bars tonight after reportedly pretending to be a security guard and then allegedly sexually assaulting a woman. the investigators say the map approached the woman and her friend as they tried to fix their car in a mountain view parking lot. all happened hat 3:00 a.m. on saturday. diaz gave the woman a ride home while her friend drove with the tow truck driver that called. the woman then says diaz sexually battered her in the fake police car as he drove to her house. tonight a gunman remains on the loose. this is a police sketch of one of the men seen with the shooter. this all happened saturday negotiate at union city's james logan high school. police say the deputy was volunteering for a school event when they noticed three men in a blocked off area. one of the men pulled out a gun and fired. the deputy was fired in the leg and is expected to recover and the gunman is described as hispanic in the late teens or early 20s. a sinkhole in fremont is blocking traffic. at this hour the construction crews are just off the auto mall parkway. the problem started saturday when a sewer main broke. police say the intersection will be closed through at least tomorrow night as crews next 24 hours, currently offshore, the center of low pressure, about 1,000 miles out but the cold front 300 to a hundred miles offshore. that will begin to produce rainfall near the california/oregon border by 5:00 p.m. tomorrow and we expect some of the first initial raindrops by tuesday at 10:00 p.m. now with this particular storm system it will also bring rainfall for that wednesday morning we don't know exactly what this woman's situation is, but we do know that investigators say that she deliberately took extreme measures just to get herself behind bars, not just once, but twice. >> this was the scene outside the contra costa county jail this morning. investigators vai 35-year-old chrissie janoccio had been released from jail for throwing rocks at cars when she began smashing windows of cars parked in the jail parking lot saying she wanted to stay in jail. >> i'm a bail bondsman so every year i -- there's a handful of clients that kind of do this. they -- they need shelter so they get in trouble or they get a drunk in public so they are in jail for a night or two. >> while it's unclear what the suspect's motive for wanting to remain behind bars is, the sheriff's department says this is a second time she's damaged cars claiming she wants to be jailed. >> it's unfortunate, but it's not surprising. >> david gerson, executive director of the company that provides meals for those in they'd says there's not enough bed, mental health help or substance abuse programs in the county. >> we have to do too a better job. >> when you're homeless and you're out here, you oakland was investigating its fourth murder of the day. two of the crimes were solved but police need help solving the other two. the families. two murdered men met with police to demand for justice. >> not about street cold or street cred or any of that. it's young men out here dying every day for no reason. >> these men were on east 17th street. edward childress was fatally shot there and minutes later police say his friend larry lovett was kidnapped or persuaded to go to the diamond park area where he was killed. >> well, a man says he suffered a seizure after his service dog was banned from a 49ers game and now he's suing the team for $10 million. a cell phone appears to have recorded some of that exchange. >> me asking you to please leave the man alone. >> the video comes from james hillborn's attorney. it happened last november at levi stadium. the attorney says ticket-takers allowed hillborn and his service dog into the stadium and uniformed security guards stopped them. the dog apparently helped them control a seizure disorder and hillborn said the stress triggered the sues you're that sent him to the hospital. the written policy for levi stadium states that service dogs are allowed. the team stays cannot comment on this active lawsuit. at the 50 yard line over super bowl 50s media center. the fight over soccer fields behind levi stadium and the plan to tear them out and build the media center moved forward today as both sides went to court. nbc bay area's marianne favro joins us live from levi stadium. boy, this is an ongoing. battle. >> reporter: certainly is. the judge will not issue his decision until tomorrow, but this is the soccer field that both sides are fighting over. you can see how quickly the media center is going up. when we arrived here this afternoon, we saw grass. now there's already flooring and a tent. >> the transformation is well under way. today crews put down plywood and flooring on top of the soccer field for the temporary super bowl media center. the city-owned fields are now on loan to the nfl leading up to super bowl, and the santa clara youth soccer league is not happy about it. the league wants the work halted, claiming the city and nfl are not making good on a promise to find them adequate fields to play in until they can get this back. they say the options the city is proposing is including the stadium are not available on weekends when the league plays games. the nfl has agreed to replace the field, but the soccer league says it's worried about how long that could take. >> we're talking more like two or three months after the super bowl before we can actually get back on it and play it. >> today in court an attorney representing the nfl argued that the field is also the best location for the game's security headquarters and making other plans for it would jeopardize super bowl security. >> the difficulty and the logistics of shuffling everything around would be difficult if not impossible for the nfl to bear. it also would have serious implications on security concerns at the super bowl. >> the santa clara city attorney says the soccer league has known since march of 2013 that the city granted the nfl possession. fields starting weeks before the super bowl. >> both soccer league and the city are now in talks hoping to come up with some kind of agreement. reporting live issue because if folks are waiting to get into this exit it's the first one off of northbound 101. other drivers coming up wanted to slam on their brakes to avoid crashing into them. the bridge has gotten so bad that bridge officials say something needs to be done before super bowl weekend. >> it's a picture worth waiting for and one that makes vista point a must-see tourist destination spot, so much so that with only 100 parking spots and 10,000 weekend visitors cars are often stuck as a standstill on northbound of the golden gate bridge. >> we're working to central artery jit to come up a plan that will work both for the tourists and just the motoring public that wants to get across to the stadium. >> reporter: bridge officials say they want to manage the exit no vista point on a daily basis and closing it when traffic becomes too heavy. they can't do that though because this is a state-run rest stop that follows specific rest stops. the decision needs to come from them but all parties involved are now working together to come up with a solution to ease the congestion. one possibility is restricting access just for tour buses and shuttling other visitors from satellite parking lots. >> oh, that's not good. >> we drove. >> we drove across the bridge. >> it would limit people too much, you know, just to bring buses in. >> now bridge officials have asked caltrans for a temporary permit that would allow them to monitor vista point during the week of the super bowl. a spokesman from caltrans hasn't said whether or not that will be granted but did say a short-term news. >> accusations of murder, cheating and solicitation of prostitutes by firefighters. that's what governor brown, jerry brown, has now prompted him to set aside millions of dollars to investigate cal fire. 4.4 million will be spent to look into the conduct of firefighters. this comes after a series of scandals including a cal fire chief convicted of murdering his mistress. there are claims that fire fighters were inviting prostitutes into a firehouse and of cadets cheating on tests with help from instructors. the money from the governor will be used to hire more than a dozen people to investigate these allegations. >> calling it common sense, the san francisco politician is calling for a change to city bathrooms. supervisor david campos held a rally on the steps of city hall to gather support for legislation. he intends to introduce tomorrow. he wants all san francisco businesses and city buildings to digs nate all single stall bathrooms as being gender neutral. it's implemented signs on the door would be changed throughout the city. >> going to the bathroom should not be something that actually threatiens people in the city county of san francisco, that people should not be afraid and convenient to do something as basic as actually going to the restroom. >> washington, d.c. is the first city to mandate gender neutral bathrooms. berkeley, new york city and would actually be ready to play on tonight because it's in such good condition and, of course, they are going to let it settle and grow for the next couple of weeks, but that also means that they might have to protect it from some serious rain. >> piece by piece the dirt at levi stadium was covered in green. today crews laid 75,000 square feet of fresh super bowl grass. >> it's a special product. it's grown a special way. >> nfl field director ed m ha ngan says he checks the weather forecast at least once an hour. >> we'll deal with mother nature as she comes. >> but if el nino storms bring massive been towers on the freshly laid grass m ha ngan admits it could be an issue. >> an inch and a half an hour, that could be a problem. >> rain and cold weather tarps will be used to protect the field and rain or not, he says the growing process will be closely monitored every day until kickoff. >> just another day at office. >> george toma calls himself the nitty-gritty dirt man. he says he's been in the football field business since he was a kid and says super bowl 50 next month will also be his 50-year anniversary with the of nfl. how have things changed? >> i had a 3 x 4 trunk of equipment, and today we have three tractor trailer full. >> and even with the state of the art equipment and experts closely watching the condition of the field the players facing off on game day will still be at the mercy of mother nature. >> and due to safety concerns on game day vta will be limiting the number of people in this area, so they said anyone taking a train directly to the stadium will also need a ticket to the game. reporting live in santa clara tonight, michelle roberts, nbc bay area news. >> to protect it from all the rain and the rain is certainly headed our way. meteorologist jeff ranieri joins us now and we're talking about a sires of storms that just keep piling up. >> and the odds of getting rain at least before, during or after the super bowl, right after the super bowl and then when a lot of folks are here are definitely increasing as february does tend to be the month we tend to see on average some of the highest rainfall across the bay area. you get a look right now and you see the storm systems lining up out here in the pacific and one major way to tell that el nino is working right now is el nino influenced storms tend to tap into moisture and subtropical moisture wrapping into the cold front and that's going to be on way here to the bay area, and the next 24 hours. tomorrow morning, nothing in terms of heavy rain. we'll have the chance here, a little bit of drizzle and san francisco and 48 and for the peninsula 45 and 40s in the south bay. overall tomorrow, it will stay dry. we'll have the overcast skies. temperatures in the 60s, so a little bit milder out ahead of the next storm system and san francisco in the north bay the only location expecting the 50s, so when does this rainfall begin to arrive. tuesday at 10:00 p.m., cold front begins to enter the north bay with some heavier pockets near middleton and santa rosa and point reyes and heavier pockets spread across the bay area and even a few isolated and embedded thunderstorms. once we hit 1:30 in the afternoon on wednesday we'll continue with some scattered showers in the forecast. we're track not only this system but two more on the way this week. we'll have the terror attack in san bernardino has triggered a new debate on gun control. a new field poll shows a majority of californians haven't changed their position. take a look. 57% still believe controls on gun ownership are more important than protecting the rights to own guns. that's consistent with prior polls. 36% disagree and 80% support background checks for buying ammunition and 75% want a in gun buys for anyone on the no-fly list. >> california teachers unions at odds with challengers before the u.s. supreme court today. the issue is whether unions can require non-members to pay for union provided services. real el all public sector unions in california as well as throughout the nation. nbc bay area's political analyst larry gerston is here. a lot of layers to this case but really the crux of this comes down to union political power and money for the unions and how they use it. >> you hit it on the button, jess. this has been brewing for sometime. under current collective bargaining law previously, by the way, approved by the u.s. supreme court, teachers unions may require non-member teachers to pay what we call fair share service fees. now, these fees along with traditional union dues are used for political contribution, salary negotiations and, gosh, a host of other activities. for all the teachers, by the way in, their districts. >> and this haley has been a long time coming, especially with the progressive movement in education but why is it being challenged now? >> well, the plaintiffs say they just shouldn't have to pay fair share service fees if they are not union members. the unions, of course, then counter and says that the plaintiffs can get nice salary increments and when have you and retirement and health benefits. all these things from these negotiations that non-members should pay something and that's the crux of the argument. >> literally when it comes down to the teachers group, rely on a lot of dues for the political contributions. they have played a huge rule. what happens if the unions lose that power now though? >> first you're right. it's true that the teachers union would find themselves really in a world of hurt if the supreme court rules against them. >> take a look for a second at the rankings of some of the top campaign contributor groups to state legislators in 2012. the financial cloud of california's teachers unions, reflected in their position at number five. that's quite a big jump when you consider all the big groups there. >> all right. so let's ask you this also. from the way you heard it today in court, listening to the justices it really did not sound good for the teachers union but what did you read? >> you know, you never want to predict the supreme court's decision. you know why, because justices are so doggone unpredictable but a lot of seasoned observers are looking at the tea leaves and they believe the conservative court we have may well say the compulsory fees violate the first amendment and if that's the case a major player in california politics and elections is going to be in a tough spot. >> all right. we'll be watching closely. thank you, larry. >> in the rare event of a crash at san jose minutia airport, how many firefighters should be at the ready? critics say right now there simply are not enough. tonight we investigate emergency readiness at sjc. they have upgraded the number of firefighters there but have they gone far enough. we'll ask that question coming up. the number of firefighters on duty at san jose inter without question it's a change. fire officials have increased the number of firefighters on duty at san jose international airport following our investigation last year. now at that time we found only four firefighters work any given shift at the airport. experts call that a safety hazard. now sjc has increased its staffing by 50%, but is it enough? senior investigative reporter stephen stock here with a follow-up. >> at least it's a change here. >> a change for the better if you talk to some people at airport. airport officials say they increased the number of firefighters also because of an increase in the number and the size of airplanes now regularly using san jose minueta international airport. one of the nation's top safety experts tell me it's not enough. he says the airport is risking passenger safety. last may we discovered that san jose mineta airport had one of the lowest fire fighting staffing levels compared to other airports its size in the country. only three firefighters and a captain were on duty at any one time at sjc. that meant that in the event of an emergency those firefighters were tasked to drive two aircraft rescue and fire fighting or arff trucks with a captain left in charge of coordinating the response. that left only one, one firefight firefighter, to help rescue and evaluate passengers from any airline wreckage, even if it was a massive passenger plane such as a boeing 777 like the asiana crash up the road at san francisco international airport. when asiana went down in july 2013 there were 23 firefighters on duty and on the scene only minutes after the crash. the ntsb's crash investigation even credited san francisco's staffing levels as being, quote, instrumental in responding quickly and saving livings. >> i think san jose is marginally inadequate. >> it's terribly disturbing to me. >> just months after our story aired last year the san jose city council approved more money for the airport to upgrade its fire fighting capability adding two more firefighters per shift and another arff truck. >> we had more staffing prior to the reduction when flights were a little more prevalent in those aircraft sizes. >> chief robert sapien overseas operations for san jose's fire department. >> i'm happy on a lot of levels. certainly the local economy is doing much better. we're drawing larger aircraft more frequently. it gives us the opportunity to provide a higher level of service. >> with more international flights and larger airplanes flying in and out of sjc the airport was required by faa rule to increase its emergency response capability. sjc had been classified as an index "c" airport and as such the two firefighters and four arff trucks there met the minimum requirements and because of the increased traffic beginning in october sjc was reclassified as an index "d" airport. that the meant under faa results it had to have more firefighters and an arff truck at the ready. >> it requires to us have three arff vehicles and the proper amount of staff to operate those vehicles. >> john aiken is assistant director at san jose mineta international airport. >> san jose is a safe airport. san jose hasn't had a major accident, and if we do, i feel confident that the san jose fire department will be here to take care of the situation. >> several sources tell us that nbc bay area story plus concern by delta airlines also played a big role in the increase in personnel there. according to these e-mails the sjc dating back to february of last year, delta airlines insisted on higher minimum staffing for safety. the e-mails show that delta even paid san jose to staff more firefighters before the airline would land at sjc with a hearted 747 aircraft. >> we had the extra truck and so we accommodated delta so that they can motor their minimum. >> critics say it's still not enough. >> we're one firefighter to the good. >> john carr wrote the book literally on aircraft fire fighting skills and prosures. he and colleague les omen served as firefighters as sjc back in the 1970s. they then developed manuals and procedures for arff training which are now used around the world. >> it's all nice on paper. and you don't have the bodies on the rig initially it's hard to recreate them. >> especially, carr says, given the size of airplanes now regularly flying in and out of san jose mineta. >> there's just not enough people to do those kinds of major aircraft. >> and that's really the bottom line. >> airplanes such as this 787 dream liner which carries up to 250 people, an aircraft that has eight different exit doors and emergency escape slides, even with the extra personnel added that leaves only two people instead of one left to man those eight emergency exit slides in the event of an emergency. john carr says that simply is not enough. >> in my honest opinion, absolutely. i mean, how does two people even get close to managing eight exits on an airplane? >> we checked with other index airports around the country and found only oakland had comparable staffing levels. all other airports we checked with have higher fire fighting rescue than san jose. at least two more or as many as nine more firefighters on duety. >> are there as many firefighters on site here? >> in our discussions with san jose fire, they are very comfortable with the fact that they can be here expeditiously with the additional staff and rigs and to support the airport. >> now john carr says san jose mineta is not alone among medium and large airports around the country where he says there are two few fire fighting sources on hand in the rare event of an aircraft emergency. he and two other experts tell me that they blame the faa for not requiring more personnel at every airport, and the faa consistently tells me that the requirements have been shown to be adequate, but it would be a tragedy if you survived a plane crash and then got hurt or died waiting on help to get to you. >> we saw issue for you. maybe some spotty drizzle in san francisco with low level moisture moving in and 48 degrees. east bay at 41 and for the south bay we start off at 46 so what about that next storm system. here's the initial time line. 5:00 p.m. cold front on tuesday. lines up to the north and then as we head throughout the late evening hours it's mainly all about the north bay, middletown and calistoga and the best chance of rain and you'll likely still be dry down into the south bay by 10:00 p.m. tomorrow. we'll eventually see some fast-moving rain as the cold front moves over by 4:30 in the morning on wednesday. gusty winds with this, maybe even some isolated thunderstorms. after the cold front passes we'll hang on to a few scattered showers wednesday afternoon and then we dry out by wednesday evening. it will be a short break with our next storm system after that lining up by thursday at 11:00 a.m. this. looks to move in by thursday evening into friday. so, how much rainfall are we going to get with these two different systems, the healthy and that keeps us out of river flooding territory. three-quarts of an inch in san jose and an inch in livermore and likely over that in arraigneda and close to an inch across the peninsula and for the north bay one and a half inches up across santa rosa and an inch in napa as well. let's take you to the microclimate forecast as we head through tuesday. another big issue and mainly cloudy skies and temperatures more milder out ahead of the cold front and 64 in cupertino and 46 in san jose. stays cloudy at the immediate coastline and you go over to patio, likely rays of sun tomorrow and 64 degrees and san francisco and the marina stays cloudy right on over to the mission and 50s. north bay, east bay and the tri-vale, notice some pockets of sunshine here for oakland and 64 degrees tomorrow and then back towards fremont likely a partly sunny day and the tri-valley will come in at 65 across pleasanton. what's ahead for us i? want to detail this again. you can see wednesday morning rain and gusty winds. by thursday evening and friday, scattered rainfall and likely one of the stronger storms of the weekend by saturday morning with another round of rain and wind. all total with three different storm systems, looking at one and a half to two inches of rain, highest amounts and north bay and the coast and this will
