a driver stopped to help accidents victims but ends up getting killed. the advice from the chp when you witness an accident. the chp investigating the death of a pedestrian last night. it happened at southbound 280. the driver pulled to the right shoulder and got out. >> reporter: and we were able to track down some of the passengers who were hit by that drunk driver. they say they did not want to talk on camera because it is too tramattic. they gave us new details saying it it happened quickly. they were out of the car a minute after the impact but they say, at that point, the good samaritan was already down. >> the driver of the silver toyota four runner said at that hour, 240 a.m. sunday morning he was on the lookout for drunk drivers and careful to watch his speed. he said the car was going 1miles an hour. >> reporter: the driver did not want to talk on camera but told us the impact sent his four runner spinning out of control and hit the median and flipped on its side. after that, a good samaritan actualed his jeep to the side of the -- pulled his jeep to the side of the road and he was hit and killed by an 18-year- old driver. >> we recommend people not to stop on the freeway and call 911 and tell us what is going on. if other people can not see you if you are stop so you are liable to get struck. >> reporter: the man who caused the crash, the 25-year- old man, suffered minor injuries and was charged with felony dui. the peopled in of the toyota suv suffered minor injuries. >> reporter: the driver of the suv is thankful to the good samaritan he stopped to help but he would not have done the same thing himself. the woman with the good samaritan, possibly a wife or a girlfriend was heard screaming and came to his side to help. but the man, a 33-year-old resident of redwood city, died on the scene. and the driver who hit that good samaritan his name is kevin lynne and he is 18 years old and from fremont. >> all right, thank you. new at 11:00, three people were taken to the hospital after a car collided with a bus. this happened just before 9:00 at mission and south van mys, the bus was taken out of service to assess the damage. a fight on the phone and loud music may have played roles in the fatal limo fire on the bridge last may. and it turns out the limo driver's first call may not have been to 911. why the authorities want to talk to the driver's estranged wife. >> to watch this long limo just engulf in flames it was just -- it was a nightmare. >> reporter: that is undisputable. it is what happened the moment the fire started that was under scrutiny. the limo's driverrest rang wife tells the mercury news he was arguing with her on a cell phone, loud music, blaring, and that he turned the music even louder so the women in the back could not hear their fight. he has admitted he misunderstood the woman as they tried to tell him about the smoke thinking he they were asking if they wanted a cigarette. >> if i had known she was saying smoke instead of i wanted smoke a cigarette maybe 30 seconds, 60 seconds would have been spared but everything happened so fast. >> the 9 passengers on may 4th remember women celebrating one of the friend's wedding when the back of the limo began filling with smoke and fire. the new bride and four other women died trying to escape through the tiny petition that eperateed them. four other woman in the back and the driver lived. browns wife tells the mercury news he called several times from the roadside before he called 911. this is what he said at the time i see them coming through, i can not use the phone, i am shaking, i am nervous. >> brown's wife says he was upset during their phone call trying to make amends after a fight in public in which the police were called, earlier in the day. >> the da says they will follow up with brown'sest rang wife to find out how distracted he may have been. before she spoke with the paper the police never interviewed her in the case. back to you. the chp has not issued the results of the investigation but it is focused on friction from the drive shaft as a cause for the fire. a ceremony today to remember the sacrifice of contra costa county firefighters. the district has lost 16 personnel in the line of duty since 1969. the names of the fallen are commemorated on a memorial wall. well, the reward is rising for information about those poisoned meatballs. sanfrancisco police are looking for the people who left hundreds of them for dogs to eat and one dog died. the animal legal defense fund says $5,000 is offered for information that leads to an arrest and conviction. well, politicians and their constituents are passionate about key issues spilling over into public meetings with ugly results. >> kpix-5 explains. >> the fish jump up in the creek. everyone knows marin as the mellow county. where people and nature get along or they used to. women say they have pictures to prove him wrong. what is the real story? we went undercover to see for ourselves. a sight most customers do not see. >> i will call animal control. >> what happened after hours here at the stables in daly city. the stables offer horseback rides to the beach and the summer camp for kids. beneath the surface, two people who boarded horses at the stable describe a darker picture of what they say is horse neglect and a pwaous. >> i would see the same horses going out four times, never being untacted, never fed water. >> they are being used to the point that they are lame, sic, diseased, dying. >> somebody needed to do something. >> they took pictures of what they say are filthy stalls. moldy hey. overgrown hoofs and videotaped skinny horses, limping horses, even a dying horse that they say never got veterinarian treatment. >> they were working him to death. >> reporter: this stable owner would not let nus for a visit. >> it is a bunch of horse crap is what it is. >> reporter: he admits his barns are in need of a remodel. but it is thinness but it is not a sign that it is dying. >> reporter: after complaining to the humane society for months with no results, the two women compiled this binder filled with evidence and delivered it in personal. but to their surprise it has not been a slam dunk. >> this is an ongoing investigation. so i am really not going to be able to give you specifics about it. >> reporter: human society director, white, says state laws protect horses for hire. but even if violations are found -- >> there is sort of a fix-it opportunity. it is fix the conditions of the animal and the crime, if you will, goes away. >> reporter: so, are things fixed here? we paid an undercover visit and noticed a state code violation right away. horses were standing waiting with saddles not loosened and no shelter. >> it is required they are provided with shelter from the elements. >> reporter: this horse was tightly tied to the fence he could not fully lie down to rest. >> it is just awful, disgraceful, disgusting. it is sad. >> reporter: back to you. an investigator with the human society did conduct an investigation but he called that is rue teen procedure. but, they feel it allowed the stable owner to hide any potential problems. a german roller coaster maker is sending the official its to sixx flags over texas to inspect it. the woman expreltszed concern about the safety bar not locking as the ride was starting. the coaster manufacture says there has never been an issue with safety bars on any of the 50 roller coasters it has made. sixx flags is conducting its own investigation. heavy rains across arizona have floodwater through yuma, tucson and scottsdale, those floods led to dramatic rescues. we show you how drivers were pulled from raging waters. >> reporter: rescue teams dropped lifelines to people in phoenix after a flash flood swept over their suv. forecasters say rain, up to two inches an hour caused the floods. some people tried to drive through the high water and got stuck. phoenix firefighters perched in a bucket over one stranded pick up truck. rescuers on the ground led two people to safety. >> they stayed in their vehicle from what i heard from my other neighbor the water was running rapidly and gotten so high. had they try to get out they could of been washed down straoeplt -- downstream and the cleanup will take days, back to you. we could see some of the rain but nothing that that was dramatic. i was talking to a girl with facetime in phoenix and i jumped hearing the thunder. now, on our radar in search of raindrops, not seeing any yet. but, look to the south. we actually had flash flood warnings in effect for san diego earlier today. as that monsoonal moisture scraped across san diego and lifted into the alaska basin. we have cloud cover. but, the clouds right now in san francisco are associated with the deck of low clouds and even patchy fog behind the area. you see it here, where, these winds out of the north at 12-14 miles an hour. oakland, middle 50s in san francisco. you couple it up with the breeze. downright it is raw outside. it is 69, however throughout the valley. we are in dublin right now. it is 68 degrees. nice bright light there in the try valley. the winds are out of the southwest at 10 miles an hour there. so, bottom line, one thing we will all have in common tonight is it is becoming cloudy. tomorrow, mostly cloudy skies and some muggy conditions, you will feel the difference. forecasters call for the possibility of a thunderstorm. not only on monday but tuesday as well. today's high, just a degree or two cooler than on saturday. going from 60 in passive ache to the middle 60s across the bay. 80 in san skwroes a have mostly cloudy and muggy can conditions. the temperatures coming down, 79 degrees, san skwroes a64 pacificca. east of the bay, the numbers topping off to near 90 degrees, otherwise 70s around the bay, back in through american canyon and martinez, 60s and 70s north of the bridge. central bay, into the 60s, extreme, up to 92 in lakeport. the extended forecast, unsettled on monday and tuesday. very muggy conditions, and, then, high pressure builds in. drier air mass which means we will see the return of the sunshine and less humidity on wednesday all of the way through sunday. the numberses
