The Sheriffs Office says the fight broke out this afternoon in the maximum security housing unit of the downtown san jose jail. We first told you about the melee on abc 7 news at 4 00. The unit is still in lockdown mode this evening. Inmates are being ordered to stay in their cells. Sheriff laurie smith says no guards were hurt trying to break up this fight. And she just told us that its a coincidence that the fight happened in this part of the jail where she had just put in new security cameras and had them installed yesterday. But thats where we installed the cameras. We dont have cameras in any of the other housing areas, and they only went in last night. Its interesting that it happened here. Outside the jail this afternoon, we saw hazmat crews as they were called in to help clean off blood from the floor where the fighting broke out. Sheriff smith says deputies used pepper spray against the inmates, and that needed to be cleaned up. Those cameras were purchased by the sheriff herself at costco of all places. She paid for them with her own credit card after a learning a county plan to add cameras would take two years. Now to a story many of you have been waiting two years to hear. Testimony sheds new light on what led up to the Fatal Police Shooting in a San Francisco park. [ gunshots ] [ bleep ]. Hear the gunfire . Thats the 911 call which captured the sound of gunshots fired by San Francisco police which killed 20yearold alex nieto at vernal heights park. He is 28 years old. That 911 call was played in federal court today during the trial of a wrongful death lawsuit brought by nietos parents. Dan noyes is back from court tonight. Reporter it was the most gripping day so far. Not a good one for police. We finally heard from the man who set the wheels in motion that night by calling 911. Justin fritz testified in San Francisco federal court on the evening of march 21st, 2014, he and his partner were walking their bulldog and springer spaniel on bernall heights park when they spotted a suspicious person. This is San Francisco 911s or and called 911. The operator asked for a description. He had a red jacket. Probably 200 pounds. What race is he . Race . Ishe hispanic . He looks like he may be hispanic. Reporter and fritz stated without equivocation, the man had a gun. The gun is visible . Yeah. What type of gun is it . Is it a handgun . It looks like a black handgun. But justin fritz never saw alex nieto ever saw any kind of weapon. He was conveying what his partner said and was practicing his draw by pulling it again and again like this. They apparently didnt see these yellow stripes indicating it was a taser. This is the same model nieto had that night. He used the taser for his job as a nightclub bouncer where he was headed. On the stand he said he was pacing back and forth in front of his chainlink fence, shadowboxing and eating chips from a bag. He watched Police Arrive and walked away before they opened fire. Hear the gunfire . Reporter fritz was in the line of fire. Bullets hit the eucalyptus tree others his heads. Theyre firing at me. Theyre firing at me. Help, help help stay on the line. Reporter fritz testified he didnt hear the exchange that police described, them yelling show me your hands nieto yelling, no show me your hands. After his time on the stands, justin fritz apologized to alex nietos parents saying i didnt want to hurt anyone. Im so sorry for your loss. The father allowed fritz to hug him. The mother refused. Late today, a witness took the stand saying he saw it all happen, that nieto was not aiming the taser at police, and had his hands in his jacket pockets when he went down. Hell be back on the stand in the morning, and we should also hear from the fourth officer who opened fire that day, 59 shots in all. Ill be there and tell you what happens. Dan . From san jose down to, oh, to lets see, salinas and monterey. Our scale, 1 through 5. 1 is a light storm, 5 is a severe storm. We have a big storm coming our way on saturday. It ranks number 3. Its a strong storm, ranking three on the impact scale. It will produce 1 to 3 inches of rainfall generally, 3 to 6 inches in the hills. Winds may gust over 60 Miles Per Hour at times. And up to our north in lake county, in the area of those severe fires last year, the burn area, there is a Flash Flood Watch in effect from 4 00 p. M. Saturday to 4 00 a. M. Subdivision. A possibility of flash flooding and debris flows. But for the bay area, the big storm coming our way saturday and sunday. Not only produce heavy rainfall, but potentially strong damaging winds. State park officials are investigating another body that washed ashore in marin county. The body was spotted this morning on a rocky stretch of beach in Mount Tamalpais state park. An autopsy will be performed to determine the cause of death. The bodies of a 62yearold woman and a man washed ashore earlier this week. We know the identity of a man found dead in a lake at Golden Gate Park yesterday. The body of 45yearold joseph munoz was found around 8 00 a. M. He may have been living in sausalito or San Francisco. An autopsy will be performed on him to determine how he died. Caught on camera. Livermore police say what a nanny cam recorded compelled them to arrest the babysitter, 20yearold Mariah Gonzalez is charged with child abuse. Investigator are working to find more potential victims. Meantime, Law Enforcement says there is nothing in gonzalezs past record that would have come up on a background check. Mariah gonzalez is facing child abuse charges after livermore pd says the 20yearold nanny was caught on camera. Neighbors describe gonzalez as smiling and bubbly. I couldnt believe when i saw a picture of her that she would do Something Like that. Reporter livermore pd says gonzalez, seen here in her facebook photo, advertised her foents care. Com. According to charges documents, on february 18th, gonzalez was caring for a 13 American Idol boy. When the boys mom came home, she discovered abuse when she watched nanny cam video. Specifically, gonzalez was attempting to calm the baby. When she placed her hands closer to the babys face, his cries went from clear and audible to muffled. The baby began to squirm and kick, and then went limp. When gonzalez moved her hand away, the baby began crying again. She then put him in his crib and left his room. Trying to smother him . Thats scary. Thats really scary. Reporter according to the charging documents, the babys mother discovered the video while gonzalez was still in the home, and asked her to leave. She obviously didnt know she was oncamera. Reporter thats what livermore pd says. When an a officer interviewed gonzalez the next day, her statement didnt match what was on the video. When the officer told her about the nanny cam, gonzalez seemed surprised. Even after the officer described what was on the video, gonzalez denied hurting the baby. You cant trust anyone with your kids. Reporter livermore pd says there could be more victims. In a statement, a care. Com spokesperson says we have proactively contacted local Law Enforcement to provide whatever assistance we can in this matter. Gonzalez has been removed and banned from care. Com. As you may well know firsthand, crowding on bart trains is unbearable. The agency is hearing you loud and clear. In the spring bart perks expected to alleviate the overcrowding. Basically, theyre saying stay way from bart from 7 00 to 8 30 in the morning, and we will reward you. It worked in singapore, and they hope it will work here. Bart passengers have a lot to complain about when it comes to the peak morning hours. Do you take bart . No, i dont. Okay, well, youre lucky. Because sometimes in this station, you have to wait four or five trains before you can get on one. Reporter bart ridership has gone up significantly with 430,000 trips on an average weekday, an increase of 100,000 trips in the past five years. So were trying to do everything we can this year to ease crowding. Reporter while they wait for the 775 new train cars to arrive in about a year, bart wants to do something now. This is a test. Reporter the test program is called bart perks. Commuters traveling outside the busiest hours from 7 00 to ei8 in the morning will get points. You can redeem these points for either small cash prizes or you can play some online games that we have. And you can win up to 100. Bart says reducing the amount of commuters by more than 1200 people during the peak times would make a huge difference in the morning commute. Yeah, we can spread out the rush, it would be ideal. Rorter it was a far different bryan stow from the paramedic who was brutally beaten march 31st, 2011 outside dodgers stadium. The victim who suffered severe brain injury. Today he walked to the stage, all beat on crutches. But he walked. A huge victory in his long road to recovery. Im bryan stow, and i want to share my story with you. Nine months i was in a coma. Nine months. I was on a ventilator with a feeding tube. Reporter he called his attackers adult bullies, two men who are now paying for their crimes in prison. But stow, the victim of their senseless attack, has a new window in his life, a window with a new mission. I survived for a reason. Im finding my purpose again. Im on a mission to tell my story of survival. I want to stop bullies from hurting anyone else. Reporter the youngsters in the packed auditorium listened to stows story, the strength of his message written on their faces. Attend, stow asked the students to take a pledge. I will not be a bystander to bullying. I will not be a bystander to bullying. I will stand up and speak up when i witness bullying. I will stand up and speak up when i witness bullying. [ applause ] stows message struck a chord among his young audience. You see him saving lives as a paramedic. And something bad happened to him and he is still saving lives. Big batch of it, as a matter of fact, south of san jose down to gilroy and farther south towards salinas and towards monterey. Its all sliding eastward. Thats nothing compared to what coming our way. Rainfall totals today have been very, very light from the system that moved through earlier. Under a quarter of an inch up at santa rosa. Over a third at mt. Saint helena. Here at San Francisco 0. 08. But there is a lot more on the way. Dark skies prevail over the bay right now. These are our forecast features. Well see scattered showers tomorrow. Stronger storms, two of them this weekend. And it will be rainy, windy with the possibility of even some thunderstorms over the weekend. Starting at 4 00 tomorrow morning, looks like the morning commute is going to get off to a wet start. There will be lots of wet spots and areas of showers. Heavy downpours, strong gusty winds, winds gusting over 50 Miles Per Hour at some times. But then the rain will ease up a little bit late before the second storm comes in on sunday.
