The 40year limit for medical malpractice awards could be the next political showdown. Raising the cap will create more unnecessary tests and lead to soaring medical malpractice insurance rates. If you boil it all down, opponents say if you have more trials the medical malpractice Insurance Companies will raise their rates and doctors will test more because they dont want to go court. Now the data shows theres a reason to believe costs will go up. There are billions of dollars being averted to provide tests that arent really necessary just because doctors are concerned about the risk of losses. This is what you will hear from all sorts of doctors who appropriately treat patients with the reality that a mistake or misdiagnosis could mean a lawsuit. The result is something called defensive medicine. Its hard to define exactly. But dr. Marty mccarey who wrote a book on the dysfunction of our Health Care System called unaccountable says the tendency to overtest has real economic consequences. To the tune of 60 billion a year. According to his recent study at john hopkins. Its not the actual payout amount but its the fear of a payout that drives the defensive medicine that results in so much waste in health care. Theres no single issue in the entire field of medicine for which theres unanimous agreement as there is malpractice reform. But theres not unanimous agreement on how much is being wasted.
