going to be mostly cloudy over the next several hours but still warming up as we reach into the upper 60s at 11:00. we'll be at 73 degrees at lunch time. then take a look at our high temperatures for this afternoon reaching 90 in dublin. martinez reaching 89 degrees and also 89 in novato. san francisco also feeling warmer with highs in the upper 70s. so we'll talk more about this warmth and what's ahead for the week. mike, you were saying we need to head back to vasco road. much less of a concern. i hit the refresh button so many times i thought it was broke. it could be a problem for contra costa county, but it's a box on fire. that is the bulk of the commute right now out of brentwood and discovery bay. the rest of contra costa county looks great. europe at speed getting to the bay bridge. an easy flow. the rest of the bay, green sensors. that's a good start. back to you. we are following breaking news this morning. a deadly shooting in san francisco. this happened a little after midnight at turk and taylor streets not far from warfield theater in the tenderloin. an unidentified person has died in the shooting. it did close turk between market and taylor. just in a matter of hours the man accused of killing several people in stockton will appear before a judge. >> "today in the bay's" bob redell joins us from the newsroom this morning. law enforcement talked about this case, but do they know a motive yet, bob? good morning to you, laura and marcus. the police chief tells us they don't yet know why wesley brownlee allegedly shot and killed five people. a seventh victim in stockton survived. a judge will arraign brownlee in a stockton courtroom. that's when we'll learn the charges brownlee faces and whether the d.a. will charge him with a capital crime. after hundreds of tips they found wesley brownlee as he searched for another victim around 2:00 a.m. saturday morning. police say he was hunting in the neighborhood where the other six shootings took place. according to stockton's police chief he was dressed in black and armed with a handgun. >> a person was in the park that may have been seen by the suspect and at that point we intervened. we believe we may have stopped the killing. >> police say they're still going through the items seized from brownlee's home. this time line shows when each of the killings took place. you might notice a gap between the second and third shooting. we asked the chief where the suspect was between april of last year and july of this year. he says there are theories and they're trying to make sure law enforcement hasn't missed any other possible cases. we've also learned brownlee had prior convictions for selling drugs. a criminal justice expert says there might be a hearing determine if he's competent to said it's unusual to see one with low drug offender cases progress to multiple murders that have nothing to do with drug deals, a psychotic break may help explain motivation or state of mind. laura? >> wow, that's really interesting. thanks so much, bob. 5:04 right now. jurors later this morning will resume deliberating the fate of paul flores, accused of murdering cal poly san luis obispo student kristin smart. the jury deciding the case against his father, ruben flores, came back with a verdict yesterday. that is on hold until a verdict is reached in both cases at which time each will be read back-to-back. ruben flores is being charged with being an accessory to that murder. decision 2022 and the first for california voters on the november ballot. voters three weeks from today will decide an abortion-remted constitutional amendment. proposition 1 would make california the first state with a constitutional provision specifically protecting abortion. as "today in the bay's" ginger conejero saab explains, that measure would also alter reproductive rights in other ways. >> reporter: reproductive rates are covered under the state's reproductive privacy act which says everyone has a fundamental right to privacy including the right to contraception and abortion up to the point of viability. the very premise of the state's protection is covered under privacy. the same interpretation that was used in roe v. wade. since the u.s. supreme court overturned that landmark case this year, advocates say existing case law is not enough to protect abortion or the right to use or refuse contraception. prop 1 would explicitly include abortion and contraception in the language of california's constitution. prop 1 is currently endorsed by big democrats including senator hillary clinton who recently paid a visit to the bay area in support of the measure. but those who oppose it say not so fast. >> proposition 1 is so extreme by allowing late-term abortion up to the point of birth we have seen pro-choice politicians join our coalition. we even had a conference on the stems of the california state capitol last week showcasing our diverse and broad coalition. >> reporter: arguments against prop 1 include it will be expensive for taxpayers to foot the bill for sanctuary abortions. the proposition's language is vague and ambiguous and is interpreted to allow for late-term abortions. >> if the intention is to protect abortion rights, then revoke the current proposition 1 language as it is written and instead introduce language that reflects california's existing abortion law. >> there have been a number of bills by the governor that pay for abortion for people fleeing from their states to california this is nothing to do with proposition 1. and concern about viability and when abortions may occur. this constitutional amendment does not change existing state law and restrictions. >> reporter: abortion related measures are not just happening in california but around the country. vermont is also asking its voters to amend its constitution to protect reproductive rights. kansas and kentucky are asking its voters to prevent those rights from being protected in their constitution. ginger conejero saab, "today in the bay." meantime people who want to keep jfk drive car free, proposition i would reopen traffic along both streets. supporters say more access is needed. but opponents say both streets are popular for joggers, walkers and cyclists and more safer without cars. another measure, proposition j, would ensure jfk drive stays car free. each measure needs a simple majority to pass. and if both pass, the one receiving the most yes votes wins. voter guides to hem you break down all the key races. head over the summer. supporters gather to celebrate. let's take a little celebratory look outside. we're tracking that tuesday forecast. it doesn't look like people are up and out the door yet. the feeling of fall is in the air but the feeling of summer will hang on. check the forecast with meteorologist kari hall right now. as you are getting up and heading out, we take a live look out in san jose. we are also looking at san francisco where this morning there's no fog as you get ready to head out. we may see it rolling in the next couple of hours. right now we're in the upper 50s and then we'll see temperatures, a nice, cool start to the day, head for the upper 60s by noon. you will notice it will be warmer today compared to yesterday as we reach up to 90 in dublin. 85 in fremont. 89 in los gatos. san francisco may reach into the upper 70s while novato heads for 89 degrees. a little bit of a summerlike feel in the middle of our october but it's not going to stay like this. and on the board. the dow jumped 500 points plus on monday. in fact, if we put 100 different stock prices on this board, 99 of them would be up. then, take a look at this, these are the futures. traders betting we'll see another rally. now we've seen some big moves to the down side as well. it's been very volatile. tech crunch disrupt gets under way in the city today. the conference disrupted itself in past years by the pandemic. a lot of startups showing off their ideas. it runs through thursday. mike told us about one gas station in the bay area with guess less than $5 -- we're having just a house is readying another drawdown of the strategic petroleum reserve to get gas prices down. it could be around 10 million gallons. this according to bloomberg, which spoke to people in the white house familiar with the matter. we should hear more about how the white house plans to rebill the reserve. there's been talk about limiting exports of gasoline keeping it all here, but those same insiders say if that happened, it would not happen before winter. and nearly 8 million americans have already applied for student loan forgiveness, just one day after the website to do so went fully online. there was a soft launch over the weekend. more than 40 million americans are in debt for their education. now there are efforts to stop this forgiveness. republican and conservative groups making two arguments against it in court, one involves the power of the presidency. does the president have the power to do that, which is certainly a very important constitutional argument. the other you very much, scott. >> you bet. okay, 5:16 right now. new this morning, netflix is rolling out a new feature called profile transfer. it lets users move personalized recommendations, their viewing history over to a new account. netflix argues it will come in handy for people when they have to transition to a new account if their living circumstances change, like you break up. a romantic breakup, moving out of your parents' home programs, or if it's part of netflix's looming crackdown on password sharing. they estimate more than 100,000 households are using the service to move shared accounts. this story is also a life lesson. never too late to do the right thing. >> reddit post is going viral. for a young person who went the extra mile to right a wrong. the man who post it had says he actually works at an ice arena and found this anonymous letter under the door. and it was from a child who admitted to stealing crackers on a dare from the vending machine. he said he actually made a terrible decision and attached $6 saying he did not know the cost. the child wrote that i will never steal again, promising to do better and set a better example. i think the child did that. >> area today and will be heating us. we will still see clouds rolling by this morning and take a look at these high temperatures. we're going to reach 89 in los gatos today as well as 89 in martinez. san francisco in the mid to upper 70s today, 75 in half moon bay and 95 in livermore. as you take a look at the bottom of your screen, it's not going to stay like this. this will be warm today and tomorrow, but then the numbers start to come back down. as we get a look at wednesday, we are going to see those temperatures really starting to cool off. as we head into the next couple of days, this is what's been making a lot of those headlines. freeze warnings going up the first big cold blast hitting parts of the midwest and the deep south where all of these areas shaded in purple are under freeze warnings, the light blue frost advisories as temperatures tonight dip into the teens and 20s for much of this area. you can call your family in chicago and say, hey, you know what, here it's going to be in the 90s today. here is what's going on. so we have high pressure setting up and a big dip in the jet stream and this area of low pressure causing all that cold air from canada to spill all the way down to the gulf coast. so this is going to be the setup the next couple of days. once it changes, we are getting ready for a chance of showers, and that happens this weekend. it starts first in the north bay for saturday morning and then it kind of falls apart but a slight chance some of us could get some rain and going into next week we'll be watching out for spotty showers. the models still disagree, showing very spotty, light amounts for the east bay and south bay. the nbc forecast that kind of blends the computer models puts all of us in a sprinkle here and there for saturday. so just keep that in your plans if you're going to be outside. temperatures going from the mid-80s to mid-90s and then to the 70s for the weekend. san francisco is going to be fairly mild for much of the week. we're watching out for that slight rain chance on saturday. mike, you are starting to see some slowing on the golden gate bridge? i think i figured out why, kari. the zimmer truck clearing the cones and now they will move that center divide. we'll have lane restrictions. i thought you would want to see what happens when most people are not on the bridge itself. two lanes north and four coming into the area. the slowing we saw did clear up as they had a bit of a break as the crews cleared the cones and now things should be clearing up as soon as they move the zipper truck. not a major concern. a smooth drive out of the altamont. it's tuesday. we are expecting more traffic, a lot more traffic later on in the morning. we'll follow this. the south bay, you are at
