available today for its free shuttle service. not clear why some of those drivers weren't told to stand down. a move by governor jerry brown bought a little more time. he appointed an independent and if they don't give it up soon. we'll be striking here until june. >> this was a scene today after governorrier reimbursements' brown at b.a.r.t's request put the breaks on a possible second strike and instead called on an independent panel to find out why the two sides can't come to an agreement. >> it was the only way to keep the trains running monday morning. >> the unions, however felt p blind sided by the governor's move. >> the last day we strength 9:23: 9:00 -- spent from 9:00 in the morning until 11:00 at night and they only gave 15 minutes or less on the issue >> given the damage a second b.a.r.t strike could have caused the region, the call for a cool down wasn't unexpected. >> we're looking for a break down in collective bargaining. >> sources close to the talks tell kpix that while there appeared to be some movement on how much workers should pay for health care, the two sides remain far apart on wages and b.a.r.t's demand that the workers begin paying into their pension. so now the panel will take a look. what they will do is look at the issues that divide the party and analyze if the character of the negotiations to date and give the governor a recommendation on what they think he should do. >> this will not cut the deal, but it will give the parties the time to cut the deal. >> but, if in a week the two sides are still far apart, then the governor could call for a 60 day cooling off period that would keep the trains running into at this point, however, no one has set a date for new talks. >> this is new territory. we're not sure. the mediators were supposed to get back to us. >> maybe we don't need to get to the governor having to decide whether to do a cooling off. we're hoping we can get to the table and hash out those to walk off the job. the union is delivering a strike notice today. the official notice that a strike could happen at 12:01 wednesday morning. union members have been without a contract sense june. christin ayers is following the talks in oakland, and we will have more. this early morning truck fire derailed the bay bridge commute all day. this is what the bay bridge toll plaza looked like at noon, a parking lot. check out the scene at 2:00. gridlock. it was not until closer to 4:00 o'clock that at least the car pool lane showed some movement. ken bastida with a look at how things are going. >> reporter: yeah, allen. i heard people describe it as a nightmare. people were not asleep, though. they had to live through this two or three hours to cross the bay bridge. a lot of them ran out of gas in the weirdest places. other pimozided to get out and argue -- other people decided to get out and argue with each other. other people said what the heck, i am going to the bathroom. that's how we behaved as commuters on the bay bridge. can't blame everybody, though. this is something that happened in san francisco this morning. >> 5:45 a.m. this trucker notices something is not right. >> i felt a wobbling on the front tires. then the passenger side front tire blew out. >> mata pulls over and sees flames shooting from his eni didn't know come partment >> i saw flames coming from the windshield wiper hose. i grabbed the fire extinguisher. >> someone captured this video on his cell phone. >> we heard the blowout. it couldn't have been but two minute and then all of a sudden the whole thing was engulfed. >> i grabbed the extinguisher, but it was nothing i could do. >> it took firefighters an hour to get the fire under control. the fire shut down two lanes bringing traffic to a stand still all day. and it's not over yet. >> we have caltran here and they are going to be looking for damage once the vehicle is removed. >> who would ever think b.a.r.t would come to the rescue, but it did. check out the car pool lane. there's two vehicles coming down wide e. fast track lanes running good. these guys are still in a good mood. they're all laughing and waving. some of them waving different signs than other people. we apologize for that. allen, back to you. >> thanks. yesterday, before the one year anniversary of chevron's fire. chevron will pay $2 million in fine after they sent toxic smoke into the sky last year. 15,000 people went to local hospitals. 19 employees were injured. kpix 5's ann notarangelo spoke with the district attorney pact why this settlement is so -- district attorney about why this settlement is so unusual. >> reporter: thed -- mark pete r.son called this settlement historic. >> he pled no contest to six criminal charges. that is very rare in the state of california. probably even nationally. >> the settlement with thed and state attorney general's office con--d and state attorney general's office confirmed they committed violations. it also failed to correct deficiencies in equipment and failed to prevent employee exposure to hazardous conditions. investigations have determines the cause was fired by a failed corroded pipe that had been semid for placement several times over the previous deck day. while chevron says they have now inspected 16,000 pieces of pipeline, in this statement chevron agrees to inspect every piece to make sure it has not worn down. >> there may be people critical of this and said you should have got more money. it's not about the money. that isn't what we're trying to achieve here. we're trying to achieve a safe refinery. we think we have achieved that or we will hold them accountable to being safer. >> in a written statement today, chevron tended to focus on what it has done since the fire. saying they spent nearly 2 million hours repairing the unit. it also says it is conducting a comprehensive inspection of the refinery. chevron says we have reimbursed we community members and local government agencies for medical and response related cost. goes on to say they are implementing a multiple dollar expansion of its air monitoring system. >> reporter: this does not end chevron's legal challenges, though. the city of richmond are pursuing civil lawsuits. with those lawsuits in mind, i should point out that today chevron pled no contest to these charges. that is not the same as pleading guilty. ann notarangelo kpix 5. >> chevron now begins a three and a half year probation. they will be required to prove inspections are being carried out and employees are being better trained. checking headlines around the bay area. a pot left unattended on the stove being blamed for a san jose apartment fire that left 20 people without a home. flames broke out about midnight on the city's west side. firefighters say those flames quickly spread to several units. fortunately nobody was hurt. fbi agents investigating a series of bank rob i reimbursementses believe the robbers may have surfaced again. this photo shows one of three men authority esiason believe are behind those armed robberies. just last week, multiple banks in san francisco's richmond and lake side neighborhood were hit. authorities captured these surveillance photos from banks that were robbed in june saying these men could be behind the recent crimes cruz the company that provided ambulance service has filed for bankruptcy protection. arizona-based rural metro filed for chapter 11 yesterday just days after it made good on more than $2 million in fines and other payments that it owed the county. the filing includes a deal with lenders that will allow the company to keep operating as normal. although it is $22,000 for the full day program, there are many programs out there sticker shock may be hard to get over, the people we -- behind the sticker price believe it is termly worth the price. >> it may look like a college, but if you take a closer look, you will notice toy trucks and a sand dune. on the inside, well supplied cottage style classrooms. >> although it is $22,000 for the full day program, there are many programs out there that are still in the same ballpark. >> andrea heart is the director. she says the price tag is justify for the comprehensive educational and early childhood development program being offered here. >> accused dings are something that are focused -- accused dings -- academics are focused on, but there are other things. parents tell us about the many experiences they will be able to have. >> we are in one of the preschool classrooms. >> what does your money buy? for one, small age specific classes with no more than 12 students each, and those students will rotate to specialized rooms from everything to art and music or s.t .e .m. or art, music and math. >> the young child is a natural scientist in the way they approach the world. >> robin stone is the s.t .e .m. specialest. she believes it is never too early for the kids to learn about the world around them. >> even thed toler who drop --ed toddler who drops the spoon is learning about gravity. they are learning about programs that are natural interest to them. >> the school is on eight acres. parker has remodeled the facility and says there is definitely a market for high end preschool. >> the parents are asking for a high quality program they can believe in. >> reporter: now, doesn't school runs from kindergarten through high school. some of the people enrolled here at the preschool level will continue on through that private school. this school is open to anyone. all you have to do is be able to afford it. >> be able to write the check. mark, is there still space available at the preschool? >> reporter: private -- believe it or not, there is space. they haven't opened officially. they don't know exactly how many or 4-year-olds they will get. you have some extra money in your checkbook, maybe this is for you. >> the yemen is behind several plots including the attempt to blow up a plane. concerns of a possible attack of san francisco and new york beefing up their police presence. security will be stepped up at landmark, religious sites and embassies. leaders in both cities say there is no specific information leading to that decision. they say they are just handling the terror threats with the t most caution. >> there are various buildings that are critical infra structures. those are just some of the places that we're going to make sure our police presence is felt. >> we always encourage our visitors whether they be on the or on our transit operation, if they see something, say something. >> san francisco police say they will monitor various areas of the city and determine whether additional resources might be necessary. the man they caused of using his car during a deadly rampage has had numerous run- ins with the law. police in santa monica say 38- year-old nathan campbell have been arrested in colorado, florida, georgia and california in the last 11 years. all the arrests were for relative limy there offenses like trespassing and shoplifting. but the biggest question surrounding campbell's attack is why he did it. cbs reporter dave lopez has more. >> according to police, one hour after nathan lewis campbell shown here on the video plowed into 12 people, he asked one of them where he surrender how many people did i hit. another camera captured the moment as campbell was driving wildly, sometimes at speeds of 60 miles an hour. >> everyone is mad at this guy. of campbell's moves were captures on video. this morning detectives went into this, the shirt shop and took video from this camera. which, according to the man who saw the video clearly shows a body on the hood of the car as campbell was driving wildly down the boardwalk. >> that was cbs' dave lopez. in addition to the woman who died, 11 were hurt. campbell remains in custody on a million dollars bail. mcalister on the purpose behind this new social media policy. >> students can't wait to sign their name on this form. >> in my hand i have at least 300 signatures. >> that's because they are being forced to seen one they don't like. >> it is forcing you to sign it without forcing you to sign it. >> students have no choice but to agree to the mandated social media contract if they want to join a club or play a sport. >> right now they have to sign that contract in order to participate. >> the contract has three key rules addressing what is not acceptable to post online. profane or inappropriate remarks, creating serious danger of another student and engaging in cyber bullying. students don't even have to type out profanity or make a threat. just a click of the mouse or a tap on their phone can get them suspended as well. >> hold students accountable for not liking a bullying statement or facebook not retweeting a bullying statement or doing anything that would otherwise be considered bullying. >> students say the contract goes beyond bullying. >> it is covering anything we talk about, anything we say about anyone could be interpreted. >> lawyers for the school district approve the language. >> what do we want? >> privacy. >> when do we want it? >> now. >> we want to send the message. we want to let them know this is not tolerate t. >> very few schools have a social media contract. when cyber bully takes place local police department takes care of it. >> other schools do not have those type of contracts. however, if students are caught bully online, police may get involved. twitter, tracking down on abusive behavior. it's created a new button to help users report threats and violence. this is all in response to recent rapes and bomb threats tweeted to female politicians and journalist in the u k. the abuse button is currently available on mobile versions of twitter and will be added on the web and other applications by next month. amazon.com
