Jason lye has been charged with illegally possessing information on a suspects criminal history and misusing confidential dmv records. Last year lye was accused of Sexual Assaulting a woman he took out on a date. Another sfpd officer is accused of interfering with that investigation. Safe and sound. Two toddlers who went missing in San Francisco yesterday are out of harms way tonight. Its a bizarre story we first broke on twitter. The toddlers have been found in a San Francisco hospital. But their mother is now under arrest. Nbc bay area pete surato is joining us live from San Francisco where the children were found. Pete how are the children doing . Reporter we learned from sfpd the toddlers are safe. They appear to be in good health but they still need to go through a medical evaluation. They were brought here at about 4 00 p. M. But that story begins with the toddlers mother, 26yearold shanise jones, dropping off her 2 1 2yearold and 14monthold at a burger king in the tender loin monday afternoon with an acquaintance by the name of jakita. Apparently there was an agreement between this mother and jakita to meet a few hours later to pick up her kids but jones showed up late. The two agreed to meet the next day once again in the tender loin and jones claimed jakita never show up with her kids. Jones went to the tenderloin sfpd station to report the toddlers missing. Investigators found her story inconsistent and booked her on child endangerment and possession of narcotics. We now know the acquaintance is the one who brought the kids to the hospital, but the mother still faces some trouble. The mother was charged with the child endangerment because of circumstances that she put the children in when she left and did not return. Reporter sfpd says this is still an ongoing investigation, one that will include child protective services. That mother is being held on a 106,000 bond. A developing story out of the east bay, bomb squad still working to determine if something brought into the Hercules Police station is an actual live explosive. We told you about this on our 5 00 show. It happened just before 3 00. Police say a man walked into the station on civic drive, which is what youre seeing right there, and said he had found a fake bomb in a bag. It was an odd statement, so the officer took a look and decided the bomb could potentially be real. Thats when the Police Department and city hall were evacuated. Two nearby Senior Centers have been told to shelter in place and the local library nearby is being used as a facility for right now. Cameras were off. Were learning new details about the Alameda County deputies caught on camera beating a suspect with batons. This video came out last november, sparked outrage. You can see the deputies hitting the man in San Francisco who had led them on a highspeed pursuit and then a foot chase. More than ten deputies took part in that chase but a newly released document shows none of them turned their body cameras on. The report did show one deputy had turned on his patrol cars dashcam. Well, today investigators officially put the blame on the driver. And for the first time, that driver is speaking publicly about that dramatic crash. Nbc bay areas Chuck Coppola is in San Francisco, and chuck, the driver insists he didnt do it, that there was a mechanical problem. Reporter thats right, jessica. The driver made an apology for the first time publicly to the people who were injured. But he also insisted hes not to blame. The tour bus driver, 53yearold kenneth malvar, has gone through multiple surgeries and insisted that the accident on post street last november, injuring 19 people, was not his fault. And for those who were injured in the accident, im very disappointed that sfpd or Highway Patrol were unable to find the mechanical cause of the accident. Reporter earlier in the day, a joint San Francisco police and Highway Patrol investigation concluded that there was no mechanical failure and put the blame on malvar. He likely panicked after he struck the bicyclist and maybe mistook the accelerator for the brake excuse me. Reporter the drivers Attorney Says the accelerator stuck. They said i didnt know my gas pedal and brake pedal. To me thats absurd. Because i no my pedals on the vehicle. Reporter investigators looked closely at the compressor. That supplies pressure to the brakes. Malvar told his attorney he heard a pop just before he claims the brakes went out. That system was looked at very detailed. It was determined to be in functioning order with no preexisting mechanical defects. Reporter but the bus involved modified into a double decker to dare sightseeing passengers and more weight was not inspected before the accident. Nor did state regulators know if the tour company has acquired it. Problem state regulators hope to change. This one was a ghost bus. It came in and there was no communication between the department of Motor Vehicles and the Highway Patrol and the puc. So now were going to have communication between those agencies so when a bus does come into california, gets registered, someone will know about it and inspect it. Reporter next month the Senate Committee will open discussion on whether tour buses older than two years in california should be inspected every six months. It shut down part of busy mission boulevard in fremont for five hours ago. Tonight one lane is still closed as police try to investigate this crash. So far it appears that the driver swerved to avoid something in the road and then lost control and thats how the truck flipped. The driver was injured but is expected to recover. Hundreds of People Living in an apartment complex in san jose are about to be displaced by a new highrise development. Today they took action to try to get financial help for their unexpected move. Reporter well, the residents here at the risoto apartments have already lost one fight to stop the new development. Today they showed they dont plan to go away quietly. Many residents at the old 216unit reserve apartments on winchester boulevard say they knew it was an uphill battle to save their homes, a Huge New Development to replace the reserve by next year will offer more than 600 units as well as retail shops and a park garage. The city approved the project, and residents will have 120 days to vacate once final permits and other steps are completed. Its going to be difficult to move out, yamt its hard. It hurts. And yeah, its going to be difficult. Reporter today the south Bay Tenants Union and Affordable Housing network met with city attorneys office. Theyre angry san jose doesnt require developers to provide relocation benefits. They offered housing in other complexes but at a much higher rate. Some of these are low income people. This is rent controlled. 216 units which maybe 500 people are look for more low income housing. Reporter jones office told tenants and nbc bay area the councilman will propose requiring developers to provide money to displaced tenants, and in a separate move set up a ensure tenant assistance in the future. Any help would be appreciated. Anything would be nice. Reporter and tenants say even with the City Councils approval, the new complex is not a done deal yet. Groups are considering filing permit challenges, citing some environmental concerns, and jones office says the councilman will bring up his proposal to the city council on april 19th when it discusses rent control. The school board is now looking for Affordable Housing in order to keep its teachers. District leaders say rental prices in mountainview are out of reach for teachers who make an average of 69,000 a year. So that means a lot of them are left with long commutes. I do know that people leave because of the commute time. And that they are always concerned about traveling, being on the road for two hours to get to their jobs. Reporter the district is now working with the city and businesses to put together a plan for a housing project. Cooper park is a potential site for housing. Old military barracks in the city are being considered as well. Well, the homes are literally hanging on a cliff but dozens of people ordered to leave their homes say they want to go back inside. A pacifica Safety Commission will rule tonight on an appeal by tenants at this apartment complex on esplanade avenue. Despite the fact that the apartment complex is in danger of falling into the ocean due to erosion, some of the ten ants say they actually want to go back in. Their amounts have been yellow tagged, which means they can go get their belongings but they cant live there.
