Judge persky has faced backlash including calls for his removal or recalled. The d. A. s office says in this case a male nurse is accused of Sexual Assaulting a woman while knocked out during a medical procedure. Kpix 5 legal analyst Ladoris Cordell says it comes down to a question of whether or not the judge can be fair and impartial. They did not believe that he could be fair. And by fair meaning i think not in the presiding over the trial itself but if there were a conviction, they dont believe that office does not believe that he would be fair in the sentencing based upon what happened in the turner case. Reporter the District Attorneys Office released a prepared statement saying that their decision that this is a rare and carefully considered step for our office in the future we will evaluate each case on its own merits and decide if we should use our legal right to ask for another judge in order to protect Public Safety and to pursue justice. Now, procedurally in any case the District Attorneys Office as well as the defense have the option of asking for a different judge to preside over a case. That request is grand automatically. We happened to grab some coffee this morning and noticed some employees wearing white ribbons. One of their own had been killed. For this tightknit group of employees they say they are family. And over the weekend, they lost the head of their family, their manager, 31yearold simon carillo. He and his partner Oscar Montero a manager. Its a deal that promises to preserve the stately landmark as a luxury hotel and get san jose out of a spiraling debt. It was built in 1905 by the the hayes family which made its fortune in farming, newspapers and pom ticks, fell into disrepair by the 1970s. The city bought the mansion and invests millions turning the house into a hotel, building a Conference Center and an underground parking garage.
