strong surf surges into a bay area restaurant. and it's all caught on video. live from the cbs bay area studios this is kpix5 news. tonight storm surges into a bay area restaurant and it's all caught on camera. good evening. i'm veronica de la cruz. >> and i'm ken bastida. kpix5's cate cauguiran is there tonight. >> reporter: standing here right now was like actually being in seaworld's splash zone. these waves are so powerful, so intense they hit the breakers and then they come up and over the railings. >> eventually it broke the window and then a bunch of water came through and then more water piled through again. that's a huge wave. >> reporter: moon raker restaurant's banker hall is stripped of its carpet and now they are trying to get out the excess water. >> the windows shattered. glass went everywhere and the room filled up with water pretty quickly. >> reporter: gary mcnamara is one of the owners. when he came to work saturday morning, he and staff found the first floor was flooded. >> i don't know if it was wind or a rock came through the window. so we went to our surveillance camera and pulled the footage back up and obviously it was something more serious than that. >> reporter: the surveillance video captured this rogue wave that came up over the breakers and straight into and through one of the first floor windows of the restaurant. >> it has to clear like 30 or 40 feet of concrete. >> reporter: gary said the damage is estimated to cost 10 to 15 hours. hour by hour these waves continue to become more powerful. the window at the moon raker restaurant is now boarded up. the good news is those powerful wave lit at 5:15 a.m. -- hit at 5:15 a.m. saturday, so no one was in the restaurant at the time. cate cauguiran, kpix5. tonight a stretch of highway in novato is shut down. major flooding has turned the roadway into a lake. one car has been stuck there since yesterday. it is expected to reopen saturday. right now it is still raining in parts of the bay area. kpix5 meteorologist paul deanno shows us our hi-def doppler tonight. what do you think? >> showers are getting less numerous, but we are not done with the rain just yet. it was also hail across parts of the bay area today, pea size hail pounding this parking lot in novato, thankfully no damage done to any vehicles. mount diablo not just rain and hail, it was snow. chopper 5 over the summit about 3,800 feet earlier today. you can see a decent amount of snow in those locations. what's going on right now? there is the radar, a line of showers perhaps with more small hail moving into the marin coastline along inverness and south city of san francisco getting some rain between 12:00 and 12:30. just east of boulder creek it's snowing not only mount diablo, but in and around mount hamilton high elevation snow above 3,000 feet. santa rosa is encroaching on 19 inches of rain in the past three weeks, napa more than a foot, more than 9 inches of rain in san francisco, more than 8 in concord, 7 in oakland and nearly 1/2 a foot of rainfall in san jose, but the tap is about to turn off. we'll talk about how long we stay dry coming up. because of all the recent storm damage tonight governor jerry brown declaring a state of emergency for 50 california counties including several across the bay area. now to berkeley, two bodies found inside an apartment building. what happened to them? how did they die? tonight police admit they're puzzled. cbs5's christin ayers is at the scene with the latest. ery. o signs of struggl >> reporter: tonight we have both berkeley police and a pg&e crew out here at the scene. that's telling because earlier pg&e crews apparently ruled out any sort of gas leak, but they are back on the scene tonight trying to figure out what happened to two 30-year-olds and their two cats killed inside that fourplex. >> it's still a mystery. >> reporter: there were no signs of struggle and no evidence of suspicious activity. tonight no one knows for sure what happened at this apartment building on deacon street. one person stopped by and found a person dead. authorities arrived and found another person dead in the house along with two cats. >> the building was evacuated out of an abundance of caution. since that time pg&e, the fire department and hazardous department has checked out the apartment. >> reporter: but they ruled out the possibility of a gas leak or any other hazardous substance. >> our homicide unit is here checking the premises for any more evidence they can find. >> reporter: so far it's unclear what could have killed the couple and their cats and police say it could be some time before they have any real answers. >> too soon to tell what this could be. >> reporter: the coroner ails office removed -- coroner's office removed the bodies a short time ago and are not yet identifying the couple and say it could take a police report and toxicology report before they know what happened here. in oakland in the fruitvale neighborhood some tenants in an apartment building say they are living in inhumane conditions. tonight the landlords are on notice to fix it up. at 1620 vail avenue tenants say there is no heat, no working smoke detectors and it's infested with bedbugs. now the city attorney's office has an injunction against the landlords. >> we have a housing crisis in this area and all the landlords are trying to do is make a lot of money of people. this is a marginalized community, spanish speaking low income. >> the judge said the owners must address the problems within 40 days or face sanctions and contempt of court charges. the president's first monday on the job, pretty busy one. just days after this massive women's march mr. trump already taking action on women's right. kpix5's joe vazquez and the president withdrew funding for abortions today. >> he did. let me show you a photo of the event. here are all of his top aides, all men, surrounding president trump as he bans federal money to groups that perform abortions in other countries. now many women are worried about what comes next here at home. >> we're going to sign three memorandums. >> reporter: on his first monday in office president donald trump signed three executive actions withdrawing the united states from a trade deal with 11 asian pacific countries. >> great thing for the american worker, what we just did. >> reporter: ordering a hiring freeze for federal workers with the exception of military and instituting a ban on foreign aid to any overseas group that supports abortion rights. it's a ban that is alternated between republican and democratic presidents as they take office. [ chanting ] >> reporter: as we saw with this weekend's women's that were, funding with reproductive healthcare is a major concern. >> -- march, funding with reproductive healthcare is a major concern. that's why more than a dozen female elected leaders will announce a new resolution tomorrow, one that makes it clear. if the federal government decides to cut the funding, san francisco will find a way to provide women access to reproductive healthcare. for example, if the feds end up defunding planned parenthood as many republican leaders are hoping, they are promising city leaders will find a means to make it up. >> this is a time in our history of our country where we will need to get creative. it was important for us coming off of the women's march, coming off of the first acts of the republican congress to attack women's healthcare to say whoa, hold on. we're going to make sure that we are protecting that healthcare here in san francisco. >> supervisor ronan will be joined by five other of her colleagues here on the board of supervisors in san francisco who also are female as well as about eight other female elected officials and they'll announce the resolution on the steps of san francisco's city hall at 10:00 tomorrow morning. reporting live in the newsroom i'm joe vazquez. the president's newest cabinet member sworn in a few hours ago, the senate voting to confirm mike pompeo as cia director. but toni coming up a car plunged into this bay area creek, so far no sign of the teenage driver, but tonight there could be a break in the search. >> this governor started his speech tonight. then he suddenly stopped and started to collapse. what happened? >> a california craft brewery is recalling some of its beer, the warning tonight. there could be glass in that bottle. ,, search tomorrow.. for a missing 18-year-old driver. authorities say: her car swerved off highway 84 saturday morning... ged into the alame dive teams will resume their search tomorrow for a missing 18-year-old driver. her car swerved off the road and plunged into the alameda creek. tonight kpix5's betty yu tells us there could be a break in the search. >> reporter: tomorrow morning at 10 a.m. the chp will close niles canyon to recover a car that belongs to a missing 18-year-old woman from tracy. she crossed the yellow line and plunged into the fast moving raging waters. today that car was spotted about 100 yards from the accident. the family of the missing teenager played a huge role in her search today. authorities shut down niles canyon road so more than 30 loved ones could walk along the creek in hopes of finding a trace of her. >> you see the determination on their faces to find their daughter. it's very moving and that determination and that love for her is what helped find that car today, absolutely, literally throwing a rock out there and hitting what appeared to be a car and that allowed us to focus our attention. >> reporter: authorities then launched a drone to get a closer look and it showed two tires sticking out of the rain swollen creek. the woman is presumed to be in the car, but crews can't reach it until the water level is lower. >> the water level coming down quite a bit may enable us to put more people in the water to get this done. if the water is still moving pretty high and there's a lot of risk involved, it may entail like kelly talked about getting winches and getting the car secured. >> reporter: officials have not formally identified the victim, but family and friends are praying for jada jenkins on social media. she was on her way from tracy to a family member's home in menlo park when she lost control of the car. she was just starting college and had plans to study psychology and become a social worker. the sheriff's office said the family asked to stay private today. the chp says recovering the car is expected to take several hours tomorrow. they don't have an estimated time for when the canyon will reopen. in fremont betty yu, kpix5. a new theory tonight about the cause of the ghost ship fire from lawyers for the building's chief tenant. the group representing derek almena say they have a reliable scientific report that concludes the fire that killed 36 people last month started in an adjacent building. almena's attorney claim the fire marshal could not conclude where the fire originated and their report should clear their client of charges. the city says no conclusions have been reached and it's premature to speculate about the origin of the fire until all investigations are complete. the city of san francisco officially has a new police chief tonight. >> i william scott do solemnly swear. >> chief william scott sworn in at city hall today. he takes the helm of a department that has been without a permanent leader since last spring. kpix5's phil matier sat down with the new chief today. >> reporter: how you doing? meet william scott, san francisco's new police chief, a plain talking guy who wasted no time getting down to business. biggest challenge facing you coming in? >> earning the respect and trust of our officers because by the same token i'm going to be expecting some things from the officers. i think we have a lot of challenges ahead of us and this is an issue across the country. the community has really been quite vocal about some things that they would like to see from the san francisco police department. >> reporter: san francisco is probably the most political city you're going to be in. how will you handle it all? >> just like i always handle it. politics are a part of this business, but i try to be above the politics and sometimes that lands you in a good place. sometimes it lands you in a bad place some of the issues that are really complex and hard to get a handle on, the homeless issue and some of the other things that are happening. >> reporter: your stand on tasers? >> i support tasers. i think it's a good thing. >> reporter: finally considering the roller coaster nature of being police chief in san francisco, you going to rent or buy? >> right now i'm going to rent. i hope i'm going to buy. this city, real estate is at a premium, but it's a beautiful city and i'm very happy to be here. >> reporter: what you saw there is pretty much what you're going to get, a confident, plain speaking come. question is can he do a politician's dance as well? in san francisco phil matier, kpix5. scary moments tonight as minnesota's governor delivered his state of the state address. >> but despite that awful cost -- . paused for several seconds... lecturn. the ex >> democratic governor mark dayton mumbled something unintelligible, paused several seconds and collapsed at the lectern. the exact cause of the collapse is still unclear, but aides say he had a fainting spell, returned home and is in good health. >> he's a tough old bird. you know, everybody in minnesota knows former goalie, so he suffered hits before. >> this tweet tonight from the governor's son. i'm with my dad now and he is doing great. thank you all for your kind well wishes and words of concern. back to our storm watch coverage tonight, a mudslide shutting down several lanes today in sausalito between nevada and spring streets. crews removed mud and nearby brush. meanwhile in oakland this sinkhole affectionately named steve was no laughing matter. it quickly opened up to 10 feet along highway 13 today. crews finished filling it back up with concrete earlier tonight. and a historic landmark in santa cruz is taking a beating from the recent storms. kpix5's len ramirez shows us what's left of the old cement ship. >> reporter: it's been a tourist attraction at sea cliff state beach for generations and an icon of the santa cruz county coast, but now storms have turned the old cement ship into a shipwreck. >> very sad day. >> reporter: crowds came out to say good-byes. last year the ship broke in two, but 34-foot waves are finishing it off. the stern has capsized and the bow is sinking. the world war i ship turned party boat and fishing platform is practically unrecognizable. >> it kind of reminds me of my own age, i guess. >> reporter: gary gray came here as a kid with his grandfather. now he brought his own wife and kids. >> it's sad to see that it's falling apart, but it's still there. >> reporter: sea cliff also took a pounding from storm debris. this is perhaps the largest collection of logs you might ever see on a beach. there are literally hundreds, if not thousands of them, big ones, small ones, trees that were toppled maybe years ago in the santa cruz mountains, then brought here down by the rivers and creeks and streams during the storms and then tossed on the beach by the huge waves. >> i think everybody should get together and come out here and just start cutting all this stuff up, you know, haul it out of here. >> reporter: as if that's not enough, a huge sinkhole opened up near the park entrance when an underground culvert broke apart. park officials say lower sea cliff including the rv camping area will likely be closed to vehicle traffic for at least three weeks. in aptos len ramirez, kpix5 news. paul deanno joins us with a look at the weather now and we finally get a break. >> we've earned a break. the ground is saturated and can take no more water. thankfully mother nature said you're going to get a break after tonight. still a couple showers on the radar. we'll check kpix5 hi-def doppler. going to get wet again, one nor line of showers moving -- more line of showers moving through and that's snow about at mount hamilton north and east of san jose. how much rain this january? more than triple our average both inland and in the north bay. san francisco is trailing at only 280% of average, nearly triple. that means a huge water rise. our three biggest reservoirs in the state shasta lake up 14 feet this month, lake oroville is up 73 feet this month and trinity lake is making a comeback as well. it is up 15 feet and we're not done with the snow in the sierra. winter weather advisory through tomorrow morning, snow level there 3,000 feet as well. another 4 to 8 inches of snowfall likely this evening and overnight tonight and then a break. we're beginning to see clear skies outside san francisco 45 right now, livermore 42, oakland 37. lows drop to the 30s in fremont, tri-valley, fairfield, vacaville, santa rosa 39. for the past five years it would be the front, a little rain and we're done, but now we have such a fast moving jet stream so fast and strong that the trailing area of low pressure behind it is also packing a punch and that was the catalyst for all the rain and hail and even a couple thunderstorms that we had outside today. now once that low is gone let's see what futurecast says about tomorrow. still a couple scattered showers 2 to 3 a.m. by sunrise when the kids walk to school, we're done. by lunchtime we get some sunshine. wednesday we also get some sunshine. is this a drying trend? yes because the latest computer models say even thursday only light rain showers for the north bay and that is it and super long range we get a ridge of high pressure. we had too much of this during the drought. now we need it a week or so. this lasts through the weekend, the storm track well to the north. we will get a much deserved break. oakland and napa tomorrow 54, afternoon sunshine but chilly, san rafael 50 and livermore 52 degrees tomorrow. tiny chance of a north bay shower. the chance decreases on thursday. then we get some sunshine. you've been stuck inside. what am i going to do with the kids on saturday and sunday?
