parts of which remain on lockdown right now. >> police are searching the campus for a suspect described as a man wearing cargo shorts and no shirt. only one of the injured men is at the hospital right now. we don't know how seriously hurt he is. >> the other man did not need to go to the hospital and students were stuck in the classrooms for about 45 minutes before police let them leave. >> we got two shelter in place notices since we left the building so they sent us out and sent us a message telling us to shelter in place which is concerning and we have no clue where we're going. our cars are on campus and we can't leave. >> witnesses say there were four, maybe five shots then they heard screaming and saw students running. >> campus police are asking people to stay away from the area. classes have been canceled for the remainder of the evening. good evening, thank you for joining us tonight. >> our top local story, the arrest of three south bay jail guards. >> the disappointment and disgust i feel cannot be overstated. >> that's the sheriff of santa clara county announcing the arrest of three correctional deputies for the murder of a jailed inmate. >> those guards are in protective custody after being booked into the same facility where they stood watch over hundreds of inmates. >> the three deputies matthew ferris and rafael rodriguez placed on unpaid leave and being held without bail. >> michael tyree was found dead a week ago in his cell. >> the autopsy results showed tyree died of blunt force trauma. >> david is live along with melanie woodrow. david, start us off, please. >> reporter: he was in jail for drug possession as well as petty theft. the sheriff today called his murder could you ardly and disgusting and contrary to the values that deputies are expected to embrace. >> the attorney for the family of michael tyree didn't mince words about his death. >> there's a fact basis for the phrase he got the [ bleep ] out of him. so they beat him badly. >> reporter: after a week of silence the santa clara county sheriff laid out details from the investigation, the deputies are accused of murder, conspiracy and assault under color of authority. the coroner's examination found tyree bled to death after blunt force trauma and found naked and covered in feces. >> this is a tragic, sad, heartbreaking event and that michael tyree, is a person of value -- >> deputies ferris were arrested at dawn -- >> each photographed at the santa clara main jail, the same jail where they are accused of taking the life of an inmate they swore to protect. >> they are being held in a jail outside santa clara county. arraignment could be as soon as tuesday, in san jose, abc 7 news. >> melanie woodrow is also live tonight. what more have you learned about the three guards. >> well, according to available court records, these three correctional deputies had not faced criminal charges previously but one had been in trouble with the law previously and tonight there is a new inmate accusation involving the correctional deputies inside this jail. as three correctional deputies are charged with the murder of a santa clara county jail inmate, there are new allegations of excessive use of force inside the jail. a source familiar with the investigation says an inmate currently in jail accused rodriguez and another deputy not facing charges in a different incident involving excessive force. the source says the inmate is being treated at valley medical for a broken jaw. rod rod they are accused of killing michael tyree. >> this act took his life is not indicative of the values that we expect and honor with the men and women of this department. >> a search of criminal court records turned up a prior arrest for ferris. in 2007 when he was 18 years old he was arrested for driving under the influence of alcohol, they were no prior arrest records for the others. social justice advocates say inmates have complained about correctional deputies before. >> the difference is now that the fact that the story has broke, it gives even more validity to an otherwise silenced population. >> a spokesperson told abc 7 news, he would look into the allegation involving an inmate with a broken jaw. melanie road woodrow abc 7 news. >> if they are charged the deputies may not face a judge until tuesday. a key witness took the stand in the shooting death of a woman at pier 14 in san francisco. she testified during a preliminary hearing for the man accused of killing 32-year-old kate steinly walking along the pier with her father when she was shot and killed july 1st. we're live with new developments from court today, vick? >> reporter: the preliminary hearing now in the fourth day recess late this afternoon, all of the testimony is over, prosecution presented its case and after the court hearing, the attorney for francisco lopez sanchez talked to reporters. >> i believe that while the defendant was aware that something had happened with this thing that he was holding, i actually don't believe he was aware that someone was shot on the pier. >> the overriding question was it second degree murder, involuntary manslaughter, or was francisco lopez sanchez simply a bad shot. >> the fourth day of hearings started with testimony from aaron carpenter, a tourist staying opposite pier 14 and took cell phone pictures from her hotel room of lopez sanchez walking briskly after she heard gunshots. carpenter was suspicious of him because he was the only person walking away from kate steinly. now lying on the ground when everyone else was going toward her. she gave the images to police. prosecutor diana garcia also called three officers who responded to the scene. officer andrew bryant was the one who arrested sanchez at embarcadero and one of the officers in the cell phone video of the arrest. during the preliminary hearings, diana garcia called a ballistic expert who showed the gun similar to this one that sanchez is accused of firing. public defender matt gonzalez called only one witness but crucial to his defense that the gun went off accidentally. crime lab director jim morris said he supported gonzalez's theory that it was an accidental discharge, that's based on earlier testimony from an investigator that the bullet struck the pier walkway first then ricocheting hitting steinly in the back. the preliminary hearing continues tomorrow morning with a judge expected to make a ruling at that time. a . >> two thieves broke into a home on friday but what has officers really outraged, what the men did to a do. this is surveillance of them broking into the home through the patio door. the family wasn't home but a dog that belonged to the couple's daughter was there. in the video, marley is stepping on the glass to eat something, they were biscuits. >> a lacerated tongue and injusted a bit of glass because they placed dog treats on top of the glass to keep her from barking. >> she is treated and now recovering. the fremont police want to charge them with animal cruelty. an 85-year-old man found himself face to face with two burglars, he was afraid for his life and fired a gun at them. one was later found shot in the head in serious condition and second suspect was caught as well uninjured. newly released video shows a man suspected as posing as a tsa screener. you can see him directing two women for private pat downs last year. a real screener eventually noticed something was wrong and happened inside a private room. the man was drunk and never faced formal charges because neither woman explained about what had happened. >> if you commute on 80, you may have seen new signs going up over the busiest parts of the freeway. they are no ordinary road signs. let's take a live look at 80 from our camera in emeryville. the traffic is not moving in either direction there. abc news reporter is live near one of the signs to explain what's going on. jonathan. >> reporter: if you're coming from the east you'll start seeing new digital signs but the really big ones like the one behind me they are mostly around berkeley. they could stop traffic jams before they happen. they may call it rush hour but it feels more like everyone is stopping to smell the flowers. >> sometimes you are sitting and sometimes you're going like, you know, 5 feet. >> there's too many people and too many cars. >> far from just a nuisance, caltrans knows it's dangerous. >> there are twice as many accidents. >> big problems call for big solutions, later this year caltrans will activate these digital road signs. >> the extensive system of its kind. >> reporter: they showed us how the signs will look when everything is normal and when there's trouble ahead, indicators warn drivers to slow down and move over miles ahead of an accident. >> we anticipate a 10% reduction in travel time and about at least a 10% reduction in secondary accidents. >> still some drivers take matters in their own hands. >> the shortcuts never seem to work. >> i sometimes will get off at powell street if it's not moving. have you ever tried to take the short cut? compromise that would have kept her out of jail. marcy gonzalez has more from both davis' supporters and opponents. >> reporter: today cheering and outrage outside of this federal courthouse in kentucky. strong reactions to a judge finding a county clerk in contempt of court, putting her behind bars for this. >> we're going to get our marriage license. >> not issuing marriage licenses. >> reporter: since the supreme court's june ruling in support of same-sex marriage, kim davis has repeatedly turned away gay couples, refusing to issue any marriage licenses testifying today that her conscious will not allow it. >> under whose authority? >> under god's authority. >> reporter: davis, who has been married four times, maintained in court while her past may not be perfect, she is entitled to her religious freedom. >> kim davis is prepared for consequences because the other consequences she would not want to risk and that is being unfaithful to god. >> reporter: aclu says while davis has a right to her religious belief she's obligated to follow the law. the judge is taking it further ordering her to stay in federal custody until she agrees to issue marriage licenses. >> we do not want to see that. the judge did his job by following laws. >> reporter: the judge explaining his belief that this is the only way to make sure davis her legal team respondinge ruling saying this is not the america the founders envisioned. marcy gonzalez, abc news, new york. we're now to the campaign, donald trump signed the republican party's loyalty pledge. this means trump will back the gop's 2016 nominee for president, if it is not him and skip a potential third party bid. this came after the ahead of rnc traveled to new york to make a direct plea to trump. >> i will be totally pledging my allegiance to the republican party and the conservative principles for which it stands and we will go out and we will fight hard and we will win. >> the decision comes just weeks after the billionaire refused to make such a promise in the campaign's first debate. the only candidate on stage not to make the commitment. they believe a third party bid by any established republican could destroy the efforts to take back the white house. it is not legally binding by the way. >> there's a new case of legionnaire's disease but things are starting to return to normal. seven inmates have the disease. tomorrow the indoor showers will reopen. inmates had to use portable showers after the first case last friday. limiting water use stopped the disease from spreading. visitation has also resumed. california drivers could soon have to pay a new fee to help fix our krem bling roads. the governor is proposing a $65 a year user fee when you register your vehicle. there would be increases in diesel and gas taxes tied to inflation, this would generate $3.6 billion a year to spend on roads but there's a tax increase involved so he needs two-third support of the legislature. >> around the bay area, individual cities have chosen to raise the minimum wage. there's a regional approach to paying workers more. nearly half of the mayors in santa clara have come together to support a initiative to raise the minimum wage. here's more from san jose. >> this afternoon, a number of silicon valley mayors announce the first step towards potentially raising the minimum wage together across the region backing a proposed study that would be funded in part by the city of san jose. >> there's a real disparity right now in silicon valley between thousands of families left behind by this boom and being prospering. >> reporter: randy muster -- >> profit margins are small. >> reporter: he supports a regional approach that helps level the player field but any type of implementation has to be carefully planned out. >> therefore we may have to cut staff. >> reporter: they believe small business owners have enough on their plate, citing rising costs due to the affordable care act. >> what happens in silicon valley it's going to affect the entire nation, a $15 minimum wage here, it's going to have ramifications for whole country. >> reporter: any decisions to raise the minimum wage would be made by individual cities and the study will take a few months to complete. >> we would like to ensure we can come together and raise wages in a thoughtful way that doesn't impact negativively small businesses and some of those folks who are struggling the most. raising the minimum wage is proving popular around the rest of the state as well. union leaders behind a proposal for a ballot measure claimed they collected a quarter of the signatures they need already, more than 100,000 of them in just three week's time. the initiative could gradually raise the minimum wage to $16 an hour over the next six years. getting in and around san francisco will be trickier this labor day weekend for those heading to the billy joel concert at at&t park. b.a.r.t. will shut down trans bay service on sunday and monday to do rail work. you know what the bay bridge backup will be like but shuttle buses will run. the shuttles will operate late for those attending the concert. >> at&t park is letting us know the moment billy joel leaves the stage so we can prepare for the big mad rush. to complicate things, king and fourth will be closed for work on a central subway from friday night to was old. i told them i was going to call 7 on my side. >> reporter: she did contact us and we told directv what happened and the company agreed to waive the fee telling us a remote control was not compatible with the customer's television sets due to their age and the customer was required to use tv remotes in addition to ours. as a result, we waived the early cancellation fee. >> good, very good. >> directv tells us satellite receivers should be compatible with any of the old analog tv sets however remote devices may not work together. if you have an older tv, may want to ask about the
