morning santa clara county health experts plan to release new information on the shigella outbreak linked to a mexican restaurant in san jose. so far, the county is confirming 93 cases of shigella. san mateo county has 2. and santa cruz county is looking into 5 suspected cases. the restaurant marisco's san juan on 4th street already faces two lawsuits. kpix 5 spoke with a man who went to an emergency room over the weekend with a fever of 105. >> really was nausea, running to the bathroom a lot, a lot of stomach cramping, really, really bad abdominal pain. >> the county health department is investigating the exact source of the outbreak. in oakland, the city council has approved funding to help enforce minimum wage and tenant protection laws. on tuesday night, the council approved a budget amendment. it allocates $240,000 to implement the minimum wage law and $100,000 for tenant protection. city leaders want to make sure workers are not being shortchanged. they also want to ensure that renters know their rights. in richmond a new policy to control rents is now suspended. it had been set to take effect last month after the city council passed an ordinance. but a petition backed by california apartment association as well as realtors and homeowners put it on hold. then tuesday the city clerk ruled that the petition does have enough valid signatures and now the issue may go to the voters. it is rivalry night in santa clara. the 49ers are taking on the seahawks. the rare week night game means football fans in trains and automobiles will be competing with people just going home from work. kiet do who joins us live from levi's stadium will set all this chaos out for us. kiet. >> reporter: kickoff set for 5:25 this evening in the heart of rush hour. fans coming to the game do so over the span of a couple of hours and that helps with congestion. after the game a much different story. if it's a close game, then you can expect about 68,000 fans to be leaving all at once. so caltrain ordered two special northbound trains leaving from the mountain view station. the second one leaves 85 minutes after the end of the game or when it fills up. this is in addition to the regular weekday service where a train leaves at the top of every hour. as a reminder caltrain is saying to buy your tickets ahead of time. about the bitter rivalry with the seahawks is going to be slow for you leaving the altamont pass from 205 approaching vasco. it's filling out as well right here closer to the dublin interchange. and over at the bay bridge toll plaza, crews switched on those metering lights and now traffic is backed up from the foot of the maze. you pass this and traffic flows well across the beautiful bay bridge as we take a look at pictures from max killed in a jet crash in england had bay area ties. it went down after take-off yesterday. several published reports identified the piloted as major taj serene of san mateo county. he got his bachelor's degree in university of san francisco in 2004, played on the tennis team there. the cause is under investigation. a san jose police officer who mocked the "black lives matter" movement is out of a job. the "mercury news" reports that the police department fired phillip white. he had posted comments like, quote, threatening me or my family and i will use my god given and law appointed right and duty to kill you. hashtag #cops live matter. such comments are covered by free speech protection but the department can still fire officers for comments that affect their ability to do their job. four suspects in custody after a manhunt in two cities. with rifles drawn san francisco police cornered them after a wild chase across the bay. the chase ended on 280 near third and mariposa streets in san francisco. the suspects jumped out of a car and fled into a nearby construction site. a worker there saw them running from police yesterday afternoon. >> crossed the job site, two jumped over the fence and ran down the street. and one ran under the garage. >> police set up a perimeter around the site trapping the suspects. two hours later with rifles drawn, a tactical unit went in and within 20 minutes police had four suspects in custody. oakland police are leading the investigation. so far they are not saying what crime in the east bay the suspects are accused of committing. a 5-year-old survives the night in the woods. now his dog is being credited for saving his life. >> plus, dancing their way to healthy and happy lives. we'll introduce you to the local we'll talk about that coming up at 6:18. a man is now charged in the shooting death of a 4-year-old girl in new mexico. alburqueque police say tips led to the arrest of 32-year-old tony torres. lily garcia and her family were riding in a pickup on tuesday when her father got into a dispute with another driver who opened fire on the pickup. the girl later died at the hospital. nobody else was injured. police say torres confessed after his arrest. >> everyone that was involved is breathing a little bit better with a sigh of relief. >> torres is charged with murder and a series of weapons violations. a 5-year-old boy in mendocino county is now safe after spending a night in the woods. he got lost near his parents' home. it started when he took his dog for a walk. brett bowman ventured out from the house on tuesday at around 4:30 p.m. in brook trails near willits. crews searched the forest field with bears and mountain lions all night. at 8 a.m. they found the boy and his dog two miles from the house. they say the dog stayed by the boy to protect him from threats and for a time would not even let rescuers get near the boy. he was a little cold, but the boy was otherwise okay. more san francisco teachers will soon be able to live where they work. mayor lee announced the plan today to help provide housing for 500 teachers by 2020. lee and san francisco unified school district superintendent richard carranza discussed renewing the federal teacher next door program. that program provides down payment and loan assistance to make buying a home in the city somewhat less outrageous. some youngsters in the tri- valley area likely have some very tired feet this morning. >> students at pleasanton's hart middle school have been dancing for three weeks and here's frank mallicoat with this week's "cool school." ♪[ music ] >> reporter: it's showtime at pleasanton's hart middle school. 300 kids getting their swing on. >> this is so much fun and we are enjoying it and having a good time. >> reporter: 15 years of good times. dance became part of hart's p.e. department in 2000. for three weeks each fall the kids couple up until they crown the top dancing pair. it's a great workout, school spirit sky high, and the kids get a big shot in the arm, too. >> i think it's just a really fun way to get into school spirit and stuff. and it's a good way to have fun. learn something new. >> it's a little nerve-racking because i want to make it far, but at the same time you just want to have fun. >> i can tell kids who started at a certain point weren't sure if they had a partner to they are doing stuff out here with smiles and compliments afterwards. it's amazing. >> reporter: this is a family affair. parents flock to the gym to watch. iphones in overdrive [ laughter ] we are going to talk about the morning commute in san jose, right, roberta? we are going to start off with san jose where there's this accident in the clearing stages northbound 101 just before alum rock. a three-car crash pushed off to the center divider. our sensors are picking up some of the slow traffic. it's backed up beyond the 280/680 interchange. meantime, if you are going towards the altamont pass, there are backups this morning west 580 going to be slow from beyond the 205 interchange. now a long line of traffic through livermore bound for pleasanton. no delays as of yet heading down the dublin grade but certainly 23 minutes between the altamont pass and 680. highway 4 much slower than usual. you can see all the red there with traffic down to 18 miles per hour. slow at willow pass because of annealingier accident on 4. -- because of an earlier accident on 4. more folks are out, but so far no major brake lights for westbound 92. the bay bridge toll plaza a different story though. that has still been -- we have delays extending through the macarthur maze. westbound traffic flows well across the bridge into the city once you get past the mess at the toll plaza. that's "kcbs traffic." i'm sure roberta has more to say -- about the weather, about schools in pleasanton. >> you know what it is? i get a little nervous and anxious when mr. hackney is in the house because he gets out the number 2 pencil and checks my weather forecast. >> it's thursday, october 22. i'm michelle griego. >> i'm brian hackney. frank is off this morning. police in becker believe the same man is trying to kidnap children. lisa chan has new information about the near abductions. good morning. >> reporter: good morning. people are being extra vigilant here in berkeley. police just told us this morning ere have been five attempted kidnappings. extra police cars are on patrol as they look for the suspect. now, the first attempt happened on september 18 when a man tried to kidnap three girls and a boy on telegraph avenue. then on october 18, police believe the same man tried to kidnap a girl at college and webster and 15 minutes later yelled at three girls on the same corner to get in his van. >> we have been seeing in these -- >> it is definitely alarming one of our highest priorities. >> that's pretty worrying. i see this as a nice residential area. >> reporter: now, witnesses describe the man as hispanic in his late 20s to early 30s with dark hair and a scruffy face. he was last seen driving a windowless black cargo van. now, police have been looking through surveillance video in the areas of these attempted kidnappings but so far no luck. the unified school district has set up workshops to teach children what to do when this happens to them. live in berkeley, lisa chan, kpix 5. a high school principal in marin county is warning parents about teens being hospitalized after overdosing on coricidin. two fro drake high overdosed on the same drug in two weeks. they take it in large doses to hallucinate calling it triple c. mount tam high school principal is asking parents to talk to their children. many parents say they didn't know. >> i did not know about it and to find out the hard way is worse than potentially a situation where now all of a sudden it gets out and some kids say i know about that, maybe i'll try it. >> you must be 18 or older to buy core seed deny. it's sold in most drugstores. a let en to tam high parents was cents out tuesday. are you ready for thursday nile football? [ yelling and cursing ] >> cell phone video shows the passenger dragging the muni driver off the train and then attacking him on the street in san francisco. the driver is in the dark colored clothing. this happened last week on the t line in the dogpatch area. >> there's a mechanical issue with the train. and he got orders to bring the train back into the yard for repairs. at that time, he did ask the patrons to off-board the vehicle and at that point, this individual appeared not to have liked that and spat on the operator and pulled him out of the train and then the video starts. >> other passengers broke up the fight. muni says the driver acted in self-defense. new this morning, two men suspected of looting during the "valley fire" have entered a plea. jeremiah mcguinness pled get. he was arrested for a stolen car and stolen items in his car car. royce moore pleaded guilty for having stolen items in his vehicle. habitat for humanity is launching a fundraising drive for victims of the "valley fire." they are accepting donations by the lake county chapter of habitat for humanity. air regulators have released tough new rules for fireplace use this winter. the plan from the bay area air quality management district is designed to reduce pollution by requiring wood fires burn cleaner. one limits how much smoke is permissible when starting a fire. the district set a 20-minute time limit to get a fire burning clean. after that, if the smoke is too black, homeowners could face fines. also no more wood-burning fireplaces in new construction. and starting next year, the air district wants to completely phase out allwood burning fireplaces. the district will offer financial incentives to convince homeowners to retrofit their old fireplaces. a mural for peace in oakland is now a memorial for the artist killed while working on it. yesterday the superheros project was unveiled on west street right under the interstate 580 overpass where artist antonio ramos was shot and killed last month. witnesses say ramos was working on a painting when he got into a dispute with an armed man. his brother was there for the unveiling. >> when is it going to stop? that's the whole point. how many walls do we have to paint for this to stop? it goes beyond your representative. it goes beyond everything. >> police are looking for this man who they call a person of interest in the shooting. no arrests have been made. sometimes it's best to leave well enough alone even for a thief. this surveillance video shows a woman attempting to take a large box from outside a concord home. it was apparently too heavy so she left it. it appears she did take off with a pair of shoes. 21 minutes before 7:00. intense questioning expected today for hillary clinton regarding the 2012 benghazi attacks. a preview of the day's events. >> and do you want super fast internet without paying big bucks? google may have the service for you. >> and the market just opened about 10 minutes ago. we'll take a quick check of the big board which is up 112. the dow now approaching 17,000. we'll get n update from kcbs radio's financial reporter jason brooks after a break. ,, ,, ♪ (vo) you can pass down a subaru forester. there is life after paypal for ebay as it turns out. this is the first report for ebay in earnings without paypal included which was spun off into its own publicly traded firm. paypal had been the main growth generator at ebay for several years. so there were big worries over how ebay would come about after spinning off paypal. ities revenue was down from a year earlier but not nearly as bad as expected. it did see some strength in its ebay classifieds and also in its stubhub ticket resale businesses and as a result, ebay's shares are surging higher by 11% in the early going. the biggest gainer in the s&p 500 so far this morning. the job market continues to look pretty solid. the labor department reported a slight gain and first time unemployment claims but the four-week average was just above 253,000 which was the lowest level since december of 1973. stock market off to a good start this morning. mainly on some hints coming out of europe that there could be more stimulus coming morning. traffic is still moving along although traffic volumes are up at the san mateo bridge still moving for that westbound commute leaving hayward heading into foster city. we have been talking about the big 49er game this evening at 5:25. expect delays beginning as early as 2:00 this afternoon for the afternoon and evening commutes along 101, 237 and great america parkway. that's "kcbs benghazi, libya. the panel will ask her about the attack on the u.s. diplomatic compound that left four americans dead some observers saying her testimony today could be crucial in her bid to win the democratic presidential nomination. >> can she weather a full day's worth of testimony in front of a committee that even some republicans have said is aiming to hurt her politically? if she can do that she will be on stable ground after a shaky summer. >> it will be the first public hearing in ten months for the house select committee on benghazi. clinton's testimony comes a day after vice president joe biden announced that he will not enter the democratic presidential race. he was joined at the white house rose garden by his wife and president obama. biden had been putting off a decision while his family dealt with the death of his son beau because of cancer. biden decided against a white house run saying there wasn't enough time to organize a viable campaign. clinton responded by posting this statement saying the violent is a good friend and great man. today and always inspired by his optimism and his commitment to change the world for the better. on capitol hill, republican paul ryan appears a step closer to become the next speaker of the house. the wisconsin congressman picked up key support from the house freedom caucus yesterday. that's the same hard-line group that helped push house speaker john boehner into retirement. ryan still needs to hear from two more caucuses. he says if he doesn't get solid support from house republicans by friday he will withdraw from consideration. the big apple is getting even bigle. apple computer, that is. the tech giant expanding again, getting even bigger. it's leasing this 200000- square-foot building in north san jose. it's still under construction and there's room on the property to grow. the new site now gives apple three major properties that could eventually provide the tech giant with more than 4 million square feet of office space. cable and phone companies are about to get some more competition. mountain view-based google is moving forward with a plan to offer high speed fiber service in the city of san jose. more now from kpix 5's julie watts. reporter: it doesn't look like much now. but this corner in san jose could soon be a high-tech hub for communication. >> probably here. >> reporter: the councilman says it's where google will install one of its first bay area fiber huts similar to this one in austin making willow glen one of the first so-called fiber "hoods" in the golden state getting access to google fiber a brand-new super fast internet and tv service. ♪[ music ] >> it's fast as it can be ♪[ music ]♪ >> reporter: now at&t, comcast and verizon each have their own fiber services promising the ability to download 25 songs in a second or a movie in a minute. but google's new system will have two advantages new equipment and at least in the beginning fewer customers. >> think about driving on an able to-lane freeway in san jose -- an eight-lane freeway in san jose during rush hour now instead of the 1950s. >> reporter: what happens when google has as many customers as say, comcast, at&t and verizon? >> their performance will probably degrade. >> reporter: based on rollouts in other cities, he expects google fiber will likely be cheaper than its competitors. >> they have tons of cash coming in from advertising. so google can compete very aggressively on price. >> reporter: so what's not to love? well, enderly says google may have an ulterior opened fire. tips led to the arrest of 32- year-old tony torres. i'm kiet do live here at levi's stadium in santa clara where the big game between the 9ers and the seahawks is set for 5:25 this evening in the heart of the rush hour. now, we know people coming to the game do so over the span of a couple of hours to help out with congestion. after the game a much different story. if it's a close game then you have 68,000 people all leaving the stadium at once. and so caltrain has added two special northbound trains leaving from the mountain view station. the first special train leaves 60 minutes after the end of the game or whenever it's full. the second one leaves 85 minutes after the end of the game or whenever it fills up. this is in addition to regular weekday service where a train leaves at the top of every hour. now, about that bitter rivalry with the seahawks. the last time they were in levi's stadium, they won on thanksgiving day 2014. seahawks players sherman and wilson were eating turkey right on the 50-yard line right on the 49ers logo as part of the post-game broadcast. this after beating the 9ers 19- 3. this time around, the two teams are 2-4 for the
