25th, 2014. Announcer from nbc news, this is today with matt lauer and Savannah Guthrie live from studio 1a in rockefeller plaza. Morning, everyone. Welcome to today on a Tuesday Morning. 7 00 a. M. On the west coast now. We look at some of the damage, some of the damage in ferguson, missouri, overnight. This is a Community Deeply troubled right now. These were not the images anyone wanted to see. Theres some question about the timing of the release of this information. The grand jurys decision coming way earlier in the day, and yet they waited until dark neness t make this information known. And that couldnt have helped the situation. One of the questions police will have to answer today. The protests, we mentioned, quickly turned violent, at least a dozen businesses set on fire. Other businesses had their windows smashed and why broken into. In all 82 arrests have been made in ferguson. The faa has restricted flights into st. Louis airport overnight and the anger is not limited to missouri. Demonstrators marched in at least ten major cities across this country including los angeles and oakland, a bridge blocked by protesters. To today National Correspondent craig melvin, what can you tell us . Reporter right now another protest is under way in the county seat here in st. Louis. Im told that was largely peaceful. Nothing lake what we saw unfold on the streets behind me and in ferguson last night. Looting and businesses torched like the one that you see in the distance here. Businesses in ferguson, several still smoldering this morning. Ferguson under siege once again. Back off reporter and on fire, following the grand jurys decision. Smoke bombs, tear gas and gunfire. Hundreds of protesters clashed with police in riot gear as they took to the streets. We will not take this sitting down reporter as a new wave of violence in ferguson, multiple fires reported. Several retail shops in flames, including three inside a strip mall, along with a meat market and pizzeria. Protesters also set fire to two police cars. Looters struck several business. Im just here, protecting the property, you know. Its a shame. Reporter crowds rushed into a dollar tree and nearby Beauty Supply store. Looters made it inside this cell phone store. I didnt do anything. Reporter are you not concerned as you have this small child out here and you see folks throwing bottles at officers . We need to move back now. Reporter you can see a line of Armored Vehicles back there at the end of the street, 50 feet in front of them. Protesters. Flares and gunshots had many scattering until they were able to help clear the streets. Nbcs Miguel Almaguer was among those taking cover. Were hearing a succession of gun shots. Theyre getting closer to this location where police are barricaded. Reporter at one point traffic in st. Louis was shut down, shutting down a chunk of interstate 44 in both directions. And fires raged in ferguson, confrontations flared in cities like new york where protesters threw what appeared to be fake blood at Police Commissioner bill bratten. Protests in oakland and philadelphia with more protests planned in as many as 100 cities across the country. Out of the street immediately or you will be subject to arrest. Reporter after hours of violence, police held an Early Morning news conference. We do not tolerate criminal activity. We do not tolerate window sma smashing, looting, crimes associated with it this. Whale we support everyones right to come out and have their voices heard, you will see a large police presence. When crimes start youll see an intervention much more quickly than last night. Reporter and governor jay nixon has called you up additional members of the na national guard, were told. Thats because more protests are expected today. We also expect to hear from the parents of Michael Brown. They will be, of course, responding to the announce of yesterdays grand jury. Theyll also be asking for peace and calm in ferguson. Were learning a lot more about the events that led to the shooting death of Michael Brown and were seeing new photos now of officer Darren Wilson from the night of the incident. Nbcs ron allen is also in ferguson. He has that part of the story this morning. Ron, good morning to you. Reporter good morning, savannah. The streets are quiet now because police are not letting residents and Business Owners back into the area. When they do come back they will see scenes of utter devastation. The prosecutors did not even finish explaining why there will be no charges against Darren Wilson. Wilson insists that Michael Brown attacked him first, and that he shot and killed the young man because he considered him a dangerous suspect. These pictures of officer Darren Wilson seen publicly for the first time show him in a hospital, bruises to his cheek and the back of his head. Part of the evidence considered by the grand jury and released by prosecutors as they announced wilson will not be charged with a crime. The physical and Scientific Evidence examined by the grand jury, combined with the witness statements, supported and substantiated by that physical evidence tells the accurate and tragic story of what happened. Reporter while Michael Browns family and protesters claimed he had his hands up trying to surrender when he was killed, prosecutors said witnesses gave conflicting accounts. Some described his hands being out to his side, some said in front of him with his palms up. Others described his hands being in a running position or in fists. Reporter the documents revealed wilson fired 12 shots after he says brown attacked him in his car, tried to flee, then turned around and charged at the officer. In a statement, browns family said they were profoundly disappointed that the killer of our child will not face the consequences of his actions. Lawyers for wilson said he thanked his supporters adding officer wilson followed his training and followed the law. A subdued president obama called for calm. There are americans who agree with it and there are americans who are deeply disappointed, even angry. Its an understandable reaction, but i join michaels parents in asking anyone who protests this decision to do so peacefully. Reporter prosecutors said the grand jury heard from about 60 witnesses over some 70 hours. They say they showed the grand jury every available piece of evidence they had and they shared it with federal prosecutors, well aware theres deep mistrust here, the reason theres so much violence, mayhem and a state of emergency. Savannah . Ron allen, thank you very much. Benjamin crump is the attorney for Michael Browns parents. Hes the one who delivered the news to browns mother and began by asking how she reacted. She was overcome with emotion. We had just prayed before the announcement came. And she really believed that the system was going to work equally for her child. And so she was just devastated. Was she shocked by it, or was there part of her that expected this might be the outcome . She was absolutely shocked. She believed that he would at least be charged with something. She really had faith that the system would work for her child, too. And so she was just profoundly disappointed, as only a mother could be. Michael browns father had released a statement prior to this, saying that no matter what the grand jury decides, i do not want my sons death to be in vain and asking for peaceful protests. What do the parents feel about whats been going on in ferguson over the night . Well, Michael Brown was very disappointed in the images he saw because he had made such a passionate plea for peace. So they continue to ask the community to not engage in violence. Its no solution to be violent when youre facing issues of violence. Sir, you are a lawyer. You know very well that, generally speaking, it is not that hard for a prosecutor to get an indictment from a grand jury. The standard of proof is much lower. When you look at what happened here, do you think that it is a case of the evidence against officer wilson being weak or a prosecutor that, frankly, didnt try very hard . Well, it may be a combination of the two. Savannah, the system needs to be indicted. This system is completely unfair to the citizens, especially africanamerican and minority citizens when you have policeinvolved shootings. This system, over and over again, exonerates Police Officers for killing young people of color. Let me ask you this. The prosecutor said i put all the evidence i had before the grand jurors and i let the grand jurors decide. Is there something wrong with him proceeding in that way . You know, he said he did it this way because he thought it was fair. He didnt recommend any charges or anything. Just put all the evidence out there and lets just be fair to everybody. And this is different than what ive ever seen in my 20 years of practicing law. So the question becomes, savannah, if for 28 years he has been prosecutor for the grand juries, he didnt do it this way. Was he being unfair to them . Why change the rules now when its our children lying on the ground . We want the same justice. We want equal justice that you do for everybody else. Dont change the rules on our children. Theres a short list of possible replacements emerging this morning following the sudden forced departure of defense secretary chuck hagel. The search is on though chuck hagel indicated recently he wanted to stay after a series of meetings over the past month, the president decided hagel had to go. Thank you, chuck. Reporter following chuck hagels resignation as defense secretary, president obama is putting the best spin on what insiders say were major policy disagreements over iraq and syria. When its mattered most behind closed doors, in the oval office, youve always given it to me straight and for that, i will always be grateful. Reporter one official says the white house concluded hagel, who was brought in to wind down the war in afghanistan, wasnt up to the job of dealing with emerging threats like isis and ebola. Its the latest indication of growing friction between the white house and the pentagon. Hagels predecessors both wrote books critical of the president. And now the administration is looking for its fourth defense secretary in six years. I can tell you that the president certainly wants to make sure that the next secretary of defense is somebody who knows the interworkings of that agency well. Reporter two former defense insiders are the leading contenders to replace hagel. Michelle lournoy was one of the top ranking women ever and would make history as the first female defense secretary. Austin carter is a Rhodes Scholar and theatrical physicist and has been a fixture under two president s. Administration Officials Say they want to move quickly. A replacement for chuck hagel could be named as early as today. Though confirmation hearings wouldnt happen until january. Natalie . Chris jansing at the white house. Thank you, chris. And president obama is hitting the road again today to promote his new executive actions on immigration. This time hes heading to chicago. Today more than 100 immigration professors and scholars declared that the president s plan to spare millions of immigrants from deportation is both con i constitutional and within his administrative powers. University of virginias governing board will hold a meeting to discuss the schools Sexual Assault policies, in the wake of a Rolling Stone article in an alleged gang rape. Student leaders are rallying together calling the latest allegations a wakeup call. The school has temporarily banned fraternity activities. We have some incredible video to show you of this massive tornado tearing across a field near dundee, south africa. Pictures like this one are popping up all over social media sites. No injuries reported here but several homes damaged in that storm. Seeing the tornado make its way through there in south africa. Does that impress you, al . If youre going to be traveling or are expecting folks coming from east to west, this is going to be a game changer. Winter storm warnings, watches, and weather advisories from the carolinas all the up to new england. These areas in dark blue is where we expect the had heaviest storm. Now here is whats going to happen. This lowpressure system will develop, move up the florida coast and into the midatlantic. Rain will start off by rain. By tomorrow afternoon colder air funneling in, bringing in snow. As the afternoon and evening wears on, we are now into the teeth of this storm. Snowfall rates, 1 to 2 inches per hour. The good news is its a fast mover. It tracks into nova scotia. Lighter winds but look at these snowfall totals, anywhere 36 inches of snow making its way through the appalachians. But you get into parts of interior pennsylvania, upstate new york and new england up to a foot to a foot and a half of snow. Were going to be watching it. And theres a huge storm thats developing out on the Pacific Northwest coast. Were going to be tracking that as well. A wave of anger in ferguson, missouri, last night, 82 people arrested as angry protesters set buildings on fire, vandalize cars, throw debris at police. All this coming in the wakative grand jurys decision not to indict the Police Officer, Darren Wilson, who shot and killed Michael Brown. Well have the latest on this tense situation coming up in a couple of minutes. Developments still ongoing there. Other headlines this morning, high winds could cause new problems in buffalo, new york, today. The threat of devastating flooding in the wake of more than seven feet of snow seems to be easing and city schools are now open for the first time in a week. A new storm with rain and heavy snow is bearing down on the east. Its expected to cause problems for millions of thanksgiving travelers on some of the nations busiest roads. Nearly a foot of snow expected in parts of the northeast. And the fda is imposing new rules for chain restaurants. Moving forward, calorie counts must clearly be labeled on menus. Reporter savannah, good morning to you. 82 people is the number of folks arrested last night. You can see behind me here burned out building, this is one of the main drags here in ferguson. This was a scene of a great deal of chaos last night. Thats one of the more than a dozen or so buildings that were torched last night. Many, many more were vandalized or looted. Another protest has popped up in clayton. Clayton is the county seat here in missouri. Im being told that is a largely peaceful protest, but we are expecting to see more protests like this one over the course of the day. Thats when Michael Browns parents will be out in a short amount of time asking for calm and peace in ferguson. Governor jay nixon has called up more members of the national guard, savannah. Shes hearing, obviously, from a lot of people about this grand jurys decision. Tamm tamron . We asked the question, did the grand jury make the right decision, yes or no . We kept it simple and here are the results. 85 say yes. 15 say no. Many of our viewers wrote in to us saying, listen, theyre not on the grand jury. They didnt see the evidence. Its a kneejerk glimpse of what they think. Here are the results of what they had to say. Several thousand people let us know their thoughts. That bears repeating. So many people are expecting opinions about what happened here. Unfortunately, we dont have all of the facts. The prosecutor tried to make that case or state that as the decision was being announced last night. There were 12 people on that grand jury. Theyre the ones who have seen every piece of evidence. Weve talked to other prisoners who were prisoners of the japanese and how you get to be hardwired and the japanese reaction n japan, they dont want to show the film. Recently i also was able to talk to her about her life. A lot going on. She got married, had an audience with the queen and shes handling it all. Its been a very big year for you. You got married. You had an audience with the queen. You were honored by her and now youre opening the big blockbuster that everybody is anticipating so much. Of all those events, the one that im interested in is marriage. There you were, living together, raising your children together. Did it change . It did change. In just a feeling of that security and comfort that we always had, but recommitting after ten years of being together. And we were fortunate enough to be in that unusual situation. We got married with our children and they were part of the ceremony and they wrote some of the vows. And so it was all of us agreeing to to be together and to just commit to this life together. Not just because we had to. Not because anything was missing in our lives. Because we were absolutely sure we felt that much of a family and it was that moment. It was really lovely. It was a lovely day. Have you codified certain things . Brad now that were married you have to pick up your socks and if you think im going to make your coffee, youre joking. No. I said im going to be a better wife. Im going to learn how to cook. He was like, honey, do what youre good at, not what youre not. He knows my limitations. We also got to know the two of you in mr. And mrs. Smith. You did another film with brad. We have. Is it hard working with your husband . Theres a really correct answer to this, im sure. It was actually great. The first one we did together, we werent together. And it was a comedy. And there was a lot of action. It was really fun. And, you know, i think theres also something, too. Theres so many ideas of what art should be and this kind of movie or that kind of movie and we just wanted to be free. We wanted to play. We wanted to try things. We wanted to push each other. We wanted to be artists and see what we could make. You didnt say stop. Brads going to have to do another take on that one. Im sure i had many moments with the actor and im sure he had many moments with the director. She brings her children on most of these. But shes also the u. N. Special ambassador. What do you make about these numbers . This is amazing. Its no different than any other thanksgiving in america. About 20 of all the calories they eat were eaten before the meal even started. You think about the calories all week long. Youre not thinking about Health Conscious and whatnot. Reporter and now its time for their nap. By the way, our news president , who clearly plans on going to town on thanksgiving said how much weight can you gain in one day . If you normally have 2,000 calories in a day, you have to have 3,500 additional calories to whatever you have. For a 2,000 calorie diet, 5,500 calories in one day, you gain one pound. Its worth it. The grand jurys decision means officer Darren Wilson will not face state criminal charges for killing Michael Brown, whose death in august inflamed deep racial tensions. Authorities released more than 1,000 pages of grand jury documents that revealed wilson fired 12 shots after he said brown attacked him in his car, tried to flee and then turned around and charged at him. Evidence photos show wilson shortly after the fatal encounter with bruises to his cheek and the back of his head. We are coming on the air because Michael Browns parents, Leslie Mcfadden and Michael Brown senior are about to speak in dellwood, missouri, a suburb right next to ferguson. A grand jury decided not to indict Police Officer Darren Wilson for the shooting death of their son. They will make a statement along with reverend al sharpton, president of the National Action network. He is a host on msnbc. He is there along with lawyers for the family. At this hour, the scene remains tense in and around the st. Louis area. Several buildings in ferguson are still smoldering after a night of violence there. More than 80 people were arrested overnight. Across the country, there were other large and mostly nonviolent protests overnight in new york, philadelphia, chicago, los angeles, oakland and seattle. Nbcs ron allen is in ferguson. He has been there for weeks. How are things at this moment . Hats it calmed . It is calm here on west fortson avenue, which is where much of the damage, the violence happened. There is a Building Back there that is still smoldering. Most of the buildings along this road are board up. Many are scorched. Some are burned completely to the ground. I think what happened here last night was stunning to this community and very disappointing to the leaders who tried to organize peaceful protests. That didnt happen. Violence broke out almost immediately when people started taking it to the streets. The police said there were people carrying automatic weapons throwing rocks and bottles and batteries at them. This effort the police and Community Leaders tried to bring together over the past few months just completely was absent and fell apart. Now, people today are picking up the pieces. Picking up the pieces and trying to figure out how this happened and trying to figure out how to move forward. Very worried and concerned about whats going to happen tonight. There have been some peaceful protests around the courthouse in clayton where the grand jury was seated, where the prossecutr is based. People fearful of whats going to happen come nightfall here, again, kate. Lets go to greater st. Marks missionary baptist in dellwood, missouri. Speaking right now is benjamin crump, one of the attorneys for the parents. The mother is not there. We do expect to hear from Michael Brown sr. Momentarily. We saw how completely unfair this process was. We object publicly and loudly as we can on behalf of Michael Brown jr. s family, that this process is broken. The process should be indicted. It should be indicted because of the continuous, systemic results that are yielded by this process. Lets be be very honest. We have the local prosecutor who has a symbionic relationship with the local police and Police Officers who sit in judgment whether to indict the police when they brutalize or kill a young person from our community. Normally, that prosecutor has no relationship or no regard for the young person of color. So, as attorney grant and attorney parks predicted at the beginning, we could foresee what the outcome was going to be. Thats exactly what exactly wha last night. It is awfully troubling when you look at what was released and you hear about the Police Officer who shot Michael Brown jr. In broad daylight, the unarmed teenager. You hear he testify for four hours. You had to scratch your head, kind of like we all did, to say, when is the prosecutor going to cross examine the killer of an unarmed person. A first year law student would have done a better job of crossexamining the killer of an unarmed person than the Prosecutors Office did. I mean, where was it vetted . Where was his voracity ever challenged . Where was his credibility ever challenged when you watch that four hours he got to give a speech to this grand jury. He told the detective testified. He told him he got hit ten times violently. He told the grand jury he only got hit two times. He said, and you all heard it, hulk hogan against a 5yearold. Nobody questioned, well, officer, you are 64, you weigh 226 pounds. Michael brown is 66. He weighs 292 pounds. You mean to tell me that he hit you with such force that you were describing that it was gonna knock you unconscious . And nobody held up the pictures to say, but, thats not consistent with the physical evidence. Reverend al, we object to this process. All across america, whether this is new york, los angeles, california, cleveland, young people of color are being killed by Police Officers and the local prosecutors put together this very unbiased grand jury. It continues to yield the same results. Now, ive been told, if you continue to do the same thing over and over again and expect a different result, that is the definition for insanity. We are not insane. We know that our children deserve equal justice, just as any american and we want the prosecutors, if they have a conflict of interest, and for the sake of the public trust, which is so critical to ferguson, and many communities all over america, president brooks. We pray that prosecutors will say, we want people to believe in the system. If that means appointing a special prosecutor that has no relationship with the accused officers, that you do so. The legacy of Michael Brown jr. Should be warn not where we just make a lot of noise, mr. Brown. That wouldnt be the proper legacy to your son. The legacy to Michael Brown jr. Should be that instead of just striving to make a lot of noise, we strive to make a difference. That difference will be changing this system where the police, who are supposed to protect and serve us, continue to kill our members in our community and we have to really address this issue as a warning that what scenario could we offer where they finally indict Police Officers for killing us . Isnt that the real question. So, as we make ready to hear from attorney gray and then from reverend al and mr. Brown will be present before you, we beg yall again that we know it is flustrating. We know it is painful. It is painful to any parent, specially parents of young people of color, because we worry about our children every day. I mean every day when we hear they have an encounter with the police, reverend al. Our heart just stops. It shouldnt be like that. We should be able to expect the police to treat our children just like they treat any other children in any other community. To hopefully really address this issue, we want to propose the Michael Brown law, that is the proposal that every Police Officer in every American City has a video body camera. So it will be transparent. We wont have to play this game of witnesses, memories, and secret grand jury proceedings. It will just be transparent and we can see it for ourselves and we can hold people accountable when they have interactions with citizens, because this system is so unfair to the citizens. We are all american citizens. We ask that everybody, not just entire st. Louis community, but all of america, join us in demanding change, making a difference for the lives of our children and for the sake of our communities and specially for Michael Brown jr. Who is crying out from the grave where so many thousands of other people of color who have been killed by police saying, you all have to change this system. Attorney gray . Ill be very brief. I just want to remind everybody you are watching an nbc news special report, reminding you that what we are watching is at the greater st. Marks Missionary Baptist Church in missouri. An attorney for the family of Michael Brown, anthony gray, speaking out about the decision not to indict. If there was evidence to indict, there would have been an indictment. If they dont present the evidence in a manner to secure an indictment, there wont be an indictment. This grand jury decision, we feel, is a direct reflection of the sentiments of those that presented the evidence. We appreciate the day that. We appreciate the fact that we got a chance to hear or read all of the testimony. We saw what was presented but we didnt hear how it was presented. We didnt get a chance to hear the inflexctions in the voices. The cynicism and the sarcasm in some of the questions that i have read just jump off the pages in you. It is all in the presentation of evidence. I dont want anybody to be misled in any other way. I would also caution all those in the media that we still have an ongoing investigation. Im not going to comment on very much of the evidence at all. I am just going to ask that you have transcripts. Read them for yourselves. As i read the testimony, one person, officer Darren Wilson, he indicted himself. Most of what he said didnt line up with the physical or the forensic evidence. You read it for yourself. You have it. It is right there in front of your face. You know, there is an old adage that some people will say. If you really want to hide something, you hide it in plain view. It was right there for us to see. Now, im just going to encourage the ongoing investigators to continue to do what they have to do. Well hold out hope that subsequent investigations would produce a result that reflect the way that evidence was presented. I would only say to you that over 50 witnesses and only four to five of them are relevant. What was the other 55 for . If you already know going into it that a person didnt see the event, they already told you that, then why would you present them in front of the grand jury . Whats the point. So it is things like that that just raises all kinds of red flags for us in this process. Were going to hold out hope that at some point justice will be served and we will at least have a presentation of evidence that is fair and impartial and then we would allow the chips to fall where they may. Without any further ado, i bring to you, mr. Al sharpton. Three days after Michael Brown jr. Was killed, we had a major rally in this very church. We said that night with his parents present, that we had little to no faith in the grand jury by the local District Attorney. We said that night we wanted the federal government to come in. Sunday, we had a unity rally where thousands came and joined us. We repeated it and all the way through the funeral. Last night, the appearance by the District Attorney made it clear to everyone why we had little faith in the state prosecution. I have been involved in civil rights all my life. We have seen cases go away that we felt were right and ways that we felt was wrong. Ive never seen a prosecutor hold a press conference to discredit the victim. He went out of his way to go point by point in discrediting Michael Brown jr. , who could not defend himself. How do you, in explaining why you are not indicting a man to kill, try and convict a young man for shoplifting, that cant explain the tape, try to convict him for interfering in the police car, when you dont hear his side of the story. Have you ever heard a prosecutor go in a press conference to explain to the press why the one that did the killing is not going to trial but the victim is guilty of several things that no one has established. Then, to go further than that, he takes his time to methodically try and discredit the witnesses, witnesses that will still be needed Going Forward in the ongoing federal investigation and if there are civil proceedings. What is the purpose of mr. Mccullough trying to undermine the credibility of the witnesses, undermine the credibility of the victim, still has not explained to us how you have a man on the force that feels like he is a child up against hulk hogan . What kind of training and policing do you do . And still has not explained the original altercation began over what in the first place and why he, in turn, fired the fatal shot . Let us not forget. There are only one that makes the presentation. The grand jury is the prosecutor. There is no crossexamination. So for him to talk about inconsistency us unchallenged, because there is no one representing the other side to come and cross examine what he put up. Bha m what may sound inconsistent is only responding to what was asked. If there was two sides, then maybe some of the gaps would have been filled. When you have the attitude of a prosecutor that feels it is his duty to go out of his way to try and discredit a young teenager that cant speak for himself, then america saw why we said from day one the federal government needs to step in to protect the rights of Michael Brown jr. And to protect the rights of the citizen. It was also very strange to us that he lectured the media, a media that he and others had no problem when you you leaked the videotape of Michael Brown in the cigar store or in the convenience store, a media you had no problem leaking all kind of favorable stuff for the prosecution, a media you had no problem leaking things for the officers. It seems to me he has had the use of the media. Then, has a strange decision in a town that has been tense, in a town that has been forecast to have all kinds of problems. His solution is, lets announce it at night after dark. Lets make sure all the kids are home, all the students are back from thanksgiving break and then lets announce it and then i am going to get up in the dark and cassty gait the character of Michael Brown jvrmt i think it was irresponsible. I think it was unnecessarily provocative but i think it only cleared why many of us said lets go to the federal government from the first place. He implied last night that the federal government and the state ran hand in hand and ended last federal government Investigation Continues in the killing and the review. Mr mcculloughs statement led others to believe differently. Let me be very clear. We were not surprised at what the outcome was. Certainly, it is painful for the mother and the father. Certainly, there will be emotional reaction. I have never seen a case where there wasnt. You are dealing with their flesh and blood. Let the record be clear. You have broken our hearts but you have not broken our backs. We are going to continue to pursue justice. This is not a ferguson problem. There is a grand jury about a week or two away from deciding the chokehold case in new york. There is a 12yearold just killed by police in cleveland. This is a problem all over the country. Right now, at 12 00 noon all over the country, people are marching and gathering in front of federal courthouses. The national network, naacp, the National Urban league, all of our members are coming out today. Others, saturday, we will be all over the country. We will continue to fight for a new level of accountability of policing in this couldnt interest i. Country. Michael brown will not be remembered for the ashes from buildings burned in ferguson. He will be remembered for new legislation and the upholding of law that protects citizens in the country. Let me also remind you. For over 100 days, young people, older people, people of all races marched and rallied in this city and they did it peacefully and nonviolently. Yes, those that got violent last night, those that acted in a destructive manner does not represent the spirit of Michael Brown. It was those young people, those old people that stood no matter what the weather for over 103 days, that kept going. Those are the ones that have stood for Michael Brown. They are on browns side. Those that burn are on their own side. If you are on Michael Browns side, you walk with dignity. If you are on Michael Browns side, you stand up with pride and uphold the law. If you do anything to harm others, you are on your own side. Your not on browns side. We are on the side of Michael Brown to fight for what is right. Dont lower those standards. We also question how you have grand juries now that you are trial juries. The use of a grand jury is defined as if there is probable cause to go to trial. You do not have a grand jury to decide on the guilt or innocence of the accused. You have a deceased body. This person did it. Their accusations, he contradicts them. It goes to trial. The fact that last night the prosecutor was not announcing whether there was probable cause. He was announcing the acquittal of the officer, because he tried him, rather than investigate him. That is a miscarriage and a misuse of the grand jury system. Lets be real clear what we saw. We also in that light. The National Urban league, who was present, cornell brook, dr. Brook, president of the naacp, Melanie Campbell of black leadership, round table women and perry maze of the national bar associate have called an emergency civil rights Leadership Meeting in washington, d. C. Next week. In that meeting, reverend jamaal bryant, we will determine an ongoing strategy that will include regular marches, legislation and economic boycotts. We will not turn around. We want you to know that we will have the leading activist, civil rights activist, including some of our young groups, that want room on the platform, that have shown the ability to mobilize. This is not about all of us liking each other. This is about all of us being bonded with a common goal. We will come out of that summit and lay out a plan that will construct tifl help to change this nation and bear on those ongoing cases, because we just had another case in new york over the weekend. In a Public Housing stairwell. Michael brown has litigato a ne energy for police accountability. I remember when rodney king happened. Our hearts were broken when we went to simi valley and watched a trial jury acquit those police. There was violence after that. We kept on going. The federal government came in and those policemen were convicted. So before you think this is over, remember what happened in rodney king. We went from simi valley to the federal government. This will not end in the valley here. Were going to keep on going. We have told this family we are with them to the end. Weve told them we are going to do it with dignity and to finish the cause. That is why we are here today, to let Michael Brown senior know we may have lost one round but the fight is not over. Brother shahid and brother akbah, any time you watch a fight. Sometimes you can even get knocked down in a round. Ive seen champions get up off the mat and still win the fight. We took a blow last night. Thats all right. We have gone to the corner and cleared our head. We come out for the next round. Thank you, reverend sharpton. You took a blow as some people said. It aint over. I am reminded again, we are listening now to attorney benjamin crump. You just heard from the reverend al sharpton talking about the case, talking about the prosecutor, talking about the grand jury and the lack of indictment last night. Lets bring back in ron allen in ferguson, missouri. Ron, this is such a contrast to what we heard last night from prosecuting attorney, robert mccullough. Explain to us how we got here. Why did the prosecuting attorney explain that there was no indictment. One thing that robert mccullough, al sharpton and ben crump all agree on, this grand jury process was unusual. Mr. Mccullough said he was going to put every piece of evidence that he had before this grand jury, which is unusual. There were 60 witnesses, some 70 hours of testimony. Mccullough said that he did this in the interest of having fairness, transparency. Then, he went a step further and took the unusual step of releasing all the documents or many of the documents and transcripts of testimony that the grand jury considered. So he said he did this in the interest of fairness. His critics are saying he did it in an attempt to twist the process. There is, perhaps, another legal fight to be had here. I also want to say that i dont think anybody here. Many people here are surprised by the outcome of this. I dont think anyone, many people thought that officer Darren Wilson was going to be indicted in this process. Mccullough basically said that the witnesses were inconsistent. The key, one of the key issues was, did Michael Brown, have his hands up at some point in this altercation trying to surrender . Thats what people took to the streets arguing and mcculloughs conclusion was that there were witnesses who said he had his hands to the side. He had his hands in a fifst and his hands in the waistband. He said there was no witness. Darren wilson said, never did Michael Brown have his hands up. Ron, just to explain what we just saw on the side of the screen there, there was some kind of disturbance in the back of the church. The press conference has ended or at least been suspended for a moment. We did not hear. You noticed Michael Brown senior nod his head no when the reverend al sharpton turned to him to see if he wanted to make any comments. Looks as if we are not going to hear from the parents of Michael Brown. I want to bring in pete williams, who covers the justice department. You heard several people talk about the federal government. Two of the lawyers mentioned there is still a federal department of justice investigation ongoing. Is there a potential for another legal avenue to go back at this case . Two federal investigations ongoing. One into whether Michael Brown should be charged with violating the federal civil rights, if wilson should be charged with violating Michael Browns federal civil rights. That is an investigate still going on. The second is a broader investigation of the Police Department in ferguson. A third one looking at the whole county. Pete, so what, how much chance is there . Let me break for one moment. I will go back to you. At this point, some stations are going to leave our live coverage and returning to regular programming. For others, other nbc sfegs report continues. Is there any way to know how quickly this might happen or when we could hear something from the attorney general . I dont think we will hear anything from the federal investigation for several weeks. It wont be anything this week or within the next few days. It is difficult. The standard in a federal investigation is more difficult to meet than a state criminal prosecution. Pete williams, thank you. A lot to digest there. We heard from sattorneys. We heard from al sharpton, talking about what they say is a miscarriage of justice, saying that they believe the prosecutor held a press conference to discredit the victim. A very different point of view from what we have heard from the prosecuting attorney, ron on th streets of ferguson and there covering the story since august. What are we anticipating for tonight . We heard them urging calm and you heard al sharpton saying if you are on Michael Browns side you walk with dignity. Anything idea whats to come tonight . No i dont. And i frankly worry about that because there is a lot of energy, a lot of passion. A lot of people who have a lot of emotion. And they want too express it. Going into this for the past three months, for the past 108 or nine days since the violence in august theres been a lot of peaceful protests and a lot of big gatherings marking the second anniversary of Michael Browns death. But last night was different and why is still not clear. The police have always been concerned about the criminal element who they thought were going to use this occasion t grand jury announcement, to incite and cause violence. If that would happen we dont know. Was it the people in the community who lashed out who were so angry . We dont know. But cleerlg this is going to play out over time. The authorities are still here very active. The street im on for example is completely closed down. It is a crime scene. Every building along here, about a dozen or more of them, Family Businesses burned or destroyed. The police trying to figure out what happened here and Going Forward there is a lot of concern about what is going to happen. Young people in particular i sense are very energized. We talked to a lot of young people and they emphasize not your grandfathers fathers civil rights movement. They are determined to keep pressuring these issues forward. Not just about policing but education, quality of life and jobs and wages. There are people who talk about this moment as something more than just what were seeing in the grand jury process. Most people thought that the grand jury process was not something that was pivotal. They said what was pivotal was the killing of this young man on a city street at 12 00 noon in broad daylight by a Police Officer. So there are a lot of meetings going on. A lot of people trying to things beyond the legal process. And well have to see if this Community Moves forwards. It certainly took a huge step backwards last night. And a sadness as here. The heart of the community is destroid destroyd dedestroyed as el. Businesses that will not come back is feared. Its a huge step back. But there is also a determination to move forward. Hopefully things will be peaceful. But i think given the intensity of what happened last night, as the chief of the county police put it, it was worse than any night in august. Worse than all of the worst that happened in august. So its unclear what is going to happen not just tonight but in the coming days and nights. And i know you will stay there the rest of the today and well have continuing coverage. Thank you so much.
