credit card statement and checking it twice. now, target says they did know about the breach as of last sunday. but they didn't say why they haven't told customers until today. bottom line, if you use a debit card, change your p.i.n. and get a new one. if you used a credit card, probably not as urgent. target set up a hotline and we have information about that on our website, kpix.com/consumerwatch. on the consumerwatch, julie watts, kpix 5. as bad as all this is, it's not the worst security breach we have seen. in 2006, tjx companies which owns tj maxx and marshalls suffered a breach that affected 94 million accounts. it cost the company $68 million in fraud losses. back in 2011, hackers accessed 77 million accounts of the sony playstation network. that same year, 60 million people were affected when hackers attacked epsilon, an email marketer with clients like best buy, capital one and walgreens. the families of eight special ed. students will split an $8 million settlement all because of allegations that a teacher hit, slapped and verbally abused the kids. the allegations center around a school in antioch. that's where da lin is tonight. reporter: this tearful father feels guilty for the abuse of his autistic son at an americans in antioch. >> i failed miserably at recognizing signs. >> reporter: one of those signs was the 6-year-old would be scared to go to school goateeding to take him out of a -- >> attempting to take him out of the car and him not speaking and grabbing the door and i dragged him and forced him. >> reporter: their son doesn't speak. they couldn't get their son to say what was hang. he would cry every day and his behavior changed. >> my son now thinks being aggressive and violent is the way to get anything. >> reporter: after five weeks of strange behavior and no answers from the school, the evanses took their son out of grant elementary school. two months later, police told them their special education teacher had abused eight special education children including their son in the fall of 2012. >> he had been backhanded on several occasions in the face. that she had put him down on the ground face first and put her knee in his back. >> reporter: police gave many more examples of alleged physical, verbal and mental abuse. the eight families sued and accused the antioch school district of covering up the abuse the district agreed to the settlement and the superintendent said we must continue to learn from this case and work to ensure that every child entrusted to our schools is educated in a safe environment. the evans family says no amount of money can give them back their son's innocence. >> this is a life changing event to where we have to adjust our lives. >> reporter: in antioch, i'm da lin, kpix 5. >> the evans family's portion of the settlement is a million dollars. they did share a photo of their son with us. we decided not to identify him or show his picture given the nature of the case and his age. the teacher by the way faces six counts of child abuse. and this is never what you want to see at a gas station. police say the driver of the car had just run a dui checkpoint led officers on a brief chase before this happened. crashed into a gas pump at a 76 station in east oakland. police pulled him out of the burning car and put him in cuffs. the woman facing vehicular manslaughter and reckless driving charges is free on bail but the judge says she is not allowed to drive. police say 58-year-old jennie zhu was driving 80 miles an hour on pine when she rear- ended a minivan in september. one teenager died. several other people were hurt. zhu pleaded not guilty to the charges and faces 7 years in prison if convicted. new at 5:00 the public utilities commission is telling pg&e pay up. the puc says pg&e has to pay $14.3 million in fines because of poor recordkeeping. pg&e insisted a gas pipeline in san carlos was seamless but gas leaks revealed the line has welds. the deaths of two workers on bart tracks has led to sweeping recommendations from the national transportation safety board. the ntsb is urging the federal transit administration to require extra safety measures for rail workers following the october accident. one is a safety monitoring system called "positive train control." another is a secondary warning device, or shunt, for the workers to attach to the rails. bart's board welcomes the suggestions. >> anything that moves us in the direction of providing a more safe work environment, i have no problems with. we'll be prepared to support it. i think we have to have an opportunity to review them and make sure we respond in an appropriate way. >> a report last week said the two men killed on bart tracks had ignored safety rules. those rules require at least one to serve as a lookout. a lot of people saying, where is all the snow? this is a look at our sierra at tahoe camera. you can see some flurries there. but not a whole lot of snow is sticking to the ground. trees are bare. outside the ski resorts, looks like a drought. typically this time of year we see all the reporters standing knee deep in the snow. don't we? but ryan takeo is at 4700 feet in the sierra and you couldn't make a snow angel if you wanted to, right? >> reporter: nope. couldn't make one if i tried, allen. not right here, not on this side of the road. normally there's snow, now just dirt. there's snow across the way not very much of it. that's not good news, because so many here depend on the snow. and the sierra is seeing a fraction of the norm. >> reporter: this canyon view is hardly ever this green this time of year. >> yeah, there's no snow out right now, huh? >> reporter: if you are expecting fresh sierra snow, you're probably disappointed. the central sierra has only had one quarter the average snowpack this time of year. at sugar bowl, only 5 lifts will be open this weekend. 8 others will be closed. >> not good for them, i don't think. >> we got about 2" out of that system that moved through last night so that definitely helped. we'll take whatever we can. >> reporter: in downtown truckee, the city's plow driver had to search for snow. >> you know, last few years, it's been slow. it's been -- we need some snow, big time. >> reporter: he knows how vital it is to truckee's economy. >> if it doesn't snow, it's going to be tough for everybody. >> reporter: while all the rentals are taken at this property management company, how the of towners have one question on their mind. >> everybody wants to know if there's snow. >> reporter: what do you say? >> there's a little bit. you know they're blowing it at the resorts. >> the snow guns are going 24/7. >> reporter: these snow machines might as well be making money. the ski resorts are having to adapt. >> it's just manmade snow. if anything, it offers a more secure base for when mother nature dumps some powder on top. >> reporter: that powder can come in a flurry. that's what the resorts hope and the area is ready. >> that will make more work for you. >> yeah. yeah. bring it on. here you go. oakland police bust what they say was an illegal marijuana operation running out of a gift shop this week after people called to say something was funny going on. cops arrested three people on suspicion of possession for sale of marijuana and one of the suspects was also nabbed on suspicion of being a felon in possession of a loaded firearm. before you cook that chicken for dinner, listen to this. consumer reports found harmful bacteria on 97% of chicken breasts sold in u.s. retail stores. more than half of the samples had antibiotic-resistant bacteria. best advice? don't run the chicken under the faucet before cooking. use a meat thermometer and always cook the chicken to 165 degrees. are you driving one of the safest cars on the road? cbs reporter marlie hall has the list of cars that makes that safety grade. >> reporter: the insurance institute for highway safety crashed cars at 40 miles per hour to find out which ones performed best in an accident. this year, the research group went a step further and found out which cars were best at preventing a crash using warning systems or automatic braking. >> we think that as important as it is for our vehicle to protect you in a crash, if it can prevent that crash in the first place, that's even better. >> reporter: to get a top ranking, cars also have to get a good or acceptable grade in the small overlap crash test. it shows how well a car holds up when just a portion of the vehicle hits another car or object. >> a lot of the front crash protection strategy that's been built into the vehicle which is located in the middle is bypassed and so manufacturers have had to change their designs to do well in this crash scenario. >> reporter: because of the tougher standards, only 39 cars received top safety ratings this year compared to 130 last year. 22 earned the highest ranking of top safety pick plus. 17 picked up the lesser ranking of top safety pick. honda, which also owns the acura brand, had the most winners of any automaker. eight of its vehicles made the list with half including the honda accord earning the highest ranking. marlie hall for cbs news. >> of course, the annual ranking often used by car shoppers this time of year there are eight newcomers to the list. the weather lab and paul deanno are out and about in palo alto tonight. paul, how's it looking. it's a beautiful night. everybody getting ready for christmas. we are having a good time and it's really getting crowded. work is done, school is done, folks are out here out and about maybe heading to their favorite restaurant or getting some of that final christmas shopping finished. the weather could not be better for this time of year. very comfortable outside. the air quality is better today. it's a thumbs-up weather day. and wait until you see the seven-day forecast coming up. let's get to the weather maps. let's talk about where we were today. livermore, 61 degrees for a high today. oakland 63. san jose you hit 58. san francisco you hit 58 degrees tonight. we did have a cold front move through today got windy especially in the hills and it will get chilly away from the water tonight. santa rosa will drop down to 34 joining napa and livermore at that mark. fremont 36 and redwood city dropping down to 35 degrees overnight tonight. satellite review, we have a low pressure area moving out to the east. we have a big strong ridge of high pressure building in. now caught right in between, we were today, and it was breezy as we have that strong pressure gradient between the high pressure area and low pressure area. that means we'll be very dry for the next couple of days. and that breeze will decrease overnight tonight. what to expect?
