>> reporter: typically, they release the name of officers involved in shooting. >> we are fearful of retaliation from the officers by the son or of associates. once we have taken care of those safety issues, we will be providing their names. >> reporter: here is why. leavy's son was arrested last week for selling heroin on the streets in pleasanton. hayward pd is worried about him calling shots from behind bars. >> we are still looking for details on who his associates were. and who he is involved with. >> reporter: another plot. atf agents have joined this investigation because it is alleged that he has a an ammunition device. they are not revealing the names of their officers. live in hayward, andria borba, kpix5. tonight, we learned an oakland police officer was arrested for trying to impress a waitress at this san francisco ihop. he pulled out his gun to impress the waitress, but she got scared and called 911. a storm caused some problems. accidents, flooding, right now paul deanno is tracking a bigger storm headed our way. paul? >> a lot more rainfall coming by this time tonight. we will be covered in intense rainfall once again. kpix5 high definition doppler sweeping the sky 300 miles in every direction. there are a few showers moving in san mateo and napa valley. we had mountain view, petaluma. we had one inch of rainfall in saint helina. that was round one and that was enough to give us enough rain in the past five days than the previous 72 days. storm one moving out. storm two has a tropical connection and it will give us more rain than some areas have seen for the entire water year. details on when it begins and ends coming up later in the show. >> thank you paul. well will is fresh snow? the sierra and more on the way. possibly several feet this weekend, but the snow pack which is critical to our water supply is still well below normal. you can get up to the minute radar for your neighborhood any time on kpix.com/weather. new tonight, a man apercussed of stealing a car and leading police on a chase is spending the night behind bars. police loaded him up after they say he crashed this black sedan in san francisco's crocker amazon district and tried to bail. also tonight, christin ayers heard a different perspective about the lunch menu at an east bay high school that had many crying racism. >> reporter: it was supposed to be a celebration of black history month at this high school in concord. >> i think they know it wasn't to hurt anyone, but it was a little too far. >> reporter: the school black student union planned a menu of fried chicken, watermelon, and corn bread. the reaction was swift. >> very offensive. >> reporter: the school issued an apology after students and parents complained but now there is a backlash against the backlash. one black leader in the east bay community said this. >> what's the big deal? >> reporter: elizabeth williams serves on the equal opportunity commission. she doesn't mind the menu. >> historically and now, we like our chicken and i'm in the going to stop eating my fried chicken or my corn bread or watermelon. >> reporter: i talked to her about the history of the watermelon stereo type. how it was used in stomach turning issues like these in slavery showing african americans as dosile and simple. >> let's move on. let's be more progressive. let's not be insulted by something so minute. >> reporter: christin ayers, kpix5. this is what is left after a car burned into blames in a burger king drive through in hayward this afternoon. the fire spread to the kitchen. it all happened very fast. >> i turned my back one moment and turned back around an there is smoke coming out of the hood. smoke coming out of the car. >> the driver was able to get out of the car safely. check out where this fedex plane wound up. in a field in tracy. they had some engine trouble and no one was hurt. just a few hours ago, a parking lot opened up, a parking lot that cost taxpayers $80,000. joe vasquez shows us this is like no other parking lot in the bay area. joe? >> reporter: you can see how the car, parked behind me here inside the cars are homeless people who tell me they would normally be on the street curb. now they are in a protective parking lot near the so know ma county fairgrounds. this is home sweet temporary home. >> how is this helpful for you? >> it is is a locked community. you don't have to worry about somebody stealing something. >> reporter: the catholic charities the contracted to feed the homeless hot meals. bathrooms and a heater are also available. sonoma county put out money for the safe parking program. >> we have children sleeping in the cars every night. this allows them to come here and be safe, be warm, get a meal. and we are also providing case management so we are working with people to help them resolve their homelessness as well. >> reporter: the program is slated to last through the cold and rainy season until the end of march. at that point, lit be reevaluated and may continue into april. some neighbors are missed. they were not consulted and have concerns. >> the safety of the children and any illegal activities that may be occurring. >> not when it is crammed down our throats. every neighborhood should have the opportunity to have some imput before they do it. >> reporter: joe vasquez, kpix5. a misdemeanor battery charge against a bullied teenager who fought back could be dropped. the fight at hercules high gained national attention. 16-year-old jules gutierrez who is transgendered says it happened after she was harassed. tonight, a team member task force met for the first time since an alleged hate crime. they are looking into university policies after a black student reported being harassed by his white roommates. >> i don't understand why they haven't been expelled. if you plagiarize, it is expulsion, but if you torture another student, you go to another dorm. >> the group will make some recommendations to the school. the next meet sergeant on the 21st. the winter olympics in sochi russia just started. this is a live look at olympic park. the opening ceremony is only a few hours away, but there is real concern tonight about a terrorist attack. so much so that the tsa is banning all liquids on flights between the us and russia. officials are warning airlines terrorists may try to sneak explosives on board using tooth paste. this is the damage a tooth paste bomb could do. for this demonstration, explosive powder was mixed with another ingredient? a paste and put in a tube with real tooth paste. it could be missed in a casual inspection. tonight, covered california is shutting down a major portion of the website following our investigation of doctor shortages. kpix5's julie watts has the exclusive. >> you would think once wow have the insurance, all you need to do is find the doctors that accepted the plan and come to realize a week later that not enough doctors are covered. >> reporter: a lot of people discovered a lot of the doctors described as in network were not accepting their insurance. >> this is something that the consumer is going to have to work out with the health carrier. >> reporter: earlier this week, dana howard told us to talk to the insurers. >> let me stop you there. he did that and we did that and they said oops, sorry, our bad. they were never contracted with us. isn't it covered california's responsibility to assure that your insurers are providing accurate information? >> it really isn't feasible for covered california to go through and check thousands upon thousands of doctors to make sure that the information that they are providing is indeed accurate. >> but we checked a few today and of the first five doctors listed, not a single one said they accepted the covered california insurance. in fact, one said they didn't accept any obama care insurance at all. covered california's solution? they are now taking the doctor search function off the website. >> reporter: in a statement, they will discontinue posting of the provider directory on the website until further notice after finding errors like the ones we brought to their attention. they said covered california enroll lees should talk about finding alternate doctors but if they are unsatisfied, they can cancel before the end of open enrollment. >> we didn't get what we thought we were getting. >> reporter: and that is what many plan to do. covered california is responsible for the content on their website, but according to the department of managed healthcare, neither covered california or the insurers are breaking any laws. they are subject to change without notice and only need to be updated quarterly. julie watts, kpix5. tonight, we are getting an unusual clue that could solve a 25-year-old murder. you have to wonder what took people so long? women on a rampage in marshall's. and wait until you see what happens next. the worst drought in decades so how come a reservoir four times the size of hetch hetchy is off limits to everyone in california? ,, does this quilt look >> police are asking for your help to solve a 25-year-old cold case. does this quilt look familiar at all? the body of cathy zimmer was found wrapped in it. she was discovered in her car at the san jose airport. the quilt did not belong to zimmer or any members of her family. police think the killer might have left it behind. >> think back to that time. and if you remember anything strange in that parking lot. seeing something. maybe you didn't think anything of it then. but if this jogs something in your memory, please call. >> police did not say why they waited so long to relice the photos of that quilt. a violent robbery caught on surveillance camera at a marshall store in southern california. take a look at the employee guarding the exit doors toward the right of your screen there. now all of a sudden, a woman in a blue dress comes barreling into her as other suspects run out the door with more than a thousand dollars in stolen goods. >> we are now dealing with a felony and a robbery now because they had made physical contact with an employee who was working for the store when they made their escape. >> the employee was feeted and released from the hospital. the suspects are on the run. thanks to all the rainfall that came down, we are not out of the woods yet. not by a long shot. the red on the map shows where we are extreme. the darker area is worse. it is categorized as exceptional. we all know there is a water shortage, but linda yee takes us to a place where there is a lot of water, but most of us can't have any of it. >> reporter: california is bone dry. >> make no mistake, this is a megadrought. >> reporter: the worst drought on record has delivered no snow pack, drained reservoirs and turned once lush vineyards brown. mandatory rationing is in the works. but there is one place where there is no shortage of water. the bountiful pomegranate almond and pistaschio fields are as green as ever. why? you can't see it, but there is a huge underwater reservoir under my feet. four times as big as hetch hetchy. it is called the kern water bank and it is controlled by two of the state's biggest agra businesses. >> i agree it is a big water bank. >> reporter: a bank penalty to store extra water for the state in times of drought. but katie stamos says the state turned it over to these businesses in exchange for a cut back. >> so no money was exchanged? >> no. it didn't have to do with the value of the property. >> reporter: in fact, the state lost money because it had originally paid for the land the kern water bank sits on. >> i think it was around $70 million. >> and that was just handed over? >> well, the cost of building a bank is significantly more than that. water managers feel that this is the kind of thing that makes good sense. >> reporter: but not everyone agrees. >> i don't think in this country we are prepared to allow fresh watt tore be a privately controlled resource. >> reporter: adam keith is with the center of biological diversity. his group is suing the state to get the water bank back. the suit claims the transfer of the kern water bank to controlling private interests amounts to an unlandfall and unconstitutional gift of a critical state asset. >> this is as important as some of the largest dammed reservoirs in the state. you can't rewrite the contract on these things. >> reporter: keith predicts the private ownership of that much water will lead to speculation and profit making. >> the drought is a perfect opportunity for them to do so. i think they are trying to lay low until they have a more solid grasp on the water. then the flood gates will open and we see the damage these guys have engineered. >> we didn't see any signs that they were planning to sell water outside the service area and we still don't. so you have any say over what they do with it? >> no. >> people can't live without water. should we leave it to a couple of rich guys or let it be a democratic process and our elected officials, if they really had our interests at heart would distribute fairly. >> reporter: linda yee, kpix5. >> really interesting lawsuit. the judge heard arguments in it last week. a decision is expected in a matter of weeks. we still have a long way to go before we fix the drought problems but the next couple of days will make a difference. >> a very big help. yes. we are not going to make append monday morning and say the drought is over. it may feel and look like it, we will possibly do about a 20% dent in this doubt. 20% is good. a couple of weeks ago, we were talking about how many days without rainfall. this is a very welcome change. radar, kpix5 high definition doppler. a couple of showers up toward eureka. may have to use the windshield wipers. but the rainfall, the good stuff will get here tomorrow afternoon and last all the way through the weekend. great stuff in the sierra. that stuff is 18% from normal. it will be higher because the snowfall will be falling above 5,000 feet. a winter storm in effect. we are looking at two to four feet of snowfall above 7,000 feet. heavy snow in the sierra. it slowed your trip to work this morning. that is gone. it is now over arizona and new mexico. storm number two is headed toward us. follow the moisture all the way down to hawaii. we call that the pineapple express. look at the moisture moving right over the big island in hawaii. follow it all the way up to the bay area. i have drawn some arrows. that's the storm track. all that moisture is headed along those arrows right toward us. right toward the bay area and north of the golden gate. we are talking three or more inches of rainfall. east bay, livermore. an inch or two. on the peninsula, that includes the city of san francisco, two or three inches of rain. that's good stuff. and the north bay, you will be the bulls eye. three to six inches of rainfall just this weekend. that is a 20% dent in our drought. san jose, 58 degrees. the average is 62. the rain will hit you tomorrow evening. san mateo, 57. concord, san ramon, you will get the rain starting tomorrow afternoon. san francisco, 56. rain, late in the day tomorrow. pretty wet weekend. lit be tough to get around. we need this rainfall. highs around 60 or dry, monday, through wednesday of next week. exactly what we need on the weekend. commutes are not going to be horrible because it is the weekend. we need this rain and finally, we are getting it. >> this is great. >> good stuff. thanks paul. coming up, there is junk mail, then what one bay area woman received. , yep, paid that one. what about your mortgage?
