The plan has been controversial from the start but tonight city Officials Say this is far from a done deal. The terminal is still going through a permit process that could take 6 to 8 months before building could begin. And on top of that, city staffer discussing whether shipping coal through oakland would pose a Public Safety threat. I know coal has been on peoples minds. Its of great concern to the council and to the city. So what we have done is that we are currently reviewing evidence that has been submitted by the public and others concerning the health and safety aspects of the coal so that is what the council will focus on in a few months. Reporter so ultimately stat will make a recommend staff will make a recommendation to the city council about whether to allow coal to be part of the terminal. They havent talked coal with the developer and as far as they know there is no contract for coal at this point. The city did not give a timeline to me for when they will make that recommendation to city council. Reporting live in oakland, christin ayers, kpix 5. Developing news in the east bay. Chopper 5 over the Hercules Police station and city hall. The bomb squad checking out a possible explosive device. We are told someone brought in what they thought was a fake bomb to have it disposed of. But after looking it over investigators decided it might be real. About 25 people have been evacuated. The nearby hercules senior center, some senior apartments and a nearby library are sheltering in place. A happy ending to a bizarre case in San Francisco. Two missing toddlers have been found and they are in good health. Shanyce jones reported her two children a 2. 5yearold and 14 monthold were missing last night. Jones later told officers that on monday, she had left those toddlers with a person named jaquita who she met a couple of months earlier. They were supposed to meet the next day but jaquita and the children never showed up. The last known location of the children was yesterday afternoon. We have information that says that they were in the south of market and tenderloin area. This afternoon, police found jaquita and the children at st. Francis hospital. The toddlers mother is arrested and charged with child endangerment and drugs. Operator error, thats the conclusion as to what caused a tour bus crash in union square. The doubledecker coach careened out of control for more than two blocks last november. It slammed into cars, concrete barriers and construction scaffolding. Joe vazquez reports. The driver not happy with what police are saying . Reporter yeah. He is pretty angry. He stand by what he told investigators. He says the brakes gave out. Investigators say you know what they did they took parts of the crashed bus that happened right here at union square and put them in a working bus and tried to replicate the problems and couldnt. They believe they have evidence that the driver never stepped on the brakes. Four months after a runaway bus hit 14 cars and injured 19 people in union square, the driver has been given a speeding ticket. 45 Miles Per Hour in a 25mile perhour zone. Police now say there is no sign of a mechanical problem and when the bus went out of control they dont believe the driver he have stepped on the brakes. Investigators say Surveillance Video even shows the brake lights never lit up. If he did in fact step on the brakes, um, which we believe he did not, we would definitely have proof to show he stepped on the throttle. So thats weeve he just apparently stepped on the wrong pedal. There was a mechanical problem on the bus. And im very disappointed that the outcome of sfpd. Reporter Kenneth Malvar gave a brief statement this afternoon. He is wheelchairbound suffering from back and leg injuries after the november crash. Malvar was driving the double decker city sightseeing bus when he says he pumped the brakes and the accelerator several times to try to get them to work correctly but they were nonresponsive. So now its going to be left upon me that it was driver error. But i was there, like i said, and there was a mechanical problem and in spite of that they said i didnt know my gas pedal and brake pedal. To me, thats absurd. Record show city sightseeing have revamped used buses from other states and at least one had a history of mechanical problems, the one that crashed. A former stanford swimming star accused of Sexual Assaulting a fellow student testified today. Reporter bart estimates that major developments are going up within a mile of three quarters of its 45 stations. Developments like downtown oaklands hive a mix of offices, shops and housing work of private developers zeroing in, on the no car market. The investors look at walk scores as a component to whether or not they want to fund or lend money to projects. When you have a policy will transitoriented development. Builder irvin just won key city approvals on its plans for the former candlestick park. It is an 8 billion, 775acre mixed use development. Plans for the first phase of Candlestick Point include an urban Retail Shopping district, a new film arts center, more than 2200 homes, and a park. New streets and utilities are going in now. Construction of the shopping district is expected to start next year. Grocery shopping a big issue for one oakland community. People there living in what they call a food desert. Some call this community a food desert. Too many Liquor Stores. You know . We dont need Liquor Stores. We need groceries. Reporter thanks to this man west oakland could soon have a grocery store. We are going to demo the whole thing. Reporter with the help of investors and a nonprofit developer, he bought this building at the corner of san pablo avenue and myrtle street. Im pretty excited. You know . Its only been two days and its surreal. Reporter it will be named the Peoples Community market. More than a store, it will have space for community meetings, live music and nutrition classes. It will be an anchor in a neighborhood. Like old Grocery Stores used to be. They used to be more than just Grocery Stores. They were kind of social hubs. They were where neighbors came together and hung out and socialized. He wants to open the store in a couple of years. He already raised 1. 2 million and is trying to secure new loans and investment money to cover construction and operation costs. There is a push to clear up Expiration Dates on food labels to save a lot of wasted food. Its all in response to a report presented at stanford this month that found the u. S. Loses 215 billion in food waste every year. Assemblyman david chiu believes part of the problem is that there are too many different kinds of food labels like best used by or sell by. Navy tugboat vanished off the San Francisco coast. How researchers stumbled on the wreckage of the uss conestoga near the farallones]. John ramos reports. Reporter on march 25, 1921, the tugboat uss conestoga left the golden gate on a voyage to american samoa. Its crew of 56 officers and sailors were never seen again. And for 95 years no one knew what happened. Reporter it became one of the oldest peacetime mysteries in naval history until today. The conestoga has been located about 3 miles southeast of the farralone islands. Noaa spotted the wreck in 2009 quite by accident. They were looking for other shipwrecks and found one they werent quite sure what it was. Reporter so last september a Research Vessel began a search of the site using a robotic camera. She was on board when the identification was made. And when that happened, um, the vessel just went up in a roar of we found it the ship is fairly intact. You can see the entire hole. You can still see the portholes and you can still see where the bridge was. Reporter its believed the conestoga got caught in high winds and was heading for the protection of the farralones when it went down. Now, it is covered in eerie white see anemones looking every bit like the ghost ship it has become. The ship will remain on the sea floor as a graveyard in memory of those people who died on the vessel. He signed a bill giving a developer more than 50 million to build an export terminal at the old oakland army base. The city of oakland says there are still hurdles ahead including permits and the safety hearings. Reporter the drive of the tour bus that careened out of control through union square is blamed for blocks of damage and multiple injuries. The Police Report concludes it was operator error and not mechanical failure. They say the driver mistook the gas pedal for the brake last november. The driver called it absurd. Brussels an active crime scene as a suspect is sought in an attack that left 32 dead and more than 250 injured. Belgian authorities think four men carried out the attack. Three died after detonating bombs. They say a man with the suspected suicide bombers at the airport slipped away during the chaos. He is the one second from the left wearing that dark hat. He has not yet been identified. Airport surveillance photos show that ibrahim elbakraoui with another man in black identified as Najim Laachraoui also died. Its believed laachraoui made the bombs in the paris attacks. Ibrahim elbakraouis brother died in the plastic at the subway station. At least four died they blast at the subway station. At least four people from america are missing. A brother and sister havent bun every been found. And another brother and sister havent been found from new york city. Several americans among the injured including 19yearold mason wells from utah. His achilles heel was severed in half during the first blast. He was able to hobble out before the second explosion. His parents say that this is the second time he has survived a terror attack. He was close to the finish line at the Boston Marathon in 2013 when the bombs went off there. Having been to that once i think helped him psychologically and emotionally yesterday. We are so grateful he is safe and that well be able to see him. Theres a report now that isis is training hundreds of fighters in europe so first of all, what does it say about the potential for more attacks . But what should european leaders and security be doing to prevent those attacks . You know, thats a real good question. And its something thats on the minds of all of us around especially those leaders in europe. Um, you know, some of the issues that theyre faced with is multiple countries have multiple borders and those borders have different, um, crossing regulations. Having lived in europe, i can tell you that, um, not every country operates under the same circumstances and they obviously dont have some of the same Security Forces at each border. I think thats some of the big challenges that they are faced with is the border control. Well, and apparently some of them were on a list they found days before with the arrest of the suspect in the paris attacks but couldnt get to them in time. One other question for you. Yeah. About the house intelligence chairman today saying the bombers had been targeting americans. So first of all, they knew who these guys were. They had their names. Now we are hearing that they were targeting the americans because the airport attacks were right by united and american airlines. Other than being on our soil, this is pretty much a direct hit if you will at the u. S. yeah. And i know that intelligence sources have said that uhm, you know, the bombs went off near the, um, american airlines, um, ticket counters and i think what we have found and what we see with this is the terrorists realize that, you know, america is a much harder target than europe but they are still going to strike out against americans and strike out against american companies. And unfortunately, they are going to strike out against americans that stay at the u. N. The American Hotels and the cafes and thats just how its going to be. They are out to get the west and they are going to do whatever they have tour bus crash try to tackle that. They know that americas target is much harder than what it used to be and so they are doing whatever they can to instill fear in us. Okay. Quickly, then, is the next step an attack on u. S. Soil . You know, i dont think we can say if. I think we have to say when. The lone wolf is a big concern for the fbi and Intelligence Community. They are doing what they can to track these people down but unfortunately, these people, um, they rear their ugly head at the most inopportune moments and sometimes they are not on intelligence radar. And so we have to be prepared for that. I think the most important thing we can do is have our First Responders and our Law Enforcement and Intelligence Community partners all working together and be prepared when something does happen. Rain stays to the north pretty potent storm in the gulf of alaska. We have a ridge of High Pressure our south and west which is building in an odd direction. Typically it builds just off of the coastline and storms go north and we dont have worry about them. Now we have a jump in the jet stream. In this case, it will be right off the coastline so the storms that go over the ridge will fly down the eastern slope of that ridge and perhaps impact our weather early next week.
