Alex tichelman faces serious charges because of her behavior, but many acknowledge the victims behavior will also be under extreme scrutiny. Alex tichelman seemed more subdued in court today than last week. She was charged with felony manslaughter and drug allegations in the death of forrest hayes, a Silicon Valley executive. He was found dead on his yacht last november from a heroin overdose. Police say a surveillance tape show tichelman injecting hayes and standing by casually as he died. Her attorneys called the death an accident from a drug and sex encounter between consenting adults. Sensationalized and to blame Alex Tichelman for his death is misplaced, unfair and simply wron wrong. A key component is putting the victim on trial. Reporter theyre saying she only had a motive to keep him alive. He was a lucrative source of income to her. She appreciated his generosity. Reporter they focused on hayes, the media and the defense. Thats not evidence. Reporter a murder charge could depend on a renewed investigation into the overdose death of tickle mans then boyfriend last year. Tichelman made the 911 call. Theres something hes Alex Tichelmans the one on trial here, and were not going to rationalize her behavior one bit. Reporter tichelman returns october 20th for the setting of her preliminary hearing. Live in santa cruz. More than 700 prisoners are on death row in san quentin. Today a federal judge struck down californias Death Penalty. He says its unconstitutional, because its cruel and unusual punishment. Mark matthews joins us, legally and financially, this is a major ruling. Reporter it really is. And it revolves around a man here on death row. His name is Ernest Dwayne jones. Hes convicted of raining and murdering his girlfriends mother. He has been here for 19 years on death row. And thats what judge carney found cruel and unusual. He said it was a random and arbitrary application of the Death Penalty. In the past 37 years, 900 people have been sentenced to death in california. And of those 900, only 13 have been executed. That, said judge carney is evidence of a system that is so dysfunctional that executions have become depen didnt on arbitrary and random factors rather than the nature of the crime and the date of the sentencing. A death opponent organization in San Francisco it is cruel and unusual in the same sense that being struck by lightning is cruel and unusual. Reporter mark klaas is fuming. He says what is needed is to fix the system by limiting appeals and streamlining the process. We asked voters on San Franciscos Market Street how they would vote. I would vote to have it. But i did get the drift that voters in San Francisco, many of them would vote for the Death Penalty if the vote were held today. In the meantime, state attorney general kamala harris, is she appealing . She isnt saying. She says she is studying the judges ruling. The same from the governors office. He was 76 years old when he was executed by lethal injection at san quentin. He was convicted of ordering the killings of three people in 1980 in fresno. At the time of his execution he was serving a life sentence in prison for killing a fourth person. Towns telling immigrant children to head home. But tonight Santa Clara County is asking those children be brought here. The controversy over immigration and the kids, the most heated debate in the nation. Theyve been taken to another location to be shipped over to san diego and the families there. Tonight the south bay is saying the immigrant children are welcome here. They come to guadalupe parish, sometimes praying for a family miracle. Today the prayers are for someone else. It breaks my heart. Reporter the parish is collecting donations for the thousands of immigrant children from Central America stuck in the middle of a national debate. I take it really personal. I love my community, and those faces are the faces of many children running around here. That could be happening to them as well. Reporter donations are collected by the group. Thousands of immigrant children have traveled 3,000 miles since october to make it into the u. S. And this is the reception theyve gotten in many cities across the southwest. In california, protesters forced three buses full of immigrants to turn around. We have children who are in need of a safe and secure place to be. Reporter so Santa Clara County supervisor cindy chavez says bring them here. She coauthored a letter with a south bay congressional delegation and other lawmakers alerting washington the immigrant children are welcome in the south bay. Our objective is to make sure that if the federal government is in need of support that the countys prepared to offer it in the most humane and dignified way that we can. Reporter the county is identifying a place right now to process the immigrants and is looking for temporary foster homes for the children. While their cases are reviewed by immigration agents. This is a defining moment in our nations history, and we have just been hearing from the bay area, specifically san jose, from people who are really supporting these families. Reporter and i heard from working partnerships a few minutes ago. They are getting more donations tonight. So they may wait until tomorrow before putting those donations on a Greyhound Bus and shipping them. Theres drama at city hall, an aide to a city supervisor is on leave as it came out she was romantically involved with her boss. John avalos was a recent mayoral candidate. Hes married with children but reportedly had a relationship with his top legislative aide, raquel, dawn diaz. There have been no allegations of Inappropriate Conduct and relationships are not banned. You have a ticket and ready to board only to be told you cant get on. Thats what bicycle riders are dealing with when they try to jump on cal train. The reason . Not enough room. And less and less bicycles are able to get on board. They wouldnt let me in, so i had to call one of my coworkers to come pick me up and take my to work. Reporter its happened to tony as well. Normally its another hour or sometimes like 30 minutes. You have to wait. Reporter the problem is one the San Francisco Bike Coalition says needs solved. Many people instead of using bikes are now driving. And thats certainly the reverse of how we want to be moving people around in our area. We dont have any solution at this point, but we are working on it. Reporter Christine Dunn with cal train says Additional Trains are on the way, but they are working on more bicycle parking. Doug williams sees bump riders all the time. When we see them, theyre mostly stressed out trying to get on the train. Reporter still the issue is bigger. With the tech boom, ridership is way up, nearly 60,000 passengers a day. And during the summer when the weathers good, we have more people wanting to take their bikes on the train, so that exacerbates the problem. Reporter rudy insists it has to be a priority. And the spokesperson for cal train says while they are trying to add more cars, it will be tough because some of the platforms are not long enough to accommodate trains with more cars. Its a worldfamous event that thrill seekers dream of, but you dont have to travel to spain to run with the bulls any longer. Now its here in the United States for people to do right in their own back yards without having to pay the 4,000 to go to spain with flights and trains to go to pamplona. Reporter Animal Rights activists are outraged. They say forcing bulls to run in such a way is nothing more than animal cruelty. Lawyers with the Animal Legal Defense Fund and people for the ethical treatment of animals have filed a federal lawsuit, hoping to stop it. The bull run is dangerous, inhumane and illegal under california law. The reason theyre running is out of fear and stress, and forcing an animal to do that for a fleeting adrenaline rush is wrong. Reporter but the people who putz on the run say their bulls are very well cared for and not hit or whipped. They perform almost every weekend, and they have somebody kicking helm in the side with metal spurs. If thats not animal abuse, and rodeos are legal in california. I cant understand why they would claim that running of the bulls is animal abuse. Reporter were back here live where just in a week and a half, bulls and people will be out on this track running. That lawsuit is under way, but it will likely take its time to work its way through the courts, not quick enough to impact next weeks run. You can bet protesters will be out here right with them. Now that goes directly against the assessment of a firefighter who spent an hour earlier this horng putting out the flames. They say a line ruptured and leaked crude oil which ignited the flames. Shechevron did not offer a caus but they are investigating. No one was hurt and no homes were destroyed. People hired to look for water wasters. We believe that theyll make the corrective measures and probably wouldnt get a fine. But we do have individuals who have a difficult time understanding the importance of it. And at that point there would probably be some sort of a fine. Reporter everyone is being asked to conserve, but goldie says the repeat offenders will be fined. People who are not conserving water, maybe that will weak them wake them up to the fact that they need to do it. Reporter the water costs consider all the circumstances before the fiens are written. Make sure when you wash your car to have a nozzle on there, and dont overwater your lawns, but the San Jose Water Company says these regulations have already been in place since march.
