bathe our dog. >> reporter: it was the last time for the 14-year-old jack russell terrier, skip. >> he should have lived another five years. >> reporter: december 30th they dropped skip off and got a call. >> the manager announced to us that skip had an incident and died in the store. >> reporter: joe eden told us the store employee showed him the back room and said the dog had been left alone by the worker for as long as 15 minutes. >> he said he was attached to a harness to a sink, next to the area on the floor, i asked to see the harness. he showed me a choking restraint leash. >> reporter: this professional groomer from the napa valley in 15 years. >> every groomer uses a choke harness, but you can never leave them alone. it's like leaving an infant a doctor's officea rope around its ck. >> reporter: a spokesperson told abc7 news an independent investigation suggests he may have suffered a serious cardiac event that report describes petco's version, that the dog collapsed while walking from the bath area. there is in mention of a harness or the dog being left alone, different from what store employees initially told the edens. >> we can't even find out how he died. we have that right. >> reporter: petco did confirm he was left alone for five minutes a violation of policy but the company claims not his cause of death. in napa, laura anthony, abc7 news. there has been a mistrial in the case of a former san jose police officer accused of rape. prosecutors charged jeffrey graves of raping a woman after he drove her to a hotel following a domestic dispute she had with her husband. today, alameda police told abc7 news there has been no activity on credit cards belonging to a man who disappeared eight days ago. the 73-year-old never made it to a hearing on tuesday morning. and he has been appealing the government for an alleged get rich quick scheme. >> most come in in the way of, i think i saw him three days ago. >> his family believes this is a photo of beck, still, there are no clues as to his whereabouts. privacy advocates are applauding apple's move to fight a federal order to make it easier for authorities to access iphones. >> whether you're an murder victim in vallejo say they're praying for the man accused of the crime. that man made his first appearance in court today, robert vega is charged with murder in shooting death of gus vegas. the accused gunman is the father of vegas's six year old grandson. in this case, they're supporting each other. >> they're trying to process this whole situation, this tragic incident. this just shows you how big their heart is. >> vega is charged with murder with enhancement of intentionally using a firearm and accused of kidnapping. police say he left with his young son. a young boy from dublin was run over on his way to school. he's going to be okay. it happened so quickly, the driver didn't know what happened. vic lee spoke to the driver and he is live with the story. vic? >> reporter: police tell us that the boy had multiple fractures on his arm, and some abrasions, and that he was lucky because it could have been worse. now, the driver was not charged or cited. he tells us the boy came out of nowhere. >> i didn't see him. that is why i hit him. >> reporter: it was before 8:00 this morning. the 12-year-old boy was riding his bike on route to wells middle school. as passing dublin high school, the man just dropped off his granddaughter. >> i looked left, and made a right turn, then, i heard a sound. two ladies said stop, stop. you hit somebody. so i jumped out of the car, and i saw the boy underneath the car. >> reporter: first responders used air bags to lift the car off the child. he was air lifted to the hospital. the police captain says the way the boy was hit may have saved his life. >> i'm assuming he didn't get run over by a tire. so he was pinned underneath there. >> reporter: firefighters were surprised he wasn't burned. >> the exhaust system, or the catalytic converter can run about a thousand degrees. >> reporter: linda picks up her granddaughter from school. >> the kids under the parking lot, parents under the parking lot. the bus is in the parking lot. special ed is there. it's hectic there. >> the boy is being treated at oakland's children's hospital. vic lee, abc7 news. after five days of searching, the chp says no video exists of a blow dart attack on the golden gate bridge. darts hit two people and neither was seriously hurt. the chp started looking at video saturday. today, they say there is no video of the attack or any cars or suspects involved. work crews in the south bay spent the day removing grass at the santa clara youth soccer field. tonight, 6,000 soccer players remain displaced and league officials are talking only with abc7 news. >> reporter: we've been reporting leaders have been taking on the nfl and the city ahead of the super bowl. the status will largely depend on the repairs of the field. tino isn't surprised to see the dying grass as workers pull out heavy plastic platforms, there are long depressions where anchored tents were housing media for super bowl 50. contractors are removing the top grass and the nfl promised to deliver the park in equal, or better condition. his league sued, challenging the use of the field on short notice. >> will we forget? no. but we're looking forward to moving forward and working closely with the city, should this come up again. >> reporter: the soccer league failed to get a restraining order to block the nfl to take over the field. in the meantime, it's the video sonoma county high wished hadn't gone viral. it shows a female student kneeing a boy in the face. the 17-year-old does not attend sonoma valley high. the video went viral after it was posted on a facebook account. facebook has refused to take it down despite requests made by the school district. the sheriff's department was at the school today, filling out a report. the young girl attends creek side alternative high school, which shares the campus. we know she will be charged with one count of battery on school grounds. she will be referred to the sonoma valley youth and family services program. if she refuses she'll go before the juvenile court. parents were notified by phone and e-mailed this letter in english and spanish stating the district takes all matters involving student safety seriously. but the incident has outraged some parents who say the school can do more to address the issues of bullying and social media. the school district acknowledged the fight began when the student posted something online, which irked the teen-aged girl. >> is the school doing anything about it? . >> i think they are, but not to a big point. >> the district tells me they're satisfied with what is in place and will not make changes to the school's antibullying policy. new at 6:00, the state just decided to keep commercial crab season closed until more testing is done. the department of fish and wildlife says it's working towards a statewide or partial opening. last week, officials declared some areas safe for recreational crab fishermen. >> abc7 news viewers have followed a story of a foal rescued on sunday from the bottom of a ravine. >> his story touched everyone and introduced us to some heros. >> good evening, not far from where that foal fell into the ravine, and if it was as cold then as now, that is one courageous animal. it turns out the foal didn't need surgery. it turns out the foal needs the money as much as we thought for rehab. today we met the woman who helped raise it. social media has a way of keeping people together. >> just moved by it. >> lisa teaches fourth grade in foster city. a six day old foal in fremont's morrison canyon. he had been there, shivering. she nursed valentine, hoping to raise thousands of dollars for medical care. little did she know, lisa set up a go fund me account that raised $15,000 in 18 hours. >> one of haven't seen the rain, south winds gusting to 40 miles per hour at times. so the one happening now is a two, a moderate storm. we have winds and it could be an isolated thunderstorm so we're tracking a cold front. by 8:00 and 9:00 that is going to be over san francisco, entering the east bay. and so we'll see activity increasing over the next couple hours and tapers into isolated showers. and into mid day. we're seeing a half inch to an inch of rain. so overnight tonight, upper 40s to lower 50s to showers with us. tomorrow, we'll see temperatures in the upper 50s to lower 60s with a chance of scattered showers and then, tracking another storm. the accu-weather forecast shows you we're tracking showers tonight. there is that next storm and a chance of wet weather tuesday. >> thank you. >> heart of the battle. it says nobody knows i'm a lesbian. the 11th grader is wearing it to school again after she, and the american civil liberties union sued the manteca unified school district. she first wore the tee shirt to seera high school, administrators sent her home, telling her it was an improper display of sexuality. taylor writes i didn't want to begin the year like this. i'm not scared to be who i am. i'm proud to be who i am. so taylor's family contacted the aclu and sued the school district. here she is. they forced the school board to address a new dress code. >> i was really upset they were going to censor me and not allow me to be who i was, so on the way to school, and once i got home i was upset about it. >> new, i also just got off the phone with taylor to talk about this day. she told me she never intended it to be a challenge, she thought she was in compliance. she tells me she wore this tee shirt to school today and got kudos from friends and other
