We all remember the story, a teen stowing away in the wheel well of a flight to hawaii from San Jose International. It happened during the Early Morning hours of a day in april. Lawmakers followed calling for increased security. Tonight our under cover cameras discovered more weaknesses in the Airport Security net. With the single swipe of a badge we watched some airport workers completely by pass all security. Investigative reporter jenna susko with our hidden camera investigation. Reporter two airport workers enter these doors just off a busy sidewalk. And seconds later enter the airport terminal. This man in a minivan heads in the doors and then he is at the gate. Or this guy sprinting to get through them, too. Scans and goes in. Reporter all these people with a single swipe of a badge just by passed all Airport Security at San Jose International airport. And its allowed. Im not really comfortable with the system when it comes to Airport Security. Reporter it is exactly why this Silicon Valley Blue Ribbon Task force was created back in 2002 to find Technology Driven solutions to make airports safer. It found weak control of the airport workforce due to inconsistent standards, uneven oversight and poor enforcement that could potentially allow for unauthorized individuals to get in. You see, some airport workers go back and forth from public areas to secure areas. So they dont always go through security. Instead, they simply swipe a badge. The Task Force Found bio metrics like fingerprinting or hand scanning coupled with an i. D. Badge is reliable in making airports more secure. Airports including sfo now have it. San jose does not. Technology is there. It can be utilized and should be implemented. Reporter congressman spear headed the task force. It has been 12 years and it doesnt appear we are betting off now than before. I believe we should revisit the recommendations. We utilize the idea that all airports should be following the same recommendations. We did pass some bio metrics here but it wasnt an area that was established at this point. Reporter the director of aviation at San Jose International airport. Even though tsa does not require it do you think it would enhance security to have bio metrics . There are Different Things s you can do. There are things you do above and beyond the basic standards. Reporter we watched these doors for a week as passengers and anyone else who wants to walks by. Insiders say anyone who gets ahold of a badge that opens these doors can go from a sidewalk to inside the terminal in seconds. From what we saw it is a swipe of a badge and they can be in the terminal within 20 seconds and there is nobody checking them. Certainly, what you see is kind of like an iceberg. You have the tip of the iceberg. A lot of things go on behind the scenes to prepare that employee for what he or she is required or allowed to do. Reporter at another set of doors feet away we watched as one worker swipedt two others follow him in. Only one badge was swiped for three employees. Reporter the sign reads all personnel must swipe their badge. Is that permitted . That is not the secure area door so that is permitted. Reporter an airport spokesperson later sent this email stating officials check the door and found it is signed incorrectly and that group access is permitted. They plan to change the sign. So what about the doors we showed you earlier that lead directly to the terminal . Who is using them . Remember these ladies . We found them stocking items at starbucks. And this man who hours earlier was unloading supplies from his minivan also swipes a badge. Moments later enters the terminal. That badge potentially could be passed on to somebody else. So the badge itself has different coding levels on it. And there is also checks and double checks that you may not be seeing. Reporter so you know for sure the person using the badge does own the badge. That is certainly the goal of the program. Security doesnt come free. Reporter an International Security expert. He helped improve security at Boston Logan Airport after 9 11. They use it as a threat. It is a very serious problem. Reporter he believes bio metrics is a needed layer that enhances security. Something unique and attached to a persons body and cannot be imitated. We are very confident in our program and feel that we have met and exceeded the requirements in many places. But i dont think you can rely on luck moving forward. That was jenna susko with our report. The airport tells us that incorrect sign has been replaced with a temporary one with the correct information. Also, you should know the airport does have different badges for employees with multiple levels of security clearance and requires badge holders pass a background check. When we return did they do what they should have done in response to your complaint . Insiders speaking out on the cleanup of a bay area toxic site. Now the city making way for homes, shops and offices. Tonight insiders tell Investigative Reporter vicky nguyen they have Serious Public Health concerns about the integrity of the cleanup. Reporter during world war ii Hunters Point was a Navy Ship Yard used as testing lab for Nuclear Weapons and licensed for unrestricted use of Radioactive Material. But this site with its toxic legacy is undergoing a renaissance. The city of San Francisco plans to turn Hunters Point into one of the most beautiful pieces of land in the bay area with acres of homes, retail and parks. I would not feel comfortable living there having a yard where i can grow a garden. Absolutely not. San francisco is absolutely beautiful. It is a shame this is happening. Reporter they worked for Navy Contractor tetra tech, the company overseeing the cleanup. Together they have decades of experience working in Nuclear Power and radio logical safety across the country. How is it comparable . The most egregious violation of standard protocol. Reporter he says a year into the job he began to witness questionable behavior by tetra tech. Having to do with the proper disposal. Reporter in december 2010 he sent the photos and emails to managers documenting trucks shipping dirt away without being surveyed and tanks clearly walked as contaminated, literally tons of material heading through the bay area that he says was not tested or cleared for radiation. The most common are radium, cesium and stronnium. What can it do . Radium in the bones you have the concern with potential bone cancer. Things like that down the road. Reporter he says the public cant be confident soil leaving Hunters Point and soil that remains here to be used as back fill for future development is radiation free. He alleged tetra tech cut corners to save money. It has been botched. It is not right. They cant be shipping potentially contaminated soil as clean land fill into the city of San Francisco. This cant be done. Reporter she says she discovered tetra tech managers made a major change in 2011 involving this monitor, a device that sounds an alarm when it detects radiation. This is an internal manual obtained by the nbc bay area Investigative Unit showing in 2011 the detector alarm set point was raised to 8. 5. The original level was 6. Andrews says that dramatically lowered how much radiation the monitored would detect. They are trying to get dirt out that is contaminated. Reporter andrews began documenting major problems she witnessed and shared with us her personal log book that tracked the trucks leaving Hunters Point. At the end there was a lot of trucks. There was 17, 20, 12 a day going out that never passed the monitor. Reporter andrews and bower say they witnessed other questionable behavior to the promotion of unqualified personnel to Senior Safety sensitive roles and took their concerns up to the Nuclear Regulatory commission and submitted 20 complaints between them to the nrc. I was told shutup. Dont talk to the nrc. They wont help you. Reporter we obtained these reports indicating nrc inspectors travelled to Hunters Point to investigate but in each instance responded they were unable to substantiate the complaints. Did they do what they were supposed to do . As an american i believed in the nrc. Im not sure i believe in them anymore. Reporter both bowers and andrews lost their jobs. Taxpayers are paying thousands and thousands of dollars, everybody across this United States is paying for that cleanup. And it is not being done correctly now. That was Investigative Reporter vicky nguyen. Tetra tech and the navy declined our interview request. Bowers and andrews along with two other former employees are now suing tetra tech for retaliation. It is part of a whistleblower lawsuit contending they were fired for speaking up. Its a National Debate that is playing out right here in california for the first time in state history we have a law that tracks and regulates the controversial practice of fracking. But six months after that law was expected to take effect Investigative Reporter steven stock found it is not being enforced. Reporter at first glance st. Andrews gardens apartments in l. A. Appear like every other neighborhood in california. The only barrier between this particular site and our Apartment Units is this wall. Reporter but beyond the cinder block wall and beyond the tarp don martin recently discovered a drilling operation was using hydrochloric acid. Absolutely we have a right to know what is going on in our backyard. Reporter only six months ago a new state law called sb 4 took effect which was supposed to require all oil and Gas Companies to notify neighbors about oil well stimulation such as fracking. Sb 4 required the state to post a list of all wells within the website within 60 days. It angers me because we werent informed there were chemicals on this particular location. Reporter an investigation by nbc bay area has discovered just as much public confusion and uncertainty over what wells are being fraced or acidized as before sb 4 took effect. We found wells like this one or this one both located in kern county where fracking occurred but so far not noted on the states website. Basically being kept in the dark. Reporter an attorney with an Environmental Group calling for a halt to all fracking operations in california. Fracking is a dangerous practice and to not know where it is happening or how frequently that is a huge concern. Reporter he analyzed state, local and Industry Data comparing the new fracking website with the industrys voluntary website and found dozens of discrepancies. We independently verified those discrepancies and found 77 wells out of a total of 116 that had been voluntarily publiced on the site fracfocus. All 77 of the wells as of may 20 have not been posted on the states website. We found 62 wells where air Quality Management records show hydrochloric acid was used. Those wells dont show up on the states website either. As you see here we mapped those wells on our website. These regulations arent working. They arent keeping communities safe frauom the dangers of fracking. We are hitting all the marks. Reporter Jason Marshall is the chief Deputy Director of Californias Department of conservation. When i see 77 more on fracfocus than this website that is not through intent or the state dragging its feet or trying to be slow . Not at all. We are working diligently. We are getting information they need to give us in addition so we can link that up and post it on our site. We are given 15 days to do that. Sb 4 is still a new law. It doesnt happen overnight. State senator mark leno cosponsored sb 4. Are you happy with the result that so far little has been done for sb 4 . I am concerned and it only reinforces why we should consider a moreatorium until we gather the information. Isnt that the point of sb 4 to make sure the public gets to see what is going on . It is absolutely. One of the central premises is to increase public transparency. We cannot impose some additional reporting requirement on operators. It is starting to be a concern about our health and safety. Reporter don martin says he and fellow residents wish they knew what was going on beyond the tarp. In order to protect the residents it absolutely needs to be enforced. That is part of the problem, the lack of enforcement. Investigative reporter steven stock with that story. Since this report aired the state has started updating its site. The department of conservation admits the law could and should be tweaked to help clear up the confusion. Local Law Enforcement taking action cracking down on Ride Sharing Companies like uber. How one bay area d. A. Aims to challenge that industry next. And welcome back. More rules may be on the way. Earlier this year Investigative Reporter elise kurshner exposed insurance issues with some. Now San Franciscos District Attorney wants to crack down pledging tighter rules for the industry. T. Why dont you get in my face again like you did before. Reporter last fall this passenger claimed uber driver was verbally abusive. A Police Report was filed but no charges until today. Whit mire is facing battery on a transit passenger, a misdemeanor. At the time that this incident took place the police decided they didnt want to cite him for this incident. Reporter in april the Investigative Unit found before becoming an uber driver he served time in prison for drug charges. We found other drivers across the country with criminal records despite ubers policy of running background checks on all applicants and disqualifying anyone with a criminal record in the past seven years. District attorney said Law Enforcement will now be stepping up efforts to regulate ride service drivers. We want to send a very clear message that this is an industry that is growing and making money. They have to be a good corporate citizen. Reporter the California Public Utilities Commission regulates ride Service Companies which use cell phone apps. Working with the cpuc to implement stricter hiring practices and insurance policy requirements. How do passengers know they are safe . It is a good question. I think they really dont know at this point. We have no way of guaranteeing anyone that the people driving the vehicles is someone that is reliable. The District Attorney says he hopes stricter regulations are implemented later this year. You see something wrong and want to make it right.
