devin kelley entered the church with a ballistic vest on dressed in all black. a neighbor called him a normal guy with a wife and children. right now, let's get to our reporter live, kourtney fisher in sutherland springs, texas with the very latest. kourtney? >> reporter: investigators will work through the night at the first baptist church. meanwhile, residents in this small texas town are coming together. mourning their friends, their families, their lives lost at this sunday church service. a vigil sunday night for the victims of the deadliest church mass shooting in modern u.s. history. the tragedy unleashing a massive response from first responders and residents of this small town of about 650 people, about 35 miles southeast of san antonio. >> the second we knew what was going on, we just ran over there to help. as much as we could. >> reporter: families in tears outside the church, wait stog hear about loved ones, praying for their safety. >> anyone in that church that died, we know they're in the presence of our lord jesus christ right now. >> reporter: state and federal law enforcement officials say devin kelley walked into the church firing his rifle, killing insent churchgoers in the middle of the sunday service. >> as he exited the church, a local resident grabbed his rifle and engaged that suspect. >> reporter: that resident enlisted the help of another local man after kelley fled the scene. >> he said we need to pursue him, he just shot up the church. >> reporter: a short while later, the shooter crashed and was found dead. >> we don't know if it was self-inflicted or if he was shot by the local resident. >> reporter: president trump reacting to the news. >> our hearts are broken. >> reporter: among the many victims, 14-year-old anna bell rene pomeroy. her father, the pastor, was out of time at the time of the shooting. >> reporter: frank pomeroy says he wants to know that his daughter was a beautiful, special child. in sutherland springs, texas, kourtney fisher, abc news. >> now with 26 deaths, this is now the fourth deadliest mass killing in u.s. history. do the numbers in comparison, 59 people died in las vegas just last month. lst year, 49 people were killed at a nightclub in orlando. 32 people died at virginia tech in 2007, and the 2012 sandy hook shooting killed 26. local leaders have been offering condolences. nancy pelosi tweeted her heart is with the people of sutherland springs. also, apple's ceo tim cook tweeted, he's shocked and sorrowed by the massacre. and california senator harris says when do we say enough is enough? all in a tweet. of course, stay on top of any new developments in the texas shooting with our "abc7 news" app. enable push alerts to get updates as new information comes out. and head to our facebook page to get the latest information and also leave your prayers for texas. happening right now, outrage from lawmakers as police search for a shotgun, rifle, and hundreds of rounds of ammunition stolen from a san mateo sheriff's deputy. >> it was stolen from the deputy's unmarked car friday night on jones near market street. kordell bernard has the latest. >> reporter: shattered glass marks the spot where an unmarked county sheriff sergeant's car was broken into on friday night on jones street. guns and ammo ripped off. >> tit's a going to be a 12 gaue pump-action shotgun. the second firearm is a colt ar-4. >> reporter: 500 rounds of ammunition was stolen, too. >> unsecured weapons in it, that's just crazy to me. >> this man says he sees car break-ins all the time in the tender loin. it's not clear where the guns and ammo were left, but oakland police put out this bulletin. [ inaudible ] >> reporter: the fbi confirms the sergeant serves on its joint terrorism task force. but the weapons and ammo stolen were not issued by the fbi. this gun and ammo theft is one of six in the bay area since 2015. the weapon used to kill 32-year-old kate steinle on pier 14 was stolen from a ranger's car in s>> it really begs the q as to when's enough enough? >> reporter: senator hill requires both citizens and police officers to store and secure handguns in cars. >> you can't legislate common sense. and law enforcement officials, sadly, are not getting it. they have to secure these weapons. and we need to do something to make that happen. >> reporter: hill will keep working. meantime, police are trying to recover the stolen weapons. cornell bernard, "abc7 news." suspected asbestos forced the federal government to block residents from turning into an area burned by the tubs fire. flames destroyed large areas of this mobile home park, but some homes remain standing. >> i was worried about my stuff, but now i know they're not going to remove it. i'm better off -- i'm just having a hard time about the whole fire thing and it just is really upsetting me. >> the epa will test 25 locations before it can determine if residents can come back. test results are expected on wednesday. just ahead, legal weed will soon be for sale in california. but tonight, there's concern that no one will buy it. >> until you're encouraging a large corporate takeover by having tax rates that are that high. >> the pot tax problem that some say could keep underground marijuana sales alive. plus, the san francisco public schoolteachers are set to get a raise. that is, if taxpayers approve it. the pay increase agreed to by the district and teachers, and one thing both sides are relying on to make it happen. >> and i'm meteorologist drew tuma. numbers are cooling off rapidly tonight. and we're tracking our next san francisco's public schoolteachers are set to get a raise after their union reached a tentative contract deal. it calls for a 16% raise over the next three years. the union says a part of the deal is contingent on the passage of a partial tax next june. school officials and union leaders have been in talks since february. the agreement still needs to be finalized from the district and the union. the dream force conference is about to take over part of san francisco. sales forces annual conference begins tomorrow and runs through thursday. organizers say it's the largest software conference in the world. they expect 170,000 people to attend howard street between 3rd and 4th will be closed through november 11. taxes on pot sold in california could be as high as 45%. and experts believe that could be enough to keep the black market running. >> state and local taxes in addition to other fees could have marijuana consumers paying sky high taxes. industry experts say the taxes will keep the black market going and hurt smaller growers. >> small mom and pops can't afford that. so you're encouraging a large corporate taxover by having tax rates that high. >> california wouldn't be alone in implementing a high tax rate. washington rate has the highest cannabis sales tax at 50%. >> licensed cannabis businesses will now be able to insure their crops. >> this is a big supply chain. you've got growers, you've got transporters, you have manufacturers, you have labs that test the product. and you have retailers. in each segment of the supply chain, there's a need for insurance. >> experts believe other insurers
