The state Supreme Court upholding the voterapproved prop 66. Melissa caen on the inmates that could end up in the Death Chamber sooner. Reporter thats right. You remember that voters endorsed prop 66 in this last novembers election and the whole idea is to speed up the Death Penalty process. The new law, the new proposition, didnt take effect because it was held up by a legal challenge. Today we got some resolution to that challenge when the state Supreme Court threw it out. They paved the way for executions to begin again. I do want to remind the court that there is a much neglected constitutional right at the heart of this proposition. The victims of crime including the families of murder victims do have a constitutional right to prompt and final resolution of the case. Reporter today the california state Supreme Court upheld proposition 66 a ballot measure designed to speed up the Death Penalty endorsed by voters in november. Opponents of the Death Penalty like senator scott weiner asked the court to throw out the new law. We really wanted to overturn this ballot measure as unconstitutional. In various respects. So the idea that we will now accelerate Death Penalty appeals in the process and flood the system and force our Supreme Court to focus even more of its scarce resources on Death Penalty appeals it doesnt make sense. Reporter out of 750 people on death row, there are more than a dozen men who have exhausted their appeals. Three of them were sentenced in the bay area. Harvey was sentenced in alameda in 1981 for raping a woman and then killing her to prevent her from testifying against him. In san mateo county, douglas mikey was sentenced in 1980 for robbing and murdering two people. And Robert Fairbanks was sentenced in 1989 for torturing and murdering a person. The San Jose District attorney will now move to set execution dates for the last two but he will work with other d. A. S. There are clemency hearings and dates to be set and were not we cant all rush to the courthouse tomorrow morning and say, lets go to work. It needs to be done with some collaboration. Reporter wagstaffe says execution could begin again next year. We dont know what the other side will try to do now but under the decision that came out today, the enforce menment of this proposition and the enforcement of this proposition and the California Law that we have had since 1977, it could start in the next four to six months. Reporter now, prop 66 also includes a number of shorter deadlines for the process and probably the most important is a rule that says all Death Penalty appeals have to be completed within five years. Today, in that ruling, the state Supreme Court said that those deadlines arent exactly enforceable but we may see see somebodys appeals property take more than five years but they can and should do their best to comply with those legally mandated timelines. Its fine to burn down San Francisco if you are wearing all black but if you come in, if you come in and youre a free speech advocate and believe in freedom and love, then all of a sudden he twists it around. Reporter but burning the city down is exactly what local agencies are working to avoid. Whatever side of the barricade youre on. And what eileen moore is hoping doesnt happen either. I hope that San Francisco is a Peaceful Place that stands up to its name of saint francis, now . Reporter the city, park and local agencies are digging in. Barricades are already out at crissy field. This may seem like a lot, but former fbi agent and kpix 5 security analyst jeff harp says you have to prepare for the worst while hoping for the best. Its better for them to be prepared than surprised. And i think the fact that sfpd is putting up barricades, i know the park police have worked to try to prepare, park police is pretty good at dealing with these things. Reporter the park service is dividing crissy field and presidio into two zones. What you need to know is there will be no pedestrian, bicycle or vehicle access to crissy field from the golden gate bridge. Streets will be closed in the presidio and in crissy field. And the only way on to crissy field will be from the east at the marina gate on Marina Boulevard near the palace of fine arts. The 49ers say the report is filled with errors. Kpix 5s devin fehely is live at the Santa Clara City Council meeting thats happening right now. Reporter just stepped out of a meeting of the Stadium Authority here at city hall in santa clara. Not a tremendous amount of agreement. There had been some hope that the findings of this final audit might form the basis of a ceasefire between the city and 49ers. But they are still divided. The long awaited audit of levis stadium has create more controversy than clarity over the financial and Management Issues that often have the 49ers and city leaders in santa clara at odds. Were being contentious litigious. This needs to stop. We need to stop wasting taxpayer dollars especially when its showing that theres not millions of dollars that we the residents are missing out on. Reporter the city council invested a year and 200,000 in an audit that begins with a stunning admission. The auditors failed to get a closer look at nonnfl events big concerts like beyonce because the 49ers wouldnt allow them to review and report on their records without First Signing a nondisclosure agreement. They refused. We need the data just like the board of directors of any corporation publicly traded corporation would have access to. Reporter the 49ers say the release of sensitive Financial Information would undermine their ability to negotiate effectively with concert promoters in the future. They describe the report as, quote, riddled with errors the adding, in the end, they wasted over 200,000 in public funds to discover that the city of santa clara failed to bill 115,000 in expenses something which was their responsibility. The Stadium Authority which consists of the city council is said to be considering a second or supplemental audit a proposal as controversial as the report itself. I fervently want it to be a very productive relationship for everybody in santa clara as well as the 49ers. So now is the time before we go any further to make sure that we have all the data that we need. Ill just agree to guys agree with his assessment. I think its inaccurate and disingenuous. Reporter yeah. They cant seem to agree on the most basic facts. When i was just in the meeting, the auditor said that they estimate that the 49ers owe the city an unbilled police and Fire Services roughly 115,000. But the citys own staff says their own estimate is far lower. Somewhere in the neighborhood of 25 to 20,000. And so with that much difference between the numbers and that much disagreement over the basic facts, it doesnt seem like this feud is going to stop. Devin fehely, kpix 5.
