>> live, from the cbs bay area studios, this is kpix5 news. >> a sex assault that led to shame and suicide. good evening, i'm allen martin. >> and i'm julie watts. ken and liz have the night off. betty yu is live at saratoga high with the details. >> reporter: they were all students here when this assault took place. today, the teen's insurance companies were ordered to pay nearly a million dollars to the pot family. but it is the rest of the settlement that makes this case unique. it is an unusual deal that is not just about money. two teens admitted to sexually assaulting 15-year-old audrey in 2012. and had to apologize to her parents in court today. they have also agreed to make ten presentations at high schools about the dangers of drinking, sexting, sharing nude photos and slut shaming. >> it is like they are making this a school project which it is very much not. >> i don't think it will teach kids a lesson. they are going to do whatever they are going to do regardless. >> reporter: retired judge cordell says she has never seen a settlement like this. >> the parents of audrey say we really want to bring change. we don't want our daughter office death to have been in vain and we want the perps to make this right. >> reporter: audrey hanged herself days after she discovered she was sexually assault at a house party. she woke up to nasty messages written on her body and there were photos shared among classmates. the men are now 18 but were not identified in the court papers. >> it was the shaming. the putting audrey's image out there that caused her to kill herself. to take her life. yet this settlement agreement says we are not going to shame you. >> reporter: as part of the agreement, the men will talk honestly about what happened in a documentary. but won't have to show their faces. however it reaches young people, daniel diaz approves. >> they will know actions were committed and it was a big mistake. they will see it as a big mistake and not a fun time. >> reporter: judge cordell says this kind of settlement be the start of a new trend. something we may see more of as a standard resolution. especially in this digital age where unfortunately, we are seeing more cases like this one. live in saratoga, betty yu, kpix5. we have new information about a martinez man accused of child sex abuse. there may be hundreds of victims. blake johnston already faces multiple charges. he has been in jail since late last year, but now, investigators say they have identified more than 30 victims and there are probably more. they say johnston met young girls online. in fact, in one case, he drove from the bay area to oregon to meet a girl and took his own daughter. the girl was found at johnston's home in martinez leaving roller skates and a suicide note next to a bridge. in walnut creek, three guys got away with an atm full of cash. one man distracts the clerk while the other attaches a cable to the pick up truck. then they rip the atm out of the ground and load the machine in the back of the truck and take off. tonight, san francisco police say they have caught the man who did this. take a look at this video. walked up to a homeless man who was minding his own business in the tenderloin and bashed his head with the pipe and then the attacker just walked away. the away. >> everyone has a right to feel safe. especially in san francisco. >> an officer saw the video on the news last night. very hard to watch. and minutes later saw the suspect in person in the tenderloin. police have charged 36-year-old arthur lee jones of fairfield with attempted murder. they don't know why he did it. the guardian angels are back on the streets of san jose saying they want to help the police fight the rising crime rate. andria borba caught up with them downtown. >> reporter: with red berets on their heads and cameras on their shoulders, the guardian angels are officially a presence in silicon valley. they say something has to be done to stop violent crime in san jose. >> since the police force has been cut, it has been like a beacon to crime. we have gotten a lot of violent crime. >> reporter: looking almost military standing in a triangle looking out in all directions outside the san pedro square market, they began their recruitment. >> we are not a vigilante group. we are not out to cause trouble. we are out looking for the safety of the community. >> reporter: shawn rogers is the region until director. he lives in stockton and patrols the streets there. >> stockton as you know, just like san jose, had a police force low in numbers. and we were actually able to help the police department and patrol the streets. and just get a sense of the security. hi, how are you doing? >> reporter: the group maintains the presence of men in uniform watching is itself a crime deterrent. they have walked these sidewalks in the past. >> it is a safe place. >> reporter: but people didn't think they were always effective. >> they are the best weapons in san jose. >> neither do the police. >> reporter: while not in black and white cruisers, these men are keeping a close eye on the city. >> san jose really needs this right now. >> reporter: members of the guardian angels say tonight was as much about recruitment and beefing up their numbers as it was about safety on the streets of san jose. once they have more numbers, the streets will be safer, andria borba, kpix5. oakland is getting new police officers. 35 recruits graduated from the academy today. now there are 725 officers in oakland. that is the largest number since 2008. in san francisco, there will soon be eight fewer police officers. the chief wants them fired for releasing racist and homophobic text messages. they surfaced last month. the chief made it clear today he doesn't want these cops working for him. >> i have suspended them. and they have been referred to the police commission with the recommendation of only termination. >> the text may jeopardize hundreds of cases. they aren't viewing them to see if the officers text messages tainted any investigation. in san jose, disgraced former santa clara supervisor george sharakawa apologuesed in court. he will have to do 45 days of community service and pay a fine. this marks the end of a five year legal saga including separate corruption charges for which he served some jail time. it is also the end of his political career. he can't hold public office again. we are getting a better idea tonight of why a house collapsed in north oakland yesterday. a contractor doing renovations on that home had lifted it to pour a new foundation. neighbors say there wasn't much holding it up. all of a sudden, it came crashing down as you see. we asked another contractor to take a look and he spotted problems right away. >> they don't have the braces to support the wall there. the temporary wall they built. they had to have a bar to support. >> cal osha and the city of oakland are investigating. they could face a big fine. >> we are hearing tonight from a man who says he spent more than two months adrift at sea. hungry, thirsty, and sun burnt. juliana goldman has his story. >> reporter: as soon as louis jordan was rescued, he called his father. >> hey dad. >> hey louis. >> oh man, nice to hear your voice. >> reporter: in late january, the 37-year-old's family reported him missing after he set sail for a solo fishing trip. the coast guard said it would be looking at his trip from start to finish but here is what jordan said. he hit rough water ins the atlantic and his boat capsized. >> i was flying through the air. and the ceiling was the floor and the floor was the ceiling. >> reporter: he said he spent his days reading the bible, praying for rainwater and eating the fish. >> i collected a bunch of seaweed and found these little critters living in the seaweed and they tasted good. >> reporter: thursday, a german container ship spotted jordan 200 miles off the coast of north carolina. he was sent to a virginia hospital where he was reunited with his family. a spokesman says there's a lot we may never know about his voyage because he was out there by himself. he is the only true source of information we have. cbs news, washington. >> don't go alone. starbucks tries to spark a nationwide discussion on race but then. >> we didn't know what to think. we were dumbfounded. >> only on 5, why starbucks thought a man born in san jose was a coffee spy from china. >> and there is help for your water starved lawn if anyone can get water for free. >> how is this for you? high ins the 50s . three straight days with a chance of rainfall, and a snow level of 4,000 feet. january? no. next week! we will talk about it coming up. ♪ ♪ ♪ >> starbucks has apologized to a bay area man after one of its executives accused him of trying to steal trade secrets and take them to china. sharon chin spoke to the man in an interview you will see on 5. >> reporter: bay area native daniel was on a trip to seattle when a starbucks executive came up to him. >> i want you to know, we are very open with our equipment, if you want to take any of it to china, you can take it. >> reporter: he came back. >> you know what you can't get in china? our training. [ laughter ] >> how did you react to that? >> i think that i was really shocked and taken aback. we didn't know what to think. we were dumbfounded. >> reporter: daniel complained to starbucks and detailed the comments in a yelp review. this is before they launched their controversial race together campaign to improve race relations. starbucks apologized. then a phone call from the executive himself. >> he really was thinking that we were from china. and wanting to steal secrets. >> reporter: the starbucks executive thought daniel was part of a group wanting to copy the chain overseas. he is not in the coffee business. he works with christian ministries. he accepted the apology. >> i want you to know that was still hurtful and made me really uncomfortable. but i want to send forgiveness to you and grace. >> reporter: daniel accepted the executive's invitation to return to seattle to talk about race and reconciliation. maybe over coffee. sharon chin, kpix5. >> starbucks confirmed that a company executive has had a conversation with a customer, but the talk is private. carrows has shut down locations. they told them by putting noticing on the doors telling them they were no longer needed. carrows was bought by another company. tonight, there is a list of the smartest public high schools in the u.s. and we are doing well. the website niche ranked the top 50 and 11 are here in the bay area. three in the top ten. all in the south bay. lynnbrook high. saratoga high. those freeway signs that usually tell us about accidents and backups are now telling us save water. caltrans put the message on 700 of the signs up and down the state. severe drought, limit outdoor watering. but tonight, we may have a solution for people who just can't bear to let their lawns and plants die. it is free water. free recycled water. christin ayers shows us all you have to do is bring your own jugs. >> reporter: pull up, grab a hose. fill up. and repeat. >> 21 gallons. >> yeah. i probably do about 12 trips a week. >> this would be my third trip. >> reporter: they come for the free water. >> this is awesome. why not in we are already facing the drought. right? and we definitely don't want to waste water. >> reporter: this water is not for drinking. it has been used and treated. but instead of dumping it into the bay as they have always done, the dublin san ramon water district is giving the water away for free so people like gary can water their lawns again despite the drought. >> the lawn was turning brown. and you know, i have always had a green lawn. it was tough to see it go. >> reporter: stevenson, a spokesperson says this was a brain child of an operation manager here and it is the first of its kind in california. >> and i think it might be the first in the country. >> reporter: the district started out with three of these stations last june. the program has become so popular, they had eight. they are expected to double that soon. they need the extra stations. in the first six months of the program, people all the way 2.3 million-gallons of free water and it will go up. >> we are in desperate times with the drought. >> reporter: in dublin, christin ayers, kpix5. >> the water stations are open noon to 7:00 everyday except thursday and sunday. anyone in the bay area is welcome to the water. we have free water coming. >> even better free water. the stuff you don't have to have a container for. >> you might want to put a container out there to catch some of that rainwater. >> there will be a lot of it. tuesday looks kind of wet, yeah. >> it is thrilling! >> yeah, it has been so long since we have had a good soaker. early february. it will feel good when it gets here. it is coming up this week. it is a weather pattern we have not seen all winter long. san jose, clear skies tonight. chilly night tonight. look at the highs though. it was a warm day. brentwood, 78. jerry in antioch, 80. norman in guerneville, 69 degrees. quite warm outside. but it is clear tonight. and it will cool off. concord down to 46. san jose, 45. if you are up late or get up really early tomorrow morning, you may catch a total lunar eclipse. it's a quickie. only in totality for 4:58 to 5:03. you will see the shadow as early as 3:00. it turns red during that totality for five minutes overnight tonight. into tomorrow morning. remember this. here is something strange. it is going to snow on mount hamilton right here in the bay area on tuesday. the snow level will drop down to 4,000 feet or below. why?
