During the search here at the apartments, one of the bart officers was shot and it appears that he was shot accidently by one of the other bart officers on the scene. So at this point, there is no outstanding suspect. Reporter again, Sergeant Nelson says the officer shot and killed had 20 Years Experience with bart, and the officer who shot him, ten years on the force. Nelson also says it is not unusual for bart officers to execute a probation search and it is not unusual at all during a probation search looking for someone who had allegedly committed a felony to have their guns drawn. Why that gun went off . So many questions a answer. How can the gun go off when the suspect was not home. We do not have a name of the officer what did the smoothing or the deceased so far. At approximately 1 45 today, members of our Detective Unit were conducting a probation search in the city of dublin when the officer was fatally struck by gunfire. Our condolences goes out to the immediate family and friends and the extended bart family, and the entire bart district. The Alameda CountySheriffs Department will be conducting this investigation. He says hes a 42yearold man and a father, described him as a great father, a great uncle and a great officer. The stars and storms are aligning for mavericks starting to come to life possibly by friday morning. Its dry in the bay area but off to the west we have a powerful storm, a 960 millibar low. You get this wind pushing the water away from the storm building the longperiod swell. As the swell approaches the coastline it bolts up with the under sea ridges right after pillar point there and thats the conditions we suspect will get higher into thursday and friday. So a High Surf Advisory up and down the bay area coastline and we could see breakers at least 20 feet and well see at least those conditions that should be good for mavericks. Numbers in the 60s and 70s towards the coast but use caution. Thursday into friday, thats the High Surf Advisory. One thing we might have to watch that could spill things for friday morning is tied into the high fire danger as the high builds to the north and low pressure moves into the bay area. This will set up gusty offshore winds. The they are too strong, it will make the waves have a flat front and prevent them from building up. Thursday the winds to be gusty and high fire danger but well see if those winds can back off enough into friday morning coinciding with the big swell hitting the coast. Despite demands shouted over a bull horn, and rubber bullets piercing the glass of the apartment where he was hiding, a san jose burglary apartment refused to come out of home for nearly four hours. Police first spotted the suspect while responding to a burglary call this morning. When those officers made contact, the suspect immediately advanced on the officers who were in the laundry room and started to attack the officers. At some point, there was a brief struggle. The suspect attempted to try and pull away the taser from one of the officers. The officer struggled to hold on the tazer and dropped his baton in the process. Reporter the suspect came at officers with the baton and took off and hit in this apartment. Gang units, the swat team and patrol officers kept a close eye on the suspect until he finally came out of the apartment on a bike. Thats when this k9 cop sprang into action. The dog did make the arrest. He did bite the suspect, and then our officers came in and again, took him sb custody. Reporter the suspect was taken to a nearby hospital to be treated for the dog bite and then taken into custody for assault on a peace officer, burglary and possession of stolen property. Dozens of neighbors were forced to evacuate during the standoff and a preschool was placed on lockdown. The boss came into the classroom and said that we were on lockdown and to keep the kids busy and windows closed. Reporter neighbors say there have been a lot of burglaries and car breakins. Neighbors hope it means an arrest. They took a criminal off the street. Reporter while no one was hurt during the standoff and police have not yet released the name of the suspect. A number of bart officers knocked down a door of an apartment as part of a probation search. In order, they were looking for a man on probation and convicted of something, and now he was suspected of robberies on bart trains. They went in, knocked down the door, they did not know at the time that the suspect was not home, and that is when the tragedy unfolded. They were inside the apartment doing a search for the suspect, and at some point a shot was fired, which struck the officer from bart and ultimately killed him. Reporter the victim had 20 Years Experience with bart police and the officer who shot him had ten years with the department. They are saying its not unusual for bart officers to conduct a search such as this for a probation violator. Hes also saying its not unusual for them to have guns drawn with such a search.
