The jury deliberating some 50 hours and thats longer than the entire trial and long after the jury said it was deadlocked some two days ago returning to the courtroom more than a dozen times to ask questions of the judge or ask testimony to be read back. A majority of the jurors is pushing for a conviction while a smaller group, a minority holds out. Perhaps sensing that cosbys jurors asked time and time again that the judge declare a mistrial but the judge is pushing back saying the jurors can deliberate as long as they want according to the law. If there is a mistrial theyll have to decide whether to start the case all over again. He left thanking his supporters and the jurors for their hard work. He stands accused of sexually assaulting Andrea Constand in 2004. A former Temple University employee. If he is convicted he faces up to ten years in prison. You have to be able to read tea leaves to see how its going to go. Whoever is holding out is standing their ground and theyre not backing off what their convictions are in this case. Based on some of the questions that these jurors have asked the judge and theres been a slew of questions. Yesterday they asked about the definition of reasonable doubt. They have reviewed every key piece of evidence presented during the trial. Based on that information alone, what do you surmise is happening inside of the jury room . Whats happening is i think the jurors expected to hear from bill cosby. I think they wanted to hear from bill cosby. It was a defense decision not to have him testify because his exposure on crossexamination would have been profound considering his previous sworn testimony. Youre not going to hear another allen charge from this judge. Thats also called a dynamite charge. You want to blow up whatever that road block is to getting to a verdict. No matter what happens today f. The jury comes back and says theyre continuously deadlocked youll not hear the judge go back for more deliberations. I think its done today no matter what. How far is too far for the judge to push the jury to reach a verdict. You could do a second allen charge. Sometimes even a third but the risk is you start to look coercive when you are the judge demanding that the jury go back and reach a decision. 52 plus hours of deliberations youre not going to hear another allen charge today. Cape cod, a major rescue operation. 57 passengers and crew pulled from a ferry boat taking on water. The boat ran in late last night near massachusetts. The coroners report on Carrie Fishers death has been released. She fell ill on a flight last december and died four days later. The l. A. Medical examiner lists sleep apnea and other undetermined factors as a cause of death. The report mentions the 60yearold suffered from Heart Disease and showed signs of having taken multiple drugs. After six days of he said she said testimony a judge made a controversial ruling that one person can be held legally responsible for the suicide of another. Reporter a bombshell verdict. Reporter Michelle Carter wiping away tears after a judge convicted her of Involuntary Manslaughter saying she encouraged her 18yearold boyfriend conrad roy to drive to this kmart parking lot outside of boston and suffocate himself with Carbon Monoxide leaving his family shattered. This has been a very tough time for our family and we would like to just process this verdict. Reporter the familys lawyers argue that roy could have been saved. But not for the actions of Michelle Carter conrad roy would still be alive. Reporter she waved her right to the jury sending the decision to the judge. At the heart of his verdict was the moment when roy expressed doubts. Im freaking out again. Im overthinking. Carter responded i thought you wanted to do this. The time is right and youre ready. You just need to do it. When he got scared and left the car carter texted the friend. I told him to get back in. I couldnt have him live that way. This court finds that instructing mr. Roy to get back in the truck constituted wanted and reckless conduct by ms. Carter. Her defense team stunned. Beyond saying im disappointed im not going to comment further. Reporter they argue that roy was determined to kill himself with or without carters help citing a 2012 Suicide Attempt and chilling videos he left about his own depression. You dont have to be happy. Reporter carter now faces up to 20 years behind bars. The verdict sending a strong message about the power of words. One of the concerns that some people might have is the slippery slope concern. Michelle carter, horrible actions. What about the next case. Will it be so horrible . Or will prosecutors also be emotio emboldened to file manslaughter charges. Even though the incident happened when she was 17 years old. She is not allowed to leave the state of massachusetts or have any contact with the roys. So this verdict surprises a lot of folks because suicide is generally thought of as an act thats done with ones own free will under ones own free will. What does this case mean moving forward with regards to precedent. Its a huge precedent setting case craig because right now the judge has determined by way of his verdict of guilty for Involuntary Manslaughter for Michelle Carter that words are now weapons. Just like bullets in a gun. If you use the right words and you are actually using those words, a prosecutor uses those words against a defendant you can be convicted. Now guys we heard from morgan, two critical determinations made by the judge to support his finding of guilty. One, she ordered to him to get back into the car when he texted her and said i cant go through with it. She texted him and said go back and do it. Two, she could have called 911, she could have called for help and she never did and thats what the judge said was wanton and reckless conduct. But as deplorable and disgusting as it might be, how does encouraging someone to commit suicide not fall under free speech. At this point legally all the elements of Involuntary Manslaughter were met by the prosecution meaning that if you know theres a substantial likelihood of harm to a victim and you do stuff by way of reckless conduct as evidenced by what she did then you can be found guilty of that crime. So looking forward she is looking at 20 years in prison. What do you expect her sentence to be . Her range could be anywhere from probation to 20 years. I expect a sentencing on august 3rd of some type of jail time followed by lengthy probation but i also expect a serious appeal that could go as far up as the Supreme Court because this is a new construction of the law of Involuntary Manslaughter in the state of massachusetts. That would be the sole basis for the appeal. Its so new and so Ground Breaking it has to be construed by a higher court to determine if everything was done properly by the trial judge. All right. We have broken it down and how long should it sit in that rub . About 10 to 15 minutes. You want that chicken to marinate and bring out the flavors from the herbs and spices that go in there. Its about 5 minutes aside. Medium to high heat. Once the chicken gets 135 degrees. We are going to start taking our Barbecue Sauce that we make in house and if you dont want to make it you go buy your own. Youre going to start giving it that nice glaze and finish cooking until the chicken gets to 160 degrees and that will carry over to the 165.
