scandal. >> this is cbs 5 news . >> thanks for joining us here at noon. we begin with the race for the white house and the latest on newly discovered emails. the fbi now has a search warrant to email -- to review emails pastor hillary clinton's private email. the emails were found by -- on anthony weiner's cbs news discovered the emails were discovered earlier this month but director james comey says he didn't find out about them until last thursday. jessica hayes has the latest on the investigation -- jeff the gase -- jeff bigaise has the latest on the investigation . >> reporter: james comey is under fire for making the disclosure 11 days before the election. >> how is the public supposed to respond to this? public to make an informed judgment . >> reporter: in a letter addressed to the fbi director sunday, senator harry reid accused james comey of partisan action and alleged that he may have broken the law by violating the hatch act. it bans most federal and some other government employees from participating in political activities that could help or hurt a partisan group or candidate in a partisan election. investigators seized the laptop belonging to one-time clinton aide, aberdeen and estranged second probe into anthony weiner's communication with an underaged girl. cbs news has learned the fbi deliberated over whether to disclose information. officials debated whether they would be accused of trying to manipulate the election by hiding the renewed investigation if criminal evidence was found. a person familiar with the process, as officials ultimately concluded, the letter was the most credible anything new came up regarding the investigation into clinton's use of a prime out -- a private email server. >> what the decision this week showed is even 11 days before an election, no one is above the law . >> reporter: law enforcement forces say there was surprise regarding the emails being on the laptop. cbs news washington. just a days -- eight days to go election day and hillary clinton is stopping here before voters head to the polls. she is going to hold an early vote rally on wednesday from 2 pm to 4 pm. her campaign is still sorting out the details on where it will be held. on thursday, democratic vice presidential nominee tim kaine will be campaigning in phoenix and tucson. the campaign says he will give his entire speech in spanish. we are also waiting to hear the a man who was kicked out of donald trump's phoenix rally on saturday insists he was misunderstood. anton weber was escorted out for staring at the media covering this event in what was described as a "menacing way. he says he was making a peaceful protest and it was against trump, not the media. his protest is getting national attention this afternoon. he says he does not associate with either party and wanted to hear from trump directly but at he had heard. >> the moment he started talking about the election being rigged again, i had to do something. i was either going to walk away or i was going to turn around and just silently protest. >> he says he was misunderstood. there's also another disturbance at that rally.>> [ chanting ] usa usa usa usa. chanting jew sa. >> he's going to win. it's going to be a slamdunk. if he loses, he got real problems, you know what i mean? you got real problems. russia will come down and crush you. >> trump's campaign manager says the man's actions were deplorable. if he looks familiar, there is a reason why. we interviewed him when he was involved with a car crash five years ago and the result went viral.>> all of a sudden i was minding my own business and ma'am, hit me hard -- pam -- bam hit me hard. i feel kind of shaken up still right now. reality hits you hard. >> he is very descriptive. the video was turned into a we are live on the scene breaking news. ahead on accident and glendale near 65th and thunderbird. two vehicles were involved in this and we have told one person went to the hospital with serious injuries. part of the roadway is shut down right now so avoid this area if you can. if we get more information, we will bring it to you. a phoenix police officer arrested for domestic violence two years ago is in trouble again and this time it is costing him his job. nevin brunner failed a drug he claims his ex-girlfriend secretly fed him drugs while he was in mexico and the same girlfriend accused him of domestic violence two years ago when they were in sedona. he was arrested and pled guilty to a misdemeanor charge of disorderly conduct. he received a 24 hour suspension after an internal investigation but then returned to work. he was a 20 year veteran of the department. firefighters and gilbert knocked down a house fire gilbert and baseline. it appears everybody got out safely but there is no word on how badly the home was damaged. a semi truck caught fire on the cactus on-ramp to the loop 330. this is what it looked like from the penguin air and plumbing chopper. firefighters to depose flings out. the on-ramp was locked for much of the morning. the gila river indian community -- indian community says it may appeal the ruling denying their insisting the freeway would desecrate land that is sacred to their community. late last week, a judge denied the injunction, which is already underway now along pecos road. community leaders say they are weighing their options let me see an injunction from the ninth circuit court of appeals. we will keep you posted on that. this weather, you deserve a round of applause. >> it just took three months.>> going to hit 100. >> a whole different story this week. let's get to the important stuff. everybody wants to know what is halloween going to be like? first off, sunset at 5:37 pm. keep that in mind. we top out around 86 degrees for our high. around 6:00, as you get the kids out, 80 degrees. and then we dropped down to about 75 by and then we dropped down to about 75x some clouds out there but don't worry about any rain in the forecast in the valley. here is a look at nau. here is a look at downtown phoenix. you can see some of those clouds overhead. the trees not swaying all that much. there's not a lot of wind up there. if you look at valley pinpoint doppler radar, you can see the clouds overhead. most of the state is in and out of the clouds. if i put the leap into motion, you can see them streaming from about everybody is dry in the southwest. some rain over in northern california but that's about it. look at these temperatures. 77 degrees in globe at lunchtime, 82 degrees in gila bend. 68 degrees in prescott, 59 degrees in flag and sedona. around the valley, nobody should be at 90 degrees, just the low 80s and the mid-80s. apache junction leading the way. we are going to see some wind today and coming up in your next forecast, i will tell you where might impact trick-or-treating. >> let's -- looks fantastic. the search for a fugitive who taunted police while on the run came to a violent end this weekend. you know those annoying rumbling of a powerful earthquake as it hit central and southern italy over the weekend. this is one of the hardest hit areas. the cathedral and other buildings crumbling. roads are split in two. italy is still recovering from an earthquake in august that killed almost 300 people. the powerful aftershocks have been happening ever since. officials say many people have evacuated the area, which is likely one reason more people weren't hurt. an explosion in a coal mine in southwest china has 33 miners underground. so far, workers have located 12 people underground. investigators are trying to figure out how this happened. china's mining industry has long been among the world's deadliest although it is getting better as safety improves in the smaller, more dangerous minds. the hunt for an oklahoma man wanted in a deadly crimes spree -- crime spree is finally over. western oklahoma. police say a sheriff spotted michael vance and pulled him over. the sheriff was hit in the shoulder and arm in crossfire. uncle fans was tracked down and eventually again killed in a shootout with troopers. they got a tip the fugitive was in the area after a car he still was spotted hidden away. >> a farmer discovered a vehicle in his field, a vehicle that came very close to matching the description of the vehicle we ha for. >> michael vance is suspected of shooting and stabbing his aunt and uncle and women to officers who came after him. he had posted facebook live videos threatening more violence while he was on the run. last-minute merges on the highways are often blamed for road rage but engineers in a handful of states are now encouraging drivers to use the so-called zipper merge when drivers wait until the last minute to join a single lane of zones. kris van cleave explains the controversial males. >> i stay in that lane as long as possible.>> reporter: can you really blame her? when the other cars line up in the right lane, all that empty pavement on the left just sitting there unused. now some traffic engineers say go, use that space. >> so it's okay to cut? >> it's okay to take turns . >> reporter: kansas eight states to try what is known as the zipper merge system. the state department of transportation put up signs asking drivers to use both lanes and take turns nearing a bridge construction project outside kansas city. >> they find what this does is bring predictability to the commute. they know it takes 5 to 6 minutes to get through the work zone in peak traffic. from the air, you can see the cars keep moving and they come together like a zipper, hence the zipper merge. several studies point to the around construction workers, and drivers reporting less anxiety and frustration. the transportation officials in other states aren't convinced. caltrans spokesman mark dinger says his state encourages drivers to merge early. >> we don't want those people to cut in at the last second. not only can it lead to road rage incidents but it can lead to sudden braking which can cause a direct collision . >> reporter: do you see a where the zipper merge is the norm? >> yeah. we'll have to do that as our cities grow. >> -- >> reporter: kris van cleave, cbs news. fire crews rescued a woman in southern california who had been missing almost a week. they found her trapped inside an overturned suv about 75 miles northeast of l.a. somehow, she rolled her hummer down an embankment and used on start to, and on one. it took a week to find her. the car and the hair on my neck started to stand up. she could barely lift her head. all i heard was gasping. >> can you imagine? rescue crews had to stabilize the vehicle to keep it from rolling further down the hill. the woman is alive in serious condition but she is expected to be okay. a live look at the big board here. the dow jones down at x volkswagen has updated more than 1 million of its cars with new pollution control software. this comes after last year's announcement that the company admitted to installing software on its diesel cars to treat -- tutee emissions tests. profits are up for volkswagen over a year ago but the company is still facing an uphill battle. the tesla ceo elon musk showed off his latest -- invention on the abc desperate housewives set. check this out. on camera in eastern china, this little boy is riding his toy car and middle of the street. nobody is even helping him. they are just going around him. traffic is flowing in both direns this guy is like there's a kid. finally somebody stopped. this policeman saw what was happening. where is mom? >> i've got a lot of questions. >> what is that? you see the policeman grabbed the boy and bring him home to his mother.>> there she is. i'm supposed to watch him? >> what is happening? >> oh my goodness. >> he is safe but he took his truck and kept on rolling. keep the kids out of the street for halloween, folks. we have a nice forecast. >> i am so excited. i should kiss you. right on the lips. >> here is your time lapse. northern arizona university from the skydome. a little bit of cloud cover but don't get excited or worried. those clouds will not be producing any rain today. even the high country, a pretty clear forecast when it comes to trick or treating. there is a look at the superstition mountains. a little bit of haze almost but all in all, a pretty nice day out there. we do see some cloud cover on the map here and also in the central part of the state and these clouds are streaming from the south and west but they are not producing rain. that is to the north end up in northern california they have had a series of systems impacting them, which is great news because we're still knee- deep in a serious drought. as these systems pass north, they are going to continue to reinforce mile there. temperatures pretty nice out there. low 80s in phoenix, low 70s in sedona, upper 50s in flagstaff. a little bit of moisture in the air, the dew points in the 40s. that's where the clouds are coming from. up in the high country, a bit of a breeze today's we get to 3:00. we see those wings in the 20 or so miles per hour range but by the time the sun sets at 5:37 pm, we will see those winds died down. shouldn't be any issues for you. not going to throw down your halloween decorations and shouldn't be a big problem. for tuesday, we will see some winds in the east side of the state but they start to calm down after that. we top out at 86 degrees in the seven-day forecast shows cool air sticking around in the mid-80s and then a chance of rain as we get going into thursday and friday. the average high for this time of year is a four degrees. it is so good to have temperatures where they should be and we're not going to be breaking any records like we did last week.>> as long as we don't round lot corner on monday and with my new nine degrees, you are in my good graces. check this out. bruce haffner found this flying around before sunrise. this is from the penguin air and plumbing chopper. this is a talking -- this is that talking stick resort. the get the side of the building animated with halloween messages. it's pretty cool. the world series heads back to cleveland for a critical game 6 tomorrow. the cubs beat the indians 3 like 2 last night at wrigley field. the indians now lead the series 3-2. and this is a dedication from liam thompson who plays cricket for the new england he ran to get the ball or whatever they call it in cricket and his artificial lead -- his artificial leg popped off. he said he didn't know what to grab but he went with the ball. thomas says the heat on the field expanded the artificial leg and made it loose and it came right off rate that -- like that. he hopes it will raise the profile of his sport. coming up, a last look at your fabulous forecast this hal vo: 13 year-old sabrina told a school counselor she was raped by her uncle. her counselor called sheriff joe arpaio's office. but arpaio failed to protect her. for three more years, sabrina's uncle continued to rape her - remain uninvestigated, while arpaio focuses on his personal agenda. arpaio talks tough, but doesn't keep us safe. i'm tom o'halleran, and i approve this messsage. paul babeu oversaw a place of horrors as headmaster of a school for at-risk youth. students were denied basic human rights and were subject to sexual abuse. arizona deserves better. arizona's largest newspapers endorse tom o'halleran for congress. s, "elect tom o'halleran. his words match his work." and "the daily star" said, "o'halleran puts the common good above party politics. i spent many years as a nuclear missile launch officer. if the president gave the order we had to launch the missiles, that would be it. i prayed that call would never come.
