily aggressive. She is happy to hear about the indictment that officers are accused of using their badges to committee crimes will now face justice. I think this is going to turn out for the best. Its going to force the chief to restore trust and respect in the community by cleaning up the department finally. Reporter firminger and four other Police Officers are due in federal court tomorrow. Live in San Francisco, im ryan takeo, kpix 5. Kpix 5s phil matier joins us now and tells us about other scandals San Francisco police have dealt with in the past. Its not common. We are not chicago. Were not new york. This doesnt come down all the time in San Francisco. Its rare. There are a lot of good cops out there. Most of them are good. But there have been problems in the past. Reporter thats right. Some of them have wound up in criminal court. Others in the court of public opinion. For example, lets go back to 2002 when they assistant chief alex fagans son and another cop who allegedly got into a fight with two bar patrons after hours over a bag of in a me thats triggered fajitagate. Another had an indictment of a police chief and nine officers including greg suhr indicted on charges of conspiring to obstruct justice. The charges against the brass made National News but were tossed out by a judge as being groundless. The two officers actually involved in the fight were acquitted in jury trials, as well. Then in 200520 officers in the bayview station were suspended for making a series of joke videos that mocked the homeless as being drunks minoritity and women as sex objects and while it embarrassed the department and some officers were fired, no criminal charges were fired. And in 2010, Deborah Madden a technician at the Police Crime Lab was found to be skimming small amounts of cocaine that were supposed to be tested as evidence. Hundreds of cases had to be tossed as a result of the scandal. Madden admitted to having a drug problem and after two jury trials, pleaded guilty to misdemeanor cocaine possession. What makes this difference is this is a case involving street cops in the performance of their duties. The question is, whats going to go from here . They are being suspended without pay. There will be a trial. If the past is any indication they will probably be found not guilty. We did this story, i remember, adachi was making noise years ago you remember this story. He had the video. He went to the Mayors Office with it. And for some reason, it im not saying it got brushed under but it went away. Now its back. Reporter ill say exactly what happened. Again this has to do with San Francisco and its byzantine nature. The then police chief is the current District AttorneyGeorge Gascon so he felt he couldnt handle the case. He passed it on first to the state attorney general, who was Kamala Harris the former d. A. Who with obviously d. A. When this problem was happening. She had a problem, a conflict so it went to the feds. Its been under investigation by the feds for the last couple of years ago and has been the subject of two grand jury investigations. This is what they have, six cops. So quietly behind the scenes the investigation is ongoing. Reporter ongoing. Most of these cops have been in the record room sort of on ice waiting until the results came out. Now they find them. We have the history on it. Thank you, phil, appreciate that. More back to that breaking news on the freeway shooting. Joining us on the line is officer eric thomas with the chp castro valley. Officer, what can you tell us about the situation right now . Reporter around 4 00 we got a call of a freeway shooting. The victim vehicle is on scene cooperating with chp officials. The shooter vehicle was a silver ford focus. And as far as any leads on that information, license plate or identification of the driver, the chp on scene is speaking with possible witnesses to gather any of that information. So you are saying that this ford focus took off. Any indication of what direction they went . They got off the freeway at all . Reporter its unknown whether they got off the freeway or continued on. Like i said, the officers on scene are trying to gather as much information as they can regarding that. Officer thomas wanted to find out several slugs appeared to go through the windshield. Anybody hurt . Nobody was hurt in this incident. Any physical description of the driver of what you say was a silver ford focus from witnesses . What did this person look like . Reporter thats all i have for now is a silver ford focus. I dont have a driver identification. Hopefully, we can get some of that information from the investigators on scene. And any indication of what led to this shooting . Was this random . Did the two know each other . Unknown whether they knew each other or if it was random. So theres a possibility this may have been a road rage incident that escalated and shots being fired then, huh . Quite possible and still under investigation. All right. It was closed down for about an hour. You can see traffic backing up just a bet now. Shots fired into a vehicle and heres the scary thing. You have a man, a woman and a couple of kids in an suv and for some reason, some sort of altercation between a couple of drivers, at least three bullets fired into the car. The windshield taking the brunt of it. But luckily almost miraculously nobody hurt. Officers are still looking for a silver ford focus. They dont have that much information about where it went after it took off after the shooting and so they are currently looking for that vehicle right now. We are going to keep you updated on the situation on the roadways and on this investigation. Meantime, phantom doctors, thats what Many Health Insurance consumers are finding on the states new healthcare exchange. Now a state senator wants changes in state law that would protect them from baitand switch tactics. Reporter julie watts was first to investigate complaints on inaccurate doctors lists on the covered california website. On the website, my providers were in network. If i wasnt going to have access to my doctor i would have chosen a different insurance. Reporter first they complained of baitandswitch when they found out their doctors originally listed on the covered california website werent actually accepting their plans. So they started calling other doctors on their insurers list. The first three or four pages of doctor, they dont take any covered california plans. We want those enrollees to contact us. Reporter the department of managed care which regulates insurers on the exchange not only helps to solve consumer problems but also relies on consumer complaints to hold insurers accountable. They say they have only received 30 complaints regarding the doctors list so far. We received nearly 100. At the end of the day, we know these lists are flawed. It amounts to a baitand switch. If it was any other industry they would have been fined by the ftc. But they are regulated by you so who hold these insurers accountable for these flawed lists . The department of managed healthcare. Do they violate the law . The law allows that list to be subject to change without notice and requires the health plan to update it quarterly. Reporter one would assume they provided an updated quarterly list to covered california. So who is checking on a quarterly basis or at all . We do spot checks. Those lists of the providers that the plans are in contract with them. We are finding so many inaccuracies i find it hard to believe that you wouldnt have found them . Reporter after consulting with a colleague in the room she admitted they dont necessarily check the insurers list for accuracy. They check for adequacy. Insurers must have one doctor of any kind for every 1200 enrollees. One primary care doctor for every 2,000. So by that rationale, state law would only require blue shield to have three doctors in all of alameda county. Reporter which is exactly why these are state minimum standards. Reporter she says patients also have to be able to get an appointment within 15 days within 15 miles of their homes. But try telling that to these folks. Still looking for a doctor where 15 miles makes a big difference. They are in areas of east oakland that have a lot of violence. Its a true nightmare. It really is. Reporter now, we asked one insurer for an updated list of every doctor in alameda county. We found out of more than 1200 doctors, fewer than 200 were actually accepting new primary care patients. After we shared our findings with senator ted gains he announced today he is calling for a public hearing and is considering legislation that will mandate daily online reporting of any changes to these lists. Tesla wants to be making those batteries by the year 2020 when it could be producing half a million cars. A far cry from 2008, when the car Company Almost went bankrupt. At tesla we had multiple near death experiences. Again, what are the odds of a car company succeeding . Pretty darn low. And launch of the spacex reporter even riskier, a rocket ship company. Beginning of spacex i really just reserved money for three failures. So we havent had three failures. Then we just barely had enough to scrape together to do a fourth flight and that succeeded. San rafael is offering free sandbags to the community in preparation for the heavy rain. Residents spent most of the day filling those bags. Kpix 5s da lin is in union city and tells us tomorrows wet forecast would be an indication of future el nino conditions. Da. Reporter its dry where we are here in union city but take a look in the distance right above me. A lot of dark patches of clouds an indication that were not going to stay dry at least not here for too much longer and if you like the rain that we saw yesterday, or the long Term Forecast for next winter is already looking better than what we have seen in the past few months. After months of persistent drought, any wet forecast is a good forecast in the minds of most. And to offer a little optimism, researchers at the National OceanicAtmospheric Administration say its getting more likely el nino conditions will happen next winter. 50 chance of one occurring. Reporter many people associate it with wet winters like in 1997 a strong el nino year contributing to double the rainfall total about 47 of rain in San Francisco, the second wettest winter on record. But el nino conditions dont always translate into more rain. During the 2006 el nino year, rainfall in california was about 30 below normal. In 19761977, the last year of the very severe twoyear drought in the 70s, the second year was an el nino year. So it doesnt necessarily mean lots of rainfall for california. Reporter but researchers believe the stronger the el nino and the warmer the water, the greater the likelihood of a wet year. Water agencies like east bay m. U. D. Can only hope for a good year to come. Something that the district is looking into is potentially taking water in wet years and storing it in ground water basins for dry years. Reporter while water districts hope noaas prediction is correct, we all know longrange forecasts are just forecasts. It would be great but im staying in the present moment. Dont want the flooding but we could use it. A weak el nino does nothing to our rainfall chances. A strong el nino is almost a guarantee that well see above normal rainfall. And we could use that and for the first time in 14 months, february 2014 will be above normal rainfallwise. How about that . The first time in more than a year. We are looking live outside tonight. We are mainly cloudy but were not wet. So where is that big storm. Its off to the west and will arrive in six hours with a thud.
