The city audit in san jose shows that some employees are using city credit cards for questionable purchases. So exactly which employees are living the high life on your dime . Damian trujillo is live at city hall where he went looking for some of those names. Reporter what we found is there are some people noted inside this audit who work here and city hall, including the mayor. There are firefighters and other employees whose expenditures are being questioned. These are some of the thousands of documents nbc bay area got from the city auditor today. This one, Sharon Erickson said in her report, violated prudent use of city funds. Its a charge for more than 2,300, including 700 in alcohol, to entertain a delegation from ireland. At the dinner table that night, the mayor. And several council members. The city manager and City Attorney were also there. There was approval for Alcohol Purchase as part of that meal. We questioned whether it was a prudent expenditure of taxpayer dollars to spend that much money on alcohol. Reporter in a statement, the Mayors Office wrote city policy allows limited expenditures of this type for Economic Development purposes. A spokeswoman said the mayor didnt have wine at the dinner and that the mayor has been briefed by the city auditor and is exploring ways to increase transparency around pcard transactions. We do question in this report the use of procurement cards for business meals, for highly compensated or highlevel employees. Reporter also mentioned in the audit, a 2250 expense for tickets to an awards dinner, a dinner City Employees did not attend. We found in the new documents it was charged by the airport director. And this one. Four top drain leather rocker recliners bought by a firefighter in charge of facilities for almost 3,500. If they did knowingly use the credit card in violation of city policy or procedures, then there are some steps to take some corrective action for that. Reporter union leader Jose Guerrero says all employees go through annual training on how to properly use their cityissued pcards. All of us as City Employees, whether City Employees or any politician, must adhere to honesty, integrity, and transparency in the use of the city credit cards. Reporter guerrero says that goal is for all employees, whether elected or not. Another expense mentioned in this audit, the firefighter who leased a bmw for two weeks. In the audit, he says that he did not have his personal car with him but he intended to switch the charge later on. Apparently that did not happen. The city auditor did make several recommendations on individual cases and on policy as well. She said the majority of the employees are following the rules, but recommends that all employee expenditures be posted online to promote transparency. And she says she will check back in six months to see if the city has acted on recommendations. New details tonight in the case of uber driver accused of beating a passenger with a hammer in San Francisco. This happened early tuesday at elsworth and alamany boulevard in bernal heights. The driver hit one of three passenger in the head after an argument about what route to take. The San FranciscoDistrict AttorneyGeorge Gascon says the suspect has pled not guilty and uber may be liable. If an employee is in the course and scope of their employment, injures others, you have certainly civil liability, depending on the extent of it, it could be criminal liability. And their names still have not been released. All of the passengers on the bus survived. And one may have escaped injury after something told her to leave the bus immediately. Reporter investigators dont know why yet, why the green van traveling southbound on south El Camino Real near downtown san mateo crossed the center divider, crashed headon into a san trans bus, in front of the funeral home where Susie Wiggins was headed. I saw the van coming from the south. And traveled across the lane. I went around the bus to park my own car. I realized that he had hit the bus headon. Reporter annabel diaz was one of 15 to 20 passengers on the bus, but instinct told her to get off the bus early at the stop just before the crash site. A oneday strike by golden gate ferry captains is leaving thousands of commuters looking for another way to get home tonight. Its also forcing hundreds of giants fans to find a way to get to the game. Tonight those 700 are joining the clogged streets and the parking lots around this ballpark, because as you can see, the ferries are not running tonight. They havent run all day. At the Ferry Landing picketers walked the line in support of 16 ferry cap tanz out on strike. Were behind the cost of living, have been over ten years. Reporter robert barley makes a little over 80,000 a year. A spokeswoman for the district says thats competitive. Ferryboat captains and deck hands are the highest paid on the bay. Reporter the skippers say thats not true. According to the districts own wage survey, were behind the scale. Reporter we checked. The districts wage survey shows the golden gate cap tanz are the highest paid, compared with red and white and blue and gold fleet, but paid significantly less than ferry captains in the districts other area, washington state. Reporter the board of directors of the golden gate transportation district met today to hear a report on the negotiations. San jose is now in the process of deciding which pot clubs will be able to stay open for business after the city ordered all clubs to shut down in july. The citys decision on applicants so far shows a huge change in its vision for the medical marijuana landscape. Robert honda joins us live at San Jose City hall with more. Reporter janelle, if you remember, at one time there were more than 100 pot clubs in san jose, about 90 by the time the city set up its permit process. But very few are going to get approved. Pretty tasty, just got it in today. Reporter officials said pot clubs were operating like the wild, wild west with no regard for city restrictions. The number of applicants for city permit indicates many simply closed doors and of the 30 or so on the list it appears only six were approved for this first phase about half a dozen are under review, 16 were denied. Its not completely barren. But once the ordinance fully goes into effect and were down to the six to ten clubs that might still be open, many of them will be limited in what they can provide. Reporter the number could end up even lower since this first phase just means the clubs approved are in compliance with city restrictions such as not being too close to a school. They still have to apply for a permit to open and clubs that cant get a permit will have to close by october 18th. So if you have a location that fits, regardless of how you run your operation, you can stay open. Theres a lot of people that work in the industry that are no longer going to have their jobs. And the biggest and most important thing is now youre going to push people to be selling these things on the streets. Now were learning a father and son hospitalized after rescue crews pulled them from San Francisco surf on wednesday died. The accident happened at ocean beach. Medical examiners have identified the victims as 47yearold jose garcia and 24yearold jose garcia jr. Both are from stanislaus county. A total of three had to be rescued that day.
