Some of those laid off twitter employees are fighting back in court. They filed a lawsuit last night in anticipation of these cuts. The suit claims elon musk and twitter violated state and federal laws that require advanced notification of mass layoffs. Nbc bay areas ian cole spoke with bay area attorneys and legal experts, too. Reporter a growing number of former employees are joining a new lawsuit claiming the mass layoff by elon musk and the company is illegal. This morning we spoke with their attorney. We filed this case last night preemptively to make sure that twitter and elon musk follow the law. Musk has a history of violating the law. Reporter shes talking about the warn act. Its a federal law requiring that Large Companies give employees along with local and state officials 60 days notice of a large layoff, which they argue musk didnt do that. She filed a similar lawsuit against tesla earlier this year for the same issue. Were also looking into how twitter made the decision about who was going to be laid off. The lead plaintiff in this case appears to have been laid off in retaliation for having helped his coworkers who were very concerned about these layoffs, and he was helping them make sure they were protected. Reporter so far supervisors say the city hasnt been notified under the warn act. Nbc news has talked with multiple former employees and viewed the layoff email they got. It says their last day working at the company is today, but theyll continue to be paid through early february. But whether or not twitter fully complies with both the federal and California Law remains yet to be seen. Reporter attorneys are urging every employee to seek legal advice before signing anything or waiving their rights. Legal experts say because the company is willing to pay them 60 days the lawsuit may be dismissed. But courts arent really that thrilled by technical violations, and the real spirit of the warn act is to lessen the impact on the employees. Reporter attorneys believe a court could make a preliminary ruling on the issue as soon as next week. Ian cole, nbc bay area news. The court is expected to act quickly in the case but just after hk this afternoon elon musk tweeted and confirmed everyone laid off was offered three months of severance. Today his daughter attended an administrative hearing in the case against david depape. During todays brief hearing the judge even acknowledged Christine Pelosis presence saying they worked together years ago at the city attorneys office. Its not clear if judge loreta george will preside over both hearings but if she does both sides may raise an objection of possible conflict of interest. That should happen prior to the hearing itself. Reporter that hearing is set for december 14th. David depape was not in court today. These are sketches from his tuesday first appearance. On december 14th the judge will hold a preliminary hearing in this case and will also listen to arguments from the San Francisco District Attorneys Office on holding david depape in custody until his full trial. During the preliminary hearing we may also hear some of the firsthand accounts from witnesses about exactly what happened inside the pelosi house during the breakin and attack. At this point we will be determining what witness we need to call, whether we call a victim, whether we call the 911 dispatcher, whether we present certain evidence. Tomorrow morning we have cloud cover with us, no umbrella needed. And tomorrow afternoon we get into showers here in the nrgt north bay. But i want to be clear as we move through this weekend it will not be just continuous rainfall. Just on and off rain chances for spotty weekend rain. So i think whatever plans you have youre still going to be able to get those done. Winds 10 to 20 miles per hour. Some sierra snow showers, and then this should pick up sunday night into monday. Now give you an early preview of that sierra snow if youre going up saturday or sunday. Totals look manageable about 2 to 6 inches but were going to add to this and in a big way. The latest on those totals coming up in 15 minutes and exactly where the heaviest rain will be. Still with temperatures dropping and rain coming in a lot of communities in the area are bracing for storm related issues and problems. How pg e is prepping and hoping to avoid any major power outages. Reporter as clouds roll in and rain heads towards the bay area, pg e says its prepping to make sure the lights stay on. We are very aware of this weather event. Were preparing for it logistically. Were making sure that we have the right number of crews in place. Reporter part of those preparations includes technology to help pinpoint where to expect storm outages allowing the utility to prestage crews to respond faster. Still the pg e spokesperson says its hard to tell how many people will be impacted. There is the possibility of outages and in some cases we do experience a phenomenon where one of the first rains of the season you do sometimes see dirt and debris and pollution sort of build up on the lines. So in some cases we will experience more outages than normal. Reporter with some areas expecting more than half an inch of rain starting this weekend the utility says its relying on storm prep and its year round efforts to manage vegetation to help protect power lines and transformers. But even with all the prep some outages are expected, and thats why the utility is asking customers to be prepared not just this weekend but all winter. Right now the team often relies on students bringing their own soccer balls and sometimes playing without any formal goal posts and nets. Sometimes players dont even bring their balls or forget or even because we have school they dont bring it because its right after school. You cant play a sport without a ball. Many of the teams players come from underserved communities, and me believes the game provides them a way to stay off the streets and a pathway to college. I feel if i didnt have this in my life it would be more challenging for me especially me as a senior it would be more challenging because i want to have colleges looking at me, scouts looking at me. And our forecast as we move through the next couple of days its changing up for us. As we take you through that microclimate forecast just wanted to update you on the bay area rain season and how things go for us. In october we generally see things kind of tick up here through the bay area. October, though, really brought us little to nothing in the way of rainfall. And november thats when we historically see things jump again and we are right on track with the way things are playing outright now. December, january, february, march, thats when we really pin a lot of our hopes on getting that big rainfall before we get into the typical dry season. So lets move it into that forecast and everything is lining up to get some rain in here through the fiveday forecast. You can see this aggressive storm track hitting the pacific northwest, and eventually thats going to lower down here through the bay area. Well have more on those rain chances in about a minute but i want to make sure youre ready to go through tomorrow morning. Cloud cover may help you sleepin a little bit on your saturday. Why not . Weve all been working hard to get to that saturday and temperatures starting off in the upper 40s and low 50s. 50 and chilliest weather, some sweater weather in the north bay, and 46. Daytime highs for tomorrow stay on the cool side. We have 63 in livermore, 62 santa cruz, 59 in santa rosa and 57 through half moon bay. We get into a spotty chance of rain as we move through saturday, but i dont think its going to ruin your weekend plans saturday and sunday. Its not going to be nonstop rainfall. The first little wave of spotty rain gets here saturday night. Then through the day sunday we get some dry weather. By the evening well see another little push here of some rainfall. Should start to pick up here by monday morning and into tuesday with some widespread coverage. And then we get into a breaking up here as we head through wednesdays forecast. May get a little isolated small hail because the air is so cold as the air moves in. Rainfall totals just trace amounts to maybe 0. 2 on saturday. Add onto that a quarter to a half inch elevations on sunday night. Monday most of us in for a half inch except for the south bay, and by tuesday were looking at about a half to three quarters for a lot of the bay area. Some of the Higher Elevations in that red color right around an inch. Sierra snow 1 to about 4 feet for the highest levels monday, tuesday, and wednesday. Lets show you that sevenday forecast and numbers remain in the 50s. Dry weather in here wednesday, thursday and friday. Those chances really drop off by wednesday. Were only looking at a 50 possibility. Its the best kind of rain. We get a little bit of chances each and every day. The kind of break and avoids a lot of the problem.
